CC MINS 20201201 SPC MINUTES RANCHO PALOS VERDES CITY COUNCIL 111 SPECIAL MEETING DECEMBER 1, 2020 CALL TO ORDER: A Special meeting of the Rancho Palos Verde's City Council for the purpose of a Closed Session was called to order by Mayor Cruikshank at 6:03 P.M. at Fred Hesse Community Park, McTaggart Hall, 29301 Hawthorne Boulevard, notice having been given with affidavit thereto on file. City Council roll call was answered as follows: PRESENT: Bradley, Ferraro, Alegria, and Mayor Cruikshank ABSENT: Dyda (excused)* Also present were Ara Mihranian, City Manager; William W. Wynder, City Attorney, Teresa Takaoka, Deputy City Clerk. PUBLIC COMMENTS: None. CLOSED SESSION ITEMS ANNOUNCED: City Attorney Wynder announced the items to be discussed in Closed Session. 1. CONFERENCE WITH LEGAL COUNSEL —ANTICIPATED LITIGATION A closed session will be held, pursuant to Government Code § 54956.9(d)(2) and (e)(1), because there is a significant exposure to litigation in one (1) case but which the City believes are not yet known to a potential plaintiff or plaintiffs, which facts and circumstances need not be disclosed. RECESS TO CLOSED SESSION (FIRESIDE ROOM): At 6:04 P.M., the Council recessed to Closed Session. * Councilmember Dyda joined the Closed Session discussion at 6:15 P.M. RECONVENE TO OPEN SESSION: At 7:03 P.M., the Council reconvened to Open Session. CLOSED SESSION REPORT: City Attorney Wynder reported that with regards to the Special Closed Session pursuant to Government Code § 54956.9(d)(2) and (e)(1) because there is a significant exposure of litigation in one case, the City Attorney's office and the City Manager provided a privileged and confidential briefing to the council on legal issues associated with recent actions by the County of Los Angeles, Board of Supervisors. There was a discussion of litigation avoidance strategy. There was also a discussion of such actions as the City Council can take to defend and advance the interest of the residents and businesses of the city. Action was given to the City Manager and City Attorney to implement that litigation avoidance strategy.
