BACKGROUND AND DISCUSSION:
As part of a 1987 settlement agreement between the City of Rancho Palos Verdes, the
County of Los Angeles, and the former Rancho Palos Verdes Redevelopment Agency
(RDA), the City constructed and installed the Abalone Cove Sanitary Sewer System
(AbCove Sewer System) in 2002 to remove septic systems in most of the landslide area
to mitigate the landslide threat. The AbCove Sewer System was built within easements
at an approximate cost of $4.7 million. Those easements were subsequently assigned
to the City. Consequently, the AbCove Sewer System is now owned, operated and
maintained by the City. Users of the system, including private property owners and the
City, pay toward the operation and maintenance of the system annually.
The existing system currently has 115 properties connected to it and is capable of
accommodating 182 total connections. On August 7, 2001, the City established sewer
maintenance fees for the AbCove Sewer System as set forth in Chapter 13.06 (Sewer
Service Charges – Abalone Cove Landslide Abatement District) of Title 13 (Public
Services) of the RPVMC. RPVMC Section 13.06.030 provides that the annual sewer
service charge may be increased annually by an amount equal to the annual increase in
the Consumer Price Index for All Urban Consumers for the Los Angeles-Riverside-
Orange County Areas (the “CPI”). The City collects annual operation and maintenance
fees ranging from $177 to $775 from the owners of properties which are connected to
the AbCove Sewer System based on the zone the property is located in. However,
these fees are insufficient to cover the full cost of operating and maintaining the system.
As a result, the City provides an average general fund subsidy of $65,500 per year to
fully cover the operation and maintenance costs. This average subsidy amount reflects
a ten year average (Fiscal Years 2010-11 through 2019-20) and includes a $200,000
capital project in Fiscal Year 2016-17.
As undeveloped properties in Zone 2 of the Landslide Moratorium Area are now able to
be developed, these properties will be required to connect to the AbCove Sewer
system, increasing demands and maintenance costs on the system, including capital
replacement of system components. Since the operation and maintenance fees
currently collected by the City do not cover the present costs, Staff anticipates that the
City’s general fund subsidy will increase as additional properties are connected to the
system.
At the July 16, 2019 City Council meeting, Staff was directed to explore options to
reduce the City’s general fund subsidy for the operation and maintenance costs of the
AbCove Sewer System. City Council Goal No. 12 states that Staff is to “[p]repare a new

financial plan for the Abalone Cove annual sewer rates that reduces City maintenance
subsidy by at least 50% for City Council consideration.” This report identifies the
following two options for the City Council’s consideration which are aimed at bringing
the City closer to that goal.
1. Establishing a New Sewer Connection Fee
Sewer operators across California require property owners seeking to connect to
their sewer system to pay a connection fee. The fee is based on benefits that the
property owner receives by connecting to the system. Property owners connecting
to the AbCove Sewer System receive a benefit associated with the cost of installing,
operating, and maintaining the system
Over the life of AbCove Sewer system to date, maintenance costs have included
replacement of system components, such as pumps, lift station components and
manholes, that have either failed or shown signs of pending failure. Replacement of
those components has prolonged the life of the system and has reset the clock for
replacements in the near future. However, components that have not yet been
replaced are nearing 20 years old and will eventually need to be replaced when
they show signs of deterioration and pending failure.
The estimated capital replacement cost of key system components in 2020 dollars
is $5,682,000, which is based on the following estimates:

One hundred eighty-two (182) lots are identified in the annual Abalone Cove Sewer
Service Charge Report as either being connected to the system or vacant. In
calculating the value of a connection to the AbCove Sewer System, Staff divided
the 2020 estimated capital replacement cost of the key system components
($5,682,000) by the number of possible connections (182), which equals
approximately $31,200.
Staff researched connection fees applied in a number of other California cities and
found that the amounts and methodologies by which they are calculated vary
greatly. Examples, for reference purposes only, include:
▪ Santa Rosa has flat rate fees ranging from $5,516 (for accessory dwellings)
to $8,733 for single family units on lots over 1 acre.

▪ Redding has rates based on the water meter size and household equivalent,
with fees ranging from $5,449 for a 5/8” to 3/4" water meter for single family
homes to $1,171,535 for a 12” water meter with 215 households
▪ Cotati City has flat rates based on water meter sizes, ranging from $16,638
for 3/4" meters to $282,858 for 4” meters
▪ Brea connection fees appear to be based on a combination of the number
and type of fixtures (i.e. bathtub, sink, laundry tub or washer, etc.) and a
base charge (based on residential type and number of bedrooms) that range
from $3,083 to $6,912 for single family homes of 1 to 5 or more bedrooms.
▪ San Jose appears to have fees based on parcel sizes, with fees ranging from
$447 per lot to $1,991 per acre.
Based on some of the above examples, Staff has learned that the connection fee
collected by Los Angeles County for residential connections to the sewer system
outside of the AbCove Sewer System in Rancho Palos Verdes is approximately
$4,500. Accordingly, Staff recommends the City Council estab lish a connection fee
for new connections to the AbCove Sewer System of $4,500. This amount was
chosen because it is similar to the amount that property owners pay for new
connections to the Los Angeles County Sewer System. Currently, property owners
pay a fee of $4,610 to the Los Angeles County Department of Public Works and
$187 to the City for staff time to process the permit and coordinate with the County.
Proposition 218 requirements are not triggered in adopting the proposed one -time
sewer connection fee for new developments which apply for connection to the
AbCove Sewer System.
2. Annual Increases to the Sewer Service Charge
RPVMC Section 13.06.030 establishes the method by which the annual sewer
service charge to be levied upon properties connected to the AbCove Sewer
System shall be calculated. With respect to annual increases to the sewer service
charge, Section 13.06.030 provides as follows:
“The sewer service charge may be increased annually by an amount equal to the
annual increase in the Consumer Price Index for all Urban Consumers for the
Los Angeles-Riverside-Orange County Areas (the “CPI”), including all items as
published by the U.S. Bureau of Labor Statistics as of March 1 of each year, not
to exceed a maximum increase of seven percent per year. For any fiscal year
that the sewer service charge is not increased by the allowable increase in the
CPI for that year, the city may add the increase for that year to the CPI increase
in subsequent years.”
In December 2017, the U.S. Bureau of Labor Statistics discontinued the Los
Angeles-Riverside-Orange County CPI and replaced it with the Consumer Price
Index for All Urban Consumers in the Los Angeles-Long Beach-Anaheim
Metropolitan Area (the “CPI-U”). The reference to the discontinued Los Angeles-

Riverside-Orange County CPI in Section 13.06.030 has effectively prevented the
City from increasing the annual sewer service charge to adjust for inflation since
2018. Accordingly, Staff recommends that the text in Section 13.06.030 be
amended to replace the discontinued Los Angeles-Riverside-Orange County CPI
with the current Los Angeles-Long Beach-Anaheim CPI-U as shown below (new
text in bold italics, deletions in strikethrough) and in the draft ordinance
(Attachment D):
The sewer service charge may be increased annually by an amount equal to the
annual increase in the Consumer Price Index for All Urban Consumers in the
Los Angeles-Long Beach-Anaheim Metropolitan Area (the “CPI-U”)
Consumer Price Index for all Urban Consumers for the Los Angeles-Riverside-
Orange County Areas (the "CPI"), or its successor index, including all items as
published by the U.S. Bureau of Labor Statistics as of March 1 of each year, not
to exceed a maximum increase of seven percent per year. For any fiscal year that
the sewer service charge is not increased by the allowable increase in the CPI-U
CPI for that year, the city may add the increase for that year to the CPI-U CPI
increase in subsequent years.
As the proposed code amendment only replaces the discontinued CPI with the
current CPI-U, Proposition 218 requirements are not triggered because no
increased sewer service charges are being imposed. However, every year around
June, City Staff presents an annual Engineer’s report that assesses the estimated
maintenance costs for the coming fiscal year. Staff will provide at least 45-day
notice to residents, pursuant to Proposition 218, of any proposed rate increase.
Next Steps
The proposed options described above are intended to bring the City closer to reduc ing
the City’s annual maintenance subsidy by at least 50%. However, at this time, these
options, particularly applying the CPI-U, will reduce the City’s subsidy by approximately
3% if all things remained constant (i.e. annual maintenance costs). To that point, City
Staff continues to evaluate the annual rate for each of the four zones within the AbCove
Sewer System to assess further changes to reduce the City’s annual subsidy. Over the
next few months, Staff will continue reviewing the current fee schedule in detail and may
return to the Council with additional recommendations, including possible additional
amendments to Section 13.06.030. Any potential changes will be introduced and
discussed with the Portuguese Bend Community Association Board and the residents
prior to being presented to the City Council. It should be noted that initial discussions
with Board members on some of the proposed options occurred earlier this year.

ADDITIONAL INFORMATION:
Public Notice
On September 23, 2020, public notices regarding tonight’s City agenda item were
published in the Palos Verdes Peninsula News and mailed to property owners serviced
by the AbCove Sewer System (Attachment F).
On September 28, 2020, the City received a letter from Corinne Gerrard, President of
the Portuguese Bend Community Association, which indicates an intent to protest the
proposed CPI-U code amendment in accordance with Proposition 218 (Attachment G).
On the same date, City staff responded to Ms. Gerrard in writing to explain that
Proposition 218 does not apply because no increased sewer service charges are being
imposed by the proposed CPI-U code amendment.
CONCLUSION:
Staff recommends that the City Council (1) adopt Resolution No. 2020-__ to establish a
connection fee for new connections to the Abalone Cove Sewer System as described
above; and (2) adopt Ordinance No.___ amending RPVMC Section 13.06.030 relating
to annual sewer service charges for the Abalone Cove Sewer System .
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative actions are available for
the City Council’s consideration:
1. Establish an alternative connection fee amount.
2. Take other action, as deemed appropriate.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES AMENDING RESOLUTION
NO. 2010-77, THE MASTER SCHEDULE OF FEES AND
CHARGES FOR CITY SERVICES, TO ADOPT CONNECTION
FEES FOR NEW CONNECTIONS TO THE ABALONE COVE
SEWER SYSTEM.
WHEREAS, the California Government Code requires that fees for services
charged by municipalities not exceed the cost of providing the service for which the fee
is levied and that no fee or service charge or increase in an existing fee or charge may
be levied without the public having an opportunity to make oral or written public comment
at a regularly scheduled City Council meeting; and
WHEREAS, the Abalone Cove Sewer System is owned, operated, and maintained
by the City of Rancho Palos Verdes (“City”); and
WHEREAS, on August 7, 2001, the City Council of the City of Rancho Palos
Verdes adopted Ordinance No. 368, which established sewer maintenance fees for the
Abalone Cove Sewer System as set forth in Chapter 13.06 (Sewer Service Charges –
Abalone Cove Landslide Abatement District) of Title 13 (Public Services) of the Rancho
Palos Verdes Municipal Code (“RPVMC”); and
WHEREAS, current sewer maintenance fees collected by the City do not
adequately cover the full operation and maintenance costs for the Abalone Cove Sewer
System; and
WHEREAS, additional connections to the Abalone Cove Sewer System increase
the demands on the system and maintenance costs; and
WHEREAS, Government Code Sections 66013 and 66016 authorize the City to
impose sewer connection fees; and
WHEREAS, City staff has analyzed sewer connection fees applied by various
other local government agencies and found that the sewer connection fee collected by
the County of Los Angeles (“County”) for residential connections to the County’s sewer
system is approximately $4,500; and
WHEREAS, the City desires to better recover the operation and maintenance costs
for the Abalone Cove Sewer System by establishing a sewer connection fee of $4,500 for
new connections to the Abalone Cove Sewer System through an amendment of the
Master Fee Schedule as described in Exhibit A; and
WHEREAS, on September 23, 2020, a public notice announcing the City Council’s
public hearing and review of the proposed amendment to establish a sewer connection
fee for new connections to the Abalone Cove Sewer System was published in the Palos
Verdes Peninsula News; and

WHEREAS, based upon oral and written presentations by City staff and members
of the public, the City Council now desires to adopt a sewer connection fee for new
connections to the Abalone Cove Sewer System.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. The City Council finds and determines that the foregoing recitals are
true and correct, and adopts the recitals as findings in support of the actions taken herein.
Section 2. That the City Council hereby establishes and adopts the new sewer
connection fee for new connections to the Abalone Cove Sanitary Sewer System as
provided in Exhibit A of this Resolution. The sewer connection fees shall be used to
finance the City’s costs associated with establishing a new physical connection to the
sewer system and operation and maintenance of the Abalone Cove Sanitary Sewer
System.
Section 3. All exhibits to this Resolution are incorporated herein by reference
and made a part hereto.
Section 4. This resolution is exempt from the California Environmental Quality
Act (“CEQA”) pursuant to Section 15378 of the CEQA Guidelines because the sewer
connection fee constitutes a government funding mechanism or other government fiscal
activity which does not involve any commitment to any specific project which may result
in a potentially significant physical impact on the environment.
Section 5. If any section, subsection, subdivision, sentence, clause, phrase, or
portion of this resolution or the application thereof to any person, is for any reason held
to be invalid or unconstitutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remainder of this ordinance. The City
Council hereby declares that it would have adopted this resolution, and each and every
section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective
of the fact that any one or more sections, subsections, subdivisions, sentences, clauses,
phrases, or portions thereof be declared invalid or unconstitutional.
Section 6. The City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original Resolutions. This Resolution shall be
effective immediately upon passage and adoption.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES AMENDING SECTION 13.06.030 OF
CHAPTER 13.06 (SEWER SERVICE CHARGES – ABALONE
COVE LANDSLIDE ABATEMENT DISTRICT) OF TITLE 13
(PUBLIC SERVICES) OF THE RANCHO PALOS VERDES
MUNICIPAL CODE RELATING TO ANNUAL SEWER SERVICE
CHARGES
WHEREAS, on August 7, 2001, the City Council of the City of Rancho Palos Verdes
(“City”) adopted Ordinance No. 368, which established sewer maintenance fees for the
Abalone Cove Sewer System as set forth in Chapter 13.06 (Sewer Service Charges –
Abalone Cove Landslide Abatement District) of Title 13 (Public Services) of the Rancho
Palos Verdes Municipal Code (“RPVMC”); and
WHEREAS, the Abalone Cove Sewer System is owned, operated, and maintained
by the City; and
WHEREAS, RPVMC Section 13.06.030 provides that the annual sewer service
charge may be increased annually by an amount equal to the annual increase in the
Consumer Price Index for All Urban Consumers for the Los Angeles-Riverside-Orange
County Areas (the “CPI”), including all items as published by the U.S. Bureau of Labor
Statistics as of March 1 of each year; and
WHEREAS, in December 2017, the U.S. Bureau of Labor Statistics discontinued the
Los Angeles-Riverside-Orange County CPI as a result of the introduction of the Consumer
Price Index for All Urban Consumers in the Los Angeles-Long Beach-Anaheim Metropolitan
Area (the “CPI-U”); and
WHEREAS, the City Council desires to amend RPVMC Section 13.06.030 by
replacing the discontinued CPI with the current CPI -U to allow for future increases to the
annual sewer service charge as a measure of inflation; and
WHEREAS, Health and Safety Code Section 5471 and Government Code Section
54344 authorize the City Council to prescribe, revise and collect , fees and charges for
services and facilities furnished by the City in connection with the Abalone Cove Sewer
System.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES, CALIFORNIA, DOES ORDAIN AS FOLLOWS:
Section 1. The foregoing recitals are true and correct and are incorporated herein
by this reference.
Section 2. Section 13.06.030 (Charges levied) of Chapter 13.06 (Sewer Service
Charges – Abalone Cove Landslide Abatement District) of Title 13 (Public Services) of
the RPVMC is hereby amended as follows, with the remaining portions of Section

13.06.030 remaining unchanged (new text in bold italics, deletions in strikethrough):
“13.06.030 – Charges levied.
An annual sewer service charge is levied upon each parcel of real property in
the district, as shown on the map adopted by the city council on January 6, 1981,
attached as Exhibit A to Resolution No. 81-4 on file with the city clerk, and connected
to the sanitary sewer system. The annual sewer service charge is necessary to pay
for the cost for services and facilities furnished by the city beginning October 2001.
The amount of the sewer service charge shall be computed by multiplying the
Equivalent Residential Units ("ERUs") for the current land use on the parcel, as of
the 1st day of March of each year, as shown on Table B set out in Section 13.06.060,
by the maximum annual charge per ERU for the applicable zone as shown in Table
C, set out in Section 13.06.070. For the purposes of this chapter, the land uses for
the parcels in the district have been assigned sewer flow rates, expressed in ERUs,
based on the Los Angeles County Sanitation District standards, as set forth in the
"Master Service Charge Ordinance of South Bay Cities Sanitation District of Los
Angeles County" as adopted March 18, 1998. The flow rates for the Abalone Cove
Beach property are based on information provided by the city of Los Angeles Bureau
of Sanitation. The sewer service charge may be increased annually by an amount
equal to the annual increase in the Consumer Price Index for All Urban
Consumers in the Los Angeles-Long Beach-Anaheim Metropolitan Area (the
“CPI-U”) Consumer Price Index for all Urban Consumers for the Los Angeles -
Riverside-Orange County Areas (the "CPI"), or its successor index, including all
items as published by the U.S. Bureau of Labor Statistics as of March 1 of each year,
not to exceed a maximum increase of seven percent per year. For any fiscal year
that the sewer service charge is not increased by the allowable increase in the CPI-
U CPI for that year, the city may add the increase for that year to the CPI-U CPI
increase in subsequent years.
Section 3. This ordinance is exempt from the California Environmental Quality
Act (“CEQA”) pursuant to Section 15273 and Section 15378 of the CEQA Guidelines
because (a) the annual sewer service charges are for the purpose of meeting operational
and maintenance expenses for services and facilities furnished by the City; and (b) the
annual sewer service charges constitute a government funding mechanism or other
government fiscal activity which does not involve any commitment to any specific project
which may result in a potentially significant physical impact on the environment.
Section 4. If any Section, subsection, sentence, clause, or phrase of this
ordinance is for any reason held to be invalid or unconstitutional by a decision of any court
of any competent jurisdiction, such decision shall not affect the validity of the remaining
portions of this ordinance. The City Council hereby declares that it would have passed
this ordinance, and each and every Section, subsection, sentence, clause and phrase
thereof not declared invalid or unconstitutional without regard to whether any portion of
the ordinance would be subsequently declared invalid or unconstitutional.
Section 5. The City Clerk shall cause this Ordinance to be posted in 3 public

places in the City within 15 days after its passage, in accordance with the provisions of
Section 36933 of the Government Code. The City Clerk shall further certify to the adoption
and posting of this Ordinance, and shall cause this Ordinance and its certification,
together with proof of posting, to be entered in the Book of Ordinances of the Council of
this City of Rancho Palos Verdes.
Section 6. Effective Date. This Ordinance shall go into effect on the 31st day
after its passage.

RECOMMENDATION
Consider for second reading and adoption Ordinance No. 368 amending the Rancho Palos Verdes
Municipal Code by adding new Chapter 13.06 establishing sewer maintenance fees for the Abalone Cove
Sewer System.
BACKGROUND
Construction funding for the Abalone Cove Sewer System was provided by the Landslide Settlement
Agreement. Under the terms of that agreement, however, proceeds may not be used for maintenance
purposes. Staff proposes that the maintenance of the Abalone Cove Sewer System be funded by sewer
maintenance fees imposed on users of the system.
In accordance with the provisions of Proposition 218 and Section 5471 et seq. of the California Health
and Safety Code, the City Council held a duly noticed public hearing at its regular meeting of July 17,
2001. An engineer�s report was prepared to determine the fee amounts. That report estimated operating
costs and the corresponding fee for each property. That report was presented to the City Council at the
July 17, 2001 meeting. Following presentation of the engineer�s report, the City Council opened the
public hearing and heard and considered all objections to the proposed sewer maintenance fees. After
receiving both oral and written testimony from all members of the public wishing to be heard, the City
Council closed the public hearing. Following the close of the public hearing, the City Council determined,
in accordance with the provisions of Proposition 218, that written protests were not made by the owners
of a majority of separate parcels of property subject to the proposed fee and introduced Ordinance No.
368 for first reading and adopted Urgency Ordinance No. 367-U adding Chapter 13.06 to the Rancho
Palos Verdes Municipal Code.
DISCUSSION
The California Constitution, as modified by Proposition 218 requires that:
• The per parcel fee may only be imposed for service that is actually used by or immediately
available to the owner of property

• The amount of fee shall not exceed the proportional cost of the service attributable to the parcel
• Revenues derived from fees shall not exceed the amount funds required to provide the property-
related service
• Revenues derived from the fee shall not be used for any purpose other than that for which the fee
is imposed
The Abalone Cove Sewer System is comprised of three types of subsystems: (i) a gravity subsystem; (ii)
a force main subsystem; and (iii) a low-pressure subsystem. Sewer service to each parcel connected to
the system is provided through one or more of these subsystems. Each subsystem requires different
levels of operation and maintenance and, therefore, has different maintenance costs associated with it.
The modified engineering study determined the annual maintenance cost of each subsystem is as
follows:

The study also identified several categories of properties, or zones, based upon the sewer system
configuration serving those properties:

Based on costs to maintain the pipelines, and pump stations, and grinder pumps, as well as the number
of properties in each zone, the annual sewer fees by zone for a residential unit are as follows:

The proposed maximum fees may escalate annually based upon the Consumer Price Index.
The calculated fees for Zones B and D are significantly greater than the fee amount estimated by staff in
discussions with property owners in the design phase of the project. In those discussions, staff estimated
that the annual cost for sewer maintenance would be approximately $ 200 per year, comprised of a

Sanitation District fee of $75 per year, and a City fee of $125 per year. Those discussions were held at
the time that only a grinder pump system was being contemplated and were in -fact accurate for a grinder
pump system
In this same timeframe, however, a consensus of property owners requested that the City revise the
project design to construct a system, which provided gravity connections to the greatest number of
properties. The City agreed to the request and redesigned the system. Given the topography of the
Portuguese Bend community, the new design required that in-street pump stations be added. The
principal reason for the high costs of maintenance in Zones B and D is the cost to maintain these in-street
pump stations, which require weekly inspections. This high cost of inspection and maintenance, together
with the limited number of parcels over which cost are spread results in the high per -parcel cost for
maintenance.
In an effort to bring more uniformity to the annual maintenance fees, the City Council agreed to have the
City subsidize sewer maintenance, principally for Zones B and D, for a total of $19,125. This reduces the
annual fees per residential unit for the 2001-2002 fiscal year to the following:

The subsidized fees will be in effect for FY 2001-2002 only. The City Subsidy will be reviewed each year
thereafter when the City�s Budget is adopted and may be discontinued, reduced, or otherwise altered as
the City Council deems appropriate.
CONCLUSION
Adopting the staff recommendation will enact Ordinance No. 368 establishing sewer fees for users of the
Abalone Cove Sewer System.
FISCAL IMPACT
Adopting the staff recommendation will result in the expenditure of $19,125 for FY 2001 � 02 toward the
cost to maintain the Abalone Cove Sewer Project. The funding source is the General Fund.

A rate increase is NOT being considered on October 6.
Since the proposed code amendment to replace the discontinued CPI in RPVMC section 13.06.030 with the Consumer
Price Index for All Urban Consumers in the Los Angeles-Long Beach-Anaheim areas" ("CPI-U") formula does not increase
the sewer service charge in Abalone Cove Proposition 218 requirements are not triggered. Similarly the City is not required
to invoke the protest procedure under Prop 218 in order to implement a new, one-time sewer connection fee for new
developments proposing to connect to the Abalone Cove Sewer System.
If the City Council considers a rate increase, it will be noticed per Prop 218 .
I hope that clarifies what is currently proposed .

A rate increase is NOT being considered on October 6.
Since the proposed code amendment to replace the discontinued CPI in RPVMC section 13.06.030 with the Consumer Price
Index for All Urban Consumers in the Los Angeles-Long Beach-Anaheim areas" ("CPI-U") formula does not increase the
sewer service charge in Abalone Cove Proposition 218 requirements are not triggered. Similarly the City is not required to
invoke the protest procedure under Prop 218 in order to implement a new, one-time sewer connection fee for new
developments proposing to connect to the Abalone Cove Sewer System.

If the City Council considers a rate increase, it will be noticed per Prop 218.
I hope that clarifies what is currently proposed .
Also, attached is a list of the 180 parcels that are either connected, or may connect in the future, to the Abalone Cove Sanitary
Sewer, per your request.

The City of Rancho Palos Verdes the Public Works Department sent a letter dated September
23, 2020 and received September 26 regarding the October 06, 2020 City Council Meeting .
1. Amending Section 13 .06 of the Rancho Palos Verdes Municipal Code . Fee changes based
on the Consumer Price Index of L.A-Riverside-Long Beach
I just spoke to James O 'Neil Project Manager at 8 :30AM today . He informed me that Staff is
recommending this to be an "Action " item at the October 06 , City Council Meeting. This will
affect the Abalone Cove Sewer fee changes if adopted.
Prop 218 requires of the City regarding notice ; "Not less than 45 days after the notices of a
hearing on fees are mailed, the legislative body must hold a public hearing on the "new" or
increased fee." Mr. O 'Neil is checking with the City Engineer Ron Dragoo as to why our
community is not being given the 45 days to respond.
In order to qualify under Prop . 218 to establish a protest to stop the Council from proceeding it is
required to have at least a majority of 50%+1 of the property owners sign a protest petition .
Members, in attaining the property owner's signature, it would include your name printed, your
signature, the parcel number or address and date of signature.
Property owners can sign separately for each property he/she owns that is part of the sewer
system. (not vacant lots)
"We the undersigned property owners under the Abalone Cove Sewer System hereby protest
the change to the fee structure as being proposed by the City of Rancho Palos Verdes as
agenized for the meeting of October 06 , 2020 "
You can give Reasons for the protest.
1. Poorly engineered and substandard system
2. City records show that the grinder pumps, pumping stations and discharge lines have failed .
In Sec. 8.3 (pg .23) of the April 2015 Abalone Cove Sewer System Management it is stated
"Hydraulic modeling identified potential capacity related deficiencies ."
3. Under Prop . 218 the "fees and charges a governmental provider imposes on its users must
be reasonable , fair , and equitable in nature ." "the amount of a fee or charge imposed upon
any parcel or person as an incident of property ownership shall exceed the proportional cost
of the service attributable to the parcel."

The annual fee for the same sewer service of the Abalone Cove Sewer System are in most
cases higher and have increased since 2001. This fee structure is not only unfair but is not
equitable in nature. The city maintenance records show that the Abalone Cove sewer category
C is costing much more to maintain than the other systems.
A 2017 RPV study states "Because this system does not meet the standards of the Los Angeles
County Sewer Maintenance District (SMD), the SMD would not accept this portion of the City's
sewer system for maintenance. As such, the responsibility for the maintenance and operation of
the Abalone Cove Sewer System rests with the City."

eliminated. If it is just one CPI reference point being replace with another then the CPI is still a part of the fee
structure. Please confirm if I understand this correctly.

studies has issues with how the existing system will handle addition load. The additional strain on the system could
increase maintenance and repair costs as well as possible capital expenditures so the City should have a serious
engineering review to fully understand potential impacts.

A rate increase is NOT being considered on October 6.
Since the proposed code amendment to replace the discontinued CPI in RPVMC section 13.06.030 with
the Consumer Price Index for All Urban Consumers in the Los Angeles-Long Beach-Anaheim areas" ("CPI-
U") formula does not increase the sewer service charge in Abalone Cove Proposition 218 requirements are
not triggered . Similarly the City is not required to invoke the protest procedure under Prop 218 in order to
implement a new, one-time sewer connection fee for new developments proposing to connect to the Abalone
Cove Sewer System.
If the City Council considers a rate increase, it will be noticed per Prop 218.
I hope that clarifies what is currently proposed .
Also, attached is a list of the 180 parcels that are either connected, or may connect i n the future, to the Abalone
Cove Sanitary Sewer, per your request.
