Dear Mayor Cruikshank and members of the City Council,
I am a Planning Commissioner and member of the zoning code update subcommittee. I submit this email for
your consideration at tonight's meeting regarding the proposed changes to the ADU ordinances, particularly
those that remove objective approval criteria and replace it with discretionary approval.
The ordinances recommended by the commission were the result of several subcommittee meetings,
discussion with staff, several revisions and multiple public hearings with the full Commission, including input
from the public. This resulted in a motion that was approved unanimously.
The fact that RPV is in a Very High Fire Severity Zone is an undeniable attribute of our community, as
designated by Cal-Fire. We not only have the lawful ability to define our community standards because of
this, but the obligation to do so. According to the press, RPV is the most populated community in California
with more than 90% of its residents living in Very High Fire Zone. We're number 1.
I have three objections:
1. Any process related to public safety of this kind should be carried out in public with a group
decision. This is not a process of assessing the fire safety of a single project, it is a process of
protecting the public safety of a community. The ordinance change before you creates a private
process in the hands of a single person. The city already has a well-used variance process that can be
used instead should there be public interest in making exceptions.
2. The existing ADU ordinance already has a discretionary review process with measurable criteria,
created less than 2 years ago and passed unanimously by the Council. If the Commission had looked
for a new discretionary review process, it would have looked to modify the existing process, not
replace it with a Director review. If there is to be any discretionary review, I recommend it start by
modification of the existing process, not by ignoring it.
3. The public is best served by explicit ordinances, so they know what to expect. State law mandated
an objective approval process and the Planning Commission delivered on that mandate, while
maintaining our lawful local control. This is not just important for our conformance with state law, but
it serves the public interest. Ordinances that reflect the discussion and debate of many people serve
the public better than the opinion of a single person.

I am a Planning Commissioner and member of the zoning code update subcommittee. I submit this email for
consideration at tonight's meeting regarding the proposed changes to the ADU ordinance, specifically proposed section
17.10.020(C}(l)(a)-Discretion to allow director to approve an ADU in high fire severity zone if an applicant includes
sufficient fire safety measures. It is located on pages A-8 and A-9 of the staff report.
The Zoning Code Update Subcommittee was opposed to providing this discretionary approval process, and I feel that
(C)(a)(l) should be stricken in its entirety.
While the proposed fire safety measures listed in this section would be helpful in the event of a house fire, they do
nothing to ameliorate the hazards associated with a wildfire that might burn through a neighborhood. Fire sprinklers
and ten foot setbacks aren't going to help the families trapped on the end of a cui de sac at the top of the hill if they
have no means of egress.
I realize this point raises the issue of egress for existing housing and regular single family development-it is not simply
a problem for ADUs, and emergency fire egress may need to be considered on a broader scale for all new development.
But this is an important issue to consider now, when we are being forced by the State to increase density by allowing
AD Us. The least we can do at this point in time is attempt to limit density in high fire severity zones where two means of
egress do not exist. Doing so may save lives.

Correction to Item #2
This late correspondence is to correct a typographical error in item #2 . The staff report states that the City
entered into a 6-month contract extension (from the period of Janua ry -June 2020). This extension was
supposedly from the January -December 2019 agreement with Alta Planning and Design. However, the City
did not enter into an extension . Rather, the 2019 contract expired in December 2019 , and the City entered
into a second agreement with Alta Planning and Design in June 2020 .

Dear Council,
I would ask that the two public forums that are contemplated in connection with the trails update and
consolidation project be rescheduled until the early part of 2021. Now they are tentatively scheduled for
November and December. These months are not a good choice for two reasons: first , they are during the
holidays when people are at their busiest and most distracted. We should not have something as important as
this project be dealt with in the holiday season. Secondly, we are still in th e midst of the COVID-19 pandemic
and the community is much more likely to participate in the forums once we can convene in person. I would
rather see the project delayed a few more months than not get the attention it deserves because of the timing of
the forums .

I understand that you have an update on the status of the RPV Trails Network Plan on your next
agenda. Please allow me to address this issue.
While due to Cov id 19 I have not been on the trails for the last s ix months, I have been a regular trail
uses before since many years -and unfortunately have seen the trails getting more neglected instead
of being improved. That needs to be corrected. Youneed to make good on your original concept of
the trail network on the entire P.V.Peninsula . Each city needs to do their part, and RVP includ ed.
So please let us know, why not more is done to keep up the existing trail network, nor even to
improve the trails and expand the network as is in the origina plan .
We don't need you to ju st receive and file the report . We need you to actua lly do something to
maintain & improve the trails -PLEASE !
In addition we need you to work on adding to the existing trail network by helping to facilitate

The fire road you are requesting is a road/trail with the Palos Verdes Nature Preserve. As a requirement of the
City's Natural Communities Conservation Plan/Habitat Conservation Plan (NCCP/HCP) permit, the City is
developing a Preserve Access Protocol to determine appropriate vehicular access within the Preserve. While
the City currently works directly with the LA Fire Department to determine what trails within the Preserve
should be accessible to LA County Fire personnel, and to what dimensions/space needs, the City will be
formalizing LA County Fire recommendations for access as part of this Preserve Access Protocol. We will also
be addressing public access to the Preserve in emergency situations. In past conversations, the LA County Fire
Department has emphasized that the public must follow the evacuation routes prescribed in real time during
fire situations for public safety.
With respect to your concerns about the blocking of a private trail connection, there are no official public trails
in this area, as the area is a gated community. It is my understanding that any trails that exist in this area are
for Portuguese Bend Community residents, and not the general public. As it stands, the trail connection
concern is a civil matter between property owners in the area. However, once development plans are
submitted to the City for the private property, staff can then work with the property owner on a possible trail
dedication/easement.
Regarding expansion of the City's trail network, there are many miles of conceptual trails that the City will
pursue developing when opportunities become available. However, the trails nearest the Portuguese Bend
Community are located within the Palos Verdes Nature Preserve, and specifically the Filiorum and Portuguese
Bend Reserves. The trail plans within the Preserve are established within the Preserve Trails Plan and Public
Use Master Plan. There is little room for expansion within the Nature Preserve for new trails, because of the
Preserve's role as habitat for the City's NCCP/HCP permit. However, the Public Use Master Plan committee
and the City worked hard to strike a balance between natural resource protection and public access. This
resulted in the 33 miles of trails within the Preserve. I've included a link directly below with a lot of
information on the Preserve trails and how they are managed. Numbers 19, 20, and 14 relate directly to your
email.

I wish to weigh in on the Trails Network Plan Update.
My husband and I are long time residents of Portuguese Bend. We've evacuated horses
during several fires and are avid users of the trails.
1. We realize that we are landlocked in a high-fire area. We request fire ROAD (type 2
trail) accessibly through the PV Preserve. This includes the neglected farm road from
Vanderlip Road to Crest Road. Please prioritize this and amend the Trails Network Plan
to implement this.
2. Please find a way to restore direct access from Portugese Bend Community to
Filiorum Reserve. We have recently been blocked by landowner.
3. Please look into expanding the trail networks rather than close them down. Due to
social media, there are a lot more people on fewer and fewer trails.
We ask that our City restore the network of access and evacuation.

miles of trails, and additional conceptual trails not yet implemented, provide a variety of user groups with trail
experiences. The Trails Network Plan update is largely a consolidation of the five trails management
documents that establish this trail system. While the purpose of the Trails Network Plan update is not to
change trail user types or to add new trails to the existing trail system, the City values and seeks all input on
the process. This comment has been included in the record, and I would encourage you to attend our public
workshops in November and December to provide feedback. The dates of these two meetings will be release

It has been several years, I believe in 2015, since there were several public
workshops/meetings with Ara Mirhanian, reviewing the Trails Network Plan with the

It would be only fair to move the public workshops scheduled for November and
December of this year to the early part of 2021. This would give the trail enthusiasts and
homeowners time to review the records and refresh our memories about the changes

Thank you for your email. City staff received our first updated draft TNP document, under the current
contract, in August . A working group of staff (the Recreation and Parks, Public Works, and Community
Development Departments) are currently in the early stages of review. The intent of the TNP Update is to
consolidate the older existing five trails management documents, and only make updates where necessary. In
any areas staff is recommending updates or altered procedures, staff will be clearly marking proposed changes
for the public's and the City Council's review . However, staff will not have this draft ready for review until
October. Staff will release the draft document to the public well in advance (three weeks minimum) prior to
the first public workshop to give all ample time to review it so meaningful dialogue can take place at each of
the public meetings.

Please move and approve a continuation of Agenda Item 2 to a date specific when Council and the
public can comment on the draft update of the TNP's Implementation Procedures /Programs
Section.
Now that Staff has clarified that the Trails Network Plan Update contract with the Consultant is not a
"repeal and replace" exercise, and the Consultant has been on the job for more than a year, what we
all need to know is what has changed in the way of how the original plan is being implemented. How
is the Implementation Procedures /Programs Section being updated? There should be a whatever
you call it, draft with strikeouts and new text available by now.
Attached are the two pages from the original document. Back in 1984 The City had only "conceptual"
trails. The TNP established many policies to direct the effort to preserve and enhance them for public
use. The long over-due update is represented on these two pages. Relatively recently, the policies
have gotten "fuzzy". What has the City's Contract Officer instructed the Consultant to draft to resolve
this "fuzziness"?

Once again, I am turning to you because nobody else seems to have a grip on what Customer
Service and Community Out-reach means to the residents of RPV. Katie did not reply. Neither did
anyone else. The meeting turned out to be hybrid. Corrected or not, the Listserv notice did not go
out to those who have subscribed to the Equestrian Category. Oh, well. Or, is there funding in the
Budget for somebody to be proofreading and watching for omissions in what Staff sends out to the
public?
My big question for the City Clerk is ... Will the Minutes of this Agenda Item "memorialize" a
redirection in Staff's actions in the update of the TNP or, did Council approve the repeal and replace
as stated in the Agenda Report? It will make a huge difference. It is the City Council who needs to
know. How/when are they supposed to be informed of Staff's "interpretation"?
Ara said that I should contact you for more detailed information about Future Agenda Items. Do you
have anything more before the whole Agenda Report is promulgated? For example, July 7,
2020 ... Has there been any discussion about whether or not the proposed traffic signal at

PVDE/PVDS should include an equestrian level crossing signal button? How about improvements at
Abalone Cove... Is the continuity of the bluff top California Coastal Trail (CCT) and/or the erosion
control plans for Altamira Canyon mentioned?

Tonight you will be once again reviewing if our City should partner with CPA to deliver green electric power
to RPV. Staff was asked to provide a feasibility study, independent of that from CPA. There is a City Council
approved budget for $15,000 to obtain this independent study. I feel that this money is a wasteful expenditure
that our residents should not have to pay. There are already so many negative aspects of the CPA program. I
urge the City Council to vote NO on CPA and recommend the SCE program, which does not obligate RPV to any
potential financial burden. This allows those residents who wish to pay more for their green power through
SCE to do so, while not automatically enrolling every resident into the CPA program. I Some of the issues are:
1. The CPA program adds another layer of bureaucracy to our power distribution system along with
potential financial issues and costs.
2. RPV has nothing to gain and a lot to lose if it joins this program. During the last meeting CPA did not
disclose the liabilities that RPV would incur. Once RPV joins, estimates to leave the program are around
$12,500,000 based on current figures and of course CPA will not release any information from other
cities contracts due to privacy issues.
3. CPA can increase our electrical costs and charge whatever they want at any time without any approval
from the PUC. SCE, on the other hand, is legally required to sell energy at cost and get approvals from
the PUC before they can impose a rate increase.
4. The SCE program is "Energy Certified" by the PUC, which only allows certain qualified and approved
forms of green energy while CPA does not.
5. The contract with CPA includes an "Eminent Domain" agreement which gives CPA control of all of our
residential property in RPV to CPA.
6. The contract also has a non-disclosure agreement (NDA) that RPV must sign. I believe our City Attorney
is reviewing the NDA that SCE requires RPV to sign to release personal information on all residents to
CPA. This is unnecessary since SCE provides energy reports already. However, RPV should not release
any personal data to CPA without resident approval.
7. Once RPV joins the CPA, every user in RPV is automatically enrolled in CPA. They can opt out, but many
RPV senior residents won't even be aware of these changes, because SCE will still provide the monthly
bill.
I urge the City Council to vote NO on CPA and recommend the SCE program, which does not obligate RPV to
any potential financial burden. This allows those residents who wish to pay more for their green power
through SCE to do so, while not automatically enrolling every resident into the CPA program.

Dear Mr. Mayor and Ladies & Gentlemen of he City Council,
I understand that you have an update on the status of the RPV Trails Network Plan on your next
agenda. Please allow me to address this issue.
While due to Covid 19 I have not been on the trails for the last six months, I have been a regular trail
uses before since many years-and unfortunately have seen the trails getting more neglected instead
of being improved. That needs to be corrected. Youneed to make good on your original concept of
the trail network on the entire P.V.Peninsula. Each city needs to do their part, and RVP included.
So please let us know, why not more is done to keep up the existing trail network, nor even to
improve the trails and expand the network as is in the origina plan.
We don't need you to just receive and file the report. We need you to actually do something to
maintain & improve the trails-PLEASE !
In addition we need you to work on adding to the existing trail network by helping to facilitate
easements over private land portions to connect existing trails.

I wish to weigh in on the Trails Network Plan Update.
1. Kindly realize that we are landlocked in a high-fire area. We request fire ROAD (type 2 trail) accessibly through the PV
Preserve. This includes the neglected farm road from Vanderlip Road to Crest Road. Please prioritize this and amend
the Trails Network Plan to implement this.
2. Please find a way to restore direct access from Portugese Bend Community to Filiorum Reserve. We have recently
been blocked by landowner.
We ask that our City restore the network of access and evacuation.

Hello to my devoted Council Members,
Please do not approve Staffs Recommendation to receive and file this report on the
status of the RPV Trails Network Plan Update without seeing the Work Product from the
Contracted Kick-off Meeting.
Scroll down to near the end to see another way I have described this "milestone" which
we all should be able to comment on before any more of our money is spent on this
exercise in obfuscation.
I was not permitted to attend said meeting . I have been asking for the Contract Officer's
clarifications with the Consultant, ever since. The Contract Extension Agreement which you
recently approved states that this work has been completed . Cory Linder is the named
Contract Officer in the Contract Extension. If he doesn't have the details of Staff's
discretionary interpretations of Councils directions, how is anyone to know that Katie's
regurgitation of glittering generalities is producing an "update" as opposed to a Plan that the
public and Council do not agree with?
One hint that the update is headed in the wrong direction ... The Conceptual Trails Plan
(CTP) includes the details of how existing trails on City owned property are to be maintained
and to what extent they are to be improved when a cost-effective opportunity comes
along . The only thing that is "conceptual" about that is that it expects Staff to be proactive
about making it reality. Ara has stated that this primary chapter in the TNP is to become an
"Appendix". That scares me to death and nobody has had the opportunity to discuss it.

I was on the Committee which drafted t he CTP which was approved by the Council in
1990. In 1993 The Planning Dept. produced an update . The Staff Report did not disclose
that they had totally changed the purpose of the information on the maps. They went from a
design tool to a use restriction tool. Please do not let that happen, again.
In 2004 , I was on the Subcommittee which produced 11 suggestions to make the CTP even
more "Staff friendly". Upon Council approval in 2012, they were supposed to be incorporated
into the update which the Consultant was supposed to complete by 2013 year-end . It is not
so much that I am personally offended by Staff's rejection of my years of work , the
Peninsula's trails network is vanishing before my very eyes and I can't seem to find a
way to get Staff to read the Plan let alone budget for the Staff time it takes to implement
it. By the way, 90 percent of that is on Public Works .
No place is safe and RPV in going to Hell faster than the rest of the Peninsula . This one is
going to take more than a majority NO vote.

Following are the two emails I have sent to Cory with no response. I went to fill in the form but
ran into some difficulties finding the Open Contract which describes the requirement to
produce the document which I want the City Council to be able to inspect. My best
description went to Cory in red type.
The Open Contracts are listed on the City's web site by the Contractor's name as opposed to
the Project's Title. I do believe that Alta Planning + Design has the Contract for the Trails
Network Plan Update. I found a listing which was Created on 2/14/2019 and Last Modified on
11/13/2019. I could only see the beginning of the text that's posted and that mentions
January 15, 2019. I have not yet been able to find the Council Meeting with the Agenda Item
Recommending the extension of the TNP Update Contract. (Sometime prior to November 13,
2019.)
This is an urgent concern because the Consultant is scheduled to present his draft to the
public before the end of this year. Nobody has had the opportunity to review Staff's directions
to the Consultant in relation to the interpretations of Council's policy and formatting decisions
made back in 2012. Council is now asking for "holistic" solutions. Repeating that word does
not produce anything.
The holistic solutions about planning for the future balance of access to the City's Parks are in
the Trails Network Plan. Signage is there, too. Any changes like creating the PV Nature
Preserve need to be addressed thorough citizen involvement. The Public Use Master Plan
does not address the changed needs at trailheads. The public and Council needs to know
what changes Staff has directed the Consultant to make. The Council should not have to
redesign things like parking controls in the vacuum of a Consent Calendar Item.
Please find this one document before various departments produce any more isolated and
unnecessarily expensive Band-Aids. Thank you and Teri for being The Detectives, again.

Just in case you didn't acknowledge the following because it slipped through a crack, I am
resending it. Council is asking for "holistic" solution suggestions for all sorts of their Action
Items. The public review process in updating the Trails Network Plan is the source of those
solutions .
It is becoming terribly urgent that the City Council be given the opportunity to review an
analysis of the consequences of Staff's current lack of implementation of the Trails Network
Plan. The current City Council is five different people than the ones who addressed the
proposed Policy changes back in 2012. Nobody has been able to see, let alone comment on
or modify, how the unnamed Contract Officer interpreted them with the current Update
Consultant. You are now the named Contract Officer .
This one document is the basis of what shou ld be guiding all of the City's Staff's little,
discretionary decisions while we wait for the draft update. Have you got it?

Hi Cory,
Ara claims you have been given the Staff Report which Council Approved as a "Move Staff
Recommendation" with the 11 suggestions from the Open Space Planning and Rec.& Parks
Task Force. What I have been asking for is the signed by the Contract Officer,
clarifications from the Kick-Off Meeting of how these policies are to be implemented in
the draft document. Are you in a position to put that document into the City Clerk's
hands as a Public Record?
If NO, please just tell me and I will find some other way to find out why Staff is not
implementing the "Preserve and Enhance the Peninsula's Trails Network" Goal in the
Circulation Element of the Updated General Plan. It has been recommended that I not
include such "confusing" background information like the following. Let me know if you feel

Given the fact that nobody, Public Works in particular , is implementing the TNP (with the CTP
and BCP as understood insertions), I am really anxious about how the change in the PVPLC's
Mission Statement has become a change in the City's direction without subsequent to 2005
Councils having the opportunity to discuss and confirm/modify that "direction".
I am fine with Council not choosing to implement my suggestions (or other input from the
public) when they have had the opportunity to discuss all the pro's and con's of each action
and, after an appropriate time, have the opportunity to make informed, course
corrections . What upsets me is the fact that Council is not permitted to do that. While various
Councils have made some progress toward such "transparency", major policy discussions are
not showing up on their Study Session Agendas and the "downside of doing nothing" is not
showing up in Agenda Reports.
The Task Force produced a draft update of SECTION TWO which represented all of their 11
suggestions. (20 pages). (Matt Waters, received them.) Since the Agenda Report for the
TNP Update names you as the Contract Officer for the Consultant's Contract extension and
indicates by strikethrough that all of the Kick-Off Meeting tasks have been completed, I am not
the only one who is uncomfortable with not seeing any review by the Council and the public
at this "milestone".

Dear Honorable Mayor and City Council:
Please move and approve a continuation of Agenda Item 2 to a date specific when Council and the
public can comment on the draft update of the TNP's Implementation Procedures /Programs
Section.
Now that Staff has clarified that the Trails Network Plan Update contract with the Consultant is not a
"repeal and replace" exercise, and the Consultant has been on the job for more than a year, what we
all need to know is what has changed in the way of how the original plan is being implemented. How
is the Implementation Procedures /Programs Section being updated? There should be a whatever
you call it, draft with strikeouts and new text available by now.
Attached are the two pages from the original document. Back in 1984 The City had only "conceptual"
trails. The TNP established many policies to direct the effort to preserve and enhance them for public
use. The long over-due update is represented on these two pages. Relatively recently, the policies
have gotten "fuzzy". What has the City's Contract Officer instructed the Consultant to draft to resolve
this "fuzziness"?

Hello Teri,
Once again, I am turning to you because nobody else seems to have a grip on what Customer
Service and Community Out-reach means to the residents of RPV. Katie did not reply. Neither did
anyone else. The meeting turned out to be hybrid. Corrected or not, the Listserv notice did not go
out to those who have subscribed to the Equestrian Category. Oh, well. Or, is there funding in the
Budget for somebody to be proofreading and watching for omissions in what Staff sends out to the
public?
My big question for the City Clerk is ... Will the Minutes of this Agenda Item "memorialize" a
redirection in Staff's actions in the update of the TNP or, did Council approve the repeal and replace
as stated in the Agenda Report? It will make a huge difference. It is the City Council who needs to
know. How/when are they supposed to be informed of Staff's "interpretation"?
Ara said that I should contact you for more detailed information about Future Agenda Items. Do you
have anything more before the whole Agenda Report is promulgated? For example, July 7, 2020 ...
Has there been any discussion about whether or not the proposed traffic signal at PVDE/PVDS
should include an equestrian level crossing signal button? How about improvements at Abalone
Cove... Is the continuity of the bluff top California Coastal Trail (CCT) and/or the erosion control
plans for Altamira Canyon mentioned?

IMPLEMENTATION
IMPLEMENTATION PROCEDURES/PROGRAMS
It is not economically feasible to immediately initiate all
the trails development discussed in this plan at one time.
It is possible however, to initiate a planned program
of construction and implementation which effectively
utilizes available funds to provide trails and associated
support facilities.
Existing sources of funding and alternatives for acquisition,
development, and maintenance have been identified in this
plan. The successful implementation of this trails plan
hinges upon the coordination of funding and planning at the
city, county, state, and federal levels.
The Trails Network Plan is intended to serve as an advisory
tool for City decision-makers. It is also intended to serve
as a guide for implementing and funding city and regional
trails. This plan should serve as a device to achieve a
consistent course of action in developing an integrated
network of trails to support the transportation, recr~ation,
and other needs of the general public.
All trails shown as proposed in this plan are:
(1) conceptual only; mapping does not legally grant their use.
(2) general in location, not intended to be lot specific.
Development of proposed trails may proceed in various manners
depending on where the trail is located, timing of land
development in the area, and budget constraints. Each trail
proposal will be accessed individually and the appropriate
development timing and technique will be used. For example,
where easements already exist, trail development may involve a
City improvement project of signing, grading, fencing, where
necessary, etc. Where easements do not exist, and land is
undeveloped, easements may be obtained and trails developed as
the surrounding land is developed.
The following table summarizes the programs, legalities,
responsible parties, and status of events for the implementa-
tion of the Trails Network Plan. In most cases, the Environ-
mental Services Department will act as the lead contact agency
in trail implementation.

My husband and I are long time residents of Portuguese Bend. We've evacuated horses
during several fires and are avid users of the trails.

Regular Business -Agenda Item 2 Trails Network Plan
It has been several years, I believe in 2015, since there were several public
workshops/meetings with Ara Mirhanian, reviewing the Trails Network Plan with the
purpose of consolidating and re-routing trails within the Portuguese Bend area. Many of
us equestrians and homeowners abutting these trails attended and gave input.
It would be only fair to move the public workshops scheduled for November and
December of this year to the early part of 2021. This would give the trail enthusiasts and
homeowners time to review the records and refresh our memories about the changes
that were agreed to; i.e., consolidating and re-routing some trails.
