Ref: Rancho Palos Verdes City Council Meeting 05/19/2020, Public Comment
Thank you for your leadership. The COVID-19 pandemic has had devastating effects worldwide. Our state and local
governments took swift and decisive action which spared California the worst of the tragedy experienced in our nation.
The purpose of this message is to express support for the City's action thusfar on the pandemic, and request that RPV City
Council denounce recent protest events related to the pandemic plus consider further actions needed to circumvent
others. Please continue to follow the guidance of Federal, State, and County public health officials and consider requesting
support from LASD and I or RPV Code Enforcement (similar to LAPD standards) for enforcement of sanctions against public
health violations. Applying our brakes has worked so well. The answer is NOT to just let up!
This pandemic seems to have been politicized and two recent protest events which conflated public health measures with
restrictions on essential freedoms, and endangered the health of community members. One, May 7 at the Trader Joes store in
Golden Cove when a protestor entered and challenged employees by refusing to wear a face covering as mandated by County
requirements and store policy. That protestor then denigrated employees and shoppers. Though store management called
LASD for assistance apparently no help arrived. Another, this past Sunday's demonstration in Torrance which
advocated reopening all businesses. That flouted Torrance City, LA County, and State of California prohibition of
events. There was minimal if any social distancing, and few participants wore face coverings. The protestors then went back
into homes, neighborhoods, stores, ... The community health effects of both are still to be determined.
);> RPV needs to be part of a regional economic recovery. To do so, it will be essential to develop robust consumer
confidence in the City's businesses. Both actions described above undermine consumer confidence and could
adversely impact public health.
Actions Requested: Please formally denounce the two actions described above, explore obtaining LASD/ RPV support for
enforcement of sanctions against public health violations, and in summary please continue to follow public health
guidance. Reopening too much too soon and allowing laxity in following public health guidelines can jeopardize lives and
further complicate the task of economic recovery.

Dear Governor Newsom:
The City of Rancho Palos Verdes thanks you for your leadership and efforts to protect
and support Californians during this unprecedented public health crisis. Cities remain on
the front linefront-line helping residents stay safe and in their homes, delivering
emergency services, and supporting local businesses and community organizations.
However, as emergency costs continue to grow, city revenues to fund local services are
plummeting . COVID-19 is having devastating impacts on city budgets and services
statewide .
Based on the League of California Cities analysis, California cities are projecting a
nearly $7 billion general revenue shortfall over the next two fiscal years. This shortfall
will grow by billions of dollars if stay-at-home orders to protect public health extend into
the summer months and beyond.
The City of Rancho Palos Verdes~ projects that these shortfalls \Viii impact our core city
services, including infrastructure capital projects, public safety, and core city services for
residents, as well as the employees have already been impacted.-;
Since the beginning of the COVID-19 crisis, the City of Rancho Palos Verdes has
stepped up to protect and serve our community, purchasing equipment and supplies to
keep residents and employees safe, and performing robust community outreach

regarding resources and services . The necessary measures our city has taken are
costly. In order toTo continue to be a full partner with the state in saving lives, protecting
our communities, and ultimately recovering from this crisis, we need your help.
The City of Rancho Palos Verdes has joined the Support Local Recovery coalition and
we are calling on you to immediately support the follmNing actions:
• PQ.rovide $7 billion in direct and flexible state funding to support critical local
services and allocate CARES Act funding for all cities for COVID-19-related
expenditures.
• Advocate to secure $500 billion in direct and flexible funding from the
federal government for all cities natiomvide to support critical local services.
The City of Rancho Palos Verdes appreciates your consideration of our requests and
look forward to further discussing in the coming days how together we can continue to

Dear City Council,
Elias called me yesterday regarding the PVDE Safety Project. I asked him why the estimated speed around the Bronco curve
had gone from 38 mph to 43 mph. He replied that that there was a newer traffic study. Perhaps I missed it, but I do not recall that
being part of the staff report. Wouldn't that make the crosswalk even less safe where it is located on the curve? The only reason
not to put the crosswalk at the lower Headland is because no one wants to deal with the issue of the pilasters between the two
Headland Drives. Are those pilasters really that important? Isn't there some way to put a 4 foot path to go behind them?

MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF RANCHO PALOS VERDES AND THE PALOS VERDES
PENINSULA LAND CONSERVANCY FOR THE REVEGETATION OF AREAS 94, 95,
AND 96
THIS MEMORANDUM OF UNDERSTANDING ("MOU") is effective as of
__ , 2020, and is between the City of Rancho Palos Verdes ("RPV") and the Palos
Verdes Peninsula Land Conservancy ("PVPLC"). RPV and PVPLC are sometimes
referred to as a "Party" and collectively as the "Parties."
RECITALS
A. RPV and PVPLC are required to perform annual fuel modification for fire
prevention purposes and the Parties wish to engage in a strategic revegetation ("Project")
of the fuel modification zones 94, 95 and 96 ("Zones"), as further described in Exhibit "A"
attached hereto, to minimize the negative impacts of traditional methods of fuel
modification while increasing habitat value.
E. The Parties desire to work cooperatively to benefit both agencies by
reducing ongoing fuel modification costs for the Zones. Accordingly, the Parties desire to
organize and fund the revegetation of the Zones.
AGREEMENT
NOW, THEREFORE, the Parties in consideration of the mutual promises set forth
in this MOU, agree as follows:
1. Purpose of Memorandum of Understanding. The purpose of this MOU is for
the Parties to work cooperatlvely to organize and fund the revegetation of the Zones. RPV
will provide funds to the PVPLC for all costs associated with the revegetation of the Zones.
2. Responsibilities of the Parties.
2.1 PVPLC. PVPLC agrees to do the following:
(a) Provide the necessary services to conduct the Project,
including the purchase of the correct vegetation, clearing of the Zones in preparation for
re-vegetation, and planting the re-vegetation materials in the area, pursuant to the
proposal PVPLC provided to RPV, attached hereto as Exhibit "8".
(b)

Provide monthly invoices to RPV for the cost of the services
2.2 RPV. RPV agrees to do the following:
(a) Upon receipt of an invoice from PVPLC, RPV will conduct a
progress check of the Project within five (5) days. RPV, in its sole discretion, will

determine whether the invoice correctly describes the work completed. Once RPV makes
that determination, the invoice shall be paid in full within thirty (30) days.
(c) RPV will provide up to a maximum compensation of $12,700
for the completion of the Project.
3. Notices. Any notice or other communication ("Notice") which either Party
may desire to give to any other Party under this MOU must be in writing and may be given
by any commercially acceptable means, to the addresses below:

4. Interpretation. This MOU will be interpreted, construed, and governed
according to the laws of the State of California. Each Party has had the opportunity to
review this MOU with legal counsel. The Agreement will be construed simply, as a whole,
and in accordance with its fair meaning. It will not be interpreted strictly for or against
either party.
5. Third-Party Beneficiaries. Nothing contained in this MOU will be construed
to create any rights in third parties and the Parties do not intend to create such rights.
6. Attorneys' Fees. In the event that any Party commences legal action of any
kind or character to either enforce the provisions of this MOU or to obtain damages for
breach thereof, the prevailing party in such litigation will be entitled to all costs and
reasonable attorneys' fees incurred in connection with such action.
7. Severability. If any provision of this MOU, or any portion thereof, is found by
any court of competent jurisdiction to be unenforceable or invalid for any reason, such
provision will be severable and will not in any way impair the enforceability of any other
provision of this MOU.
8. Amendment of MOU. This MOU may be amended at any time by mutual
agreement of the Parties. Any amendment must be in writing and signed by both Parties.
9. Entire Agreement. This MOU constitutes the entire agreement between the
Parties relating to the subject of this MOU and supersedes all previous agreements,
promises, representations, understandings and negotiations, whether written or oral,
among the Parties with respect to the subject matter hereof.

Dear RPV City Council,
My name is Nick, and I'm writing to you as a concerned resident of Rancho Palos Verdes.
I wanted to raise to your attention to the lack of residents actively wearing mask coverings when they are
outdoors along trails and sidewalks. I know LA County is asking all their constituents to wear face masks in
public that started this week, and I'm extremely annoyed, disappointed, and disturbed by the lack of our
residents who are adhering to this order (understanding that things can take time and that government resources
are scarce).

As someone who also works in a local municipality and is actively working on mitigating COVID-19 effects in
Los Angeles (and even seeing that the former mayor of Palos Verdes tested positive awhile back), I'd wish that
our residents would take this seriously not just for their own health and safety, but especially for others (given
that we have an older population and children who are potentially vulnerable to the Kawasaki disease).
I wanted to also offer some suggestions on what I'd like the Council to do instead of just vent, so I hope you'd
look into the following:
1) Have local/county first responders (when out and about) to inform anyone in the public to wear masks. Even
just a quick engagement is enough to let people know that the City of RPV is serious about this.
2) Offer a service where first responders can drop off free PPE at residential homes for those that do not have
the ability to leave their homes.
3) Provide PPE and education materials at local facilities (fire stations, police stations, City Hall, community
groups, along specific trails and local businesses, etc...)
4) Provide council video recordings and on the city website of members/leadership notifying constituents about
the need to wear PPE (English, Spanish, and other major constituent groups that make up the demography of
residents). Encouraging residents to get tested at a LA County/City site is also recommended.

Thank you for your reply. I just now reviewed the City Trail Map and I am unable to understand your 95%
figure claimed below. Do you mean that 95% of the parks that have trails are open but with only a fraction
of the trails actually open for use? The argument that the Trump course trails are closed for "maintenance" is
an insult as those "trails" are concrete and are now serving the golf carts. Not buying it. Must do better.
Please include my emails in the record as public input/comments.

Thank you for your email about Trump National Golf Club and the adjacent trails. I certainly understand the frustration
that you and all our residents have experienced over these past challenging months.
The City is happy to report that the public trails and Founders Park are open to the public again, with some restrictions,
such as required social distancing and face coverings required at parking areas, at trailheads, and when near other trail
users. This re-opening went into effect on Wednesday. 95% of the City’s trails are open. Those that are closed will re-
open in the coming days as they are in need of some maintenance.

Greetings Honorable Council Members -
Just when you think it can't get any more absurd, something simple like RPV opening it's trials proves that we, the
common citizen, are always wrong in this regard.
Example: I can now pay the Trump Organization an exorbitant green fee ($175/person?) and lawfully be on the shared
trail/cart space on the Trump course OR I can be a law-breaker standing in the exact same spot (ok 6' away anyway) if I
didn't pay. WHAT KIND OF IDIOCY IS THIS!!! Aside from looking like gross favoritism for the rich/elites, it looks a heck
of a lot like the City is more interested in protecting it's golfer fee/tax income stream than protecting health. Same
argument for all the trails "partially" open.
PLEASE STOP BEING OVERTLY STUPID AND FIX THIS!

Hi Mickey,
Thank you for taking the time to bring to the City Council’s attention that Agenda Item No. E was
inadvertently placed on the Consent Calendar when the staff report indicates it as a Regular Business
Item.
The City Council will be asked to pull it from the Consent Calendar at tomorrow’s meeting and
consider it as discussion matter.
At this time, the funding source to cover the cost for preparing the state-required CEQA documents
will come from restricted Measure R funds and not from TOT revenue.
Prior to the current COVID-19 health crisis, Staff and the City Council Subcommittee were meeting
with our elected representatives to see what state and federal funding could be used for this project.
Additionally, the City is looking to submit the project for Measure W funding. All of this is in an effort to
minimize the use of City dollars to address this regional problem.
As for the septic issue in Rolling Hills, a draft plan was prepared and submitted to Rolling Hills to
consider connecting their homes that are on a septic system to a sewer system.
The City Council and the public will receive a report on this matter when more information becomes
available.

Item E, About the Portuguese Bend landslide, does not belong on the Consent Calendar and should have a
public hearing. The City staff has been notified and will make the change.
The Portuguese Bend Landslide stabilization program is the most important project that we face. Now with
the coronavirus upon us, there are so many things that have already changed in our lives and so many more that
will further change our lives. Our City is fortunate to have a large surplus as compared to many other local
cities and I feel that we should protect it as much as we can because of the current coronavirus situation we all
face. Most of this surplus has accumulated thanks to the TOT tax that we receive from Terranea that funds our
CIP program. I feel that Terranea has some very big hurtles to overcome before they are fully recovered from
their shutdown and I think City future projections for the TOT tax are very optimistic. It will be some time
before people and Groups flock back to Terranea. Even before Terranea won the Measure B election, the Union
was able to force many Union organizations to cancel their events at Terranea and I think, at that time, there
was about a 10% cancellation rate. Ever after this virus passes, the Unite 11 Union will continue their efforts to
discourage Union groups from coming to Terranea, which will continue the cancellation rate.
I know that the landslide is a huge problem for RPV and could become a huge environmental disaster with a
potential for many lost lives, if it is not corrected. Now getting back to Item E, staff has recommended Council
action to:
1. Award a professional services agreement, in an amount not to exceed $292,289.30, to Chambers Group,
Inc. for the preparation of environmental documents in accordance with the California Environmental
Quality Act (CEQA) for the Portuguese Bend Landslide Mitigation Project; and
2. Approve an additional appropriation in the amount of $292,289.30 from Measure R funds to cover costs
associated with the preparation of the environmental documents.

It is my understanding that by approving this Item, and receiving CEQA certification, it will allow us to look
for grants and other options to provide funding for the remainder of the project. Once this item is approved by
our CC and CEQA certification is satisfied, the next step becomes a $20 to $40 million dollar project. If we
proceed to self fund this project, we will wipe out our complete surplus that we have accumulated, thanks to
Terranea, and much more. What will happen if Terranea never recovers and remains closed and we don't
receive any additional TOT taxes?
I have always said that the most important first thing that the City should do about correcting the landslide is
to resolve the issue of the significant volume of water filtering down into the landslide from Rolling Hills via
their septic tanks and ground water runoff, and I still feel that way. Keep in mind that when RPV was
experiencing a significant 5 year drought a few years ago, the slide still continued to move, which is a sign that
water from Rolling Hills was still affecting the slide movement during that drought . I also feel that the City
should have completed the drilling of the 8 wells above the landslide perimeter last year, which might have
been able to indicate the volume of water that Rolling Hills contributes to the continual landslide movement.
They do have a liability, when their water continually feeds into the slide area. With Council approval of this
item, the City will probably have spent $1 million on this project.
I am in favor of approving this Item, to complete the CEQA reporting, only if it will put us in a position to
determine if there are any grants or Federal Infrastructure Programs that would cover the balance of the project
cost, and I am not a believer in P3 funding because our residents will have no say in that approval process.

Ladies and Gentlemen:
Once again, on my daily walks I see no signs by the city of preparation to fend off the forthcoming fire season.
Wouldn't you think*******???
Once again, about the only thing we can do is the best we can to clear our own property of most of the vegetation
and, I guess, keep our fingers crossed. Fortunately due to lack of much rain this year and the resulting growth of
vegetation so far, it is not quite as scary as it often is. Still--- there is plenty too much growth creating a fire hazard
and when it happens, as has been pointed out, for those of us on top of the hill the choice is trying to drive out or
staying in our houses and hope for the best or burn to death. All we can do in addition is pack an overnight bag and
put a few things in the car and hope for the best.
One day we will (the city) either do something about it or we will have a killer fire.

I am pleased to see that you are happy regarding the cost reduction and the proposed schedule for this project.
Regarding your concerns, my responses are highlighted in yellow:
1. I'm still not convinced that a third lane is the best solution on the curve. Drivers will
become confused, just as they do when the 4-lanes are reduced to 2-lanes in the
Marymount College area, but I do think the residents on this curve should decide for
themselves. Answer: Staff and most of the residents along the curve are in favor of this
center lane.
2. I question the placement of the crosswalk and I have concerns about
northbound/southbound traffic having enough stopping distance. So, for sure, flashing
lights strategically placed north and south of crosswalk are paramount. Was a traffic
engineer consulted about this placement? The last written traffic report placed 85%
percentile of motorists at speeds of 38 mph so that may be the deciding factor as to
where those flashing warning lights be placed. Answer: Yes, the City Traffic Engineer
was consulted and the 85% percentile of vehicular traffic is 43 MPH as stated in the Staff
Report.
3. Item 5 of the project's itemizations lists - 8' wide equestrian/pedestrian trail -
that may be possible at the Bronco curve but northerly, towards the 28100 residential
block, that area narrows and I don't think there is width enough for 8', more likely 6',
and, of course, a guardrail, as needed. Answer: Once the detailed engineering plans are
prepared we will have better information regarding the width of the path. Our goal is to
have 8’ wide path through out.
4. I completely agree with the installation of the radar units now to help improve safety
for our residents. Answer: Great.

And, finally, please no more signage! The many signs now are being ignored by
bicyclists and motorists. Or, at least remove those signs that are no longer relevant
before erecting more that blights our pretty drive. Answer: Staff is not recommending
any more signage at this time other than advanced warning signs for the crossing
(which are required) as reflected in the Staff Report.
