The Palos Verdes Peninsula Chamber of Commerce would like to voice our strong support for
the City’s consideration of the programs suggested in the Staff Report regarding the
development of a “Small Business Financial Assistance Plan”. The Chamber greatly appreciates
the City’s leadership in stepping forward to support local businesses.
The “One Time Refund of 2020 Business License Tax” would provide much needed relief to
small businesses. The Chamber supports this proposal. In addition, we encourage your
thoughtful consideration of the other ideas, including the possibility of some type of TOT Tax
Relief Credit. The hospitality industry, as you know, has been especially hard hit and will likely
experience a longer road to recovery than other sectors.
I would also like to take this opportunity to thank the City Council, the City Staff, and City
Manager Mihranian for your ongoing support for local businesses and your collaboration with
the Chamber.

The City is in receipt of your request that the City Council consider establishing a moratorium on the
deployment of wireless facilities during the quarantine.
At this time, the City has received one wireless application since the “safer-at-home” orders were
issued.
This application, as well as the others submitted earlier in the year, continue to be processed based
on the City’s wireless ordinance.
To date, there has been no indication from the wireless carriers that the City streamline or skip the
City’s permitting process including public noticing.
Staff will continue to monitor the City’s wireless activity to determine whether a moratorium is
warranted.

Dear Mayor & City Council Member,
We ask that you impose a moratorium on “small cells” and other wireless infrastructure permits process and
deployment until the COVID-19 emergency is over.
The wireless providers are using the COVID-19 emergency as cover to expand and cement their rapid and
virtually unsupervised deployment of harmful wireless infrastructure. Our local leaders should not have to
dedicate time and resources to policing whether the wireless companies are following local and state law, they
have far more important things to do.
The FCC wireless permit rules allow emergency moratoria. Homeland Security guidelines emphasize that
maintenance of existing communications capability is the priority. New construction is not “essential.”
The COVID-19 emergency has led to a government shut down of non-essential activity. Hospitals, emergency
response and local officials are overwhelmed and they must be allowed to focus on what is indeed “essential”.
Now is not the time to be dedicating resources to expanding, rather than just maintaining, our networks.
The FCC has directly held a local jurisdiction can impose a temporary halt to deployment and permits during
emergencies. In the Matter of Accelerating Wireline Broadband Deployment by Removing Barriers, FCC 18-
111, 33 FCC Rcd 7705, 7784-7785, ¶157 (2018) (“We reco gnize that there may be limited situations in the case
of a natural disaster or other comparable emergency where an express or de facto moratoria that violates section
253(a) may nonetheless be ‘necessary’ to ‘protect the public safety and welfare’ or to ‘ensure the continued
quality of telecommunications services.’”)
Homeland Security has declared that local government is on the forefront and can take control over determining
whether to temporarily halt all non-essential activity. Homeland Security guidance documents prioritize
maintenance of existing Communications Systems, and do not support “essential” status for new construction.

Moratorium on Processing Noncommercial Antenna Applications
Honorable Mayor and Council Members,
We appreciate that the City Council has directed staff to update RPV municipal code regarding
noncommercial antenna applications in residential areas to address neighborhood
compatibility, visual impacts, placement of silhouettes to assess impacts, and current FCC
regulations (including health and safety requirements) and adopted a temporary 45-day
moratorium on processing such antenna applications until the code is updated.
Since the temporary 45-day moratorium on processing antenna applications was originally
adopted, federal, state, county and local emergency declarations and executive orders have
been issued to govern operations as we try to mitigate the impact of the coronavirus pandemic.
The operational changes have resulted in cancellations of public meetings, the closure of City
Hall to the public, and major City actions to implement the Safer at Home program throughout
the City. These changes have understandably strained the City's ability to complete the tasks of
drafting appropriate noncommercial antenna code language and obtaining resident input.
In light of the difficult circumstances under which the City is operating, we strongly support
extending the moratorium for up to 10 months and 15 days to enable Staff to complete the

necessary work. Since the installation of such antennas has the potential to permanently affect
the character and livability of most neighborhoods within the City, we feel it is important for
Staff to take whatever time they need to complete a thorough analysis of the relevant issues
and to make carefully considered recommendations for appropriate changes to the code for
Council and resident consideration.
