BACKGROUND AND DISCUSSION:
On September 4, 2018, the City Council approved the Amended and Restated
Declaration of Restrictions which, among other things, requires a review of the
Applicant’s compliance with trail maintenance obligations (Attachment B). Specifically,
Condition No. 7 of the Amended and Restated Declaration of Restrictions (Attachment
B) states the following:

7. Review and Monitoring For Compliance. The City and Owners [Trump National
Golf Club] shall review the Owners' compliance with its Maintenance Obligations
and compliance with the terms and conditions under this Declaration at least
once every twelve (12) months based on a tracking system and protocols
implemented by City for monitoring compliance. Owners shall implement and/or
perform all reasonably practical recommendations or requirements of City
following such annual review.
This condition was added after the Planning Commission expressed concerns that,
although the Development Agreement requires an annual review to ensure good faith
compliance by the Applicant, there were no formal metrics or procedures in place to
measure and track the maintenance of the 14 trails and open space areas to ensure
timely compliance. Subsequently, Condition No. 7 was presented to the City Council to
include language requiring that a tracking and monitoring program be established as
part of the annual review.
Pursuant to this Condition, Community Development and Recreation, Parks and Open
Space (RPOS) Staff have worked together to create a maintenance spreadsheet. In
early 2019, Staff, in collaboration with Staff from Trump National, created a tracking
system for trail and open space complaints and the Applicant’s responses. The resulting
document is the maintenance matrix (Attachment A), which was most recently updated
on January 23, 2020. If any additional updates are submitted after the agenda is
distributed, they will be provided to the City Council as Late Correspondence.
Process and Applicant’s Response
Typically, a complaint will be received from either the RPOS Staff or the public, and
RPOS Staff will add the item to the appropriate trail page in the maintenance matrix.
The matrix isn’t transmitted to the Applicant for each complaint, as several issues are
usually discovered and sent to the City at the same time, which results in groups of 30
or even up to 60 separate issues discovered on the same day, and then submitted to
the Applicant a few days later. Once the updated Matrix is sent to the Applicant, it is
Staff’s understanding that the Applicant immediately begins working on the items.
However, due to the number of the items, it may take them some time to address all of
them. Also, due to the number of items, it then takes the RPOS Staff additional time to
inspect all the items that have reportedly been completed, and to update the matrix on
each item’s status, which may explain the delay in some of the completion times. As
noted in the key on the first page of the matrix (Attachment A), there are items that
RPOS Staff has confirmed were completed (shown in green in the status column);
items where the Applicant has responded to the City (shown in black), items that the
Applicant reported completed but Staff could not confirm (shown in red), and issues to
which the Applicant hasn’t yet responded (blank).
Regarding the unconfirmed items, there are several possible explanations for why Staff
and the Applicant do not agree that these have been completed . It may be because the
issue has a tendency to reoccur often, such as an empty doggy bag dispenser or

graffiti. It could also be that the Applicant repairs the issue, but not to the City’s
specifications, or that there is some confusion regarding the exact location of the issue.
Regarding the items with no response from the Applicant, most of them appear to be
recently-reported items but some older items remain on the list. Staff will be following up
with the Applicant regarding these items — especially the older ones — and has some
proposed solutions to expedite and improve the repair of some of the larger items that
remain, as discussed below.
Remaining Issues and Proposed Solutions
Staff has followed up with the Applicant regarding several of the outstanding items that
they are working on, including the replacement of signs and obtaining estimates from a
trail contractor (Bellfree) for trail repairs, as summarized below:
a. Replacement Signs - Staff has requested additional information from the
Applicant regarding the status of these signs, as it has been several months
since the Applicant stated the signs would be replaced. The Applicant has
informed Staff that they are working with their sign company, who is working on
drafting proofs for the Applicant’s approval, which should be received in the next
few days. Once the Applicant receives and approves the proofs, they will provide
Staff with an estimated timeline for production and installation.
b. Trail Repairs - The Applicant’s trail contractor recommends deferring the trail
repairs until after the rainy season, which “officially” ends in mid- to late-March
because of the soil condition. Additionally, Staff was recently contacted by Kurt
Loheit, a local resident and volunteer trail construction expert who has observed
several of the major persistent trail issues. He has offered his volunteer services
to help identify and complete the best repair methods for some of these issues,
and has also offered his volunteer crew for some of the work. Staff has informed
the Applicant of Mr. Loheit’s offer, and the Applicant will be reaching out to him
soon.
As for the unconfirmed items where there may be some misunderstanding, Staff will be
working with the Applicant to clarify these issues, either by providing photos of the issue
or meeting the Applicant’s maintenance crew on site.
Although maintenance of the trails is a work in progress, Staff believes that the
Maintenance Matrix has been helpful in tracking and resolving maintenance issues in a
more timely manner than in the past.
ADDITIONAL INFORMATION:
On January 16, 2020, a public notice was mailed to all property owners within a 500-
foot radius of the project site and published in the Palos Verdes Peninsula News. Notice
was also provided to interested parties through the City’s website listerv. In response to
the public notice, Staff received emails (Attachment C) from several residents who hike

the trails often. They provided photos of some areas that have consistently been in poor
repair and expressed their concerns and frustration with the app arent neglect of and
possible safety issues with these trails. Staff believes that, with the hiring of the trail
contractor, as well as with the participation of the volunteer trail expert, Kurt Loheit, the
City will likely be seeing resolution of many of these lingering problems in the near
future.
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative actions are available
for the City Council’s consideration:
1. Identify areas of concern regarding the property owner’s complian ce with
the maintenance obligations and direct Staff to address these concerns at
a future meeting.

Hi Amy - My name is Jacqueline Davis (Jac), and I am a volunteer trail watcher with the PVPLC. I received
notice about the upcoming city council meeting and wanted to give some information concerning my efforts to
improve the Ocean Trails maintenance.
My husband and I have been hiking Ocean Trails weekly, often daily, since we moved to the area 4.5 years ago.
I have filed many reports with the land conservancy over the years, and I am told you have access to these
reports. It has been very frustrating to file report after report, and see no changes to this beautiful part of the
Preserve. I began to understand over time that the maintenance is supposed to be done by Trump Golf Course,
so about a year ago (Feb. 25th, 2019) I contacted the general manager, Lili Amini, and reported some of the
conditions of the trails - which I felt had become dangerous. Our email exchange went back and forth, I
included many pictures for her reference. She was very accommodating over the phone and seemed interested
in doing the repairs. Disappointingly, some work was done, it was minimal, and much of what I reported a year
ago remains unchanged.
Ocean Trails Reserve is such a stunningly beautiful part of our community, it is busy every day of the year,
especially on weekends. I think it is extra special because it is so easily accessed by everyone. Yet, in terms of
trails we hike all over the peninsula, it seems to receive the least attention. The degradation of the trails is a
shame. Trail signs have been out in many areas for years, the stairs from the Shoreline Park to the upper paths
are in rough shape, etc.

Is someone from your staff making regular inspections of Founders Park?

This has been like this at least two weeks, another junction box is loose, and there is one
location that initially held a light but the wiring is now below ground level and no junction
box on top. I have seen no activity to replace the two missing benches or any effort to replace
the lighting.
