We want to first commend the City Council and Staff. A lot of work and due diligence has been performed on this issue and we appreciate it. On November 19,2019, the City Council passed unanimously a resolution that approved and certified the Final EIR which allows for the development of 31 undeveloped lots in Zone 2 of Portuguese Bend. As your consultants indicated during the meeting and in its report, the City has been looking at this issue for many years. Multiple Studies/Reports, CEQA required EIRS and public hearings have been performed and conducted. The conclusion remains the same--it is safe to build on the remaining Zone 2 (Non- Monks) lots. We're writing today to strongly support the staff recommendation to adopt Ordinance No. 631, as written. The City Council that was in effect in November 2019 has performed its job. Pulling this resolution from the Consent Calendar now would be highly unusual and would only draw out the issue further, at more expense to all those involved. 1 E. After the big rain on Wednesday and Thursday , and for few days after , a rat is still rotting in the water drainage between our property and GH Pacific terrace mausoleum. Also , although it is not very visible from the pictures , you can see that the gutters are rusty, all covered with green disgusting sludge , which is also in the cement drainage and over the walls around the drainage holes ... Seems like no one is taking care ofthat area, which gives rise to flies and unpleasant odor. See the pictures below . I can send you more detailed one of you need me to. One of the CUP for GH requires the perimeter to be kept in good condition , clean and free of debris , I guess dead animals included :), sludge and slime also ... Could you please help with this? I really believe that being a good neighbor includes taking care of the property so it is not disgusting to the neighbors . STOP the presses. Madam City Clerk, do not submit these documents to LA County until we have a closer look at them? I hope so. I hope it is not too late. This was not in the text of the Agenda Report nor in Staff's Power Point Presentation. l. J>urposes. The purposes of this Conservation Easernent are to ensure the Property will be retained for~yer in its natural, restored or enhanced condition consistent with the habitat protection requirements of the NCCP/lTCP and to prevent any use of the l)roperty that will impair or interfere vvith the Conservation Values of the Property. Grantor intends that this Conservation Ease1nent will confine the use of the Property to 1 activities that are consistent \vith such purposes, including, \Vithout li1nitation, activities involving the preservation, restoration and enhancetnent of native species and their habitats. Unless we do something to better define "Conservation Values", that means "pure habitat"; No humans allowed except authorized Biologists. As a Grantor, it is not my intent to give up the pleasure of visiting open space on unfenced trails based on omissions in the list of activities which are "consistent" with the RPV General Plan as opposed to Conservation Values. Then, there needs to be a consideration of changes to standard procedures so that more undisclosed consequences don't get slipped past us. Council and the public need more access to Staff's decision-making process. Even the standard notice to property owners within 500 feet comes too late. A ListServ notice should go out whenever a "project" that involves physical property is assigned to an Administrative Analyst, Planner or Engineer. The categories should be updated and a new PR program initiated to educate the public about the opportunity. This will make it all the more important for everyone who composes said notices to follow the template so that all the info is included, particularly the name of a contact person, not just a department. Following are suggestions I have made in the past. Given the changes in several situations, I am requesting that Council request that Staff produce a "Position Statement" on each one for the record. As in justify why they keep pursuing obsolete programs, avoiding completing other goals and are not meeting deadlines. These are not just rhetorical questions. I call it "damage control" while "moving forward". First and foremost is that Staff produce a clear and concise "interpretation" of Council's Requests to the City Manager. This is the sort of thing I would expect to see come back on the Consent Calendar. What I have noticed on many occasions is that Council Moves Staff's Recommendation with some modifications and some time later, the Minutes do not reflect what the City Manager actually instructs his Staff to do differently. Please restore having speakers state their name for the record at the beginning of their comments. In general, Emily's voice does not record well on the video. Along the same line of transparency, on every Agenda, the public is advised not to include "personal information" in their correspondence because it may end up on the "public record". This admonishment does not include when it is to the public's advantage to have people of a like mind be able to contact them for future lobbying or legal action. This one comes under "follow the money". Item D is an annual process based on keeping individual departments from squirreling away "earmarked" donations. The "recycle drawing" has "grown like 2 Topsie". The "Quimpy Fund" gets almost no mention. These are all monies which come out of resident's pockets. Council has the "discretion" on how these funds are spent but is rarely given the opportunity to discuss/modify how much money is going where. Item E. My suggestion was that Staff present a defense of why they keep recommending tweaks to the Moratorium Codes instead of just recognizing that it has accomplished its objective and recommending that all this "fine print" go away based on the validity of the Codes which apply to the whole City. Why not? Item G represents my concern about what "receive and file" really means. No matter what the Council, Commission or Committee has to say, Staff just keeps doing and not doing whatever. Is there a list anywhere of all the activities people are no longer allowed to do in the whole City because one little group, somewhere, was offended? Nudity, smoking, consuming alcoholic beverages, growing hedges just to name a few. Make a "law" and we all get to pay for the enforcement. To what end? Item H, This is not the end of a long and winding road. Pun intended. Deadman's Curve is an historic landmark's name. The Sol Vista Trail is an historic trail name. The Palos Verdes Loop Trail is a regional concept. The PVDE Roadway Safety Project is based on a grant application. The City has completed construction of the Trail Connection for the Deadman's Curve Segment (Conestoga Trial) Project. This trail project was approved by the City Council in the Fiscal Year 2016-17 Capital Improvement Program budget. A public meeting was held on June 6, 2018 to obtain feedback regarding design elements of the project. $404.688.00 for what? That makes a year and a half and I still have not been able to comment on how the "design elements" for this little segment compare with the Design Program for the PVDE Roadway Safety Project and the expected update of the Trails Network Plan "narrative" for the PV Loop Trail segment A29. Not that I haven't asked to see them. There is no Conestoga Trail. Deadman's Curve is one of nine portions of the PVDE Roadway Safety Project. How can Council and the public get to see an accounting of the status of the whole project? As in, has Staff proposed a modification to the Palos Verdes Drive East Roadway Profile north of Calle Aventura? Oops, we don't have one. Somebody might want to Ask Willdan Associates since they are still working for the City and produced our original Street Standards Study Report. There are two sides to each of these suggestions. One is how do we, the people get to make sure that Staff is considering all of the "consequences" while Staff manages a project? (When given the opportunity, our informed population can spot errors and omissions before serious damage is done.) The other is... How does Council get to learn which policy or goal took precedence when Staff recommends a particular action? (From here on, every action will be a balance between infrastructure enhancement and habitat enhancement.) Staff has been given the authority to decide what is "appropriate development". That also means they get to choose what is "not appropriate". There should be a time and a place for them to justify each such decision. That should be the primary discussion when we all consider the Landslide Remediation Engineering recommendations. My continued observation and suggested solution is that we need a Commission to work out the kinks in the projects which don't get reviewed by the Planning Commission. Too many decisions are being made 3 before Staff produces a complicated recommendation to Council. Do notice that recording the Conservation Easement was one of four parts of the NCCP approval recommendation. My suggestion is to call it an Infrastructure and Activities Commission. Our parks, reserves, utilities, storm water flow controls, trails, emergency access and other public amenities all need to fit together in an order which makes them the most cost effective and the least impactful on our greater community. For instance. Did any "citizen body" get to really look into the details of the Conservation Easements which Council just approved in the same Motion which approved the NCCP/HCP? Reality check. It is the recording of these easements which will officially eliminate the continuity of the California Coastal Trail and the Palos Verdes Loop trail. Not, the pending permits based on the NCCP. Now you know why there have been no public workshops to review the progress of the Trails Network Plan update. Since before 2004, the "pure habitat" advocates could not allow the public to know about this very important step toward their ultimate goal. Can the new Council and the new City Manager say... STOP the presses. Madam City Clerk, do not submit these documents to LA County until we have a closer look at them? I hope so. And, some people are calling Trump a BS artist. Does RPV still have a swamp to drain? Or, which side is Ara Mihranian on? However, if you recall, cameras in the Eastview area were first approved at the December 20, 2016, meeting, and then discussed and/or mentioned in staff reports at the following meetings: March 20, 2018, June 5, 2018, July 31, 2018, and August 20, 2019. This doesn't even include the SCE pole purchase that took place mid-year, which was to provide a way to provide a cost-effective way to place the cameras in addition to savings from changing out the LED bulbs. The cameras have been discussed at length as part of the City's Public Safety Strategic Plan, which is an ongoing plan to reduce crime, and only item forthcoming is the contract and minor adjustments to the language. This is just another case of Staff feeding "the public" a little piece of a much bigger plan with no opportunity for even this Advisory Committee to influence the quality or advisability of said "bigger plan". Even the PVDE Roadway Safety Project is a fragmented piece of a bigger plan which Staff has not presented to anyone in relation to the Updated General Plan and the NCCP which they have been implementing since 2004. Item H on the December 3, 2019 Council Consent Calendar essentially authorizes payment for what could have been a much better infrastructure project for a lot less money. It is not as though you and I and some other people did not show up and speak up when we had a chance. Keep asking about the Bronco to lower Headland piece of the project. If the funding for the construction drawings shows up on the Council's Consent Calendar without further public review, we will all get screwed, again. Or, has it? I sent "my epiphany of 2018" about this lack of master planning to the City Council and a lot of other people. Just last week, I sent it again with the observation that the Council and the Public are still being excluded from the decision making process. Even the City Clerk cannot produce signed records of what Staff instructs our Consultants to accomplish. That email follows. The PVDE Roadway Safety Project and the lack of a functioning Trails Network Plan continue to be the best examples of how the residents of the City Rancho Palos Verdes are being physically misled and fiscally drained even though Staff is claiming that the NCCP has nothing to do with it. Thank you for being willing the attend the Traffic Safety Committee Meeting. Be very careful about saying anything that Staff might construe as your being in support of any part of this design or encroachment permit. Even indicating an 8 foot wide trail is bogus until Staff discloses how it fits with the continuity of the PVDE Roadway Safety Project and the Peninsula Wheel Trails Network. My epiphany of 2018 appears to have fallen on deaf ears as revealed by the RPV City Council's unanimous votes on several Agenda Items on November 19, 2019. So, I am repeating it. It is not just my expectation of enjoying my private property and my expectation to circulate freely on community/government owned property which has been given away, it is yours, too. "Local Control" is gone. The 2020 elections will reveal whether or not we have any "National Control" left. My gift to you all is the attached "World's Smallest Political Quiz". It all comes down to your personal and economic preferences. You need to know which political direction you want your votes to encourage. Being in favor of "open space", "world peace", "sustainability", "free trade" and "human rights" means nothing until you have that epiphany which defines how much you, personally, are willing to pay to not only give up some of them for yourself but, for most everyone else. The US of A is not a "Democracy". You pledge allegiance to a Republic which as lasted more than the average lifecycle of a "civilization". That reduces our "local control" and facilitates the spending of our money on frivolous, poorly designed and/or otherwise uncoordinated activities. 3 I am big on the One World Order Conspiracy Theory. If this does not explain why Staff is doing things the way they do, one certainly cannot blame it on incompetence. It takes serious skills to obfuscate and omit the facts. This big example is the Palos Verdes Drive East Roadway Safety Project which has now come a long way toward becoming a "debacle". Like with so many in the past, it started with a poorly written Grant Application which the City Council authorized based upon very limited analysis and public review. The grant divided and prioritized this project into nine sub-projects. Two of them have been completed to the dismay of the roadway and roadside users. One is now under construction despite objections by the public. (Most of which were not disclosed to the City Council.) Another, now called variations of a Bronco to Lower Headland Roadway Widening Project, is in its fourth metamorphosis. A recent review by The Traffic Safety Citizen Advisory Committee (TSC) essentially sent the whole "concept" back to "square one". According to the Power-Point Presentation and the minutes of their June 24, 2019 meeting, the project now includes a redo on the completed PVDE/Bronco Intersection Project, the directives in the RPV Trails Network Plan have not yet been considered and the Committee thinks that the City Council should be given the opportunity to consider several different options in the effort to accomplish several overlapping and not clearly defined objectives. Widening the roadway (and the project name change) is a recently proposed solution to the reduce head-on collisions and lack of line-of-sight near- misses objective. According to the Agenda for the TSC's July 22, 2019 meeting, Staff will be presenting another concept, anyway. And, said presentation/Staff Report is not available which precludes any comments in the form of "late correspondence". Council rejected Staff's recommended version 3 ish and approved Staff's recommendation to return the grant money. The east side people are now getting jerked around using our local money. Other than sending out infomercials such as this, I am at a loss as to how we can get our Staff to think of the Palos Verdes Peninsula as an interconnected community which will be populated by more than birds, plants and butterflies for at least a few more decades.
