PC MINS 20191022 Approved 12/10/19 )e CITY OF RANCHO PALOS VERDES PLANNING COMMISSION MINUTES REGULAR MEETING OCTOBER 22, 2019 CALL TO ORDER The meeting was called to order by Chairman Bradley 7:10 p.m.at the Fred Hesse Community Room, 29301 Hawthorne Boulevard. PLEDGE OF ALLEGIANCE Senior Planner Silva led the assembly in the Pledge of Allegiance. ATTENDANCE Present: Commissioners James, Nelson, Perestam, Saadatnejadi, Santarosa, Vice Chairman Leon, and Chairman Bradley. Absent: None Also present were Community Development Director Mihranian, Senior Planner Silva, Senior Planner Alvarez, Associate Planner Nemeth, Assistant Planner Yoon, .and Deputy City Attorney Laymon. APPROVAL OF AGENDA Approved as presented. COMMUNICATIONS City Council Items: The Director reported that at the October 15th meeting, the City Council: 1) Adopted Ordinance 628 codifying the City's new requirements related to accessory dwelling units; 2) Received and filed a report on the Regional Housing Needs Assessment; and 3) Introduced Ordinance No. 630 adopting by reference.the California Building Code. He also announced that the City Council will conduct a Special Meeting on Tuesday, October 29th on the consideration to adopt the Rancho Palos Verdes Natural Communities Conservation Plan / Habitat Conservation Plan. Staff: Director Mihranian informed the Planning Commission that Senior Planner Octavio Silva is here this evening to learn how to run the meeting and Granicus after the Director steps into the role of Acting City Manager; that the governor signed several bills that will go into effect in January related to streamlining housing construction projects and accessory dwelling units; the view restoration case PLVRP2017-00088 regarding the date palm tree and juniper tree on Madeline Cover were voluntarily removed by the foliage owner; late correspondence was handed out for agenda item No. 2; and late correspondence was provided to the Commission from a resident considering appealing the Director's decision of a site plan review with neighborhood compatibility on Basswood. Commission: Commissioner Nelson inquired what would occur if the State Housing and Community Development finds that the City's accessory dwelling unit ordinance is out of compliance with state laws; Chairman Bradley reminded everyone to vote on November 5th and wished best of luck to Commissioner Perestam; and Commissioner Perestam wished Chairman Bradley best of luck in the upcoming election. COMMENTS FROM THE AUDIENCE (regarding non-agenda item): Mr. Andrew Yakubik spoke on the Director's approval of a project on Basswood Drive and his neighbor's consideration to appeal the decision with a request to extend the 15-day appeal period and waive the applicable fee. Director Mihranian noted that the project is not yet under the Planning Commission's jurisdiction, as the basis of the appeal has not yet been filed with the applicable filing fee,, which cannot be waived by the Planning Commission. The Director added that the appeal fee may be fully or partially refunded if the Planning Commission overturns the Director's decision or a modification is made to the Director-approved plans. CONSENT CALENDAR 1. APPROVAL OF THE OCTOBER 8, 2019 P.C. MINUTES COMMISSIONER JAMES, SECONDED BY CHAIRMAN BRADLEY, MOVED TO ADOPT THE OCTOBER 8, 2019 P.C. MINUTES WITH AMENDED LANGUAGE REGARDING AGENDA ITEM NO. 4. THE MOTION PASSED ON A VOTE OF 7-0. CONTINUED PUBLIC HEARINGS NONE CONTINUED BUSINESS: NONE NEW PUBLIC HEARINGS: 2. VIEW RESTORATION PERMIT: (CASE NO. PLVR2018-0016) 28731 Shire Oaks Drive (Applicant) / 6303 Alto Circle (Foliage Owners) (RN) Planning Commission Minutes October 22, 2019 Page 2 Associate Planner Nemeth presented the staff report to propose restoring the views from the viewing areas located at 28731, Shire Oaks Drive. He described the viewing areas and the view impairing foliage, and concluded with the Staffs recommendation to crown reduce 1 Brazilian Pepper Tree, 1 Magnolia Tree, and 2 Juniper Trees located in the rear yard. Discussion ensued between the Planning Commission and Staff regarding the view impairing foliage. Chairman Bradley opened the public hearing. Delia Nelson the applicant addressed the Commission and gave a statement on her family's view over the years and how the foliage in question is impairing the view. She thanked Staff and the Commission on their support. Junru Pan the foliage owner addressed the Commission with the history between the two neighbors. Y.B. and S.D. Ma spoke in favor of the Applicant's request. Chairman Bradley closed the public hearing. Discussion ensued between the Planning Commission and Staff regarding the proposed conditions of approval and the annual maintenance. COMMISSIONER NELSON MOVED, SECONDED BY COMMISSIONER JAMES, TO ADOPT P.C. RESOLUTION NO. 2019-27, CONDITIONALLY APPROVING A VIEW RESTORATION PERMIT REQUIRING THE FOLIAGE OWNERS AT 6303 ALTO CIRCLE TO CROWN REDUCE 1 BRAZILIAN PEPPER TREE, 1 MAGNOLIA TREE, AND 2 JUNIPER TREES LOCATED IN THE REAR YARD. THE MOTION PASSED ON A VOTE OF 7-0. 3. CONDITIONAL USE PERMIT TIME EXTENSION (CASE NO. PLCU2019-0004) 28732 H ig h ridge Road. (JY) Assistant Planner Yoon presented the staff report requesting to renew an expired Conditional Use Permit for the continued operation of an existing T-Mobile wireless telecommunications facility originally approved by the Planning Commission on August 11, 2009. She noted that no additional modifications are proposed to the existing wireless facility and that the original conditions of approval, including maintaining the monopine to resemble an artificial pine tree, will continue to be imposed. Planning Commission Minutes October 22,2019 Page 3 Discussion ensued between the Planning Commission and Staff regarding why the Conditional Use Permit extension is granted for 10 years and how well the monopine has been maintained for the past 10 years. Chairman Bradley opened the public hearing. Alexandar Lew - the applicant, stated the facility would continue to be well maintained and thanked Staff. Chairman Bradley closed the public hearing. COMMISSIONER NELSON MOVED, SECONDED BY COMMISSIONER SANTAROSA, TO ADOPT P.C. RESOLUTION NO. 2019-28, EXTENDING THE CONDITIONAL USE PERMIT UNTIL AUGUST 11, 2029 TO ALLOW THE CONTINUED OPERATION OF AN EXISTING T-MOBILE WIRELESS TELECOMMUNICATIONS FACILITY CONSISTING OF A 45'-TALL MONOPINE AND A 365FT2 EQUIPMENT AREA. THE MOTION PASSED ON A VOTE OF 7-0. NEW PUBLIC HEARINGS: NONE ITEMS TO BE PLACED ON FUTURE AGENDAS 4. PRE-AGENDA FOR THE MEETING ON NOVEMBER 12, 2019 THE COMMISSION UNANIMOUSLY AGREED TO CANCEL THIS MEETING DUE TO A LACK OF AGENDA ITEMS. 5.
