RECOMMENDED COUNCIL ACTION:
(1) Authorize the Mayor and City Clerk to sign Chapter 8 Agreement 2830 to
purchase a vacant lot on Crownview Drive (APN 7566-015-026) and a vacant lot
abutting the Agua Amarga Reserve (APN 7583-022-012)
FISCAL IMPACT: The County has set the purchase price for the Crownview Drive
property at $9,380, and the Agua Amarga property at $15,386 . Additional estimated
costs include approximately $2,000 per property in county processing fees and $5,000
per property for a Phase 1 Environmental Site Assessment, for a total expected cost of
$38,766.

BACKGROUND AND DISCUSSION:
Purchase Agreement and Cost
On September 3, 2019, the City Council authorized Staff to pursue the acquisition of
two tax-defaulted properties in the City: a vacant lot in the 3100 block of Crownview
Drive (APN 7566-015-026) to help the City work toward completing a trail segment in
the Conceptual Trails Plan; and a vacant lot abutting the Agua Amarga Reserve (APN
7583-022-012) to enable the City to preserve open space by expanding the reserve.

Staff submitted an application to acquire the properties to the Los Angeles County
Treasurer and Tax Collector (TTC) on September 5, 2019. On October 4, 2019, Staff
received the attached Chapter 8 Agreement 2830 for the signatures of the Mayor and
City Clerk (Attachment A). TTC has set a purchase price of $9,380 for the Crownview
Drive property and $15,386 for the Agua Amarga property. Additional costs expected to
complete the purchase include:
County processing fees: ±$4,000
Phase 1 Environmental Site Assessments: ±$10,000
There is $25,000 allocated in the Fiscal Year 19-20 budget for property acquisition, so
Staff is requesting an appropriation of $13,766. TTC requires that the signed purchase
agreement be returned no later than November 29, 2019.
CONCLUSION:
In conclusion, Staff recommends proceeding with the acquisition of the vacant lot in the
3100 block of Crownview Drive (APN 7566-015-026) and the vacant lot abutting the
Agua Amarga Reserve (APN 7583-022-012).
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative action is available for
the City Council’s consideration:
1. Do not authorize the Mayor and City Clerk to sign Chapter 8 Agreement
2830.
2. Direct Staff to further research issues related to this acquisition, and bring
this matter back to the City Council for a final decision on or before
November 20, 2019.

LOS ANGELES COUNTY TAX-DEFAULTED PROPERTY
(Public/Taxing Agency)
This Agreement is made this day of , 20_, by and between the Board of
Supervisors of Los Angeles County, State of California, and the City of Rancho Palos Verdes (Purchaser),
pursuant to the provisions of Division 1, Part 6, Chapter 8, of the Revenue and Taxation Code.
The real property situated within said county, hereinafter set forth and described in Exhibit A attached hereto
and made a part hereof, is tax-defaulted and is Subject to the Tax Collector's Power to Sale by said county for
the nonpayment of taxes, pursuant to provision of law.
It is mutually agreed as follows:
1. That as provided by Section 3800 of the Revenue and Taxation Code, the cost of
giving notice of this agreement shall be paid by the PURCHASER.
2. That the PURCHASER agrees to pay the total purchase price listed for each real
property described in Exhibit A within 14 days after the date this agreement becomes
effective. Upon payment of said sum to the tax collector, the Tax Collector shall
execute and deliver a deed conveying title to said property to PURCHASER.
3. That the PURCHASER agrees that the real property be used for the public use
specified on Exhibit A of this agreement.
4. That if said PURCHASER is a taxing agency, as defined in Revenue and Taxation
Code section 121, it will not share in the distribution of the payment required by this
Agreement.

BACKGROUND AND DISCUSSION:
Pursuant to the California Revenue and Taxation Code, the City may request to
purchase properties that are determined to be in default for unpaid property taxes if it is
determined that a parcel is needed for public purposes. Staff has identified two such
available parcels in the Miraleste Canyon area and next to the Agua Amarga Reserve (a
sub-area of the Palos Verdes Nature Preserve).
Crownview Drive Property
Assessor’s Parcel No. 7566-015-026 (see aerial photo below) consists of a .63-acre
vacant lot in the 3100 block of Crownview Drive in the Miraleste Canyon area. The
parcel resembles a trapezoid with a long, thin strip jutting south into a residential
neighborhood. It abuts the City of Rolling Hills to the north and vacant land to the east

and west. The upper portion of the parcel is zoned Open Space Hazard and the
southern tip is zoned RS-2 (residential single lot greater than 20,000 square feet).
Staff believes acquiring this parcel could help the City work toward completing a trail
segment in the Conceptual Trails Plan. At this time, the City does not have trail access
easements over any of the private properties for the two conceptual trails described
below.
Agua Amarga Property
Assessor’s Parcel No. 7583-022-012 (see aerial photo below) consists of a .95-acre,
triangular vacant lot abutting several homes on Baycrest Drive near Fred Hesse Jr.
Community Park to the north, the Agua Amarga Reserve to the west, and vacant land to
the east and south. Most of the parcel is zoned Open Space Hazard, but a sliver on the
north side is zoned RS-4 (residential single lot greater than 10,000 square feet).
Staff believes acquiring this parcel would enable the City to preserve open space by
expanding the Agua Amarga Reserve.

If the City acquires these parcels, it will be responsible for fuel modification.
If the City determines that these properties are needed for public purposes, the City
may file written statements for each setting forth the purpose of the acquisition and the
necessary Chapter 8 Agreement forms to the Los Angeles County Treasurer and Tax
Collector (TTC).
It should be noted that, in authorizing Staff to submit an application (Attachment A) to
acquire these tax-defaulted properties, the City Council is not committing to complete
the purchase of them. If the current owners redeem the properties by paying the back
taxes, they would no longer be available for purchase. The county charges a non-
refundable application fee of $100 to submit each application, but at any time thereafter,
if the City Council decides not to proceed with the purchase of these properties, it may
withdraw from the process.
At this time, Staff does not know what sale price the county may set for these parcels.
The Crownview Drive property has been in default for four years and its current
assessed value is $18,467. The Agua Amarga property has also been in default for four
years and its current assessed value is $32,751. There is $25,000 allocated in the
Fiscal Year 2019-20 budget for property acquisition. Staff would expect to return to the
City Council with a budget adjustment once the county’s purchase prices have been
determined.
If the City Council authorizes Staff to pursue acquiring these properties, there will be
several additional steps to complete the acquisition process. The City Council will be

asked to approve the sale prices set by TTC. The City’s Planning Commission will then
be asked to consider the consistency of this acquisition with the goals and polices of the
City’s General Plan. Finally, Staff will retain the services of the City’s environmental
consultant to conduct a Phase 1 Environmental Site Assessment of the properties. The
typical cost of a Phase 1 study is about $5,000.
CONCLUSION:
In conclusion, Staff recommends that the City Council authorize the Mayor to sign
Request to Purchase Tax-Defaulted Property from the Los Angeles County Treasurer
and Tax Collector for a vacant lot on Crownview Drive (APN 7566-015-026) and a
vacant lot abutting the Agua Amarga Reserve (APN 7583-022-012).
ALTERNATIVES:
In addition to the Staff recommendation, the following alternative action is available for
the City Council’s consideration:
1. Receive and file this report, thereby directing Staff not to pursue the
acquisition of this tax-defaulted property

The subject property (APN 7583-022-012) is a .95-acre, triangular vacant lot abutting
several homes on Baycrest Drive near Fred Hesse Jr. Community Park to the north, the
Agua Amarga Canyon Reserve to the west, and vacant land to the east and south.
Acquiring this parcel would enable the City to preserve open space by expanding the
Agua Amarga Reserve, which is part of the 1,400-acre, City-owned Palos Verdes
Nature Preserve. The 59-acre Agua Amarga Reserve contains Agua Amarga and
Lunada canyons, which merge at their western ends just above the border with Palos
Verdes Estates. Agua Amarga Canyon was acquired by the City of Rancho Palos
Verdes in 2005. Habitat restoration grants have resulted in the creation of three acres of
coastal sage scrub and a willow wetland. It is home to endangered California
gnatcatcher thriving in large pockets of the restored native coastal sage scrub
vegetation. Since planting in 2004, willows have grown to heights of more than 20 feet. DRAFTB-10
