Palos Verdes Peninsula Unified School District, RHE & RPV MOU - FY2019-028 MEMORANDUM OF UNDERSTANDING BETWEEN PALOS VERDES PENINSULA UNIFIED SCHOOL DISTRICT, CITY OF RANCHO PALOS VERDES AND CITY OF ROLLING HILLS ESTATES FOR USE OF POOL FACILITIES THIS MEMORANDUM OF UNDERSTANDING (MOU) is made and entered into this 27th day of June, 2019 ("Effective Date"), by and between the Palos Verdes Peninsula Unified School District (hereinafter "School District"), a California public school district duly organized and existing under Chapter 1 of Division 3 of Title 2 of the Education Code of the State of California, as well as the City of Rolling Hills Estates and the City of Rancho Palos Verdes (hereinafter "Cities"), both municipal corporations (individually a"Party" and collectively"the Parties"). RECITALS WHEREAS, School District owns property located at 27118 Silver Spur Road, Rolling Hills Estates CA 90274-2300, known as Palos Verdes Peninsula High School ("School Site"); WHEREAS, a pool and related facilities ("Pool Facilities") are located at the School Site; WHEREAS, the Cities and their affiliates have had access to the Pool Facilities to offer City- sponsored summer swim programs, and the community at large, beyond School District teams or City related programs, have had some additional access to the Pool Facilities; WHEREAS, the current MOU between the Cities and the School District expired on January 31, 2019. WHEREAS, the Cities and the School District desire to implement a new MOU for the time period from June 1, 2019 through May 30, 2024. NOW, THEREFORE, the Parties hereto agree as follows: Section 1. A satellite map depiction of the Pool Facilities subject to this MOU is attached hereto as Attachment"A". Section 2. School District programs and students, and groups licensed by the School District to use the Pool Facilities shall have priority use of the Pool Facilities at all times. Section 3. Subject to Section 2 above, School District agrees that, to the greatest extent possible, it will make the Pool Facilities available for City-sponsored summer swim programs during the term of this MOU to a similar extent as it has in the past, as described in Attachment"B". Section 4. The cost to be charged to the Cities for the use of the pool facility will be $25.00 (twenty five) dollars per hour which is, to help defray District operational costs. This rate is half of the non-profit pool use rate in effect for any approved non-profit group, which is currently $50.00 (fifty dollars)per hour. 1 Section 5. Subject to Sections 2, 3 and 4 above, School District agrees that, to the greatest extent possible, it will continue to make the Pool Facilities available for community recreational use for teams or organizations of the type identified in Attachment "C". The Cities may allow another non- profit organization to run pool hours during the times agreed upon, subject to prior approval by the School District. Section 6. The Parties acknowledge it is not the intent of the Cities to earn a profit from the uses contemplated in Section 5 of this MOU. However, if any such use as contemplated in Section 5 of this MOU results in an operating profit for the non-profit organization at the rental rate outlined in Section 4 of this MOU, the Cities agree to encourage the non-profit organization to pay such operating profit to the District as reimbursement of the full, non-discounted rental rate, which is currently $50.00 per hour. Section 7. The Parties agree to meet as necessary to discuss the use of the Pool Facilities and how the Pool Facilities can best serve the needs of the School District, the Cities, and the community. Section 8. The official representative for School District shall be its Associate Superintendent of Business Services or his/her designee. The official representative for Cities shall be their City Manager,or his/her designee. The official representative of each Party will be a point of contact for the other Party to facilitate use of the Pool Facilities. Section 9. This MOU shall remain in effect from June 1, 2019 through May 30, 2024 unless mutually extended in writing by both Parties. Section 10. Any Party to this MOU may terminate this MOU without cause by providing written notice to the other parties at least 60 days in advance of the date of termination. E-mail communication is considered a satisfactory form of written notice for this MOU. 2 IN WITNESS WHEREOF the Parties hereto have accepted this MOU as of the date first above written. Associate Superintendent, I usiness Services 8-Zo --ilDATED: CITY OF : %r ING HI ,o' TATES By: / 11 Greg Grammer City Manager DATED: CITY OF RANCHO PALOS VERDES By: G1 Doug Willmore City Manager 3 ATTACHMENT "A" DEPICTION OF POOL FACILITIES iart ../ 1 . . r , i 1 as P I- s 4-"--44 A, 11 / Ir."---Ni p a ro . .;i + rdes ■ 4 ATTACHMENT B DESCRIPTION OF CITY SUMMER SWIM PROGRAMS City sponsored community summer swim programs run by the YMCA/YWCA at the Pool Facilities, including: • Youth instructional swim programs • Youth water safety programs (pre-lifeguarding classes) • Recreational/family swim sessions • Adult lap swim sessions The above programs have typically been offered for approximately ten weeks while school is out of session during summer months within the following time blocks: • Youth instructional and water safety programs on weekdays • Recreational/family and adult lap swim sessions on weekdays and weekends 5 ATTACHMENT C DESCRIPTION OF OTHER COMMUNITY RECREATIONAL USES Typical community aquatic groups and potential contractual aquatic program instructors which may be requesting pool time year-round could include: • Competitive youth swim teams • Water polo teams • Synchronized swim teams • Adult masters swim teams • Junior lifeguard instructional programs • Lifeguarding, Lifeguarding Instructor, and Water Safety Instructor certification programs • Swimming lessons or recreational swimming sessions for persons with disabilities • Water fitness programs • Scuba diving instructional certification programs The above groups and contractual programs, if approved, would typically be given access to the Pool Facilities as a third priority after School District use and City summer YMCA/YWCA program use. 6
