AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES
REPEALING AND REPLACING SECTIONS 2.20.020 (MEMBERS)
2.20.060 (ORGANIZATION), AND REPEALING SECTION 2.20.080
(TERM LIMITS) OF CHAPTER 2.20 (PLANNING COMMISSION) OF
TITLE 2 (ADMINISTRATION AND PERSONNEL) OF THE CITY'S
MUNICIPAL CODE, RELATING TO TERM EXPIRATION OF
PLANNING COMMISSIONERS AND APPOINTMENT OF VICE-
CHAIRPERSON.
WHEREAS, the City Council of the City of Rancho Palos Verdes ("City") has broad
authority under State law to establish and appoint commissions as part of the sub-
government of the City, and to modify the characteristics of such commissions.
WHEREAS, the City Council, pursuant to Ordinance No. 80, created and
established the City's Planning Commission, consisting of five members with two-year
terms of office, in accordance with the provisions of State Planning and Zoning Law, Title
7 of the Government Code, and in particular pursuant to the provisions of Chapter 3
thereof.
WHEREAS, the City Council, pursuant to Ordinance No. 165, amended Sections
2.20.020 and 2.20.060 of the City's Municipal Code to state that members of the Planning
Commission serve at the pleasure of the City Council, extend the term of office for each
commissioner to four years, and set the expiration date of terms of office for the first City
Council meeting in December of odd years, or until a successor is appointed.
WHEREAS, the City Council, pursuant to Ordinance No. 278, amended Sections
2.20.020 and 2.20.040 of the City's Municipal Code to increase the membership of the
Planning Commission from five members to seven members, establish a two-year term
limit for each commissioner, and establish that regular meetings of the Planning
Commission shall be held at 7:00 p.m. on the second and fourth Tuesdays of each month,
unless the regular meeting date falls on a holiday, in which case the meeting shall be held
on the next succeeding day which is not a holiday.
WHEREAS, the City Council, pursuant to Ordinance No. 550, amended Sections
2.20.020 and 2.20.080 of the City's Municipal Code to change the term of office of the
Planning Commissioners back to a four-year term and to state that members of the
Planning Commission shall serve no more than two consecutive terms of office.
WHEREAS, the City Council wishes to standardize the term of office dates for all
commission appointments to expire on June 30 of even-numbered years.
WHEREAS, the current seven members of the Planning Commission shall
continue to hold office after the adoption of this Ordinance until the expiration date of
the term for which they were originally appointed and upon the expiration date of said
term of office, the duly appointed successor's term of office shall be adjusted to coincide
with the June 30 appointment date of an even-numbered year.

WHEREAS, the City Council further wishes to establish the appointment date for
the vice-chairperson of the Planning Commission as the first meeting where the incoming
chairperson is presiding instead of the commission's first regular meeting in December.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES ORDAINS AS FOLLOWS:
SECTION 1. The forgoing recitals are true and correct and are incorporated
herein by this reference.
SECTION 2. Sections 2.20.020 (Members) and 2.20.080 (Term limits) of Chapter
2.20 (Planning Commission) of Title 2 (Administration and Personnel) of the Rancho
Palos Verdes Municipal Code are repealed and replaced with the following:
2.20.020 Term limits.
A. The term of office for each member of the planning commission is four
years.
B. The terms of office for members of the planning commission shall expire on
June 30 of even-numbered years, or until a successor is appointed.
C. No person shall serve more than two consecutive terms of office as a
member of the planning commission. Any member of the planning
commission who has served for at least two years shall be deemed to have
served a term of office. For the purpose of this section, "consecutive" shall
mean immediately following, without an intervening hiatus in service.
D. Any person who has served two consecutive terms as a member of the
planning commission shall not be eligible to serve again until the expiration
of at least six months after the end of that person's last term of office.
E. The term limits imposed by this section shall apply prospectively only to
those terms of office that commence after the adoption of this ordinance by
the city council.
SECTION 3. Section 2.20.060 (Organization) of Chapter 2.20 (Planning
Commission) of Title 2 (Administration and Personnel) of the Rancho Palos Verdes
Municipal Code is amended to read as follows (deleted text in stfikethrough and new text
in bold underline):
2.20.060 Organization. The city council shall appoint the chairperson.
The planning commission shall elect a vice-chairperson, from among its members, at
the first organization meeting and thereafter at its first
meeting where the incoming chairperson is presiding. The commission may also
appoint such other officers as may be necessary for the administration of its business,
at the same time and for like terms. Said officers shall enter in the duties of their office

commission shall adopt rules and regulations for the transaction of its business and
shall keep a record of all its minutes, resolutions, actions, findings and determinations.
Minutes, resolutions, and official records shall be filed with the city clerk.
SECTION 4. If any section, subsection, subdivision, sentence, clause, phrase, or
portion of this Ordinance or the application thereof to any person or place, is for any
reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remainder of this Ordinance.
The City Council hereby declares that it would have adopted this Ordinance, and each
and every section, subsection, subdivision, sentence, clause, phrase, or portion thereof,
irrespective of the fact that any one or more sections, subsections, subdivisions,
sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.
SECTION 5. The time within which judicial review of the decision reflected in this
Ordinance must be sought is governed by Section 1094.6 of the California Code of Civil
Procedure and other applicable short periods of limitation.
