Resolution amending the City Council Rules of Procedures relating to advisory board and commission appointments (page E-1) 1 EXECUTIVE SUMMARY: At the February 19, 2019, City Council meeting, Councilwoman Brooks requested that Staff examine and standardize the expiration dates of terms for all advisory boards, including the Planning Commission, in an effort to reduce the number of special meetings held throughout the year to interview applicants for vacancies and to streamline the recruitment and selection process. Staff reviewed the anniversary dates for all members and determined that adjusting all term dates to expire on one single date (June 30) and creating a uniform process involving recruitment once a year or biennially (in even numbered-years) for all advisory boards, including the Planning Commission, would streamline the process and meet the request. BACKGROUND AND DISCUSSION: The majority of members have terms expiring on different dates. Per City Council Policy No. 6, when a term of service expires and creates a scheduled vacancy, recruitment for the position is conducted and “each applicant shall be interviewed by the City Council.” Typically, interviews are conducted at a special meeting followed by appointments at a regular meeting. Having multiple scheduled vacancies throughout the year requires a recruitment each time and for the Council to hold several special meetings to interview applicants. In 2018, five special meetings were held for interviews and in 2017, six were held. Also, per the policy, term dates expire on odd-numbered years to coincide with the City’s election. However, beginning in year 2020, elections for the City will be changed from November in odd-numbered years to November in even-numbered years to coincide with statewide election dates. Staff took the opportunity to standardize, consolidate, and reexamine City Council Policy No. 6 and recommends the following: 1. Standardize the anniversary date for all future appointments to terms commencing July 1 and ending June 30 of even-numbered years. Justification: Adjusting all terms to begin and expire on the same month and day would allow holding recruitment and interviews once a year or biennially, eliminating the need to hold multiple meetings for interviews throughout the year. Changing the expiring year to even-numbered years would coincide with City Council Policy No. 6. (Attachment B) Initially, the duly appointed successor’s term may be adjusted to coincide with an anniversary date ending on June 30 of an even-numbered year. 2. All current commissioners and board members shall continue to hold office until the expiration date of the term for which they were originally appointed. 2 Justification: Term adjustments would apply only to future appointments and not affect the current seated commissioner and board member terms. The adjustments would instead reduce the terms for incumbents, if necessary. Council approved a similar approach when deciding whether to shorten or extend City Council member terms to comply with SB 415 (moving elections to even-numbered years). Staff looked at many options to extend and/or shorten anniversary dates and determined that the above recommendation would be best for the transition. Shortening or extending current anniversary dates would result in either a decrease or increase to most terms by up to nine months. 3. A chairperson for each advisory board shall be appointed by the City Council by July 1 of each year to streamline the process. Justification: This is in conjunction with streamlining the process. Currently there is no set date when this happens. 4. The appointment of a vice-chairperson shall take place at the first meeting where the incoming chairperson is presiding. Justification: This appointment is generally done at a regular meeting in December. This new change would be in conjunction with recommendation #3 (above) and to streamline the process. 5. Approve City Council Policy No. 6 as presented to incorporate all changes. As a result of Staff reviewing all Code sections relating to boards, commissions and committees, the following additional proposed changes are included in the attached ordinance: 1. Amend RPVMC Section 2.20.020 (Members) and Section 2.20.060 (Organization) to incorporate changes affecting the Planning Commission. 2. A chairperson for the Planning Commission shall be appointed by the City Council by July 1 of each year to coincide with the new recruitment and selection timeline. 3. The appointment of the Planning Commission vice-chairperson shall take place at the first meeting where the incoming chairperson is presiding instead of the commission’s regular meeting in December, also to coincide with the new recruitment timeline. Lastly, a new recruitment and selection timeline is being proposed to create a uniform process. When creating the timeline, Staff considered the current policy, timing of when incoming council members are seated after the election, scheduling of budget review and adoption, and dates during election season. Conducting recruitment, interviews and 3 appointments early in the year would provide Staff ample time and would not interfere with election proceedings, which typically begin in mid-July and commence in mid- November, followed by the council swearing-in ceremony and re-organization in December. New to the timeline is an orientation where the City Attorney would brief the incoming members on legislative matters. The orientation would also give members an opportunity to meet their committee liaison, take their required Oath of Office, address any administrative matters necessary (Form 700, email policy, etc.) and ask any questions they may have regarding their appointment. a. All advisory board members serve at the pleasure of the City Council for designated terms. 2. To be considered for appointment, an applicant must be a resident of the City of Rancho Palos Verdes. 3. Appointments will be made to advisory boards in even-numbered years and as defined in this policy. Initially, appointments will be made annually until terms become concurrent in an even-numbered year rotation. 4. Members shall be appointed by the City Council for a term of four years with terms commencing on July 1 and ending on June 30. Terms will be staggered to maintain continuity. 5. A chairperson for each advisory board shall be appointed by the City Council by July 1 of each year and shall serve for one year or until successors are elected. Each advisory board shall elect a vice-chairperson, from among its members, at the first meeting that the incoming chairperson is presiding and shall serve for one year or until a successor is elected. 6. Whenever a vacancy occurs due to resignation, death, disability, or failure of a member to attend meetings, the City Council shall make an appointment to fill the vacancy for the remainder of the term. 7. The procedure of filling scheduled and unscheduled vacancies and provision of notice thereof shall be subject to the provisions of the Maddy Act (Govt. Code §§ 5497054974) which require a 10-day notice of the availability of the position for appointment. Applications shall be accepted from January until mid-March, or on a schedule to be established by the City Council. 2. A notice of recruitment for scheduled advisory board vacancies shall be advertised in the Palos Verdes Peninsula News and City website. Additionally, the vacancies shall be posted at the City’s designated posting locations. Advertising may take the form of a press release and a summary of duties shall be included in the recruitment notice, press release and any other recruitment material. 3. As part of the recruitment process, the City Clerk shall notify incumbents with expiring terms about the term expirations and vacancies, the deadline for receipt of applications, and the dates for the interviews and appointments. 4. Persons interested in serving on an advisory board, including incumbents who wish to be considered for reappointment, must file an application with the City Clerk's Office. 5. Applications may be completed for vacancies that currently exist or for consideration when future scheduled or unscheduled vacancies occur. An application remains on file in the City Clerk’s Office for a period of two years from the date of receipt or until the next scheduled recruitment unless the applicant requests that it be withdrawn. 6. In the event an unscheduled vacancy occurs, the City Council may fill the vacancy from the applications received by the posting deadline and any existing applications on file with the City Clerk. 7. The City Clerk will provide new board members with a copy of City Council Resolution No. 2018-04, City Council Rules of Procedure and Fair Political Practices Commission (FPPC) - Statement of Economic Interests (Form 700) and AB 1234 Ethics Training information if applicable to their appointment. 4. The City Attorney will brief new board members of their responsibilities under the Brown Act and conflict of interest laws and other legal obligations mandated by their appointment. BACKGROUND: On December 4, 2001, January 12, 2002, January 31, 2002, and September 16, 2003, the City Council considered the process for recruitment and selection of City commission and committee members. After discussing various alternatives, the Council agreed on September 16, 2003, to the procedure contained in this policy in order to encourage residents to apply for and serve on City boards, to create a procedure that allows the City Council to become familia r with the applicants’ qualifications, and to maintain continuity on the various boards by staggering the terms of service. In February 2019, the Council requested to standardize term dates by having the expiration month and day be the same for all board member. By doing so, the recruitment and selection process can be conducted once a year (initially) and eventually every two years. Standardizing term dates would eliminate the need to interview and appoint members multiple times of the year. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES REPEALING AND REPLACING SECTIONS 2.20.020 (MEMBERS) 2.20.060 (ORGANIZATION), AND REPEALING SECTION 2.20.080 (TERM LIMITS) OF CHAPTER 2.20 (PLANNING COMMISSION) OF TITLE 2 (ADMINISTRATION AND PERSONNEL) OF THE CITY’S MUNICIPAL CODE, RELATING TO TERM EXPIRATION OF PLANNING COMMISSIONERS AND APPOINTMENT OF VICE-CHAIRPERSON. WHEREAS, the City Council of the City of Rancho Palos Verdes (“City”) has broad authority under State law to establish and appoint commissions as part of the sub - government of the City, and to modify the characteristics of such commissions. WHEREAS, the City Council, pursuant to Ordinance No. 80, created and established the City's Planning Commission, consisting of five members with two-year terms of office, in accordance with the provisions of State Planning and Zoning Law, Title 7 of the Government Code, and in particular pursuant to the provisions of Chapter 3 thereof. WHEREAS, the City Council, pursuant to Ordinance No. 165, amended Sections 2.20.020 and 2.20.060 of the City’s Municipal Code to state that members of the Planning Commission serve at the pleasure of the City Council, extend the term of office for each commissioner to four years, and set the expiration date of terms of office for the first City Council meeting in December of odd years, or until a successor is appointed. WHEREAS, the City Council, pursuant to Ordinance No. 278, amended Sections 2.20.020 and 2.20.040 of the City’s Municipal Code to increase the membership of the Planning Commission from five members to seven members, establish a two-year term limit for each commissioner, and establish that regular meetings of the Planning Commission shall be held at 7:00 p.m. on the second and fourth Tuesdays of each month, unless the regular meeting date falls on a holiday, in which case the meeting shall be held on the next succeeding day which is not a holiday. WHEREAS, the City Council, pursuant to Ordinance No. 550, amended Sections 2.20.020 and 2.20.080 of the City’s Municipal Code to change the term of office of the Planning Commissioners back to a four-year term and to state that members of the Planning Commission shall serve no more than two consecutive terms of office. WHEREAS, the City Council wishes to standardize the term of office dates for all commission appointments to expire on June 30 of even-numbered years. D-1 WHEREAS, the current seven members of the Planning Commission shall continue to hold office after the adoption of this Ordinance until the expiration date of the term for which they were originally appointed and upon the expiration date of said term of office, the duly appointed successor’s term of office shall be adjusted to coincide with the June 30 appointment date of an even-numbered year. WHEREAS, the City Council further wishes to establish the appointment date for the vice-chairperson of the Planning Commission as the first meeting where the incoming chairperson is presiding instead of the commission’s first regular meeting in December. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ORDAINS AS FOLLOWS: SECTION 1: The forgoing recitals are true and correct and are incorporated herein by this reference. SECTION 2: Sections 2.20.020 (Members) and 2.20.080 (Term limits) of Chapter 2.20 (Planning Commission) of Title 2 (Administration and Personnel) of the Rancho Palos Verdes Municipal Code are repealed and replaced with the following: 2.20.020 Term limits. A. The term of office for each member of the planning commission is four years. B. The terms of office for members of the planning commission shall expire on June 30 of even-numbered years, or until a successor is appointed. C. No person shall serve more than two consecutive terms of office as a member of the planning commission. Any member of the planning commission who has served for at least two years shall be deemed to have served a term of office. For the purpose of this section, “consecutive” shall mean immediately following, without an intervening hiatus in service. D. Any person who has served two consecutive terms as a member of the planning commission shall not be eligible to serve again until the expiration of at least six months after the end of that person’s last term of office. E. The term limits imposed by this section shall apply prospectively only to those terms of office that commence after the adoption of this ordinance by the city council. SECTION 3: Section 2.20.060 (Organization) of Chapter 2.20 (Planning Commission) of Title 2 (Administration and Personnel) of the Rancho Palos Verdes Municipal Code is amended to read as follows (deleted text in strikethrough and new text in bold underline): D-2 2.20.060 Organization. The city council shall appoint the chairperson. The planning commission shall elect a vice-chairperson, from among its members, at the first organization meeting and thereafter at its regular meeting in December first meeting where the incoming chairperson is presiding. The commission may also appoint such other officers as may be necessary for the administration of its business, at the same time and for like terms. Said officers shall enter in the duties of their office at the second regular meeting in December immediately after appointment. The commission shall adopt rules and regulations for the transaction of its business and shall keep a record of all its minutes, resolutions, actions, findings and determinations. Minutes, resolutions, and official records shall be filed with the city clerk. SECTION 4: If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remainder of this Ordinance. The City Council hereby declares that it would have adopted this Ordinance, and each and every section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. SECTION 5: The time within which judicial review of the decision reflected in this Ordinance must be sought in governed by Section 1094.6 of the California Code of Civil Procedure and other applicable short periods of limitation.
