PC MINS 20190813 Approved 8/27/19' (L CITY OF RANCHO PALOS VERDES PLANNING COMMISSION MINUTES REGULAR MEETING AUGUST 13, 2019 CALL TO ORDER: The meeting was called to order at 7:03 P.M. at the Fred Hesse Community Room, 29301 Hawthorne Boulevard. PLEDGE OF ALLEGIANCE: Deputy Director/Planning Manager Kim led the assembly in the Pledge of Allegiance. ATTENDANCE: Present: Commissioners James, Nelson, Perestam, Saadatnejadi, Santarosa, Vice Chairman Leon, and Chairman Bradley. Absent: None Also present were Community Development Director Mihranian, Deputy Director/Planning Manager Kim, Senior Planner Seeraty, and Special Counsel Aleshire. APPROVAL OF AGENDA: COMMISSIONER NELSON MOVED, SECONDED BY COMMISSIONER JAMES TO APPROVE AGENDA AS PRESENTED. THE MOTION PASSED 6-0. COMMUNICATIONS: City Council Items: Director Mihranian reported that the City Council, at its August 6th meeting, considered the Planning Commission's recommendation regarding the Employee Housing Code Amendment and decided not to amend the Code as recommended by the Planning Commission and directed Staff to proceed with an interpretation that the Code currently allows employee housing. Staff: Director Mihranian reported that there were no appeals filed on the Commission- approved revisions to Wireless Telecommunication Facility Permits ASG Nos. 43 and 55; Planning Commission Minutes August 13,2019 Page 1 Approved 8/27/19 that two Minor Modification Notice of Decisions were issued yesterday for Wireless Telecommunication Facility Permits ASG Nos. 10 and 36 to allow the vaults to be relocated; the City Clerk's Office will be hosting a Brown Act training presented by the City Attorney on Thursday,August 29, 2019, at 6:30 pm at Hesse Community Park; the Director will be speaking at the upcoming August 21St Council of Homeowner's Association meeting; the passing of long-time resident Diane Smith and requested that the meeting adjourn in her memory; and that Deputy Director/ Planning Manager So Kim, after nearly 15 years of service with the City, will be leaving for a position with the City of Laguna Beach. MINUTES COMMISSIONER LEON MOVED, SECONDED BY COMMISSIONER SAADATNEJADI, TO APPROVE THE JULY 23, 2019 P.C. MINUTES WITH CHAIRMAN BRADLEY ABSTAINING SINCE HE WAS NOT AT THE MEETING. THE MOTION PASSED 6-0-1. CONTINUED PUBLIC HEARINGS 2. SECOND DWELLING UNITS - CODE AMENDMENT TO CHAPTERS 17.02 (SINGLE-FAMILY RESIDENTIAL (RS) DISTRICTS), 17.04 (MULTIPLE-FAMILY RESIDENTIAL (RM) DISTRICTS), 17.10 (SECOND UNIT DEVELOPMENT STANDARDS), AND 17.96 (DEFINITIONS) OF TITLE 17 (ZONING) OF THE RANCHO PALOS VERDES MUNICIPAL CODE (CASE NO. PLCA2019-0006): Citywide (AS) Senior Planner Seeraty presented the Staff Report updating the Commission on changes discussed at the July 9, 2019 P.C. meeting to Chapters 17.02 (Single-Family Residential ((RS)) Districts), 17.04 (Multiple-Family Residential ((RM)) Districts), 17.96 (Definitions), and Chapter 17.10 (Second Units) of Title 17 (Zoning) of the Rancho Palos Verdes Municipal Code on the revisions made to the development standards for second dwelling units. Discussion ensued between the Planning Commission and Staff regarding the number of accessory dwelling units (ADUs and JADUs) currently in the City, the proposed language regarding required setbacks for ADUs located over existing garages, and the exemption for fire sprinklers in ADUs located within the space of a primary dwelling unit or detached accessory structure, when the primary residence does not require them. Lynda Lima —a resident in the Portuguese Bend area spoke on the fire requirements and fire safety regulations and requirements for a garage conversion to an ADU. Rogelio Martinez—an ADU consultant introduced himself to the Commission as a resource for the city regarding ADU conversions. Chairman Bradley closed the public hearing. Discussion ensued between the Planning Commission and Staff regarding one of the speaker's ability to pursue a variance permit and to clarify references in the amended Code between "sections" and "subsections." VICE CHAIR LEON MOVED, SECONDED BY COMMISSIONER JAMES, TO ADOPT P.C. RESOLUTION NO. 2019-22, RECOMMENDING TO THE CITY COUNCIL THAT AN ORDINANCE BE ADOPTED AMENDING CHAPTERS 17.02 (SINGLE-FAMILY RESIDENTIAL (RS) DISTRICTS), 17.04 (MULTIPLE-FAMILY RESIDENTIAL (RM) DISTRICTS), AND 17.96 (DEFINITIONS), AND REPEALING AND REPLACING CHAPTER 17.10 (SECOND UNITS) OF TITLE 17 (ZONING) OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO UPDATE THE DEVELOPMENT STANDARDS FOR SECOND DWELLING UNITS. THE MOTION PASSED ON A VOTE OF 7-0. Chairman Bradley requested to hear Agenda Item No. 4 prior to Agenda Item No. 3. NEW PUBLIC HEARINGS 4. HERITAGE CASTLE MUSEUM - CONDITIONAL USE PERMIT TIME EXTENSION (CASE NO. ZON2014-00332): 5500 PVDS / Ginsburg (SK) Deputy Director/Planning Manager Kim provided the Planning Commission with a brief background and status update on the project since it was last heard in December 2018, noting that the Applicants are requesting this matter be continued to September 10, 2019 since they are out of town and unable to attend tonight's meeting. Discussion ensued between the Planning Commission and Staff regarding the Conditions of Approval pertaining to the Conditional Use Permit, the number of extensions and re- issuances granted by the City, the status of lot line adjustment required to address encroachments on to City property, the past and current unpermitted grading, and the operations of the museum. Planning Commission Minutes August 13,2019 Page 3 Approved 8/27/19 COMMISSIONER NELSON MOVED, SECONDED BY VICE CHAIR LEON, TO ADOPT ALTERNATIVE NO. 2 THEREBY DENYING, VIA MINUTE ORDER, THE REISSUANCE OF THE COMMISSION-APPROVED ENTITLEMENTS FOR PLANNING CASE NO. ZON2014-00332 ADOPTED UNDER P.C. RESOLUTION NO. 2014-32. THE MOTION PASSED ON A VOTE OF 7-0. CONTINUED BUSINESS 3. FIFTH GENERATION (5G) SMALL WIRELESS FACILITIES MASTER DEPLOYMENT PLAN: Citywide (AM/CML) Director Mihranian provided the Planning Commission with a brief report on the genesis of this agenda item by Chairman Bradley to create a Master Deployment Plan for 5G technology in an effort to regulate and control the proliferation of the installation of wireless facilities throughout the City, as well as the overall Peninsula. Chairman Bradley added that he is concerned with the number of carriers and number of wireless facilities that is needed to deploy 5G technology using Crenshaw Blvd. as an example of what the Peninsula, as a whole, should be avoiding. Discussion ensued between the Planning Commission and Staff regarding the City forming a committee to develop a peninsula-wide 5G Small Wireless Facility Master Deployment Plan, the likelihood of getting the other three Peninsula cities to participate, and how the Planning Commission's recommendation should be delivered to the City Council for its consideration when this matter was not initiated by the City Council. Director Mihranian suggested the Chairman Bradley discuss this matter with City Council Liaison Dyda. COMMISSIONER JAMES MOVED, SECONDED BY COMMISSIONER NELSON, TO CONTINUE THE DISCUSSION TO THE AUGUST 27, 2019 MEETING SO THAT CHAIRMAN BRADLEY CAN CONVEY TO CITY COUNCIL LIAISON DYDA THE COMMISSION'S UNANIMOUS SUPPORT THAT THIS MATTER BE PLACED ON THE CITY COUNCIL'S FUTURE AGENDA.
