Map of property transferred and accepted by the City (page B-1) BACKGROUND AND DISCUSSION: In recent months, the City received a request from the owner of the Trump National Golf Course property (the “Property”) to confirm and clarify the title for the Property by executing two grant deeds for portions of the Property that the City acquired in 2018 and accepting certain portions of the Property to reflect lot line adjustments (LLAs) completed in 2006. On August 22, 2006, the City approved the recordation of two Certificates of Compliance for two LLAs requested by the owner of the Property. When the LLAs were approved by the 1 01203.0018/570808.1 2 City, the Property subject to the LLAs was owned by VH Property Corp. (“VH”) and VHPS, LLC (“VHPS”, together with VH, collectively, “Owners”). The Los Angeles County Office of the Assessor (“Assessor”) generally requires deeds of transfer executed and recorded in order to properly reflect the transfer of ownership of property as a result of LLAs when two or more parties are involved since Certificates of Compliance do not typically convey title. On August 21, 2018, the City Council adopted Resolution No. 2018 -57, accepting an offer to dedicate certain open space lots on the Owners’ Property to the City (the “Dedication”). Therefore, since the City is now an owner of portions of the Property as a result of the Dedication, in order to enable the Assessor’s office to properly reflect fee title ownership of the Property, the City must execute and have recorded (i) a certificate of acceptance for portions of the Property subject to the LLAs, and (ii) two grant deeds for portions of the Property subject to the LLAs: (1) one to VH Property Corp., and (2) one to to Peyam Vafadari and Mojan Omifard (husband and wife), who now own a residential lot located on the Property. The actions presented here for the City’s approval are merely to correct the failure of the Owners to record deeds of transfer for the property subject to the LLAs in 2006. Since the City is now an owner of portions of the Trump Property, it must execute deeds of transfer for the property subject to the LLAs and accept certain property that was subject to the LLAs. WHEREAS, on August 22, 2006 the City approved the recordation of two Certificates of Compliance for lot line adjustments (the “LLAs”) requested by the owner of the Trump National Golf Course property (“Property”); WHEREAS, at the time, the Property subject to the LLAs was owned by VH Property Corp. (“VH”) and VHPS, LLC (“VHPS”, together with VH, collectively, “Owners”); WHEREAS, the Los Angeles County Assessor’s office (“Assessor”) generally requires deeds of transfer executed and recorded in order to properly reflect the ownership of the property as a result of lot line adjustments when two or more parties are involved since Certificates of Compliance do not typically convey title; WHEREAS, certain portions of the property subject to the LLAs were transferred to the City in 2018 pursuant to the City’s a cceptance of the Owners’ Irrevocable Offer to Dedicate Fee Title, dated September 26, 2018 and recorded as Instrument No. 2018- 1122132 (the “Dedication”); and WHEREAS, since the City is now an owner of portions of the Property as a result of the Dedication, in order to enable the Assessor’s office to properly reflect fee title ownership of the Property, the City must execute and have recorded (i) a certificate of acceptance for portions of the Property subject to the LLAs, and (ii) two grant deeds for portions of the Property subject to the LLAs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: The above recitals are true and correct and are hereby incorporated into this Resolution as set forth herein. Section 2: The City Council hereby approves the acceptance of the Grant Deeds attached hereto as Exhibit A-1 pursuant to the Certificate of Acceptance attached hereto as Exhibit A-2, and approves the execution and recordation of the Grant Deeds attached hereto as Exhibit B.
