The two cases, Wickramarachchi and Eric Mark Trust are not part of the Code Enforcement Short-Term Rental
Case Summary (the list) on Item G because the two cases have been turned over to the City Attorney to handle
legal proceedings as part of the administrative citation process to assure compliance. These case are now
considered legal cases and no longer are code enforcement investigations hence why they are not on the list.
The summary report on Item G only lists code enforcement investigations that are pending or have been
resolved (without legal action).
Since the two cases are now litigation the only status report available at the moment is the information that I
shared with you in my previous email -the cases have been discussed with the Council and City Attorney and
no action has been reported. Any other information is privileged.
I hope this clarifies things. If not, feel free to give me a call to discuss further.

Emily,
Please know, I have previously viewed the video links you provided. I understand some council actions are
not "reportable".
As far as I can tell, these two "Cases" are not shown/listed/included on Feb. 5th agenda which raised my
question of case status. Can you or Kevin simply share with me the current status of these cases or explain
to me the status is not reportable?

Thank you.

Hi So ,
How are you? I am sure you are busy with the Staff Report regarding
Green Hills ' Annual review of their Conditional Use Permit on February
5, but I felt I needed to make you aware of what I feel is an unfortunate
and inappropriate situation.
I have included a picture I just took of the rooftop of the Pacific Terrace
Mausoleum from the window of my home-I have enlarged it so you can
see what I am seeing. This picture shows a grave that was dug a couple
hours ago in preparation for a funeral tomorrow . It is hard for me to
believe that the site was left this way!?
This is a top of a cement crypt , pulled up from the grave , that is sitting
on top of a large container of dirt. Needless to say, this is very
disturbing to look at, not only for us, but I am especially concerned
for families that come to visit their loved one's graves' and come
upon this site. At the very least, it should be covered, so the visitors'
or we don't have to look at this.
If this stays as is, this is our view from our windows and balconies
until the fences and set up is done tomorrow late morning for the
funeral.
This is unacceptable.
Thank You for your time and consideration in advance.

Hello,
Thank you for your email.
Simply for clarification purposes for both you and Debbie, I would like to note that Green Hills is allowed to conduct pre-
service interment preparation, burials and associated services, sales, and use mini-haul vehicles during the hours of
10AM and 3PM (Condition 11.h). Based on the time I received emails from you and Debbie, it appears that the work was
conducted within the permitted hours. As for noise, the condition that applies to noise (Condition No. 14) pertains to
visitations, live/amplified music, funeral services, etc. and is not intended for temporary noise associated with permitted
work. Having said that, I will still forward your concerns to the Green Hills Staff.

Hi So Kim,
Attached us another photo with a perspective from my Vista Verde Condo patio (Unit #205). Note, how close
this is to our pool. Further, the noise was horrific with all the heavy duty equipment.

Hi So,
Just to clarify, I am well aware of the rules concerning "pre-service interment preparation, burials and
associated services, sales and use mini-haul vehicles during the hours of lOAM and 3PM". I have never made a
complaint regarding that process. I do understand there is noise, etc. involved in this process. I deal with it.
As I stated in my initial email, I took exception to the unsightly "props" if you will, left after the grave was dug.
I have never seen an area left like this after grave preparation. It was very distressing for me to look at and, as I
said, I would assume it would be for those visiting at their gravesites.
Thank You,
Debbie
