PC MINS 20190122 Appro /26/1 9 CITY OF RANCHO PALOS VERDES PLANNING COMMISSION MINUTES REGULAR MEETING JANUARY 22, 2019 CALL TO ORDER: The meeting was called to order at 7:06 P.M. at the Fred Hesse Community Room, 29301 Hawthorne Boulevard. PLEDGE OF ALLEGIANCE: Commissioner Perestam led the assembly in the Pledge of Allegiance. ATTENDANCE: Present: Commissioners Nelson, Perestam, Saadatnejadi, Vice Chairman Bradley and Chairman James. Absent: Commissioner Leon Also present were Community Development Director Mihranian, Senior Planner Seeraty, Assistant Planner Arellano, and Assistant City Attorney Gerli. APPROVAL OF AGENDA: The agenda was unanimously approved. COMMUNICATIONS: City Council Items: Director Mihranian reported that at the December 18, 2018 City Council meeting, LA-RIGS pulled their item off the agenda to explore alternative locations other than the Civic Center; the City Council at its January 15, 2019 meeting adopted an Urgency Ordinance requiring the Neighborhood Compatibility finding for second units exceeding 12' in height; and the City Council at its February 5, 2019 meeting will consider the annual compliance review for Green Hills. Staff: Director Mihranian reported that the City Council will conduct interviews for the vacant Planning Commission seat on January 29th and reminded the Commission that the last day to register for the League of California Cities Planning Commission Academy to be held March 6-8 is February 12th. CONDITIONAL USE PERMIT REVISION (CASE NO. PLCU2018-0007): 5739 Crestridge Rd. /T-Mobile (MA) Assistant Planner Arellano presented the Staff Report with an overview of the project site and request for approval of a Conditional Use Permit Revision for the installation of an emergency backup diesel generator for an existing T-Mobile wireless communication facility. Discussion ensued between the Commission and Staff regarding the Applicant's noise study. Planning Commission Minutes January 22,2019 Page 2 Chairman James opened the public hearing. Doug Walkup representing T-Mobile answered questions regarding the backup diesel generators operation and noise levels. Chairman James closed the public hearing. COMMISSIONER NELSON MOVED, SECONDED BY VICE CHAIRMAN BRADLEY, TO ADOPT P.C. RESOLUTION NO. 2019-01, APPROVING WITH CONDITIONS A CONDITIONAL USE PERMIT REVISION TO ALLOW THE INSTALLATION OF A 250 GALLON EMERGENCY BACKUP DIESEL GENERATOR FOR AN EXISTING T-MOBILE WIRELESS COMMUNICATION FACILITY, ON A VOTE OF 5-0. 3. SECOND UNITS AND NEIGHBORHOOD COMPATIBILITY CODE AMENDMENT (CASE NO. PLCA2018-0008): City-Wide (AS) Senior Planner Seeraty presented the staff report on the City-Council initiated proposed ordinance amending certain sections of 17.02 (Single-Family Residential (RS) Districts) and 17.10 (Second Unit Development Standards) of the Rancho Palos Verdes Municipal Code to require the Neighborhood Compatibility finding for second units over 12' in height and to clarify the trigger that requires the Neighborhood Compatibility finding for structures over 16' in height. She added that the City Council at its January 15th meeting adopted an urgency ordinance with similar language that put the proposed requirements in place immediately while the regular code amendment occurs. Discussion ensued between the Commission and Staff regarding the definition of a second unit in the current code, how the height of second units are measured, the provisions of the View Ordinance, when Neighborhood Compatibility is triggered for certain residential projects, and the State requirements. Director Mihranian stated that this ordinance would only apply to projects submitted after this ordinance is adopted. Chairman James opened the public hearing. Director Mihranian addressed the Commission's questions regarding the ordinance and provided clarification of the height triggers for the Neighborhood Compatibility finding. RESOLUTION NO. 2019-02, RECOMMENDING TO THE CITY COUNCIL THAT AN ORDINANCE BE ADOPTED AMENDING CHAPTERS 17.02 (SINGLE-FAMILY RESIDENTIAL (RS) DISTRICTS) AND 17.10 (SECOND UNIT DEVELOPMENT STANDARDS) OF TITLE 17 (ZONING) OF THE RANCHO PALOS VERDES MUNICIPAL CODE TO REQUIRE NEIGHBORHOOD COMPATIBILITY REVIEW FOR RESIDENTIAL SECOND UNITS OVER 12' IN HEIGHT AND TO CLARIFY THE TRIGGERS REQUIRING THE NEIGHBORHOOD COMPATIBILITY FINDING, ON A VOTE OF 5-0. NEW BUSINESS: 4. GENERAL PLAN CONSISTENCY FINDING: APN 7572-008-014 & 7572-008-016 / City (MA) Assistant Planner Arellano presented the staff report for a General Plan consistency review for the acquisition of two tax-defaulted properties in the Portuguese Bend landslide area from the Los Angeles County Tax Collector. Discussion ensued between the Commission and Staff regarding the movement of property improvements on City-owned land, the benefits in acquiring the property, the process, and the relevant General Plan goals and policies. VICE CHAIRMAN BRADLEY MOVED, SECONDED BY COMMISSIONER SAADATNEJADI, TO ADOPT P.C. RESOLUTION NO. 2019-03, FINDING THAT THE ACQUISITION OF TWO TAX-DEFAULTED PROPERTIES IN THE PORTUGUESE BEND LANDSLIDE AREA (APNS: 7572-008-014 AND 7572-008-016) IS CONSISTENT WITH THE GOALS AND POLICIES OF THE CITY'S GENERAL PLAN, ON A VOTE OF 5-0. ITEMS TO BE PLACED ON FUTURE AGENDAS: 5. PRE-AGENDA FOR THE MEETING ON FEBRUARY 12, 2019 Moved to cancel the meeting due to lack of agenda items, on a vote of 5-0. 6.
