AGENDA DESCRIPTION:
Consideration and possible action to authorize the Mayor to enter into a new
Memorandum of Understanding (MOU) between the City and the Los Angeles Gateway
Region Integrated Regional Water Management Joint Powers Authority (Gateway
Authority).
RECOMMENDED COUNCIL ACTION:
(1) Authorize the Mayor to enter into a new Memorandum of Understanding (MOU)
between the City and the Los Angeles Gateway Region Integrated Regional Water
Management Joint Powers Authority (Gateway Authority)
FISCAL IMPACT: The recommended action will result in an annual total authorized
expenditure of $11,842 for the next five years with a total 5-year cost of $59,210. The
current funding necessary to complete this work is in General Fund under the Storm
Water Quality program, and will be included in the budget for the next five years.
$15,000 was budgeted in this account this fiscal year for this purpose.

BACKGROUND AND DISCUSSION:
On May 5, 2011, the California Regional Water Quality Control Board adopted a Total
Maximum Daily Load (TMDL) for the Dominguez Channel and Los Angeles and Long
Beach Harbors for metals and toxic pollutants. The City of Rancho Palos Verdes was
identified in the TMDL as a responsible party because drainage from the City is tributary
to the Harbor. This TMDL required the development and subsequent implementation of
a water quality monitoring plan. The cities and agencies tributary to the Los Angeles
and Long Beach Harbors (Greater Harbor) worked together with the Gateway

Authority to develop this Memorandum of Understanding (MOU) to share the cost of
developing and implementing the plan. This agreement allowed for joint monitoring of
several locations within the harbor areas.
The MOU is for administration and cost sharing for the preparation and implementation
of a coordinated compliance monitoring and reporting plan, as required by the Regional
Water Quality Control Board, Los Angeles Region, for the Dominguez Channel and Los
Angeles and Long Beach Harbors Waters Toxic Pollutants Total Maximum Daily Loads.
The existing MOU was signed by the City on May 20, 2014, and will expire on April 30,
2019. A new MOU was sent to the City for approval by the Gateway Authority. The
agreement in principle remains the same. The only change made to this new MOU
includes additional participating cities. This additional participation has reduced the
City’s yearly cost from $22,614 to $11,842. The total 5-year cost to the City will be
$59,210.
The Gateway Authority has agreed to act as the fiduciary agent for the TMDL
monitoring project. The Gateway Authority has experience with similar projects such as
the Lower Los Angeles and Lower San Gabriel River and Los Cerritos Channel
Watershed Management Programs. The new Memorandum of Understanding between
the agencies and the GWMA is attached.
Without this agreement, an independent monitoring program would result in
considerably higher costs and the procurement of a sampling vessel and crews to
collect the necessary samples. This agreement allows for joint monitoring of several
locations, resulting in better coordination with the surrounding agencies and a significant
cost savings to all participants.

In addition to the Staff recommendations, the following alternative action is available for
the City Council’s consideration:
