Consideration and possible action to enter into real property negotiations with the Palos
Verdes Peninsula Unified School District (PVPUSD) regarding the Ladera Linda fields
(APN 7564-001-909)
RECOMMENDED COUNCIL ACTION:
(1) Authorize the City Manager to be the City’s real property negotiator and enter
into real property negotiations with Palos Verdes Peninsula Unified School
District (PVPUSD) and their negotiator, Superintendent Alex Cherniss, regarding
the Ladera Linda fields (APN 7564-001-909).

BACKGROUND AND DISCUSSION:
The Palos Verdes Peninsula Unified School District (PVPUSD) is interested in entering
into real property negotiations with the City regarding the potential lease or sale of
PVPUSD’s Ladera Linda fields, located next to the City’s Ladera Linda Community
Center. According to Gov. Code, § 54956.8, the City Council will need to identify the
following in an open and public session prior to meeting in a closed session: 1) the
negotiator for the City; 2) the real property or properties being discussed; and 3) the
person or persons with whom its negotiators may negotiate. It is recommended that the
City Council designate the City Manager as the negotiator for the City to meet with
PVPUSD and their designated negotiator, Superintendent Alex Cherniss, regarding the
Ladera Linda fields (APN 7564-001-909).

1. Designate another individual to be the negotiator for the City.

54956.8. Notwithstanding any other provision of this chapter , a legisla t ive body o f
a local agency may ho l d a closed session w ith its negoti ator prior t o the p urcha se,
sale, exchange, or lease of real proper ty by or for the l ocal agency to gr ant authority
to its negotiator regar ding the price and tenus o f payment for the purchase, sale,
exchange, or lease.
H owever, p rior to the closed sessi on, the legislative body of the local agency shall
hold an open and public session in which it identifies its negoti ators , the real property
or real proper ties which the negotiations may concem, and the person or persons w ith
whom its negoti ators may negotiate.
For purposes o f this section, negotiators may be members of the legislative body
o f the local agency.
For purposes of this section, "lease" includes renewal or ren egotiation o f a lease .
Nothing in this section shall preclude a local agency from holding a closed session
for discussions regar ding eminent domain proceedings pursuan t to Secti on 54956.9.
