CC SR 20190219 M - Permit Parking for Park Place HOARANCHO PALOS VERDES CITY COUNCIL MEETING DATE: 02/19/2019 AGENDA REPORT AGENDA HEADING: Consent Calendar AGENDA DESCRIPTION: Establish permit parking on Park Place for the Park Place HOA RECOMMENDED COUNCIL ACTION: (1) Adopt Resolution No. 2019-__, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING PERMIT PARKING ON PARK PLACE IN THE PARK PLACE HOA NEIGHBORHOOD. FISCAL IMPACT: Adopting Staff’s recommendation will result in an impact to the FY 2018-2019 budget. The costs with establishing the permit programs is approximately $1,000, which funds the production and installation of the permit parking signs and procures the parking decals. Funding for these costs is available in the Traffic Management Program of the adopted FY 2018-2019 budget. Draft Resolution No. 2019-__ (page A-1) BACKGROUND/DISCUSSION: On January 15, 2019, Staff presented an update to the City Council regarding the parking issues on Park Place. At that meeting, the City Council directed Staff to proceed with establishing the Neighborhood Permit Parking program for Park Place, which would allow dual use parking for Park Place guests and Residential Recreation Permit Parking along the existing 16 non-ADA parking spaces on Park Place. In accordance with Municipal Code Chapter 10.20, a neighborhood may apply for permit parking with a minimum 60% approval by residents. The Park Place HOA has submitted a petition signed by at least 60% of the affected residents along Park Place. This petition has been verified by Staff. 1 The permit parking program is necessary in order to allow the guests of Park Place to park at any of the existing 16 non-ADA parking spaces on Park Place, every day of the week, 24 hours a day, 365 days a year, up to 72 consecutive hours. However, the Residential Recreation Permit Parking is limited to three hours between dawn and dusk. CONCLUSION: Staff recommends establishing a permit parking program on Park Place for the Park Place HOA. ALTERNATIVE: In addition to the Staff recommendation, the following alternative action is available for the City Council’s consideration: 1. Take other action as deemed appropriate by the City Council. 2 01203.0006/532483.3 Resolution No. 2019-xxxx Page 1 of 6 RESOLUTION NO. _______ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES ESTABLISHING THE PARK PLACE NEIGHBORHOOD PARKING PERMIT PROGRAM WHEREAS, Chapter 10.20 of the Rancho Palos Verdes Municipal Code authorizes the City Council to establish permit parking in areas in the City by resolution pursuant to the authority provided by California Vehicle Code Section 22507. WHEREAS, on January 15, 2019, the City Council of the City of Rancho Palos Verdes adopted City Council Resolution No. 2019-02, revising the City’s Resident Recreation Parking Permit Program reserving 16 non-ADA parking spaces on Park Place to residents visiting Del Cerro Park and the Nature Preserve. WHEREAS, the City Council found that the 16 parking spaces on Park Place may also serve as spaces for guests of Park Place residents, subject to a properly submitted and approved petition for neighborhood permit parking by the Park Place Homeowners Association. WHEREAS, the Park Place residents have submitted a signed petition requesting that the Council establish a permit parking program in accordance with Chapter 10.20 of the Rancho Palos Verdes Municipal Code, the petition bearing the signatures of at least 60% of the affected residents. WHEREAS, the City Council finds that a Park Place Neighborhood Parking Permit Program is consistent with the goals of Resolution 2019-02 and Chapter 10.20’s purpose of providing resident parking relief. WHEREAS, the City Council has determined that establishing the Park Place Neighborhood Permit Parking Program would not result in significant environmental effects because the program will not significantly alter existing conditions. Therefore, in accordance to the California Environmental Quality Act (CEQA), the City Council finds that establishment of the permit parking program is considered a Categorical Exemption from CEQA based on Section 15301(c) of Article 19, which states that operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographic features involving negligible or no expansion of use beyond that existing at the time of the lead agency's determination. A-1 01203.0006/532483.3 Resolution No. 2019-xxxx Page 2 of 6 NOW, THEREFORE THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1. Findings The City Council finds that a neighborhood parking permit program for City residents and their guests is appropriate. Currently, the parking spaces on Park Place may be used by residents of the City pursuant to the Resident Recreational Parking Permit Program pursuant to City Council Resolution No. 2019-02: under this permit parking program, residents are limited to parking for a maximum of three hours, and may not use the parking spaces after sunset and before sunrise. These limitations serve to mitigate parking congestion, as articulated in Resolution No. 2019-02, but they also unduly restrict the ability of Park Place residents and their guests to use the parking spaces as residents and their guests normally would. The City Council finds that creating a Neighborhood Parking Program for these spaces is consistent with Resolution No. 2015-02, and also consistent with the purpose of Chapter 10.20 of the Rancho Palos Verdes Municipal Code. The signed petition of at least 60% of the affected residents agreeing to the permit parking program, is complete and attached as Attachment 1, and incorporated by reference. Section 2. Park Place Neighborhood Permit Parking Program The Park Place Neighborhood Parking Permit Program is hereby created. Based upon findings in Section 1, the following areas shall be also subject to the Park Place Neighborhood Permit Parking Program, in addition to the Resident Recreational Parking Program: Park Place 16 existing non-ADA parking spaces Section 3. Parking Restrictions for the Park Place Neighborhood Parking Program Pursuant to Section 22507 of the Vehicle Code, the permit parking restrictions on the portions of the streets listed in Section 2, above, shall be as follows: Resident and guest parking (non-recreational) shall be by permit only. Park Place resident and guest parking permits shall be issued to residents of Park Place upon application to the City. A-2 01203.0006/532483.3 Resolution No. 2019-xxxx Page 3 of 6 Vehicles displaying valid resident and guest parking permits issued pursuant to the Park Place Neighborhood Parking Program may park in the spaces described in Section 2, above, every day, 365 days a year, for up to 72 hours. Parking limitations of the Resident Recreational Parking Permit Program shall not apply to vehicles displaying valid resident or guest parking permits issued pursuant to the Park Place Neighborhood Parking Program. Vehicles parked in violation of these provisions may be cited and/or towed at the vehicle owner’s sole expense. Section 4. Posting of Signs. The Park Place Neighborhood Parking Program shall not be effective until signs are erected that indicate the area to which the program applies. The Director of Public Works is hereby authorized to erect such signs. Vehicles that are parked without displaying the required permit may be towed pursuant to Vehicle Code Section 22651(n). Section 5. Resolution No. _____ is hereby adopted, shall go into effect and be enforceable immediately upon placement of signage, in accordance with Section 4. Section 6.
