A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF RANCHO PALOS VERDES FINDING THAT THE
ACQUISITION OF TWO TAX-DEFAULTED PROPERTIES IN THE
PORTUGUESE BEND LANDSLIDE AREA (APNS: 7572-008-014
AND 7572-008-016) IS CONSISTENT WITH THE GOALS AND
POLICIES OF THE CITY'S GENERAL PLAN.
WHEREAS, on September 4, 2018, the City Council authorized Staff to pursue
the acquisition of three tax-defaulted properties (APNs 7572-008-014, 7572-008-022
and 7572-008-023) in the Portuguese Bend landslide area from the Los Angeles County
Treasurer and Tax Collector (TTC) for landslide remediation purposes; and,
WHEREAS, on October 11, 2018, the City received a letter from TTC advising
that two (APNs: 7572-008-022 and 7572-008-023) of the tax-defaulted properties were
redeemed by their owners; and,
WHEREAS, on November 7, 2018, the City Council authorized Staff to purchase
the remaining one (APN: 7572-008-014) of the three tax-defaulted properties in the
Portuguese Bend landslide area from the TTC. That same evening, the City Council
also authorized Staff to pursue the acquisition of an additional tax-default parcel (APN:
7572-008-016) in the Portuguese Bend landslide area from the TTC for landslide
remediation purposes; and,
WHEREAS, Section 65402(a) of the California Government Code requires that,
"no real property shall be acquired by dedication or otherwise for street, square, park or
other public purposes,...if the adopted general plan or part thereof applies thereto, until
the location, purpose and extent of such acquisition...have been submitted to and
reported upon by the planning agency as to conformity with said adopted general plan
or part thereof."; and,
WHEREAS, on January 22, 2019, the Planning Commission conducted a
meeting, at which time all interested parties were given an opportunity to be heard and
present evidence; and,
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS
FOLLOWS:
Section 1: The purpose of the acquisition is allow the City to acquire two
undeveloped lots measuring 0.42-acres (APN: 7572-008-014) and 0.2-acres (APN:
7572-008-016) within the active Portuguese Bend landslide area from the Los Angeles
County Treasurer and Tax Collector for landslide remediation efforts.
Section 2: The Planning Commission finds that the proposed location
purpose, and extent of the proposed acquisition conforms with the City's General Plan,

specifically Safety Goal No. 4, in that it may protect life and property, and reduce
adverse economic, environmental, and social impacts resulting from any geologic
activity. The subject properties are vacant lots, located in an area with the underlying
General Plan Land Use designations of Residential 1-2 du/ac and a Zoning Map
designation of Open Space Hazard. As City-owned properties, these two lots could be
used to support landslide remediation efforts such as dewatering wells, in- or above-
ground drains, and other remediation infrastructure, and that City ownership of the
properties would prevent any future development that may aggravate further landslide
movement.
Section 3: Any interested person aggrieved by this decision or by any portion
of this decision may appeal to the City Council. Pursuant to Section 17.80.070 of the
Rancho Palos Verdes Municipal Code, any such appeal must be filed with the City, in
writing, setting forth the grounds of the appeal and any specific actions requested by the
appellant, and accompanied by the appropriate appeal fee, no later than fifteen (15)
days following January 22, 2019, the date of the Planning Commission's final action.
Section 4: For the foregoing reasons and based on the information and findings
included in the Staff Report and all other records of the proceedings, which are made a
part thereof by reference, the Planning Commission hereby finds that the acquisition of
two tax-defaulted properties in the Portuguese Bend landslide area (APNS: 7572-008-
014 and 7572-008-016) is consistent with the Goals and Policies of the City's General
Plan.
PASSED, APPROVED AND ADOPTED this 22th day of January 2019, by the following
vote:
