BACKGROUND AND DISCUSSION:
The claimant alleges that the City erroneously charged excessive sewer fees for
property owned by Vanderlip Investment Company, LLP, located at 100 Vanderlip Drive,
during the period from 2002 to 2018. Due to the statute of limitations, the claim seeks a
refund of sewer fees only for 2017, in the amount of $7,675.13.
The City’s Claims Administrator, Carl Warren and Company, has reviewed the claim
and advised the City that the claim is not within the City’s coverage. The City Attorney’s
Office has reviewed the claim and discussed it with Public Works Director Elias
Sassoon and City Engineer Ron Dragoo. This property was inadvertently assigned to
the wrong sewer fee classification which resulted in sewer fee overcharges. In light of
the statute of limitations, the property owner is requesting, and is entitled to, a refund of
only one year of sewer fees. Due to the unique circumstances of the property in
question, payment of this claim is unlikely to lead to similar claims from other property
owners. Therefore, the City Attorney’s Office recommends that this claim for $7,675.13
be paid.

Overcharge of Abalone Cove Sewer District Fees to Elin Vanderlip at 100 Vanderlip Drive
Per instructions I received from Public Works Chief Engineer Ron Dragoo, I am enclosing a Claim for
Damages. This claim is being filed to recover a small part of the Abalone Cove Sewer District fees
overcharged to my mother, Elin Vanderlip, who owned 100 Vanderlip Drive through her ownership of
Vanderlip Investment Company, LLP. The overcharge started in 2002 and run until 2017. The total
overcharge of annual sewer fees for the parcel is $100,320.27. However, the City Attorney and other
City staff have decided to limit this $7,675.13 claim to a single year, 2017.
The error was discovered in late 2017 and brought to the attention of the City's Public Works Chief
Engineer in January 2018. On October 29, 2018 the agreed by email that a refund was due (see attached
emails).
Elin Vanderlip was 83 years old when the Abalone Cove Sewer District was created. Based on her age,
the City owed her a special duty of care to protect her from error and false claims. Instead, the City so
overcharged her single lot for sewer fees that she bore a full 18% of the total district sewer fees
collected for the entire period from 2002 to 2018. She was charged for a dozen grinder pumps which
did not exist, and a routing of her effluent via the most expensive pressure pumps, which was also
incorrect.
From my experience of Elin's capabilities between 2002 and her death in 2009, I believe it was
impossible for her to have ever figured out the complex billing system employed by the Sewer District,
which she would have to have done to understand this gigantic error. Unfortunately, Elin Vanderlip was
just too old and infirm to figure out how she was being overcharged by over $7,000 per year by the
City.
It is also clear that no one in the City ever applied any test of reasonableness to the charge assessed
against my mother. Not the City staff, nor any of the highly compensated consulting companies which
the City employed to compute the annual charges, ever brought this billing error to Elin Vanderlip's
attention.
Finally, you should remember that Elin's decision to join the Abalone Cove Sewer District was not
voluntary but was imposed by the City as a condition of approval of her variance. Even if Elin had been
able to figure out how she was overcharged, at age 82 she did not have the energy to start another fight
by questioning the City's sewer assessment against her.
The City's calculation of the excessive charge is based on a claim that the City installed 13 grinder
pumps on Elin Vanderlip's property. In fact, the City installed just one grinder pump. In walking the
property with the City's Chief Engineer this year, it was clear that there never were 13 grinder pumps
installed. The imaginary grinder pumps for which she was billed do not even show up on the City's
own plans.

The error in sewer fee assessment against 100 Vanderlip Drive was finally corrected in 2018 (see
attached) and the correction was approved by the City Council on July 31 2018, the agenda of which
says in part:
"The charge for one specific parcel in the district, that has multipl e cottages on the prop-
erty, was being calculated based upon several Zone D connections. The charge was ad-
justed this year to reflect the actual usage of this parcel, which included one Zone D con-
nection and several Zone A connections. This correction, along with a reduction to the esti-
mated maintenance of the Force Main Subsystem, resulted in a reduction of the Charge,
$5,148 over the charge for the previous year."
The actual reduction in Charge based only on the 100 Vanderlip Drive sewer fee error between 2017
and 2018 was $7,574.53. The amount of over-assessment for 2017 was $7,675.13, which is the
amount of this claim.
On behalf of all of Elin Vanderlip's children, we hope the City might see fit to refund or credit the total
of the excess sewer fees charged from 2002 to 2017 ($100,320.27). This full refund would be based on
fairnes s and equity; other Cities have granted full refunds in similar circumstances. The $100,320.27,
incorrectly taken under the City's taxing authority, is not the City's money, and it is wrong for the City
to keep it.

The City Attorney's office has looked into the reimbursement issue regarding the Abalone
Cove sewer grinder pump fees. The four (4) year statute of limitations you have referred to
does not apply in this case. Rather, the appropriate statute of limitations is one (1) year. The
grinder pump fees were adopted under a Proposition 218 structure. The default law for claims
for over-charges is the California Torts Claims Act, which states that any monetary claim must
be made within one (1) year. Further, the City adopted a similar time limit structure in the
Municipal Code section 3.24.030.
Attached to this e-mail is the City's claims form. Please complete this form in its entirety and
return back to the City for a reimbursement.

Dear Carol,
Thank you for your call yesterday. As we discussed, the parcel at 100 Vanderlip
Drive, Parcel Number 7572002021, is currently assessed Abalone Cove Sewer
District fees based on 14 Equivalent Residential Units (11 ERU 11
) in Rate Zone D. This
came to over $10,000 last year, and represents about 17% of the assessment for
the entire sewer district.
The fee appears to be based on several assumptions which I believe are in error. I
am asking you to review the computation of the sewer fee for the subject parcel.
There are now 13 buildings on the parcel, of which 11 are habitations, and 2 are
accessory buildings (Avocado and the Gardener's Shack). All 13 buildings have
sewer hookups. All the sewer connections are above a single grinder pump at the
bottom of the property, and all the hookups drain by gravity to this grinder pump,
at a low point on the parcel, from which the sewage is lifted in a black plastic
surface pipe up to the gravity flow line on Vanderlip Drive.
I have attached the 9/18/2001 map of the sewer installation (11 Sewer Plan ... pdf") for
the parcel so that you can verify my description. I have seen the single power
hookup to the single grinder pump, and I can point the grinder pump and electric
meter out to anyone who needs to verify the layout of the sewer line.
The 14th connection was for the unnamed cottage labeled "N" on the Sewer Plan.
That cottage, also known as Peacock cottage, was demolished in 2012. There is a
permit for the demolition of this cottage, and an inspection report, at the Rancho
Palos Verdes community development office. The sewer line for this cottage is no
longer connected to anything .
I have also attached the 8/30/2010 Site Plan filed with the City of Rancho Palos
Verdes as part of the parcel's conditional use permit. This map has a table listing the
buildings and their square footages and might help with orientation.
I have attached a spread sheet which reconciles names of the buildings on the
Sewer Plan and the Site Plan. it gives you a count of the bedrooms and bathrooms in
each building.
These are the reasons I believe the assessments for sewer fees, going all the way

back to the early 2000's, are incorrect:
First, there were never 14 "standard" ERU habitations on the property, as few of the
cottages have more than 1 bedroom, and several are studios. We need to correct
the total "ERU" on the parcel for the sizes of the actual buildings. Many are partial
"ERU"s.
Second, as far as I can see, 100 Vanderlip is at the high point in sewer district and
its effluent drains by gravity all the way to the collection station on P.V. Drive South,
never passing through a high pressure lift pump. Rate Zone D is not correct; the
"ERU" with grinder pump followed by gravity flow should be assessed in Rate Zone
c.
Third, there is a single grinder pump on the property, not 14. Therefore, while at
least one of the buildings should be in Rate Zone C, it is excessive to charge the
parcel for the maintenance of 14 grinder pumps. Most of the buildings/ERU should
be charged in Rate Zone A.

I have not heard back from Carol Hill of Harris & Associates about the possible error in
billing computations for the Abalone Cove Sewer Maintenance Fee as they relate to the property
at 100 Vanderlip Drive. Could you please follow up with Harris & Associates again? I called
the Harris & Associates off ices in Los Angeles and Concord but I have only been able to leave
messages.
