Hello Sharon and many trails advocates
I am so sorry that Doug pulled this Item D before it got to Counci l. (L auren just sent me a confirmat ion of
that.) Now, he won't have to pub li c ly exp la in how Staff proposes to fix this latest screw-up .
What I first noticed is that they included the nearly 30 years old proposed vacation map. That has nothing
to do with the current demand from LA County . The 100 foot wide port ion of the deed restricted area was
e limin ated from the grant project because it put us over budget even with the General Funds contr ibut ion
which brought the cap up to $445,000.
The whole Agenda Report goes "south" from there . This leads to the question I have been ask in g about
this trail segment ever s in ce Mr. Poddatoori's bu ll dozers showed up in 2003 . What sort of Errors and
Om iss ions Insurance does the City carry to pay for a ll the Staff T im e it will take to make this s itu at ion
comp li ant with the Genera l Plan and the Tra il s Network Plan? Apparently, none. Even though both the
Plann in g Department and the Pub li c Works Department contribu ted to "The Debac le", neither have
requested funding in the Budget to make it right. Then a long comes a "Grant Opportunity" with many
"strings" attached .
Staff's withdrawn recommendation is:
RECOMMENDED COUNCIL ACTION: (1) Authorize the Mayor and the City Clerk to
execute the Use Covenant and Restriction Running with the Land for the Sunnyside Ridge
Road Trail Segment for recordation with the County Recorder's Office.
The City Attorney's office has reviewed the attached Use Covenant and Restriction
Running with the Land (i.e. deed restriction) and has found it acceptable for recordation.
In order to receive that last $30 K of the grant, what is the least we have to do? Are the multitude of 19??
"non-street easement restrictions" not adequate? Or, have they not been recorded? (I sent Doug Willmore
an ema il ask in g this question. But, he has not yet replied.)

Once that question is answered and an appropriate document is drawn up, I have lots of suggestions about
what it is going to take to make lemonade out of this lemon and all the other Grants which require the City
to place more restrictions on public property .

I'm not seeing what you are saying is in error. If the errors are in the legal description in
that they do not agree with what is shown on the map, then that certainly needs to be
fixed. The legend on the map and the map show what I recall as the intent of the vacation
actions.
All of Pat Poddatoori's lot was to be vacated from the Narbonne Ave Right Of Way
restrictions except for the northern half of the Sunnyside Ridge Road easement. New trail
related (non-street) easements/restrictions were placed on the area that is 35% or more
"slope" and the 10 foot wide easterly portion. Originally, the 10 foot wide easement was
proposed to be on the westerly side.
This map of 19?? shows the beginning of the debacle. The topo lines do not show what a
steep sideways slope there was on the easterly side . So much for site visits. But then,
there was a huge hedge of oleander. My point is that future projects should show the
topography and other conditions surrounding a project area for quite some distance. for
instance, the trail connection and traffic concerns surrounding Ladera Linda should have

been considered at the very beginning. Is there anything you can do to help promote this
policy?

Quick question. No matter how much I enlarge the map in this Agenda Report, I still can't read the
date nor the number of non-street easement restrictions. My question regarding Consent Calendar
Item Dis whether or not this recommended action is adding to the original restrictions from 19??,
duplicating them, in conflict with them or, have the originally promulgated restrictions never been
recorded?
My concern is that the City's construction of raised planter beds, for private use, in the restricted
area, appear to be a violation.

Our challenge is to educate the newbie Staff and Council so that this sort of error upon error
never happens again. Altogether too many projects are in the Capital Improvements Plan
