Bryan, our good friend for some time, has our total support. As an experienced leader and listener, who can sort wheat from

Hi Ms. Yap,
Thank you for your response . Please allow me to set the record straight. My earlier questions for Nicole had absolutely nothing to
do with Senate Bill 34 . I first became aware of Senate Bill 34 just yesterday (Sunday) and read it myself, therefore I asked nothing
from Nicole on this matter. Also, I must have missed seeing the SB 34 public comment opportunities. As you might imagine, It 's
quite time consuming keeping up with the city over-loaded agendas.
Fact is , my only two questions for Nicole were about 1) the Eastview border map as provided, which showed 8 location designations
with a "Star" symbol and I wanted to know where the remaining 12 of "22" cameras were to be installed. 2) the HOA dealing with
the city in regards to the neighborhood entrance cameras . I have yet to receive any further information on these two issues.
Please know, I am not at all concerned that the city would have access to the data collection. Nor am I concerned about the law
enforcement. My concern has only to do with unintentional glitches in the system itself.
In response to the sections of my Jetter that you have highlighted; I felt the commissioners did not receive all they needed to know in
order to justify their approval or disapproval of the plans.
At this point, could you please confirm the PC 4/25117 meeting included a PUBLIC HEARING on the entire Capitol Improvement
Program or not? (I noted the chair's "open the public hearing" words just prior to one lady that spoke well over 3 minutes about the
"cove at abalone" as well as a variety of opportunities to work with the county on a number of pending city projects. ) I just want to be
certain about the public hearing opportunities as things move forward.

Thank you for your email. Nicole let me know you had questions for her last week about the ALPRs for Western
Avenue and Senate Bill 34 (SB 34) that she thought I could further address. SB 34 was meant to provide privacy
protections, while also balancing ALPR technology as a legitimate crime -fighting tool. A large part of SB 34 was
requiring a public agency considering the use of A LPR to provide an opportunity for public comment at a
regularly scheduled public meeting of its governing body . Rest assured that the City has done that every step
of the way.
SB 34 also limits who has access to the data. The law authorizes a private civil action against a person who
"knowingly caused" harm by violating the law. The law sets a floor of $2,500 statutory damages, but allows the
recovery of actual damages and authorizes punitive damages, attorneys' fees, and equitable relief. The
Sheriff's Department has put into place the necessary policies and procedures to ensure limited access and
only legitimate uses of the data . The images captured are only accessible by our law enforcement agency -no

one here at the City is able to access that data, so the City could not "knowingly cause" harm and violate the
law .
Lastly, agencies are required to properly secure their data and must disclose iftheir ALPR database is breached
in some way and provide an avenue for citizens to sue the policing agency if their data is compromised . SB 34
amended the definition of "personal information" under the breach notification law to include information or
data collected through the use or operation of an ALPR system. This means that a license plate number, if
obtained from an ALPR system, is now a data element if combined with an individual's first name or initial and
last name and subject to breach notification. In our case, the database is completely handled by the Sheriff's
Department. They have taken significant measures to secure the data and their entire system. If a breach were
to occur, they would notify citizens.
I'm not sure how to address the other parts of your email (see highlighted sections be low) and would like to
find out what you're referring to. If you would like to provide more information, perhaps we could address
your concerns on those fronts.
Eastview residents continue to be a high priority area for the Council, and the Council has committed to
putting a significant amount of resources, both ALPR and additional supplemental patrols, to the area. Please
feel free to contact me with any additional comments or questions.

I respectfully request your open discussion regarding consent calendar item (L) Vigilant
Services. This subject relates to Capital Improvement Program considering (ALPS) 22
surveillance cameras targeted for Eastview .
The Western Ave corridor data collection/ HOA's entrance data collection/ mobile unit
data collection and the "See Something, Say Something" (human input) is something to talk
about out loud. I hope you agree.
As you may be aware, Governor Brown signed Senate Bill 34 into law on Oct. 2015. (The
issues seem something akin to item #1 on the regular calendar.) In any case, The law

allows data breach victims the opportunity to complain and sue for damages, if so
desired. As if ....... huh? In any case, your local constituents would benefit from knowing
and understanding state law protection in ordinary terms and language which I think you
could provide.
Also, please know I think the staff's presentation on April 25th was half-bake and I believe
anyone listening would be hard pressed to suggest otherwise. I also feel Nicole provided
her best effort under the unusual circumstances.
On a related matter, there are certain times during the planning process in which it seems
the staff is somewhat disrespectful to the council members and committee members
seemingly in the nicest way ossible. My personal observation creates an
unsettling perspective of the future of local control.
In closing, I urge you to consider making Eastview residents a priority on future agendas
given the high impact additional housing and economic growth along Western A venue will
impose.
