A grand jury has indicted an oil pipeline company and one of its employees on criminal charges related to a massive oil spill last year in Santa Barbara County, prosecutors announced Tuesday. Plains All-American Pipeline has been indicted on 46 criminal charges, including four felony counts, while a single employee of the Houston-based company was indicted on three criminal charges relating to the 2015 spill, according to Atty. Gen. Kamala Harris and Santa Barbara County Dist. Atty. Joyce Dudley. Both state and local prosecutors had been investigating possible wrongdoing related to the pipe rupture, which sent oil onto beaches and into the ocean. Plains faces up to $2.8 million in fines plus additional costs and penalties, prosecutors said. "This is the first step in holding Plains accountable and we are committed to putting all the resources that are necessary into seeing this case through," Harris said at a Santa Barbara press conference. The corroded pipeline owned by Plains All American Pipeline ruptured May 19, 2015, and spilled roughly 143,000 gallons of crude along the coast near picturesque Refugio State Beach west of Santa Barbara. About 21,000 gallons made its way from where the underground pipe is buried above U.S. 101 into a storm culvert and flowed into the Pacific Ocean. Some tar balls from the spill were found as far away as Manhattan Beach in Los Angeles County, state officials said this week. The section of pipe that broke had worn down to 1116 of an inch, and investigators found a six-inch crack along the bottom of the pipe, according to preliminary findings from the federal Pipeline and Hazardous Materials Safety Administration. In a statement posted to its website, Plains officials said they were "deeply disappointed" by the decision to pursue criminal charges in the matter. "Plains believes that neither the company nor any of its employees engaged in any criminal behavior at any time in connection with this accident, and that criminal charges are unwarranted," the company said. "We will vigorously defend ourselves against these charges and are confident we will demonstrate that the charges have no merit and represent an inappropriate attempt to criminalize an unfortunate accident." The company said it "sincerely regrets" the accidental release and its effects on the community, the environment and wildlife. To date, Plains has spent $150 million, either directly or indirectly, on the response effort, the statement said. Gov. Jerry Brown overhauls oil pipeline laws after Santa Barbara spill The indictment remains sealed, however prosecutors said the charges against Plains include four felony charges of knowingly discharging a pollutant into state waters. Both the company and James Buchanan — a 41 -year-old environmental and regulatory compliance specialist at Plains — were charged with misdemeanor violations for failing to provide timely notice of the oil spill to the Office of Emergency Services. In addition, the company was indicted on three dozen misdemeanor charges linked to the spill's impact on birds and mammals. According to Harris' office, 221 birds and 142 marine mammals died as a result of the spill. Animals that were recovered dead, or who died in care, included sea lions, dolphins and brown pelicans. The defendants are scheduled to be arraigned on June 2 in Santa Barbara. At Tuesday's press conference, prosecutors described Plains as being uncooperative during the criminal investigation, but declined to elaborate. "They have, I think, been less than cooperative," Harris said. "As we go forward, we'll see if their cooperation and performance in this process improves. It's been quite disappointing so far." For many area residents, memories of the spill remain vivid, according to State Sen. Hannah -Beth Jackson (D -Santa Barbara). "We will never forget what we experienced in the days following that spill: a half -mile slick of crude oil along our coast, the stench of petroleum, oil -drenched birds, holiday visitors sent home, and a beach transformed into a toxic clean-up site," Jackson said in a prepared statement. Environmental advocates said Tuesday they were pleased to hear of the indictments. Linda Krop, chief counsel for the Santa Barbara -based Environmental Defense Center, said she had reached out to the district attorney's office about a week ago because she knew the one-year statute of limitations for any kind of a criminal filing was approaching. "We are relieved that the matter is being pursued aggressively by the attorney general and our district attorney and we look forward to seeing the specific allegations," Krop said. "We're happy that the agencies seem to be taking this seriously and that the parties who are liable will be held accountable." The Center for Biological Diversity and Sierra Club also said they approved of the action. "There's some satisfaction in knowing that the legal authorities are pursuing this," said Kathryn Phillips, director of Sierra Club California. "We hope it will result in some penalties that can be used to help restore some of the damage." Phillips, who is based in Sacramento, said the pipeline break had a far-reaching effect, and the indictments might help illuminate exactly how it happened, why there wasn't a quicker response and why there wasn't some kind of automatic shutoff device. Although the company said in a statement that the spill was an accident and they felt no criminal behavior occurred, Phillips challenged that. "I think at the time it was pretty clear that they weren't doing the appropriate monitoring and that they have a long history of not doing the appropriate monitoring," she said. In the weeks following the pipe rupture, Plains officials released a chronology of events that illustrated their difficulty in reporting the spill to regulators. The company did not alert federal regulators to the leak until nearly 3 p.m. Mav 19, despite the fact that operators in Midland had shut down the line at 11:30 a.m. According to the company timeline, workers near Refugio State Beach didn't know about the leak until they received reports of oil in the water from state parks staff around noon. Initially, company employees struggled to spot oil leaking from the underground pipeline. Around 1:30 p.m., they realized oil was reaching the ocean via a storm culvert near where a corroded pipe had broken. Meanwhile, company officials in Bakersfield, who were responsible for alerting federal regulators, were unable to contact employees near where Line 901 ruptured. 4 In a letter to lawmakers, the company said workers in the field were "busy dealing with the immediate demands and distractions." Finally, at 2:56 p.m., federal regulators were notified. However, company employees in Bakersfield provided an inaccurate estimate of the volume of oil that had spilled. The company initially estimated about 21,000 gallons of crude were spilled and later revised the number to 101,000 gallons. Ultimately, the company estimated that as many as 143,000 gallons had escaped. Hoses and downspouts should not feed directly into the rain barrel. An air gap is required so that water can pass through the screen and into the rain barrel. 2) Overflow Spout This opening helps keep water from filling above the intake screen but if left open it creates an access point for mosquitoes to enter. Cover the overflow spout with tight fitting 1/16" screening. 3) Spigot Because the spigot is usually 6" to 12" above the bottom of the barrel, when drained, the barrel will still hold water in the bottom below the spigot valve. The remaining water needs to be removed and the barrel should stay completely dry between rain events. Mosquitoes need water to lay their eggs and develop into adults. Rainwater collection devices create a perfect environment for mosquito breeding. Prevent mosquito breeding with these tips: . Collected Rainwater Collected rainwater should be used right away and the barrel should stay dry between rain events. . Regularly Check Barrel Regularly check the structural integrity of the barrel and quickly repair damaged or worn screens, clogged openings, and loose fitting lids or caps. . Mosquito Breeding :- If you believe mosquitoes are breeding in your barrel, remove all of the water immediately. This will kill any mosquito larvae breeding inside. . Scrub Inside of Barrel Periodically scrub the inside of the barrel with a scrub pad to remove mosquito eggs that may have attached to the inside walls. . Bacterial Larvicides The addition of "mosquito dunks" to the rain barrel water can help get rid of and prevent mosquito larvae. "Mosquito dunks" specifically target the mosquito larvae and does not cause harm to wildlife, pets, plants or humans when used in accordance with label instructions. We are doing some homework to find the best footing solution for comfort, traction and durability. The reason for the change is this. When council directed us to keep the entire structure within the easement, the footings for the proposed parallel retaining walls had to be redesigned to include some overlap, making construction (excavation and shoring) very difficult and costly. This is a simpler, and we believe, cheaper solution. The contractor will need to give us his change order proposal (once design is complete) before we know value of savings. Over the past several months there has been a very noticeable increase in the number of different cars in the driveway and on the street, various occupants coming and going at all hours of the day and night, people walking from/to cars with open alcoholic beverages, an increase in trash littering the street, and a general increase in boisterous activity from the house. This type of activity is not in keeping with the demeanor of the neighborhood and will certainly get worse during the long, warm nights of summer. The rental cost ($795/night with a 2 day minimum) encourages multiple people to split the cost, increasing the number of cars and associated issues. And with the recent addition of a pool and spa in the backyard, the home is becoming more attractive as a short-term party house. While I recognize there will be an economic impact to the owners and I generally adhere to a "live and let live" attitude, the trend of increasing noise, traffic, trash, and transient occupants at 3664 Hightide Dr. is not sustainable and, if allowed to continue, will disrupt the tranquil, peaceful and safe nature of our neighborhood, potentially causing increased calls to the Sheriff to enforce noise regulations or address other unlawful activity. Does staff really expect a horse to traverse a concrete trail, that is an 18-20% grade safely? And, what about rainy or wet conditions? Not safe for either horse or pedestrian. I was told to not get focused on the budget or the additional expense for KOA and geotechnical engineering but the proposed design change. Therefore, I would like to recommend an increase to the project budget because of this design change. A sufficient amount (?) to cover the concrete in decomposed granite, compacted, of course, to improve the traction on this trail. In addition, the City may want to set aside future funds for maintenance to replenish the decomposed granite, as necessary, after washouts that might occur after rainstorms. Oh, and shouldn't the $20,000 being proposed by Staff to KOA for the 'extra work' be covered in the $100,000 contract that Staff recommends you approve (Agenda Item H) so KOA can administer assistance since Public Works is understaffed. There are only a couple of hundred people offering this service in the City and not too many complaints verses how many people live in our City. It's a wonderful service. We should be able to keep providing this service. If, there was a small Hotel in the City in which we were taking revenue away from or numerous Hotels in the City like all of the other beach Cities have, Redondo, Manhattan, etc I could understand the City's position and frustration, but there is not, our City does not have hardly any hotels nearby the resort or the glass church. Prices are almost 610.00 dollars per night for 2 persons, it's crazy, the average Joe can not afford this.This is why they seek out our services. We offer a good service. Terranea is getting busier and sometimes the people find me because they are so booked up. The resort is bringing in many more people now and they can not accommodate everyone. Please try to see it this way. I know some neighbors get upset so just regulate this service. Let us do short term rental for so many days in the year or something like that. If city going to manage our private property usage in XXX%, the city should take off or share the property TAX payment at the same percentage. 3. If city is controlling the property rental, our property value going to go DOWN. 5. Just checked the few web site lists, total have 30 house listed, and 10 of them are from Terranea. We have 321,418,820 people live in RPV, the 20 houses is not enough just for our own resident's temporary need, why we need to spend many thousand dollars of city money to hire the outside company to MONITOR this short term rental. 6. The racous noise woke us, finally at about 3:30AM we notified the sheriff who said nothing could be done. The noise up to this point has been tolerable but with the warmer evenings, partying will be an intrusive issue. These short term rentals, less than 30 days, must be totally stopped. Additionally if not registered for the RPV hotel tax, the penalty needs to be severe and enforced. Why not issue citations for disturbance after 11:00PM with a hefty penalty. I was unable to find the definition and stipulations for a private home short term rental in RPV relative to conpatibility with zoning. Please send me that RPV code reference. This intolerable situation should have been specifically noted and included in the original writing of RPV Code. It is disappointing to find that the omission exists. When an individual pays that much money to rent a home, you can believe they are going to enjoy it and not give any concern to neighbors not able to sleep at night because of the loud conversations, loud music, swimming, singing and partying. My concerns are: Disruption of our quiet, family neighborhood by strangers. Excessive traffic coming into our neighborhood. Being awakened at all hours of the night and having to call the sheriff. Value of our real estate decreased. The owner(s) of the property at 3664 is operating a hotel in an R-1 residential area at the rate of $795/night. A minimum two -night stay with cleaning and service charges allows the owner to collect $1,972 less any charges to Airebnb. Checking the calendar on the website shows that Airebnb will collect approximately $39,440 for the month of June for reservations already booked. Comments on the website say: "Extra People, No Charge!" I have been advised by a realtor that should I decide to sell my home, I must disclose that this Airbnb is two houses away and that the sheriff has been called more than once to squelch the noise created by the short-term rental tenants. Certainly, this will reduce the resale value of my home and other homes in the area. I don't know of anyone who would want to purchase a million+ dollar home knowing there is a private residence two doors away currently being managed and rented out via Airebnb. I understand this issue will be discussed at the May 17 meeting. I hope the staff s recommended option to prohibit short-term rentals will be deemed acceptable and a Code Amendment regarding short-term rentals will be initiated.
