That's the only reason why there was a public hearing -it was at the Council's direction. There cannot be a public hearing on a possible ordinance unless there is a draft ordinance. I couldn't imagine the backlash that the Council and the City would receive if they held a hearing on a possible new ordinance and yet there wasn't a draft ordinance that the public could read and comment on. I understand that transparency is time consuming, but it is the price of transparency. The Council clearly thought it was worthwhile to give the issue a full and transparent hearing in the public. My own opinion is that is not disrespectful at all. It is giving the public a chance to study an issue and weigh in on it and then the Council deliberating on it in public and making a decision. However, at the same time, I understand your frustration with the issue. Then the details are worked out, but details and documents are not drafted until there is a basic agreement to go forward. I still would like a response as to how much it cost and how much staff time was used? That might help the Council understand why it should agree, in general terms, to go forward with a project or plan before getting into the weeds of the details. Why, then, does staff (and our City Attorney) waste time and money preparing a Resolution and Ordinance as though adoption of such a fee tonight was a fait accompli? Is that not putting the cart WAY before the horse? Which members of the public have expressed support for continuing the fee? Who ran for office with a promise that the fee would expire and not be reinstated? Who supports the fee other than a few Council members and the staff? Certainly there has been no public support expressed of which I am aware. The staff report asserts that the existing fee is "restricted to expenditures for the storm drain system". We all know that is a false statement, as funds generated from the fee over the last 10 years have undeniably been misappropriated for uses beyond the restrictions that were imposed. I am opposed to the fee. Do not reinstate it. It is a tax and needs to go to the public for passage by a two-thirds' majority. It will not pass and you know it. I do not trust the City to comply with the proposed restrictions, just as it did not comply previously. Further, as I stated at the last meeting when this issue arose, the idea of having funds from the General Fund be deemed "loans" is absurd. If you look at the amounts spent on storm related expenditures over the past 10 years (info on the website) it is readily apparent that the expenditures far exceeded the funds generated from 3 the fee, thus General Funds in the millions were also used, and if this new fee is adopted and this "loan" arrangement goes into effect, there will no doubt be a "need" for a new or continued "fee" 10 years down the road in order to pay off the "debt" that will undoubtedly be owed to the General Fund. This is a shell game to assure that this unnecessary source of gravy continue. Transient Occupancy Tax was committed to pay for the storm drain needs. Use it accordingly, as promised. The 40 mph speed limit is unrealistic in view of the extreme multi-use and should be returned to the previous 35 mph. The 40 mph speed limit combined with social media has encouraged more racing as we have witnessed in the past year. The additional "inviting" entrances to San Ramon Canyon (with a new echo) after the Canyon repair have encouraged vandalism as well. The dropping off of photographers to film the cruising with illegal after-market exhaust systems causing nerve wracking noise has terrible effects on the community. Attached are photographs I have taken on the Switchbacks showing: Inappropriate cruising of motorcyclists and race cars where they ride up and down in a loop pattern, along with multiple uses: bicyclists who ride several abreast, joggers both alone and with pets and walkers on the road in the bike paths, where a collision with a vehicle going 40 mph on the hairpins is inevitable. We have read the memo sent to you by resident Diane Smith and would like to submit our support for the comment she provides. The problems presented by this unique 2 lane mountain road are twofold. First, this stretch of road poses a danger for everyone due to the multi-use designation. There is not a designated bike lane or a shoulder yet autos, motorcycles, many, many bicycles, pedestrians and hikers are all expected to share the road. The Palos Verdes Peninsula Land Conservancy indicates that the San Ramon Reserve Trail is located on the actual street, with no designated path or trail (http://pvplc.org/lands/docs/UPDATEDMAPS/sanramonREVMAR2013.pdf). Those that utilize the switchbacks do so in the lane designated for automobiles. Secondly, the switchbacks have become a destination for street racing. Professional photographers are often seen taking photos to sell on line, much as they do on Mulholland Drive and the Malibu Canyon areas. Motorcyclists we have spoken to have come from as far away as the Valley. Salespeople at Bert's Mega Mall in Chino inform their clients of the switchbacks. The dangers of racing are evident, but the noise created by daily motorcycle racing echoing through the San Ramon Canyon into nearby neighborhoods is horrendous and frequently drives us from our home on the weekends. More recently, the switchbacks are being used for auto racing on weekday evenings beginning about 10:30 PM. Recommendations fall into two categories: Deterrents and Enforcement. Grating of the hairpin curves and speed cameras would deter racers. Those motorcyclists we have spoken with say that grating the turns would "take away the fun" and they wouldn't use the switchbacks. These solutions would not require on site law enforcement. Recommendations such as an ordinance prohibiting cruising, speed limit reduction, and ticketing for the installation of after-market exhaust devices are all determinant on our Sheriff's Department willingness and ability to enforce city laws. When reporting street racing (not, as some deputies insinuate, street riding), we are often asked if we can see the motorcycles or "just hear them". We have been told that because of social media the noise is something we have to "get used to". The noise of street racing and those riding along our streets to enjoy the views is starkly different. Motorcycles re-circulating for hours on end, passing autos, bicyclists and pedestrians and exceeding posted speed limits are breaking laws and creating a hazardous situation for this multi-use road. We feel that the most effective way to deter racing on our streets is for the City Council to impress upon the Sheriff's Department that racing by motorcycles and cars will not be tolerated in our community. We ask that the City Council consider the following recommendations to traffic calming on the 'Switchbacks'. • Cutting grid lines into one or more hairpin turns to deter racing • Installation of a speed camera 1 • Reducing the posted speed limit from 40 MPH to 35 MPH to make the road safer and aide law enforcement • Installation of a No Cruising sign to aide law enforcement • Sheriff's training to recognize after-market exhaust devices and enforcement of RPV noise ordinances • Revisiting the PVPLC Trail Plan and re-evaluate the logic of a hiking trail located on a two-lane, multi- use mountain road with many blind curves • Installation of cigarette disposal containers at turnouts where visitors gather in this very fire sensitive area Thank you for your time and attention to this matter. This is a beautiful but treacherous toad that has become more popular with social media and it is time to review the speed and safety of the road and its impact on local neighbors. My neighbor, Diane Smith has provided an outstanding report documenting several issues and providing a set of realistic recommendations to try and address these concerns. She is to be commended for preparing such a detailed report that provides to the council examples of hazardous situations. My recommendations are similar to Diane's and are as follows: 1 Reduce the speed limit from the current 45 to 30 or 35. This is consistent with the speed limits posted on virtually the entire PV Drive east road and with the number of curves reflects a more realistic speed. 2 Expand the area under review to include all of PV Drive east from Crest to PV Drive south. The switchbacks actually start at Casalina, well above Ganado Drive. 3 Include some type of striping or pavement treatment to force traffic to obey the speed limit and discourage round about rides by motorcyclists. 4 This is a beautiful piece of road for bicyclists as evidenced by the amount of bicycle traffic, especially during the weekends. In California, bicycles are allowed to ride two abreast (no more than two) AS LONG AS it does not impede traffic. The road is not wide enough for two or more bicycles and a car without going into the opposite lane. Not wanting to restrict this beautiful ride for all bicyclists, post "Bicycles must not impede traffic" signs in both directions. In that manner, should there be no traffic, the bicyclists can ride two abreast, but when traffic would result in a hazardous situation, they must ride one abreast. 5 Create some type of noise barrier to reduce the road noise, particularly from loud cars and motorcycles. 6 Encourage our outstanding sheriff's department to patrol this section of roadway, especially on early weekend mornings. Drive East Switchbacks Agenda item 4 We have sports cars and motorcycles racing up and down the upper third of P.V. Drive East's switchbacks, located Between Marymount University and P.V. Drive South. The vehicles pose traffic hazards to pedestrians, bicyclists and drivers who obey the speed laws. They also make excessive noise, disturbing area residents within an approximately Yi mile radius of the switchbacks. Primary victims are those living toward the end of San Ramon, parts of Ganado, Vista Del Mar and residents on the West Side of Tarapaca Road. This by no means includes all the affected areas of this nuisance. Cars and motorcycles collect at the turnouts, and stay for protracted lengths of time. In some cases, the motorcycle noise is so exacerbated that residents from San Ramon and Tarapaca have gone down to confront the drivers. Usually the worst noise occurs on the weekends when residents are attempting to enjoy their properties. CA DMV codes "CAVC27150" and "CAVC27151" establish noise levels under "2.5" that prohibit vehicles from having after manufacturing modifications made to their exhaust systems to enhance noise. Many of the motorcycles and possibly the sports cars are not compliant with these codes . Examples: Regarding speed, since January of this year, I have seen numerous examples of motorcycles passing vehicles traveling at legal speed on both the right and left sides, many times dangerously close to one of the hairpin turns. I have seen 3 unreported accidents where motorcyclists went down on their bikes on the turns of switchback. Close to the intersection of Miraleste Drive and P.V. Drive East, I personally observed two young motorcyclists, one whose bike had gone down after running into the back of a small utility truck. On the switchbacks, members of the motorcycle groups serve as "look-outs" for their other speeding members; they warn each other via phone and hand signals of encroaching law enforcement. I have been told, and seen examples for myself on YOUTUBE, that these switchbacks have been advertised as the perfect place for motorcycle and auto racing. Watch as Mike speeds up the switchbacks, first speeding past another motorcycle on the right side and then flying by a car on the left side, only to crash himself a few moments later. The Possible Solutions: (1) Return speed limit on switchback to previous 35 MPH (2) Establishment of a municipal code making it illegal to cruise back and forth on the switchbacks (3) Possible task force with CHP and Lomita Sheriff's Departemnt to enforce DMV vehicle noise requirements (4) Temporary or permanent closure of turn-outs to prevent congregation of the speeders (5) Periodic placement of unoccupied black and white sheriff cars for short periods of time (6) Digital speed signs along switchback Last Item: I want to thank the Lomita Sheriff's Department and the City for their efforts to date. Additionally, I have observed a sharp reduction in the back and forth cruising, speeding and noise on the P.V. Drive East Switchbacks due to a greater Sheriffs presence from 4/5/2016 through today. This is not a law enforcement issue only. The City may need to assist by creating codes and speed limits that will insure safety on our multi-use roads. We will continue to need your help on the switchback issues. .. San Pedro is just about 40 minutes from downtown ·LA. To get to San Pedro you basically would just take the 110 south tt1l you see the exits for San Pedro. Take the last one which will drop you off on Gaffey street. You"U have to cut through San Pedro by taking Gaffey street south. After about 5 minutes youll start to dimb a large hill and Gaffey will basically dead end into Paseo Del Mar/Sheppard St. Note: If you want to see the Korean Bell (AKA Friendship Bell) then look for Angel Gate paJk on the right ••• you can't miss it. Otherwise, once 25th dead ends, take a right on to Paseo Del Mar and head east. Take this about 1 D miles, all the way past White Point Park and then you want to look for Western Ave. which wm be on road that veers off to your right. Take Western Ave only for a mile or two and then take a left on to 25th street and head west on Palos Verdes Drive south. Now the directions are less tricky and you can really start to see some of the coastal scenery. Head west for about 10 miles and you'll see a road off to the right that is cutting back up steeply into the hills. That road is Palos Verdes Drive East. l highly recommend you take a detour there and head up Into the hills. Although its not very long, it has some great switch backs that will be a lot of fun as you lean and twist into the turns and accelerate up the hill. Take this road up untt1 you come to a stoplight at which you want to take a left on to Crest Road. follow Crest Road right up to the crest of the hill and enjoy the great "!ew as you take a break. Follow your same route back down hill to get back on to Palos Verdes Drive South and continue to head west along the coast line. Now you'll have about 25-30 miles of great coastal driving with relatively minor traffic congestion. Hopefully Catalina Island will be in full view for your trip!!! At the end of the route, Palos Verdes Drive South will tum into Palos Verdes Drive West and will dump you off into Torrance and South Redondo Beach. There if you want to continue along the coast (not nearly as majestic and much more crowded, you can take Catalina Ave or the Pacific Coast Highway. This is the perfect end to the drive as you will have plenty of places to pull over and eat or shop at. Good luck and enjoy this hidden gem in l.A! Scenery ***** The scenery on this route is the best coastal scenery you are going to find in LA County. The Palos Verdes peninsula with its hills, cliffs, and impressive elevation offers breathtaking scenery and its only 40 minutes or so from downtown LA. If you live in/near LA and haven"t discovered it yet, you've really been missing out on an incredible coastal area. ff you follow the path that I spell out below in my directions, you'll start out on a large hill overlooking the southern coast of LA. from there you can see the Port of Los Angeles and all the huge commercial ships coming in and going out as well as smaller pleasure boats. As you drive you'll wind your way around to the southwest and eventually western coastal areas along high cliffs that give you a great view of the ocean scenery (especially beautiful during sunsets!!!}. If you·re lucky and the weather is dear over the water, you'll see the beautiful and mysterious Catalina Island. Many people in LA have no idea that such large and beautiful island is parked just off shore because the island often is not visible. However, when the ocean air is dear enough, you'll be amazed at the large island sitting only 20 or so miles of shore. You1l also get a great inland view high above LA's south bay towns (Rolling Hills Estates, San Pedro, etc.) if you take Palos Verdes Drive East detour that I recommend in my directions below. This road will take you nearly to the very top of the Palos Verdes hill where you'll be at a great vantage point over the areas below. This is especially pretty at night with all the lights. Also, since this area has some of the most dramatic ocean views near LA, you'll see some magnificent houses in some really upscale neighborhoods that are positioned to take advantage of the wonderful coastal views. Road Quality ***** The road conditions couldn•t be much better when you compare them to the normally overcrowded LA streets. This road Is relatively smooth with gentle twists and twllS. If you take the Palos Verdes Drive East detour I recommend, you'll get into some fun tighter turns wilh steep elevation gains. Keep in mind that some road construction was taking place in the swnmer of 2003 ••• should be ideal whe,n they get done and have all the brand new smooth pavement in place. Overall this is a great road with on IMPORTANT exception. Just after 25th street becomes Palos Verdes, there is a 1 /8 mile stretch of road that runs by the coast where there is constant land shifting toward the ocean. The road has some SEVERE dips which can easily dump you if you don't know they"re coming. If you are prepared for them with slower speed you'll be fine. After that the road is beautiful! Roadside Amenities ***f<i~: As far as things to do when its time to pull aver and take a break, there's enough stuff to do to keep you busy for a full day or weekend if you look around. If you bl<e seeing large commercial ships as well as smaller private boats, just bead down the hill and find the Port of Los Angeles. There are two large tourist areas near the port that offer parks, restaurants, shopping and some very inexpensive and enjoyable coastal cruises. One of the tourtst areas is the Port's O Cal! ViUage which is a vintage New England style port replica (apparently fi!mina for 1V and movies takes place in this area). Also, the Port of LA has an annual Lobster Festival {in mid September} that is ideal for lobster lovers. At the start of the directions I provide below, you can visit San Pedro's "Korean Bell" or "Friendship Bell" which is located in Angel's Gate park. This huge bell was donated to LA from the South Korea back in 1976. It has a park and sits up at the crest of a hill offering a great view. Also, if you like history, this park has the Fort MacArthur Milita;v Museum which highlights a fort that was built back in 1916. Just about a hundred yards away from this park is another park named Point Fermin park. This park offers tours of an old lighthouse and has a long walk/jogging trail around the perimeter of the park. If you llke shopping, then you'll find a couple boutique centers that are found toward the tail end of the road when you start getting back into the more crowded areas. These boutique areas are great places to pull OVe£, get some ice cream, and walk around looking at the arts and crafts. Also, if you want to do something really exciting, take a boat to Catalina !s!and which by itself, Catalina island could tum into a week"s vacation if you wanted it too. Others have cited many is sues, so I will not repeat them all here, except to say that public safety should be your number one priority in making your decision. I personally do not believe, no matter how many sheriff's deputies, firefighters, lifeguards, and other EMS personnel and city staff are on hand, that there is any way to make this a "safe" event, given the unique nature of RPV and the huge crowds that would be attracted . I believe this was a very well intentioned and patriotic idea -I just don't believe it is "workable" for our particular location.
