Box 942850 Sacramento, CA. 94250-5872 Re: Government Compensation Analysis Dear Ms. Yee: In the spirit of helping all California cities and agencies achieve full and complete transparency with respect to public employee compensation and benefits, on behalf of the City Council of Rancho Palos Verdes, I am requesting that your Office examine the expansive reporting methodologies adopted and employed by the City for the reporting of compensation and benefits costs. We are keenly aware and appreciative of the extensive efforts and mandates that your office, and that of your predecessor, have put into place thus far in an attempt to ensure greater transparency and ease of research. However, to address the public's concerns regarding public employee compensation and benefits, our City Council believes your efforts could be significantly bolstered by embracing and ultimately mandating reporting requirements in line with those adopted by Rancho Palos Verdes. For your review and consideration, I have taken the liberty of attaching the 2013 and 2014 Compensation and Benefits Analysis documentation prepared by our Finance Department, which clearly, definitively and completely illustrates the total compensation received by all City of Rancho Palos Verdes employees. By way of background, this City Council firmly believes that our citizens have a right to full transparency with respect to all public information, including the compensationwages and benefits received by City employees and elected officials. To that end, salary range and benefit information has been available on the City's website for a number of years. In late 2010, the City added a section on the Home Page of our website, which provides links to these documents from a single location, as well as a link to the California State Controller's Office website, which as you know displays compensation information for all cities and agencies in the state, including Rancho Palos Verdes. (J) City of Rancho Palos Verdes State Controller Government Compensation Analysis Page 2 of 3 In 2013, the City Council requested that the City's independent financial auditor, Vavrinek, Trine, Day & Co., LLP, conduct additional Agreed Upon Procedures related to the City Manager's compensationsalary and benefits for calendar year 2012. The purpose of this additional review procedure was to determine the City's compliance with its policies and procedures for employee compensation and benefits, beginning at the top with the City Manager. The results, which were reported to the City Council in October 2013, verified that the City was in full compliance and there were no exceptions noted . In light of these results, and in order to provide greater transparency for the public regarding the compensation and benefits received by all City employees, the City Council directed the independent auditor to again test the City Manager's compensationsalary and benefits for calendar year 2013, and additionally to test a sample of 20 employees (whichemployees. which sample included all senior managers and approximately 10% of non-management employeest . Furthermore, the City Council directed City Staff to prepare an Employee Compensation and Benefits Analysis for all full-time and part-time employees for calendar year 2013. In January 2014, the independent auditor reported to the City Council that their work was completed and the results noted no exceptions. In addition, the City Council was provided with the results of the 2013 Employee Compensation and Benefits Analysis, as validated by the independent auditor. The Compensation and Benefits Analysis schedule/spreadsheet (which is interactive to facilitatefef the use and review by any interested party, but primarily and specifically our residents), includes every full-time and part-time employee, by job title, who worked for the City in 2013, and lists all actual compensatiomvages (not merely the Medicare taxable income f from box 5 of an employee's W-2t which is currently the standard required by your Office) to be reported , including salary, overtime pay, and bonuses. Early this year, the City Council requested that an Employee Compensation and Benefits Analysis be conducted for calendar year 2014. Again, this document is included for your review. While it is our hope that this City Council, and those elected in the future, will continue to unilaterally require this comprehensive analysis on an annual basis, it is our goal, in the spirit of full and complete transparency for all cities and agencies , to have your Office mandate that each city and agency in the State of California report compensation and benefits costs using the Rancho Palos Verdes template as a minimum reporting standard. The appeal of the Planning Commission decision is based on a letter from the attorney for S & K Industries the owner of Lot 6 of Tract 27142. The letter states that the City Staff and the Planning Commission " ... are under the erroneous understanding that the owner of Lot 7 has some legal rights to access Lot 7 via my clients drive way." The Tract map for Tract 27142 creates Lot 6 as a "flag lot." The "pole" of the flag is the driveway to Lot 6. Lot 5 is also a flag lot and also has non-exclusive use of the same easement. The 1965 deed to Lot 7 grants the owner of Lot 7 a non- exclusive easement over the same portions of lot 6 and Lot 5. With all due respect, we contend that the conclusion in the letter by the S & K attorney is wrong and the materials submitted do not support that conclusion. If there was no easement, the only alternative is access from Knoll View Drive. The staff report to the City Council is not available as of the date of this letter. My client was informed by Leza Mikhail of the City Staff that the City Attorney believes the owner of lot 7 has a valid legal easement. We concur with the City Attorney. The December 9, 2014 report from the City Staff to the Planning Commission states at page 6: "The applicant has redesigned the project to eliminate driveway access from Knoll View Drive and instead provide access to the property via a legal private driveway that extends eastward from Knoll View Dr. along the north side of the property ... This application utilized a private drive way with direct access to the garage from the street. This application was denied in that meeting by the Planning Commission, due to the objections of the appellant. I have attached that design to this letter. I submitted another application that was presented to the Planning Commission at the December 9, 2014 meeting. Unfortunately, I was not able to come and speak at the April 21 51 CC meeting, nor will I be able to attend tomorrow night's meeting. I did, however, watch the video of the 4/21 meeting and have read the staff reports. I do want to express my opinions for your consideration tomorrow night. I believe there is a significant problem of overcrowding occurring at Abalone Cove. Attendance has been steadily increasing over the years, and with recent improvements last summer, even larger crowds are going to be attracted this summer. The current $5 flat rate for automobiles is an exceptional bargain when compared to other cities, people know that, and come from all over the Los Angeles basin and beyond to enjoy this beautiful area (and, unfortunately, some trash the area, spray graffiti on the rocks, jump from precarious cliffs and swim into sea caves, trample the tide pool wildlife, etc.). The City of RPV needs to do something to help get the crowds under control, and I fully support an increase in fees towards that end. This should be the primary goal of increasing parking fees. Any increased revenue the City realizes from such increased fees should be turned right back around and invested at Abalone Cove, not through any more major development, but through things such as increased trash receptacles and maintenance of them, increased ranger patrols and enforcement of rules/regulations, increased lifeguard presence, etc. Along these lines, I have reviewed the proposals so far. I also listened carefully to the 4/21 meeting, and applaud Councilman Campbell on wanting to develop something that was preferential to residents of RPV. In general, I like the direction the current proposals are heading, but respectfully ask you consider some minor "tweaks," in particular to the rates for automobiles. Here is what I would propose: Basic Fees: Up to 30 minutes: FREE 30 minutes - 2 hours: $6 2 hours - 4 hours: $12 4 hours and beyond: $18 Discounted Fees for RPV resident, Senior Citizen, and Disabled: Essentially a $6 discount over the fees above. In other words: Up to 30 minutes: FREE 30 minutes - 2 hours: FREE 2 hours - 4 hours: $6 4 hours and beyond: $12 Volunteers should have a free access pass to use ONLY when the are acting in an active volunteer capacity (in other words, a volunteer that happens to go there on a weekend to enjoy the beach with their family should pay just like everyone else, but when they are there to educate visitors, or help clean the area, etc., then it should be free). This would likely have to be an "honor system" for the volunteers. 1 In order to realize the discounted fee, the individual would need to get a special "pass card" from City Hall during normal business hours. I'd suggest the card be valid only thru the end of the calendar year (folks would need to go in each year to get a new card). RPV residents would have to show driver license and proof of residence, seniors proof of age, and disabled folks proof of their disability. When the person with such a pass card goes to pay, they insert the pass card either before, or after, their regular ticket, and the automated system would adjust the fee. For the RPV resident discount, it would be one card per RPV address, transferrable only to residents at that address. In order to avoid people obtain such cards and selling them on the internet, perhaps the first card could be free, 1st replacement card $10, second replacement $25, 3rd $50, and no replacements beyond that. The idea of my proposal above is that local RPV residents, elderly, and disabled can go visit Abalone Cove for 2 hours for free, and for up to 4 hours for only $1 more than they currently pay. That seems like a pretty good deal and encourages local residents to perhaps take more advantage of the park that their taxes pay for than they currently are. Those traveling from further (and do not pay any taxes that help support this park!) generally pay more (with exception of the first 30 minutes), and the longer they want to stay, the more they pay. This will help move cars in and out of the parking lot throughout the day, and I believe the city would realize an overall decrease in crowds at any given time during the day. I do believe the city needs to carefully consider the impact of these changes on nearby HOAs, perhaps increasing patrols and enforcement of "parking by permit only" signs already in those areas. Again, any increase in revenue from the parking could be used to offset costs associated with this. I would like to close by saying that, while I believe the "tweaks" I indicate above would be an improvement over the current proposal, I could live with the current proposal from the Parks Department if the City Council feels it is better. do believe it will be important for the Council to make a decision tomorrow night so that new fees (whatever they are) can be implemented as early as possible this summer. I understand that the City Council will be hearing this matter at your May 5, 2015, meeting. Based on the staff report prepared by your Deputy City Manager, it appears that the City has additional concerns that we would like to address. Below, please find questions along with responses from LA-RICS that were identified in the staff report: 1. Will the Coast Guard and/or the County want to include their existing, nonfunctional antennae on the new monopole? The County of Los Angeles currently holds a lease with the United States Coast Guard, which allows the placement of Land Mobile Radios (LMR) equipment at the site. Although the site currently does not have County equipment, there are plans for such installation. This planned County equipment will likely not be necessary when LA-RIGS completes its installation. However, if the County choses to maintain its installation plan, that equipment will be collocated on the LA-RIGS monopole. If the Coast Guard would like to include their equipment on the installation, the Authority will accommodate them. The Honorable Jim Knight May 1, 2015 Page 2 2. Will the Coast Guard permit the removal of the second guyed pole from their property? • The Authority's current site plan is to remove either or both poles to ensure the impact of the Authority's installation has a net positive impact on the site, particularly aesthetically. The County and the Coast Guard have had discussions outside of LA-RJCS regarding the site. It is the intent of the Authority to remove the existing pole and replace it with a shorter 70 foot (ft.) monopole that is not guyed and is painted to blend into the environment. 3. Is it technically feasible to install the antenna equipment and/or back-up generator in the existing bunker? The Authority is intending to utilize the bunker to house its equipment. 4. Will the new monopole require lights and/or markings in order to comply with FAA regulations? • The current pole, which is approximately 80 ft., tall, does not have Federal Aviation Administration (FAA) lighting on it. The expectation is that a smaller installation would not trigger new lighting. 5. To what extent will sensitive biological and historical resources on the Coast Guard property be affected by the construction and operation of the new monopole? • The Authority wtll do a complete National Environmental Policy Act (NEPA) analysis on the site to determine if there are significant biological or historical resources. It is not the intent of the Authority to significantly alter the site in any negative way. In fact, removal of guy wires will benefit the avian species by removing a particular flight risk. As you can see, there are distinct advantages to replacing the existing structures; it would reduce the number of poles and lessen clutter. This facility is extremely important in providing future public safety radio coverage throughout the City of Rancho Palo Verdes and the Palos Verdes Peninsula. As you may recall, in 2012, Congress passed legislation that requires public safety agencies to vacate the UHF (T-Band) spectrum in the not too distant future. The system proposed for this site will replace the existing T-Band radio system with a 700 MHz radio system.
