CONNECT WITH US:
(d) All final reports, information, data and exhibits prepared or
assembled by VENDOR in connection with the performance of its services pursuant to
this Agreement are confidential until released by CITY to the public, and VENDOR
agrees that they shall not be made available to any individual or organization without
prior written consent of the CITY prior to such release. All such reports, information,
data and exhibits shall be delivered to CITY upon demand without additional cost or
expense to CITY. All charts, tables, figures, and maps, which are prepared with
computer-based mapping or spreadsheet programs, shall be provided to CITY in a
format that is acceptable to CITY.
(e) This agreement and the scope of work to be performed by
VENDOR may only be amended in a written document executed by both of the parties
to this agreement.
1.2 Schedule of Work
Upon receipt of a written Notice to Proceed from the CITY, VENDOR shall
perform with due diligence the services requested by the CITY. Time is of the essence
in this Agreement. VENDOR shall not be responsible for delay, nor shall VENDOR be
responsible for damages or be in default or deemed to be in default by reason of strikes,
lockouts, accidents, or acts of God, or the failure of CITY to furnish timely information or
to approve or disapprove VENDOR's work promptly, or delay by CITY, or any other
delays beyond VENDOR's control or without VENDOR's fault.
ARTICLE 2
COMPENSATION
2.1 Fee
CITY agrees to compensate VENDOR an amount not to exceed thirty-one
thousand two hundred fifty dollars ($31,250) for the services described in Article 1.
2.2 Terms of Compensation
VENDOR shall submit monthly invoices for the work completed in the
previous month. CITY agrees to authorize payment for all undisputed invoice amounts
within thirty (30) days of receipt of each invoice. CITY agrees to use its best efforts to
notify VENDOR of any disputed invoice amounts within ten (10) days of the receipt of
each invoice. However, CITY's failure to timely notify VENDOR of a disputed amount
shall not be deemed a waiver of CITY's right to challenge such amount.
Additionally, in the event CITY fails to pay any undisputed amounts due
VENDOR within forty-five (45) days after invoices are received by CITY, then CITY
agrees that VENDOR shall have the right to consider said default a total breach of this
Agreement and be terminated by VENDOR without liability to VENDOR upon ten (10)

I see that the Council will be reviewing Ms Petru's job performance as acting City Manager. While we have never met or
con -versed, my dealings with her have been exemplary. While she was reluctant to be considered for that position, she
would have done a stellar job. As it is, I'm delighted that she will continue in her present capacity
I have contacted her regarding several issues:
most recently the slum -like appearance of the silhouettes left standing for months along PV Drive East, constituting an
unsightly blight on the property of Mediterranea Homeowners. She got the problem resolved promptly, and they were
dismantled. She has been respon- sive on other issues, such as publicizing the names of recycle lottery winners.
I request and urge that this correspondence be made a part of the record for this hearing.
The new City Manager will benefit greatly from taking advantage of her experience. She is a distinguished public servant,
and should be compensated accordingly.

Dear Michael,
The Department of Public Works and the Traffic Safety Committee should be aware of Marymount's current application
for a new enlarged athletic field right on the curve of Palos Verdes Drive East going down towards the switchbacks past
Crest Road.
Because of the proximity of an athletic field so close to a descending curving Palos Verdes Drive East residents voiced
concerns over the hazards of errant soccer balls and lacrosse balls flying into vehicles, bicycle riders and
pedestrians. Staff decided to put up high nets around the proposed field. Our semi -rural community is home to hawks

and falcons and other precious birds, even endangered bird species, all of which was considered in the extensive EIR
study. So Staff required retractable nets be used around the soccer field to protect the wildlife.
But, there are no such nets.
Now Marymount is back to erecting permanent nets. (When residents were told of the permanent nets, they reminded
Staff that they must first obtain authority from the wildlife officials before erecting sample nets. Staff rushed to obtain
authority to do this.
The proposed athletic field is shown on the attached AERIAL02A(1).pdf. City Staff has represented to me that this is the
exact attachment that was sent by Staff with their email correspondence to the wildlife agencies February 6, 2015. (1
have asked Staff to go into their "sent" email and forward to me the exact email they sent with the attachment but to
date I have not received this.)
Enclosed is a copy of Marymount's current contract with the Palos Verdes School District showing an estimated
attendance of 250. That figure may be important when considering traffic safety and parking in our quiet residential
neighborhood.
I am not sure you were made aware of these important issues but it seems to me that both your department and the
Traffic Safety Committee should be aware of concerns by the residents living around Marymount when studying the City
Council's 2014 Goal No. 2 Public Infrastructure.
The athletic field is not safe in that location — not safe for people nor birds.
Residents have urged City Staff to enforce Marymount's enrollment cap. If Marymount complied with its Enrollment
Cap then there would not be a parking problem. However, we'd still have to deal with the enlarged athletic field.

I have read your report included in the City Council Agenda (link below).
Your recommendation to the City Council is to consider:
1) The Traffic Safety Committee's recommendation to not establish parking restrictions on Palos Verdes Drive East
near Marymount California University, and
2) Provide direction to staff.
Over 25 years ago Marymount's enrollment was capped at 793. Last year, Staff admitted to the City Council
that there was a discrepancy regarding enrollment. The City Attorney has consistently opined that in cases
where there is a discrepancy then the stricter shall apply.
1 am sorry but you and your office are being USED.
There is an ELEPHANT in the room. The ELEPHANT is Marymount's ENROLLMENT. Their increased
ENROLLMENT is a violation of their Conditional Use Permit. This must be resolved first before anything else
is considered and Staff knows that.
It makes me and other residents real mad that you and your good office are being sucked into this zoo.

Restricted Parking: (1) Northbound Parking lane along Marymount California
University (MCU) road frontage on Palos Verdes Drive East (PVDE).
Recommendation: Restrict parking with time limited hours and days of week,
similar to the successful on -street parking in the neighborhoods around Palos Verdes
High School. Not Red -Curbing.
Rationale: Marymount officials promised the Community that their approval of
entitlements in 2010 would eliminate student on -street parking. Since that time, such
parking on -street by students has continued despite the addition of the full 463 space
parking capacity granted by those entitlements. Marymount officials have accepted
parking restrictions by RPV in this frontage area, including Red Curbing, which is
not recommended here.
Justification: Despite persistent attempts by RPV (See November 3, 2014 RPV
Letter to Dr. Brophy), implementation of various Parking Management programs
have not achieved MCU's promised elimination of student on -street parking,
specifically by application of various measures as provided by Mitigation Measure
TR -5.

Restricted Parking: (2) Northbound Parking lane along PVDE past San Ramon
Drive.
Recommendation: None, N/A. Former Parking lane no longer available after PVDE
re -striping this area; now a continuing Traffic and Right Turn Lane into Carina
Drive. At least one NEW Sign is still needed that warns right Lane Traffic to Merge
left because of that lane ending in a right turn lane only.
Restricted Parking: (3) Southbound Parking lane along Palos Verdes Drive East
(PVDE) before Crest Road.

prior to Crest Road. Parking in this location typically inconvenient/unused by
Marymount students; Primarily used by residents. Restricted Parking not
Recommended.

Recommendation: None, no restrictions: Neighbors have raised valid concerns.
Restricted Parking: (5) Crest Road going Downhill toward the stoplight intersection
at PVDE.
Recommendation: Red Curb: Alternate is Time Limited parking signage. This is an
area often utilized for on -street parking by Marymount students.
Restricted Parking: (6) PVDE from Crest Road intersection to Casalina Drive.
Recommendation: None, N/A. Former Parking lane no longer available after PVDE
re -striping this area; now a continuing Traffic and Right Turn Lane into Casalina
Drive.

Correction to Item #4 Staff Report
I noticed an error in my Volunteers on Patrol staff report (Item #4) on next Tuesday's agenda. I incorrectly stated in the
report that two residents (Bill James and Dave Tomblin) addressed the City Council about increased crime in the
community on December 2, 2014. The correct meeting date was December 16th. I sincerely apologize for the error.
