MISSION Our mission is to nurture an interest and appreciation of our local history, its land and its people by collecting and preserving archaelogical, cultural, and historical artifacts. GOAL Our goal is to establish an outstanding local museum in which to display historic documents and archaelogical and cultural artifacts with an emphasis on continuing education for an on-going and lasting experience for future generations. From a Mammoth tusk to Native American artifacts to the original Vanderlip models, the Historical Society is a guardian of treasured Palos Verdes artifacts. It was to be a copy of the home of Pope Julius III, just outside of Rome, but 90% of the size, so as not to offend the Pope. In 1914, he commissioned two detailed plaster models from a master craftsman in Paris. The model shown above, of the design for his home, and its companion depicting the planned artisan colony, are just two of the many treasures being preserved by the Palos Verdes Historical Society. In September of 2014, it acquired the collection of artifacts of the original museum, which had lost its home in the Malaga Cove School Tower in 2006. Southern California Gas Company (SoCalGas®) is upgrading its system by adding an Advanced Meter communication device to all residential and most business natural gas meters. The Advanced Meter will read and transmit customer natural gas usage to SoCalGas. However, until our communications network is fully operational, SoCalGas will continue to require access to manually read the meter for a few more months. The Advanced Meter, which will be installed on the existing analog meter, is battery -powered and turns on for only a fraction of a second each day — for a total of less than two minutes per year. Advanced Meters cannot turn customer gas service on or off. Advanced Meters provide customers with the opportunity to view their gas usage online by visiting My Account at socalgas.com or take it on the go through SoCalGas Mobile App (To find out more, visit socalgas.com/innovation/mobile-app/). Customers can use this information to manage energy consumption and to potentially reduce monthly costs. SoCalGas is scheduled to install the Advanced Meter on approximately 6 million natural gas meters through 2017. What if I don't want an Advanced Meter? SoCalGas recognizes that some customers prefer to continue to have their natural gas meter read manually each month. An Advanced Meter Opt -Out Program has been established for residential customers who do not want an Advanced Meter installed. I received feedback from multiple Council members and hope that our updated proposed list of agencies will be agreeable to the Council, including reanalysis of various factors, putting modified weight on certain factors (such as services provided, contract city, number of employees, budgets), and including additional cities suggested by some of you. We looked at multiple different scenarios and calculations. What stands out to me most, and this is not uncommon, is that the majority of cities on the attached list (about 7-8 of them) rose to the top in every scenario. I think that it will mostly be a matter of agreeing as to the remaining 2-3 slots, considering that, in the end, we will look at the median derived from all of the cities surveyed. In my experience, the median is typically not affected hugely by one or two data points. I think that the attached list is a solid list of comparators and I look forward to the Council's additional input and discussion this evening. Thank you and best regards, Georg S Solving the Hurrian Resources PUZZle for 30 Years To: City of Rancho Palos Verdes Council Members From: Georg Krammer, Project Manager Subject: Proposed Comparator Agencies Date: November 3, 2014 Koff & Associates has been retained to conduct a total compensation study for the City of Rancho Palos Verdes. We were tasked to identify ten comparator agencies to be used for this study. We have completed our analysis of potential comparators (a total of 34 analyzed) based on the following factors: Organizational type and structure — We generally recommend that agencies of a similar size, providing similar services to that of Rancho Palos Verdes be used as comparators. Typically, we start by identifying agencies with a similar size and services and that are competing with Rancho Palos Verdes over the labor pool within the geographic vicinity. When it is difficult to find agencies that are similarly sized, it is important to get a good balance of smaller and larger agencies. When it comes to classes such as administrative and technical classes, the size of an organization is not as critical as these classes perform fairly similar work. The difference in size of an organization becomes more important when comparing classes at the management level. The scope of work and responsibility for management becomes much larger as an organization grows. Factors such as management of a large staff, consequence of error, the political nature of the job, and its visibility all grow with larger organizations. 2. Similarity of population, staff, and operational budgets — These elements provide guidelines in relation to resources required (staff and funding) and available for the provision of services. 3. Scope of services provided and geographic location — Organizations providing the same services are ideal for comparators and most comparator agencies included in the analysis provide similar services to Rancho Palos Verdes. We tracked all services provided. However we placed emphasis on, and analyzed as an additional factor, whether the agency is a contract city or not. 4. Labor market — In the reality that is today's labor market, many agencies are in competition for the same pool of qualified employees. No longer do individuals necessarily live in the communities they serve. The geographic labor market area, where Rancho Palos Verdes may be recruiting from or losing employees to, was taken into consideration when selecting comparator organizations. In order to identify a sufficient number of like -sized cities with similar service provision, we also considered, and analyzed, cities that are not in the immediate commuting radius of Rancho Palos Verdes Koff & Associates Page 1 5 Solving the NU rnan ReSOUrces PUZZle for 30 Years The comparator agency analysis includes specific data for each proposed agency: Services Provided; Contract City (we analyzed whether each city provides fire, police, water/wastewater, transportation, and/or library services, or not); Geographic Location (distance from Rancho Palos Verdes); Total Number of Full -Time Equivalent Employees (FTE); Total Expenditures and Total Expenditures to FTE Ratio (shown in $1,000's); Population Served and Population Served to FTE Ratio (shown per 1,000); % Above/Below U.S. Cost of Living Average; and Median Household Income. There is one worksheet for each data factor and all factors were considered in our final analysis. The exception is Median Home Sales Price because we are using a factor for the overall cost of living in each area that captures this component and, therefore, including it would weight the factor of cost of living too heavily. We did include Median Household Income as one of the factors in our final analysis. As part of the City Council's feedback, we heard that Rancho Palos Verdes' community consists of some blue collar neighborhoods and the City has some low-income housing. Therefore, Median Household Income was an important factor to consider in identifying similar communities. The Rank column shows each comparator agency's ranking compared to Rancho Palos Verdes. The lower the value of the ranking, the more comparable the agency is to Rancho Palos Verdes for that particular factor. For Services Provided and Contract City (yes/no), we allocated points based on whether the potential comparator city had each of the same services as Rancho Palos Verdes or not, and whether they contracted out any or all of the five types of services identified above (fire, police, water/wastewater, transportation, and/or library services). We then ranked each city compared to Rancho Palos Verdes based on the total number of points. Per the City Council's feedback, we placed additional weight on services provided by breaking apart overall service as one factor and then adding contract city (yes/no) as a separate factor to increase the importance of services provided in our analysis. In addition, to place more weight on factors such as number of employees (FTE) and agency financials, we included FTE as a factor by itself, agency financials (expenditures) by itself, as well as, the FTE to expenditures ratio as a third factor. In addition, we analyzed the FTE to population served ratio, i.e., this is another factor that considers FTE. Each ranking is based on the absolute value difference between the agency on each factor and Rancho Palos Verdes regardless of whether the agency is higher or lower for that factor. For example, an agency that has 20 fewer FTE compared to Rancho Palos Verdes will rank lower than an agency with 30 more FTE compared to Rancho Palos Verdes. The Recommended Agencies worksheet represents a summary of the ranking for each data factor. The overall rank is equal to the sum of the rank of the data factors. Based on our analysis of the data categories and ranking of each potential comparator agency, we recommend the following ten (10) agencies to be included in the compensation study: 1. This will enable more individuals to enjoy Abalone Cove for a shorter time. $10 for a day at this particularly special beach is not, in my view, excessive or unreasonable. $10 for a 1 or 2 hour walk along the shoreline or hike along the bluffs is excessive. With an automatic pay system, it should be relatively easy to manage an hourly fee structure. 2) Exempt PVPLC volunteers doing volunteer work, such as monitoring for the KEEPER program and patrolling for the Volunteer Trail Watch. I am writing in regards to letter my father had written you in July of this year (see attachment). As you may be aware, my family has been in an ongoing dispute with the Hessers, the neighbors situated to our north at 29023 Sprucegrove Drive, since February 2014 (this year). It is now in October and a resolution does not appear to be forthcoming. I became involved in the matter in August of this year. Admittedly, when I first heard the circumstances, I was weary in accepting it all as true given the emotional state my parents were in and the look of despair gleaming from their faces. As any son would, I had no choice but to interject and attempt to understand why and how my parents have come to this state of despair. After reviewing the address and project file, reviewing correspondence between the Planning Department and my family, researching applicable Municipal Code sections, and a significant amount of time and money, I realized that everything my father had said was entirely accurate. The story my parents told me is the same story they continued to tell to the Planning Department pleading for them to listen. But to no avail, time and time again, their concerns, issues, and pleas for help were ignored, disregarded, and swept under the rug. What we were initially concerned about was preserving the pristine view that brought us to this city in the first place. Our view was the primary reason we chose to move to Rancho Palos Verdes. For more than 20 years, as my father indicated, we have lived in our RPV home and enjoyed the Malibu and ocean view. This was possible because, when our property was purchased, we constructed a view -preserving 4'0" white lattice fence that extended from the front building fagade to the rear building fagade along the property line between our home and the Hessers. At the rear building fagade, we constructed a 3'9" chain link fence that tapered as is neared the rear yard slope. Now, some 20 years later, for reasons unknown and incomprehensible, our neighbors are seeking to destroy the very thing that makes Rancho Palos Verdes one of the most desirable cities in the country by erecting a 6'0" fence. 0 a. Not only is the process by which the Planning Department undertook a major issue of this dispute, but is also a reason by which the Planning Department is responsible for both the removal of our pre existing white -lattice fence, damage to our property as a result of non -permitted, non -investigated grading, as well as handing the Hessers a portion of our upper pad elevation which my family, as well as the Hessers, believed was ours prior to this dispute. What took months to uncover would be nearly impossible to explain in a simple email, or 3 minutes given at a hearing. While some may believe that this fence dispute is relatively insignificant, to my family and I, this is our home and has been our home for over 20 years. I imagine that every RPV resident would feel the same if they were in the situation we have been in. Throughout this process, we have seen a great show of support, both from our friends and the community. They are in disbelief just as much as we are as evidenced by numerous letters drafted by RPV residence in support of our position. At the end of the day, Mr. Duhovic, we are a family that has been treated unfairly, unjustly, and in a manner in opposite to what our city stands for. The planning department could not solve a simple problem which is crystal clear when it come to the fence/wall permit. Our property is located on the upper pad elevation of a 3ft plus pad difference, which now our neighbor has compromised by his altering of the wall. An approval has been granted to our neighbor, which was granted based on fraudulent information which the city is aware of. This has been going on since January to now. Unfortunately, the planning department has a selective standard for different individuals. The approval the city agreed to was based on the measurements of the lowest part of the wall, which is where he made the alterations. The city has come out on numerous occasions, and on one of these visits Ms. So Kim, a representative from the city, stated she could not make the measurements from Mr.Hesser's side of the wall because the integrity of the wall had been compromised. I am wondering how the city can make this decision, and allow my neighbor to build an 8 foot fence that will obstruct the ocean view I have paid millions for. My family and I have lived in the RPV community since 1990, and the ocean view was one of the reasons I bought this house. I am asking to you to please make sure to thoroughly investigate this situation so we can finally get to the bottom of it. Our civil rights have been violated by the planning department of the city of Rancho Palos Verdes. They are bias, and have harassed us for the last 7 to 8 months in regards to an after the fact permit for a deck that was built, now about 2 years ago. My wife and I went to the city for help to obtain the after the fact permit due to a threat we received by Mr. Hesser, our neighbor. We were told by Leza Mikhail to draw up a plan, submit it, and there should not be a problem. Mr. Hesser at this point had not filed a formal complaint. He had only threatened to do so. Mr. Hesser had now torn down our 4ft lattice and chain link combination fence that had existed for 20 years. He had already put up about 5 to 6, 8ft concrete columns, and put up a solid wood panel in between. We came home from work and saw this and were in shock. We then spoke with Mr. Hesser and told him this was not acceptable. The next day we went to the city and spoke with Leza Mikhail, who directed us to the code enforcement department. We spoke with enforcement, Mrs. Julie Peterson, to find out our rights. We explained our situation and showed her photos. We wanted to know what type of fence, if any, would be legal. At this time Mrs. Peterson said, that due to the height in the pad elevation the difference between Mr. Hesser's property. and ours, he would not be allowed to put any type of fence. If there were to be a fence it would be our choice because we were the property on the higher pad. We then asked Mrs. Peterson to please take a drive by our property which she agreed to. Mrs. Peterson after verifying the pad elevation difference told Mr. Hesser that he could not build any fence on the upper pad property, and the columns needed to be taken down, which he did. Then Mr. Hesser went to the city and put in a complaint about our deck (that had existed for about a year at this point in time). Mrs. Peterson at this time was trying to help us get our deck permitted, and solve the whole current situation. When we went back to the city to review the plans that the planning department requested, we wanted to talk to Mrs. Peterson about a couple issues we had been having with Mr. Hesser. When we tried to talk to her she put her hand up, and rudely said to go to the planning department. Her whole attitude from that point on has completely changed. We decided to return to the city to place a formal complaint against Mr. Hesser and all of the illegal construction he has done, Mrs. Peterson now told us to contact the police and no longer wanted to take our complaints. We followed Mrs. Peterson's advice to contact the police. When the police came to our house, they indicated that we needed to contact the city, which should help us rectify the situation. When we tried to go back to the city we were given the run around, and not welcomed. Originally when we purchased our home in 1990 there was no fence. Five years later we purchased a dog, and put up the 4ft combination lattice and chain link fence to keep him in the yard. Our property 29029 Spucegrove Dr. is the property that is located on the highest upper pad elevation of all the properties on 0 Sprucegrove Drive. With each property differentiating 3ft to 4ft in pad elevation difference all the way down the street. We purchased our home for $412,000 in 1990, and were charged $580,000 in property taxes. We appealed the increase, but were declined and told by the state board that houses sold for $412,000 had no views and yours has a 180 degree view. The stated that we should be happy and we got a good deal. If this fence is built, we will be robbed of $250,000 because this is the current market value for a 180 degree view. It would have to be an extreme invasion of privacy, which is being claimed by Mr. & Mrs. Hesser, to be worth $250,000. When Mr. Hesser purchased his home 7 to 8 years ago, he saw there was no solid fence on either side of his property. What he was purchasing was an old house built in the 50's or 60's that needed to be completely remolded. Mr. Hesser has renovated his house from top to bottom including moving his kitchen from one side to the other, the creation of a pond, and installation of a gas line, moving his electrical panel, raising the elevation of the property level, and much more. We assume all of this was done without any permits, which we have brought to the attention of Mrs. So Kim. Mr. Hesser put up a solid 8ft fence on the other side of is house adjacent to his other neighbor. The 8 ft. fence is illegal, and he is now attempting to put one on our side of the property. This huge fence makes us feel like we are being put in jail in our own home. Mr. Hesser is a teacher, and house flipper on the side, who will eventually sell his home when the market goes up. Once he is gone the problems with all of the unpermitted renovations both inside and out will be left to us and the future homeowner. In regards to our deck, we have complied with every request that has been asked of us. Leza Mikhail, our city planner, came out on two separate occasions always saying that something else is needed, and always one shade lighter than her expectations. We have incurred heavy penalties that were not deserved due to the fact that originally we were told we would not need a permit since 161 the majority of the deck was on a flat surface. The city officials have abused their power and empowered Mr. Hesser's aggression by wishy washy decisions made by the city planning department. We are continually harassed by Mr. Hesser, and videotaped by Mrs. Hesser when we are at home. That is what you call invasion of privacy. In our opinion the planning department is unprofessional, untrustable, and unhonorable. We say this because of the numerous visits and inconsistency in their decision in regards to Mr. Hesser's fence. The first visit was from Mrs. Julie Peterson, who stated due to the pad elevation Mr. Hesser is not allowed to build any type of fence. In the second visit Mrs. So Kim said Mr. Hesser could build up to an eight foot fence on the lower pad elevation with no permit. Therefore it would have made it about 5 feet from our property prior to the alteration of his property. He altered the elevation of the wall between our properties by pouring 5 inches of concrete with a 1 inch base, plus whatever was needed for the new drainage he installed therefore increasing the elevation of his property. He also lowered the height of the wall from the top making the difference between our property pads less than 2 feet at certain points. Ms. Kim came one additional time claiming that this was the final decision of the city. She put yellow tape indicating how high the fence could be. It was about 3 feet 9 inches and gradually got lower to about 3 feet as it got closer to the end of the property to prevent our view from being obstructed. The measurements she took for this final line were from our side of the fence because the integrity of the wall on Mr. Hesser's side no longer existed per Ms. Kim. After we thought everything was finalized we received a call from Mrs. So Kim stating she would like to come by the house with Mr. Joel Rojas, her director. We weren't sure of the reasoning behind their visit, but agreed. We were not happy with the decision that Ms. So Kim made at this point because she allowed Mr. Hesser to build a solid fence. All of the city codes that we read required the fence be 80% 0 breathable, and this fence was obviously solid. Although we were unhappy we decided to move forward and put this fence situation behind us. With the fence taken care of we decided to tackle the deck situation, and contacted Joel Rojas. When we contacted Mr. Rojas, he said that we would schedule a meeting. We met with Mr. Rojas, Leza Mikhail, Eduardo, and we brought our contractor Mike to discuss the deck and what the holdup was. We had complied with all of the requests and required documentation that Leza Mikhail asked for and paid all the associated penalties. In this meeting the fence was brought up and Mr. Rojas assured us that our view would not be compromised. Even with the evidence of fraud we have brought to the city's attention including the manipulation and altering of the side wall, the alteration of the elevation of his property accompanied by the damages that have occurred to our property by Mr. Hesser, the city has done nothing to help us. Our issues have been ignored and disregarded, with no investigation. Instead Mr. Hesser has rewarded with a permit to build a solid 8 foot fence impairing our view and devaluing our property. Our deck still is being scrutinized, and we don't have a definite answer on when it will be resolved despite the plans being stamped by engineer and the payment of the penalties associated with the deck. This deck doesn't obstruct any view or interfere with anyone's property while it still being put on hold with one step forward two steps back. We are seeking a thorough investigation from the highest authority in the city's organization to revoke any permit that has been issued to Mr. Hesser. We may seek damages in regards to the devaluation of our home. As a result, the Association has only monitored the process that the Council has undertaken up to this point and has not provided input of any kind. The Association reiterated this in an email sent to Council on October 7, 2014, after questions arose about the Association's involvement at the September 30, 2014 City Council meeting. The Association appreciates the hiring of an independent third party firm and takes no issue with the selection of Koff and Associates as the independent third party firm to conduct the council initiated class and compensation study, as long as this study does not cause additional undue delay in the negotiations process. Further, the Association understands that, because Koff and Associates is an expert firm with years of experience, they were tasked with developing a draft list of comparator cities to use in the study. The draft list was presented to the City Council on September 30th. This was the first time the association saw any list of cities, and it appears that it was the first time the City Council saw the list too. Although the Association appreciates the opportunity to now provide input on the comparator cities (as directed by the City Council on October 21st), the Association holds that any manipulation of the criteria or weighting of the list by any party that would change the firm's recommended list would defeat the purpose of hiring an independent third party subject expert to conduct the study and could be construed as inappropriately affecting the outcome of the study.
