This is the first West Nile virus (WNV) update and public health advisory for 2014 for all cities and unincorporated county areas within the Los Angeles County West Vector & Vector -Borne Disease Control District. New WNV Positive Indicators inside the District's Boundaries (7-21-14 thru 7-27-14): (WNV indicators are positive dead birds, sentinel chickens, mosquitoes, or squirrels) LA City: DB (1): Zip 90045 Rancho Palos Verdes: DB (1): Zip 90275 Types of Positives: (DB) Dead Bird(s): This is a dead bird tested for West Nile virus (WNV) (MP) Mosquito Pool(s): This is a group of trapped adult mosquitoes tested for WNV (SC) Sentinel Chicken(s): This is the testing of chickens housed in sentinel chicken flock coops located throughout the District designed to monitor WNV activity (DS) Dead Squirrel(s): This is a dead squirrel tested for WNV How do WNV infections occur: Mosquitoes become infected when they first bite an infected bird and then transfer the virus to other birds and humans as they bite again. A wide variety of wild birds, including the American crow, are the reservoir for West Nile virus. Most mosquitoes do not carry the virus and most people bitten by a mosquito are not exposed to the virus. The virus is not spread through person-to-person contact, or directly from birds to humans. In most cases, people who are infected with West Nile virus never become sick, or have only very mild symptoms that include fever, headache, nausea, bodv aches, and a mild skin rash. Symptoms of WNV could appear within 3 to 12 days after infection. Fewer than 1 in 150 people who are bitten by an infected mosquito become severely ill, according to the Centers for Disease Control and Prevention (CDC). The elderly and those with weakened immune systems are most at risk for developing severe symptoms, which may require hospitalization. There is no specific treatment for this disease. Page 2 Positive Dead Birds: WNV is endemic (constantly present) throughout Los Angeles County, California and the United States. With respect to positive indicators (dead birds, sentinels chicken flocks, mosquitoes, and dead squirrels), dead birds are the least reliable with respect to where the birds were actually infected. This is due to the fact that 90-95% of all dead birds that are positive for WNV are American crows which have extensive daily travel patterns. American crows routinely travel as many as 10-20 miles each day from their nighttime nesting and roosting locations to feed and scavenger before returning to their original location in the evening. Infected mosquitoes bite the birds in the evening and at night as they roost and sleep. Because of these daily flight and roosting patterns, American crows may travel and die as far as 20 miles away from the location where they were actually bitten and infected by a mosquito. This is particularly true the last two years as the crows have been travelling further west to the coastal cities during the days to escape the hotter inland temperatures to the east. Positive American crows collected in a specific area are significant only with respect to trends on a more regional or countywide basis. It does not indicate that a specific zip code, city, or location was the site where the actual mosquito bite and infection occurred because of the bird's extended daily travel patterns. However, positive results for mosquito pools and sentinel chicken flocks are very specific with respect to the locations where positive mosquitoes exist and can transmit disease since the locations of the traps and chickens are fixed. How to decrease your risk of infection: 1. DEET & other repellents: Apply insect repellent according to the label. Repellents containing DEET, picaradin, IR3535, and oil of lemon eucalyptus are the longest lasting and most effective. Repellents keep the mosquitoes from biting you. 2. DAWN AND DUSK: Mosquitoes that carry WNV primarily bite in the early morning and evening so it is important to wear repellent at this time. 3. MOSQUITO PROOF YOUR HOME: Make sure that your doors and windows have tight -fitting screens to keep out mosquitoes. Repair or replace screens with tears or holes. 4. DRAIN STANDING WATER: Mosquitoes lay their eggs on standing water. Eliminate all sources of standing water on your property, including flowerpots, old car tires, rain gutters and pet bowls. Ensure that swimming pools, spas, and ponds are properly maintained. 5. INOPERATIVE POOLS AND SPAS: If your pool or spa is inoperative and still has any amount of water in it, the District will treat or plant mosquito fish in it at no cost. This service is confidential. You can call for service or make arrangements to pick up free mosquito fish at the District by calling 310-915-7370. Page Reporting & Picking Up Dead Birds: 1-877-WNV BIRD (1-877-968-2473): The public is encouraged to report dead birds to help with West Nile virus surveillance and control efforts. Dead birds should be reported to the toll-free hotline number at 1-877-WNV BIRD (1-877-968- 2473). Dead birds must be less than 24 hours old to be tested for West Nile virus. If the bird is rigid or decomposed, it cannot be used for testing. Disposal of Dead Birds: General Disposal: For birds that are too old, determined not to be in a condition to accurately test, or outside of the testing cycle, they can be disposed of in your normal weekly trash pickup by taking the following steps: 1) Take a plastic garbage bag and inserting your hand in the open end; 2) Grab the dead bird and pull it into the garbage bag using an "outside -to -inside" pulling motion; 3) Tie off the bag with the bird inside and place it in your regular trash for disposal. District: Please note that the District does not pick up or disposed of dead birds that are not collected for testing. Symptoms of West Nile Virus: People infected with WNV can experience a variety of symptoms that may include: no symptoms, West Nile Fever, or West Nile Neuroinvasive disease. Symptoms usually occur 3-12 days after infection. If you suspect you have contracted WNV, consult your physician for testing and care. My comments about the height of a flagpole in the Coastal Zone should in no way be construed to mean that I am not proud to see the American flag displayed where and when it is appropriate and consistent with the federal laws regarding the American flag. I do find it disturbing that I would even have to say this in my letter to you but there are clearly strong emotions about this subject and comments have been made about unpatriotic leanings, etc. The proposed amendment to the LCP should be of concern to the city council on two levels: consistency in the application of the code and issues concerning flag display. Consistency a. The City Council and Planning Commission have applied RPV codes in different ways depending on the circumstances.. How can I resident be expected to understand all the RPV rules if there is inconsistency in the application of the rules. All residents and businesses should be held to the same rules. b. The new General Plan has not been approved. There are a myriad of plans for the coastal area and it is almost impossible to look at all of them to ensure one plan is consistent with another. Short of becoming an expert myself, the Community Development is the keeper and interpreter of this knowledge. Over the years there has been turnover in this department and some plans are changed on a piecemeal basis. With so many plans to consider in making a decision about the flag pole issue and to ensure that all plans are in agreement, can the city council confidently make a good decision about a small fragment of the LCP without having full knowledge of the impacts on other aspects of our coastal plans? Trump Flag a. If the city council sends this to the Planning Commission for language amendments, will the council ensure that a resident can make comments when it is sent back to the council, without paying a $2000 fee to appeal the PC decision? a b. Will or can the city council require that only the American flag be displayed on the city flagpole? Can Trump fly any flag of his choosing? 20 years from now, can a flag of another country be flown? There are constitutional considerations that should be reviewed before a decision is made. c. As a resident, what protection am I afforded to prevent the proliferation of 70 -foot flagpoles along the coast. Can the city erect flagpoles at each fence post in Abalone Cove, or elsewhere along the coast? d. Since the code amendment applies to property owned or dedicated to the City of RPV, the City has responsibility to raise the flag, to lower the flag, to replace the flag when necessary, and to ensure that all federal laws pertaining to the proper display of the American flag are followed. Has the City budgeted money for these requirements? Who is going to be responsible for these requirements? It is clear to me the city must accept these responsibilities for all flags displayed in the city, and allowing an outside party such as Trump to control these very important obligations is abdicating the city's responsibilities. e. Who decided that the Trump flagpole was a "landmark focal point"? Was this decision made during the construction of Ocean Trails, which would make it a preplanned and carefully considered decision to our LCP? Or was the inclusion of the Trump flagpole made after he illegally constructed a 70 -foot flagpole? The latter could leave the impression that the city made accommodations to a private developer. The most logical focal point along our coast is Lower Point Vicente. This is city -owned property; is the home of the world -renown Point Vicente Interpretive Center; and is adjacent to the Point Vicente Lighthouse, a federal landmark. A flagpole already exists at PVIC. Lastly, require Trump to lower his flagpole to the normal code height and make no changes to the Local Coastal Plan. Conclusion The City Council has the opportunity to be proactive in determining how our precious coastline is used and the statement our city wants to make to the public. I thought it had done just that by developing plans for coastal use. I think it is a grave mistake to make changes to our Coastal Plans in order to accommodate an illegal action of one person/business. Our Plans are for all the residents of our city not just one. Our immediate prior City Manager perhaps lark the finesse to keep people as updated on the positive as she could have, but time and again her decisions were proven to be effective and in the best interests of the City_ Unless and until the community and Council begin to realize the interrelatedness of staff retention, knowledge, and morale, then my tax dollars will not be spent wisely as new people are constantly having to be trained to replace those that lease for greener pastures. This item should be continued until the City can disclose and illustrate which deed restrictions are on which property parcels at Upper Point Vicente ( including boundary lines) and until the Council has all the facts. Also, no alternative sites are identified, although "SPV has indicated that they are willing to discuss alternate locations both at Point Vicente Park and at other locations in the City." (pg. 5-5) Why aren't these details provided now? Question: Why is Fig. C pg. 5-6 and 5-30 labeled "existing active recreation area" even though the Program of Utilization only refers to it as a "potential" active recreation area. Likewise the RPV General Plan Land Use Map does not indicate that area as "active recreation". The Staff Report illustrations do not show which land at Upper Point Vicente Park is owned by the City "in fee", which land is still owned by the Federal Government [Coast Guard] and which land is burdened by the deed restrictions which are monitored by the National Park Service. Without that illustration, the Staff should not recommend changes. Another missing detail is comments from the National Park Service about this land swap. On Fig. C and D. I see yellow lines, red lines, blue shading, green shading, but no legend. Transparency/ accuracy: The Task Force Strategic Parks Master Plan was presented to the City Council in 2004 after volunteers and city staff worked for two years on it. No vote on it was taken by the then City Council. STAFF Recommendation on June 29, 2004: "Approve the Parks, Recreation and Open Space Strategic Plan submitted by the Open Space Planning, and Recreation & Parks Task Force to be used as a guiding document for the future of recreation and open space in Rancho Palos Verdes." All the discussion was about the NCCP and the Reserves. There was no motion on the staff recommendation, therefore No Vote was taken. The current Staff Report says "the Task Force's recommendations, which were included in a Draft Strategic Parks Master Plan, were not adopted by Council." The phrase "were not adopted" makes it sound like action was taken and the recommendations were rejected which is not true. There was no CC action taken as there was no motion and no vote on the Task Force recommendations. Here we are ten years later. It does not appear to me that the proposed location (pg. 5-16) is the existing lawn area "between the existing tennis court and the main City Hall parking lot." It appears to be the area between the tennis courts and the access road to/from Hawthorne Blvd. eastward from the tennis courts. The text should correspond with the illustrations. This recommendation is putting the cart before the horse. All the City's plans and zonings and related ordinances must be consistent with the 1975 General Plan Land Use Map. It is still the primary guide for all land use decisions, and it conforms to Deed Restrictions of the National Park Service and other state and federal agencies. As you know, the Recreation Staff has been directed to investigate the "feasibility of allowing a privately funded skate park," as requested by the Board of Directors of SPV, "to be constructed at the City's Civic Center." Because this area is owned in fee by Rancho Palos Verdes, the Deed Restrictions of the National Park Service do not apply. The General Plan Land Use Map designates the Civic Center for public use and active recreation. It is the City Council that determines the suitability of various proposals. It is the only area on Upper Point Vicente where a skate park may be allowed. On December 6, 1979, the Department of the Interior recorded Quitclaim Deed Number 79-1370945. This Deed grants a major portion of Upper Point Vicente to Rancho Palos Verdes free of charge. The Deed requires that the land be used by the general public in perpetuity as passive open space. No active recreation is to be permitted. Picnic areas and trails are mentioned as desirable uses. As time goes by, native plants could be added to enhance the landscape. If, after reviewing the results of the Staff's investigation, the City Council decides that the Civic Center is a good location for a skate park, the skate park might become an economic and social asset for the City. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES UNANIMOUSLY DECLARING AN EMERGENCY IN CONNECTION WITH THE PLACEMENT OF A MEASURE THAT DECREASES THE RATE OF THE CITY'S UTILITY USER TAX AND MODERNIZES THE TAX ON THE BALLOT FOR THE NOVEMBER 4, 2014 ELECTION WHEREAS, the City of Rancho Palos Verdes has historically operated with fiscal prudence and caution and without spending more than the amount allowed by the City's General Fund reserve policy. As a result, the City has been very fiscally responsible; and WHEREAS, in 1993, the Rancho Palos Verdes City Council adopted a utility user tax ("UUT") in the amount of 3% to provide a source of income to the City, which could not be diverted by the State of California to balance the State's budget, to fund important City services; and WHEREAS, following the adoption of Proposition 218, the City Council placed the City's UUT on the ballot for approval, and in 2004, the City's voters ratified the City's UUT at the same rate of 3%; and WHEREAS, the UUT continues to be an important source of revenue to the City to fund important public services that are funded by revenues in the City's general fund; and WHEREAS, the City's Tax originally was imposed upon telephone services that were subject to the Federal Excise Tax ("FET"). In response to litigation, in 2006, the Internal Revenue Service issued a ruling stating that the FET does not apply to most common telephone billing plans. This invalidated the basis for the City's Tax as applied to telephone service; and WHEREAS, in response to the change in the law regarding the FET, the City of Rancho Palos Verdes amended Chapter 3.30 without voter approval to delete the reference to the FET and replaced it with other terms to cover telephone services that had been subject to the FET; and WHEREAS, since 2006, many changes have occurred with respect to telephone services that have caused the definitions in the UUT to become outdated so that some types of telephone services currently are not subject to the tax, while others are; this inequity cannot be corrected without placing revisions to the Tax on the ballot for approval by the City's voters; and WHEREAS, recently, new legal challenges and claims have been filed against other cities that did not place their amended utility user taxes on the ballot, and attorneys in those cases have claimed damages and substantial attorney's fees; and R6876-0001\1 727460v4.doc ( DI WHEREAS, on May 28, 2014, the City received a Public Records Act request from a law firm seeking records relating to the City's Utility User Tax; and WHEREAS, the City of Rancho Palos Verdes seeks to protect future revenues from its UUT from such claims and lawsuits and avoid unnecessary legal expenses and exposure; and WHEREAS, the continuous State takeaways in the last few years, including the state's recent elimination of redevelopment agencies, have resulted in significant reductions in revenues that the City intended to be used to repay the City for loans made previously to the Rancho Palos Verdes Redevelopment Agency for expenditures to address landslide damage and increase land stability within former Redevelopment Project Area No. 1; and WHEREAS, the Portuguese Bend Landslide is a large active landslide that continues to move and adversely affects public infrastructure, including Palos Verdes Drive South, a major arterial street in the City; the constant damage caused by the landslide requires constant and increased City expenditures exceeding $500,000 annually to maintain it as a viable arterial street; and WHEREAS, during the recession, the State took money monies that previously were allocated to cities to reduce the State's budget deficit, and it is expected that similar actions will occur again in the future in response to downturns in the economy; and WHEREAS, the cost to the City of complying with state and federal clean water rules continues to increase significantly each year; and WHEREAS, the City has many unfunded important infrastructure projects within the City totaling more than $28 million, including unfunded projects to improve City streets ($4.7 million), and storm drains ($9.4 million); and WHEREAS, the City of Rancho Palos Verdes seeks to maintain current levels of public safety and police services within the City, even though the cost of such services continues to increase, including the City's contribution to the County liability trust fund for law enforcement services, which the City has been notified will increase again in fiscal year 15-16; and WHEREAS, If future revenue from the UUT is lost due to legal challenges, the cost reductions the City has made to the City's Capital Improvement (infrastructure) Program in recent years in order to maintain a balanced budget will not be sufficient to avoid future cuts to services and would have a negative impact upon public safety and the character of the community in Rancho Palos Verdes; and R6876-0001 \1 72746M.doc WHEREAS, due to changes in technology the City Council wishes to update the City's UUT ordinance so that it is applied fairly and uniformly to users of gas, water, electricity and telephone services in the City and to correspondingly reduce the tax rate of the UUT from 3% to 2.75%, which will benefit the City's residents; and WHEREAS, without further action to modernize the provisions of the UUT that is based on telephone services, it is possible that someone could challenge the City's UUT on those services; any unexpected loss of utility users' tax on telephone services would have a detrimental impact on the City's budget, including future reductions to infrastructure maintenance; and WHEREAS, without Council action to place these revisions on the ballot at the earliest possible time, which is the November 4, 2014 election, there will be an unnecessary delay before the City's residents will be able to determine if the City's UUT ordinance should be modernized and if the residents' tax rate should be reduced; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES AS FOLLOWS: Section 1. This will happen again. Please do NOT even think about any other poles exceeding 16' other than Trump. We are not stuck with the Trump pole; we can compel compliance with the CCC decision and require reduction in the height of the existing pole. We should probably do that. But since more people seem to be OK with it than opposed to it, fine, let it stay but please do not allow this to become a recurring issue. Perhaps I misunderstand the language, but it would appear this proposal would allow the city or landowners to construct flagpoles of any height over 16' on any land in the coastal zone, provided the land is subsequently dedicated to the city. This seems like it is too broad and general. I do not see any language indicating that proper public notification and hearings be required before allowing any flagpole over 16 feet to be constructed, and that proper permits must be pulled before construction begins. Perhaps I have missed something. I am proud to see the American Flag properly displayed at various locations throughout our city. It is a symbol of our great country and all of those who have served it. At the same time, it is a symbol of democracy, justice, and law and order. As such, it is important that those wishing to construct flagpoles honor the laws of our country, state, and city when doing so. I urge the council to consider carefully their wording, paying great attention to possible abuses by future landowners in our city, and trying to be as specific as possible to prevent such abuses. The City Manager will be an innovative individual with excellent manage- ment and listening skills who demonstrates a collaborative, team - building style. The City Council seeks an individual who will both empower staff and ensure that accountability is maintained. The new City Manager must have the ability to evaluate current policies and procedures with a customer service focus and mindset, and the aim of improving the consistency, responsive- ness, and timeliness of City operations. Post -Retirement Health Care Saving Account — Employees contribute I % of salary into mandatory retirement healthcare savings account. The City currently contributes $55.36 per pay period into this account. This is Terranea overflow parking. All lots, including the back dirt lots, were completely full. I find no mention of the current use in the report, and believe that Council and staff need to address Terranea's much-needed use of this facility, which I understand is rented. While this may be temporary, I believe an explanation by staff of any contractual use of this land is appropriate. They are our largest income producer in the City, and their needs should be considered, as well. (pg. 5-5) Why aren't these details provided now? Question: Why is Fig. C pg. 5-6 and 5-30 labeled "existing active recreation area" even though the Program of Utilization only refers to it as a "potential" active recreation area. Likewise the RPV General Plan LAnd Use Map does not indicate that area as "active recreation". The Staff Report illustrations do not show which land at Upper Point Vicente Park is owned by the City "in fee", which land is still owned by the Federal Government [Coast Guard] and which land is burdened by the deed restrictions which are monitored by the National Park Service. Without that illustration, the Staff should not recommend changes. Another missing detail is comments from the National Park Service about this land swap. On Fig. C and D. I see yellow lines, red lines, blue shading, green shading, but no legend. Transparency/ accuracy: The Task Force Strategic Parks Master Plan was presented to the City Council in 2004 after volunteers annd city staff worked for two years on it. No vote on it was taken by the then City Council. STAFF Recommendation on June 29, 2004: "Approve the Parks, Recreation and Open Space Strategic Plan submitted by the Open Space Planning, and Recreation & Parks Task Force to be used as a guiding document for the future of recreation and open space in Rancho Palos Verdes." All the discussion was about the NCCP and the Reserves. There was no motion on the staff recommendation, therefore No Vote was taken. The current Staff Report says "the Task Force's recommendations, which were included in a Draft Strategic Parks Master Plan, were not adopted by Council." The phrase "were not adopted" makes it sound like action was taken and the recommendations were rejected which is not true. There was no CC action taken as there was no motion and no vote on the Task Force recommendations. Here we are ten years later. It does not appear to me that the proposed location (pg. 5-16) is the existing lawn area "between the existing tennis court and the main City Hall parking lot." It appears to be the area between the tennis courts and the access road to/from Hawthorne Blvd. eastward from the tennis courts. The text should correspond with the illustrations. Let's have all the precise facts presented so you, the Council, can make an informed decision. Do not take action to start a process without all the facts. I have no objection to a Skatepark - whether at Upper Pt. Vicente or at Upper Hesse Park (which already has the necessary amenties of restrooms and parking spaces) or at the McKay property at Crenshaw and Silver Spur Road ( a more central location). All sites are accessible by bus. I just want all the facts presented to the public, the Council and the PC. A really short BACKGROUND: "The City" has spent a lot of money and has consumed a lot of volunteer effort to "update" the 1984 RPV Parks Master Plan and has nothing to show for it. A previous City Council seated a Task Force to find out what people wanted on our parklands and Come up with a way to pay for the improvements. The Task Force did that. The next City Council created the PV Nature Preserve and a contract with the PVP Land Conservancy to manage "The Preserve" at taxpayer expense. "The City" has jerked around and then said "OK, walk away" to a lot of non -profits who have offered a lot more than funding a facility construction and managing a recreation program. All I have is pity for the Skate Park advocates. Unless something is changed, the RPV in house culture will bleed them dry like all the others who have come before. Unless the current City Council can agree on a new City Manager who is devoted to a "mature" City of Rancho Palos Verdes, that word "sustainability" is going to keep explaining away why We, The People, don't have a City web site with an up to date RPV Land Use Map, an up to date RPV Coastal Specific Plan, an up to date Parks Master Plan, an up to date Trails Network Plan and an up to date Municipal Code. Thus, when I see that it is an "emergency" to reduce the 3% to 2.75% you get my attention. Having read the proposed 'ordinance", I believe I understand that the "emergency" has to with the legalities of communication taxes and Proposition 218. 1 am reasonably familiar with that proposition in that I have been reminding the MR&PD for years that they are in violation and that there could be consequences. I also understand that perhaps other communities have been threatened with lawsuits but I did not read that there was any imminent action that makes this an "emergency" for RPV. The reduction of 0.25% is obviously a carrot to entice the dumb voters to vote for it but if it truly was an "emergency" I think folks who pay any attention would understand that a legal correction was required w/o attacking the basic fee. Especially those in the "tax and spend" camp. It may also be a ploy to show how fiscal conservative you are so that you can once again fool the voters including the 80% who pay it into extending the SDUF in order to cover the ever increasing costs of the Preserve. Unless there is a real and imminent threat of legal action against RPV then it seems like spending $80K on a special election is not only disingenuous but downright foolish and fiscally irresponsible. Surely, we could exhibit an intent to comply with Proposition 218 while waiting a year to put it on the ballot. will try to listen carefully to see why this is an "emergency" and why the 0.25% reduction is necessary other than as a fop or if it is just an opportunity o spend more $ on the city attorney.
