Hello Councilman Campbell,
Thanks for the invitation. I will try to be at the meeting but I may have a time conflict.
I'm also a little camera shy. I noticed "Fences, Walls, and Hedges" being an agenda item
that Mr. Rojas will speak on.
I can only encourage both of you to place lots of restrictions on front yard as well as back
yard wall building and tree planting within set back zones, as this may have prevented
our neighbor Dr. Allman from doing what he is doing to block our view.
Dr. Allman saved his healthiest, most vigorous 12 foot sapling to plant right in right in
front of my parent's most prized Queen's Necklace ocean view yesterday. I will have
additional photos when the sun comes out again.
My contention is still that either the wall must go or the trees must go. And Mr. Rojas
has the power to enforce the removal of the wall.

Mr. Rojas,
Yesterday was the last business day of the week that you and Daniel could have stopped
Dr. Allman with a stop work order. Today is Friday, and guess what? Here is a picture
of Dr. Allman personally planting a very large pepper tree right in our Queen's necklace
view in front of Dr. Poxin's home, as I am writing this email at 11:30 am.
There is no reason Daniel or Julie couldn't have approached Dr. Allman yesterday
regarding the grading issue, the wall issue, and the tree issue.
As you can see from the photos, the trees, (and there are many of them), are already
perhaps 12 feet high or more and will rather quickly approach a 16 foot height or more.
These trees will have to be cut down before I consent to any legalization of the wall that
the city may be contemplating. It needs to be a condition of any legalization of the wall
that these trees be cut down and that no large trees be plantable behind this wall.
Please notify my mom and dad at 5319 Bayridge and me via email of any action you are
considering before your actions become final.
Although I just had a very polite conversation with Commissioner Gerstner regarding his
own home improvement project, which you are in the process of approving next door to
Dr. Allman, I must say, that all planning on this street needs to be put on hold until this
tree planting and illegal wall issue is addressed by the city. It is hard for me to believe
that the City has been allowing this to occur, with the commissioner living right on the
street, and is a construction project manager, and Architect by profession. Enough is
enough.
You can count on me voicing my objections at the Nov. 27 hearing and having this tree
encroachment issue addressed first and foremost.

I'd like to clarify that while our Code Enforcement staff explained the code requirements for
grading to you at the counter, we have yet to confirm any violations as we are in the process of
scheduling an inspection of the site. Once our code enforcement staff goes out there and
confirms that unpermitted work has been preformed, Dr. Allman will be instructed to either restore
the site or obtain the necessary city approvals to allow the wall and grading to remain. If the
improvements are within the private street easement he must also obtain the permission of all the
easement holders for the improvements to remain. I should note that while you spoke to Code
Enforcement Officer Daniel Pitts about this issue at the counter, he has relayed the information to
Code Enforcement officer Julie Peterson who will be handling this case. Please feel free to

I am grateful Dr. Allman did not plant his trees today. I am hoping he is waiting to
discuss this further before planting.
Your staff is saying Dr. Allman has done unpermitted grading into our hillside and
erected the unpermitted 4 to 5 foot high wall on the hillside, whereas only 2 feet 11
inches is allowed in a front yard. Additionally, he did this without signatures from the
easement holders. To the extent that the unapproved wall, which is too high, would be
retaining and supporting the earth of the waiting pepper trees, this really does appear to
be a city planning matter and not a civil matter involving only encroachment of foliage.
It is also an opportunity to discuss the type of foliage to be planted, if any, and make this
a condition of any post -construction permit approval. No tall trees are really desirable to
have at this location in the first place.
I am a little concerned that this wall is only a part of a larger puzzle in this neighborhood
involving also Dr. Allman's objections to Commissioner Gerstner's home improvements
next door to him. Getting these approved in an unbiased way with the other committee
members while also restraining the wall building and tree planting, may be a tall order.

concerns with various staff members. I understand it was explained to you how we cannot stop
someone from planting trees now that could potentially impair your view sometime in the future.
However, you can protect your view rights by documenting your existing view from your viewing
area through photographs. By doing this, if and when the trees that you are concerned about
significantly impair your view in the future, you can take advantage of the View Preservation
portion of the City's view ordinance to get your view restored at no cost to you. I believe the whole
process for preserving your view was explained to you at the counter.
Also, I understand it was explained to you that the issue of whether the trees are planted on your
property or whether they will drop leaves or berries on your property is a civil issue between you
and Dr. Allman which the City has no jurisdiction over. However, if Dr. Allman has performed
unpermitted grading, this is a matter which the City can pursue. I understand that you spoke to
one of our code enforcement officers about this and they are going to go out and investigate the
alleged.grading work.

Dear City Manager,
If it is true, it is totally outrageous that RPV allowed Dr. Ralph Allman to build a wall and
now plant pepper trees in our ocean view and in the views of 3 other neighbors on
Bayridge without ever even making any of us aware this was going on.

Why does Dr. Allman suddenly have to plant pepper trees known to grow 40 feet high on
our property line with foliage that will constantly hang over on our side with associated
dead branches and berries dropping all over our side of the line? We dispute that the
tree trunks will even be on his property. We demand that you immediately order Dr.
Allman and his landscapers to cease and stop planting these trees immediately on the
morning of Thursday, November 15, 2012 until such time as the neighbors are able to
establish an accurate survey and have had input into the city planning process in this
regard. Certainly a compromise involving smaller shrubbery would make sense, if
indeed his property line allows it.
It is no secret that one of your planning commissioners lives on this street and that Dr.
Allman has been in protracted litigation with his other neighbor, Dr. Trowbridge,
regarding the removal or trimming of trees blocking his own view. Notwithstanding Dr.
Allman's success or lack of success with his neighbor Dr. Trowbridge, we think it is
outrageous and shows very bad lack of character that he would contemplate now
blocking the views of his four neighbors on Bayridge, who, at one time, supported him
publicly in the planning commission to win approval of his unusually large floor plan.
Now, this is the thanks we get!!! How quickly friendships will change!!! We ask that you
immediately send out an enforcement officer on the morning of November 15, before
these large trees, which are waiting in his driveway, start getting planted. We ask that a
temporary stop work be issued until this neighborhood planning issue can be resolved.
Among other things the four Bayridge neighbors would like to establish baseline ocean
view impingement photographs of the current view conditions, so that, when it comes
time to fight Dr. Allman or his successors in City Hall for tree trimming rights under the
City View Restoration Ordinance, that we already have this suitable documentation on
file. In the meantime, we dispute that the holes dug to plant the trees are even on his
property, and even if they are, that substantial nuisance will be created with tree limbs
over our property and dead branches and fallen leaves and berries affecting our
property.
In addition to the code enforcement relief, please also give us an appropriate response
to this letter in writing. Thank You.

Code Enforcement Officer Julie Peterson conducted a site visit and confirmed that there is a 3 to 5 -foot
retaining wall that has been built along the private street roadway without permits. She also noted about
6 recently planted trees and some holes for presumably more trees. All of the new trees are less than 16
feet in height, as measured from the base of each tree. Based on a review of a boundary and topographic
study of Dr. Allman's property which we have on file, it appears that the new wall and new trees are on
Dr. Allman's property and that they are also within the private street easement. We have reviewed this
information with the City Attorney and she concurs that the retaining wall and trees are considered
improvements which are not allowed within the private street easement without permission of all the
easement holders. Therefore, Dr. Allman will be immediately advised that no more grading or tree
planting may occur within the street easement without written permission from all the easement holders.
Furthermore, he will be given a deadline to remove the retaining wall and trees or submit written
authorization from all the easement holders that they can remain. If he is able to obtain all the easement
holders' permission, he will also have to obtain the appropriate city permits to allow the retaining wall to
remain. However, the recently trees would be able to remain and new trees can be planted provided the
trees are less than 16 feet in height. Even if such trees block your view, under the City's view ordinance,
nothing can be done about the new trees if they are less than 16 feet in height.
While I understand your concerns about this matter, please understand that we cannot stop the
processing of a property owner's application because his neighbor has a confirmed code violation. Thus,
Mr. Gerstner's application will be heard by the Planning Commission at next Tuesday's Planning
Commission as scheduled. If you have any concerns with said application, please contact Associate
Planner So Kim.
I'll ask Julie Peterson to keep you updated on this matter.

If it is true, it is totally outrageous that RPV allowed Dr. Ralph Allman to build a wall and now plant pepper trees in
our ocean view and in the views of 3 other neighbors on Bayridge without ever even making any of us aware this
was going on.
Why does Dr. Allman suddenly have to plant pepper trees known to grow 40 feet high on our property line with
foliage that will constantly hang over on our side with associated dead branches and berries dropping all over our
side of the line? We dispute that the tree trunks will even be on his property. We demand that you immediately
order Dr. Allman and his landscapers to cease and stop planting these trees immediately on the morning of
Thursday, November 15, 2012 until such time as the neighbors are able to establish an accurate survey and have
had input into the city planning process in this regard. Certainly a compromise involving smaller shrubbery would
make sense, if indeed his property line allows it.
It is no secret that one of your planning commissioners lives on this street and that Dr. Allman has been in
protracted litigation with his other neighbor, Dr. Trowbridge, regarding the removal or trimming of trees blocking his
own view. Notwithstanding Dr. Allman's success or lack of success with his neighbor Dr. Trowbridge, we think it is
outrageous and shows very bad lack of character that he would contemplate now blocking the views of his four
neighbors on Bayridge, who, at one time, supported him publicly in the planning commission to win approval of his
unusually large floor plan. Now, this is the thanks we get!!! How quickly friendships will change!!! We ask that
you immediately send out an enforcement officer on the morning of November 15, before these large trees, which
are waiting in his driveway, start getting planted. We ask that a temporary stop work be issued until this
neighborhood planning issue can be resolved.
Among other things the four Bayridge neighbors would like to establish baseline ocean view impingement
photographs of the current view conditions, so that, when it comes time to fight Dr. Allman or his successors in
City Hall for tree trimming rights under the City View Restoration Ordinance, that we already have this suitable
documentation on file. In the meantime, we dispute that the holes dug to plant the trees are even on his property,
and even if they are, that substantial nuisance will be created with tree limbs over our property and dead branches
and fallen leaves and berries affecting our property.
In addition to the code enforcement relief, please also give us an appropriate response to this letter in writing.

A school group, on a field trip for the day might begin
at the Gateway Park, learning about the Preserve and
the Peninsula's environment through the interpretive
displays at the small nature education center, before
taking a docent led hike up the trail to the outdoor
education area overlooking the ocean. Here the
students could participate in an activity learning about
the fascinating site geology, and enjoy a picnic, before
boarding their bus to finish with a visit to Lower Point
Vicente and its indoor and outdoor exhibits about the
animals of the peninsula and the ocean that surrounds
it.
E ti An equestrian might spend some time using the rings at
Y" the equestrian area within Gateway Park, (maybe even
teaching some school kids a few things about horses),
head out for a trail ride, and picnic back in the park
before heading home.
A cyclist might enjoy a safe ride heading onto the
Peninsula from the south, take advantage of well
marked areas to rest and enjoy the view at Trump
National, before parking at Abalone Cove and enjoying
a solitary walk to Inspiration Point.
Visitors to the resort at Terranea might take advantage
of outings, perhaps in a "Coast Traveler" shuttle, to trail
ride or hike from the Gateway Park, to performances
and exhibitions at the cultural facilities at Upper Point
Vicente, and to the exhibits and whale watching at
Lower Point Vicente.
Before a walk on the Burma Road Trail, a resident
might walk to the overlook at Del Cerro Park to enjoy
a wide view of the Preserve while perusing the names
of the people who made It all possible on the donor
recognition wall. Another resident may leave home on
a Sunday morning and spend all day hiking the trails
and silently enjoying this 7400 acre sanctuary. In short,
myriad opportunities to explore and enjoy the Rancho
Palos Verdes Coast will exist, identified by well placed
signage, supported by trails, bike ways, and parking,
and all designed to blend into the awe-inspiring natural
landscape.
The following is a summary of each of the key vision
dimensions for these precious coastal, civic and open
space areas of the City, followed by a series of vision
statements associated with each. This Vision, together
with Vision Plan goals, guides the concept design for
the key sites within the Plan (included in Chapter 3 of
this document), as well as the goals developed for the
design guidance for the Vision Plan area (included in
Chapter 5 of this document), and generally serves as
a touchstone or benchmark for the concepts included
in the Plan. The Vision also reflects common ground
among community stakeholders in relation to these
resources, and the basis for action in the future.
THE VISION FRAMEWORK PLAN
The plan provided on this page synthesizes all of
the Vision Plan elements into one framework plan,
so that not only the potential of the individual spaces
and places within the Rancho Palos Verdes Coast
can be seen at a glance, but their connections to
each other, to the Preserve, and to other City parks
and destinations are highlighted as well.
The Plan locates uses, including each of the Palos
Verdes Nature Preserve Reserves, City parks in the
Coast areas, approved sites for Preserve or Rancho
Palos Verdes Coast Overlooks or Vista Points,
building areas anticipated on the key sites, and
Rancho Palos Verdes coast destinations. The Plan
also identifies significant Access and Connections
features within the Plan area, including roads, trails
and trailheads, bikeways and parking lots. The
trail network identified on the Plan is the result of
many months of work by the City's Preserve Public
Use Master Plan Committee. Trail routes and uses
are identified, as well as trailhead locations. On
the key backbone spine of the Vision Plan area,
Palos Verdes Drive, two locations are identified for
gateways into the Rancho Palos Verdes Coast,
as well as locations for roadway median planting
improvements, pedestrian crossings, sidewalk
improvement areas and even a short stretch of Palos
Verdes Drive which may in the future be considered
for narrowing.
Chapter 3, Key Sites, provides concept designs and
further guidance for future development (uses) and
enhancement of each Key Site, while Chapter 4 further
explains the suggested enhancements to the key
connIctions elements shown on the Plan. Gateways
and other potential signage improvements suggested
in the Plan area are described in Chapter 5, Design
Guidance.

Five Key Sites

LOWER POINT VICENTE
Presently the Lower Point Vicente site is zoned
Open Space Recreation, and is identified for passive
recreation in the City's General Plan. The 20.5 acre
site incorporates the Point Vicente Interpretive Center
(PVIC), at 10,000 sf of developed building area,
and 13,000 sf of hardscaped plazas and outdoor
amphitheater area. The Interpretive Center is focused
on the coastal setting, marine life and history of the
Peninsula, and since its expansion, also serves
as a destination for community functions, such as
meetings, weddings and parties. The Interpretive Center
continues its tradition of hosting the annual Whale of
a Day celebration as well. The adjacent Point Vicente
Lighthouse is presently closed to the public, and home
to Coast Guard personnel. The Lighthouse Itself is
periodically open for tours, and Coast Guard related
exhibits and activities are integrated into the Whale of
a Day event as well. A pathway along the bluff edge
of the site connects into the Ocean Front Estates bluff
front trail system via a bridge over the storm drain at
the northern edge of the site. However, the connection
terminates to the south at the Lighthouse property line.

Outdoor History Museum/PVIC Phase III Program
Components - The outdoor history museum must
be designed to complement the Interpretive Center,
as envisioned by the Point Vicente Interpretive
Center docents. (It is depicted on the concept plan
at 69,000 sf/7.8 % of the site area). The components
include a Tongva village, geology display, interactive
archaeology exhibit, and dry farming/water
wise landscaping demonstration. This could be
complemented by an exhibit tying the story of the
site together, and focusing on the whole ecology of
the Peninsula and the continuum of marine, coastal,
bluff top and terrestrial life within It.
Parking and Access - Parking, driveways and drop
off areas must be provided in order to serve all
site uses (in the concept plan depicted at just over
102,000 sf/11.4 % of the site area, and 136 parking

to be planted with native and locally appropriate

Update to the Coast Vision Plan/Lower Point Vicente
Council Members,
I applaud the initiative of Council Member Knight and RPV staff to examine the current and
future status of Lower Point Vicente (LPV). The amendment to the Coast Vision Plan begins to
address this area and the proposed public workshops about LPV will continue this. I urge you to
proceed with this amendment so that we can further define how this public area will be used.
Lower Point Vicente has a long history prior to and since the founding of Rancho Palos
Verdes. We need to agree on the conceptual plan for this area so that any proposal for future
use is evaluated according to this plan. The time of interest groups, residents and staff will be
used more efficiently if everyone understands that LPV can only be used for specific
purposes. Changing the Coast Vision Plan to expressly accommodate the narrow interests of a
group or individual is poor policy making, and hopefully this council will be able to establish
their vision for this property and what they see is in the best interests of the community. Deed
restrictions, as noted by staff, are an important aspect of any future use of LPV.
Questions for consideration:
- The remaining text, after removal of the canine educational facility, includes outdoor
museum, parking, open space, and expanded trails and picnic use. I am not sure if this
still applies, and the Los Serenos docents and City need to review the status of Phase III
for PVIC. Public input in this area is also necessary, particularly the need for an outdoor
museum.
- Staff would like LPV temporarily be considered a public area for grant
purposes. Please don't let the grant writers dictate public policy. We shouldn't accept any
grant money if it does not meet the policy needs as set forth by Council, and policy
shouldn't be changed to get "free" money.
- Multi -Use for a park is a laudable intent but experience in the Preserve has
demonstrated that multi -use excludes a portion of the public who can't or won't compete
for the use they want. Please don't allow this wonderful, serene coastal property to
become something for which it was never intended.
- A plan was developed by RPV residents, at their own expense, that tried to address
many of the uses and concerns about LPV. In fact this was discussed with previous
Council members. This may be a good starting point for the workshops that would
provide a framework consistent with the remaining Coast Vision Plan text that assists all
residents in forming their own thoughts and ideas.
- Deed restrictions that currently exist should be reviewed for compliance. I recall that
there are some areas that I think the City needs to address to meet these restrictions.

Thank you for moving forward to re -design the Lower Point Vicente Parkland plan for the
benefit of the general public. Acknowledgement of the federal and state deed restrictions
as a necessary part of any proposed change is appreciated.
We have a question regarding three words (printed in red) on page
nine: "enhanced recreational amenities." It should be very clear that these recreational
amenities do NOT exclude participation by members of the general public at any time. The
deed restrictions require that Lower Point Vicente be used by individuals in perpetuity
for passive recreational activities that are consistent with the attributes of the Pacific
Ocean.
Recently, a number of different groups have envisioned designs for the Lower Point Vicente
site. Opinions may have changed since the withdrawal of the Annenberg project. Some
people might want more open space to be devoted to individual choices of passive,
unstructured, unorganized recreational activities. Some people might want more exhibits
that feature the marine environment and the history of local native American Indians to be
included inside the Interpretive Center with a few related examples of a Tonga Village to
be provided outside.
Will 136 parking spaces still be needed? A smaller area with fewer hard -surface parking
spots might serve the purpose since some of these parking spaces were to be shared with
the Annenberg facility.
The suggestion of new public meetings and discussions seems like a good idea. We look
forward to seeing this planning process evolve.

The fact is that I broached this issue at the Jan 3rd council meeting as I have been working on it for
two years, long before Susan was ever involved in voting to reinstate it Jan 3rd. The facts are that I
encouraged Susan to make the motion on Jan 3rd which I said I would support. The audio tape of the
meeting will verify. Susan should spend her own time reviewing this if she prefers, as I hope that this
does not now initiate an expensive city manager -driven hours -long review of this Jan 3rd tape at
taxpayers' expense.
I have been working with several HOA's and numerous other stakeholders for the past several months
on the practical and legal aspects of reinstating the program, per the council vote of Jan 3rd, and am
encouraging all parties to stay focused on what council voted to do as opposed to this new policy that
seems to be the focus of Councilmember Brooks and the city manager. In my opinion, this is
incorrectly being performed under the auspices of the council subcommittees (Campbell & Brooks)

I have previously offered to share this progress and the community input regarding the Jan 3rd council
direction but I am not supportive of any new policy development regarding the NBG's program that is

So that we don't experience further delays in getting the Neighborhood
Beautification Program back up and running, I would propose that we set a
meeting for the NBG Subcommittee—together with City staff—asap to discuss
the program proposals and a way forward.
Brian, based on your email on Thursday, you seem to take the position that the
City should immediately put the NBG program of 2008-09 in place first, and
then the Subcommittee would propose modifications to it after applications are
received. Although I haven't heard back from you, Brian, on my question as to
whether it is the proposed revised guidelines or the options for allocation of
funds that you believe strayed from Council's assignment, but it seems clear
that we need a Subcommittee meeting to sort out these concerns and for staff
to prepare a reasonably cogent report to the Council for further direction
regarding the work assignment.

Please provide staff with any comments or questions you may have regarding the above items by
Monday, July 23rd. This will allow staff the time to update the draft guidelines.
With the 8/21 City Council meeting fast approaching, staff plans to start public outreach ASAP. Our
goal is to send out the draft NBG guidelines to interested parties (HOAs, CHOA) and place it on the
website and list server early/mid next week. This would allow 2-3 weeks for a public comment period to
solicit feedback on these draft guidelines. Later those comments would get incorporated into the staff
report, or indicated as an exhibit.
Additionally, Councilman Duhovic brought up another possible beautification program, the "Adopt a
Median" program to staff's attention. This suggestion has a lot of merit, and would be in addition to the
NBG program. I am preparing a short draft summary of a proposed program for your review. I plan to
e-mail it to you and Councilwoman Brooks tomorrow. Staff would appreciate your comments on that
also.
Finally, if you prefer to meet to discuss the draft NBG guidelines with staff this week, please let me
know your preferred time for this Thursday and/or Friday.

Ladies and Gentlemen,
In the past, the Ladera Linda HOA has been a recipient of numerous city Beautification
Grant awards, a fact for which we are most grateful. We have used those funds in
beautifying both sides of Forrestal Drive with New Zealand Christmas trees, installed a
timer -operated watering system on the east side, removed dead or dying assorted pine
trees from the east side, built a community -naming monument at Forrestal Drive and
PVDSouth (actually Aqua Vista Drive). Earlier this year we paid for plants and got your
Emilio (from PW) and the Trump folks to supervise and do the planting on both sides of
Forrestal and PVDSouth; the funds for that project, dreamed up by my predecessor
(Steve Lapine) came from our treasury.
Our hope is that as you debate the merits of the prior program, that you consider the
good that it has done for our little LL community and for RPV as a whole. As I travel our
streets on trash day (Thursday) I see very few of our homes which do not have recycle
containers out for collection. We are into it and take recycling very seriously; this
started before there was any official pick-up of recyclables, by Roger Mills who
convinced our HOA to put a bin at Ladera Linda School (and newspapers came by the
ton).
To revise the use of the funds and allow staff to do their favorite projects will defeat the
idea of community awareness and pride in RPV citizens. I, and the LLHOA Board, ask
that you support a Beautification program that emphasizes that pride and not staff ego
by allowing HOAs, individuals, and other organizations to submit requests that are
judged impartially on their merits, for it is they who generate the dollars in the fund.

My suggestions are that you refer to the existing RPV General Plan and the existing
RPV Parks Master Plan, offer Martin Martinez a very good deal to keep the flower
farm going and round file the Coastal Vision Plan just like the previous Council did to
the proposed PARKS, RECREATION AND OPEN SPACE STRATEGIC PLAN.
Pretty much everyone knows that the Annenberg Foundation paid for the RPV
Coastal Vision Plan. I see no reason to throw tax payer dollars in after that
disrespectful freebie. A lot of research and public input went into both of these plans.
Staff has access to all of it.
Staff should respond to opportunities which walk through the front door and be
sensitive to disasters in the making. In between, they should be taking care of regular
business. The Lower Point Vicente flower farm is gone and the Lower Point Vicente
bluff top is still eroding. Who's fault is that?
Do any of you really think that word processing the "plans" will get Staff to implement
the policies in any of them any differently? Follow the money.

I just talked to MPT Campbell. He said that what he'd be forwarding to us is a Plan that he developed
(that reflected the input of the City Attorney) that he would like to be included with our staff report (part of
the packet) as his proposed way of moving forward with the program. Once you receive it and have a
chance to see what's in it (he did not articulate that for me), you may want to discuss with Carolyn.
While I have not seen the document, I think it would be best to go ahead with the 3 options we've
discussed for inclusion in the staff report — and attach Brian's report (intact) as an item for additional
consideration by the Council.

Written as a private citizen, not a member of your Planning Commission.
Of the 4 options, Option #3 (billing credit - refund) staff calls out as 'the most fair and equitable
solution' and therefore deserves a closer look.
Your choice would be refund $96K or $296K to residents, depending on whether we should continue
median maintenance / improvements. I would opt for $296K. Our year after year budget surpluses
easily support our $200K median effort but ...
I cannot support any monies for, as the Staff report calls out, 'median maintenance,' as grant
applications may not apply for 'maintenance' and, following that, our city should not earmark
these funds for that effort. Improvements - yes.
In the upcoming 2013 election year the 'less is more' issue will probably again raise its head and
this action would clearly show your support.
Tuesday night Sandie is co -hosting a neighborhood 'Thanksgiving' dinner for +60 at our church and,
therefore, I will not be able to testify before you (I'll be chief dishwasher - I suspect). I know you will make
the right decision for all of us.

Hi all,
Attached is the document prepared by the City's staff that will be given to
the Council for Tuesday night's session. Chances are they will vote as to the
disposition of the Homeowner earned Beautification Grant Funds received from
EDCO and Universal Waste Systems for recycling our sorted solid waste. Four
options are given;'they start on page 2-5 of the attachment.

The level of funding received from both trash collectors to be available to
our homeowners is approx. $300,000 per year. This is up from the amount we
received from our former trash collectors. City staff has done a
comprehensive job of summarizing the years of internal strife between the
Council and the Homeowners on disposition of these funds.
Ironically, the program functioned fairly well for a number of years until a
former councilman decided to impound these monies in the interest of "equity"
to all homeowners, (Private Homes as well as HOA,$)
In reality, these funds were then diverted to other non -Beautification Grant
Program activities without consent, (or in many cases), even knowledge of the
homeowners who have been dutifully supporting the recycle effort. Also, any
discussion by the Council on retuning these funds to the homeowners was
limited to only a fraction of the monies received from the trash the
collectors and is reduced even further by "administrative burden."
Some have viewed this as disenfranchising the homeowners through a breach of
trust, or in the extreme, a provocation of profession ethics. That will only
be answered in the next election cycle.
Latest development,
After much debate on this subject, back in Jan 2012, the Council did vote to
restore the original program.
However, their action did not reflect their words! Instead of automatically
implementing the program as it was, they went on to task staff to "re-
engineer" it and submit more options to the Council. The original plan to
engage the community, (HOA's and private homeowners) to get widespread input
on the mechanism of the program, never happened!
This resulted in an open ended and difficult problem statement putting staff
in the position of coming up with alternatives, not solutions, that do not
fully enjoy ownership from the homeowners. Perhaps this is more a reflection
what the Council wants to hear, instead of what is the best resolution. .
By not being conclusive with staff or visibly allowing them to submit and rank
their "best shot", (as is done in the real world), a lot of talent, time and
money has been used to generate a document that meets all trains but shuts
down the station!

With respect to the document,it is clear that the only viable options are:
Option 1
Return to the original grant program --keeping available all of the monies received from the trash
collectors and reviewing results after a year to evaluate percent of actual usage and enable
constructive critique.
To reduce the burden on the City, CHOA could oversee the effort and make a significant contribution
to working with non HOA's to help prepare applications for the grants as well as provide a string of
landscapers and gardeners to help design their projects. (Curb Extensions -as found in the City's
traffic calming program, not only beautify the street, they provide an excellent safety benefit).
The important issue is that no neighborhood is "red -lined out" of the program because it's not on a
main artery. (as is found in option 2)
Option 3
Just refund the recycling monies to each RPV homeowner as recognition for their stewardship to the
community.
However, use applied common sense... Discard the nonsense about only returning $96,000 to the
homeowners out of the total grant of $300,000. This ranks with "Union Skimming", insults the
homeowners and compromises the veracity of the council!
Option 4 is of course a total non starter, since it completely eliminates the Beautification Grant
Program and confiscates the homeowners earned recycle funds for other`City purposes.

As a longtime resident of the city of RPV I am deeply disappointed in your ability to work
together as a council dedicated to the residents. The lack of oversight, accountability and
transparency of the city manager is disgraceful and borders on negligence.
Who are we kidding here? The City Manager runs the city with a clear disdain and lack of
respect for the residents' wishes. This has been evidenced by her refusal to fully disclose
her pay and monetization of her payments to herself, her resistance to the citizen's
knowledge of the multi-million dollar unfunded pension liability and the recent attempt to
undermine citizen control of their own city government. How can we forget the failed
attempt to radically change our city council's authority in favor of turning it over to the city
manager? The Council majority, despite having a clear fiduciary duty to do so, chooses to
exercise little control or oversight of the City Manager and (the majority of council) won't
even vote together to find out that information. Do you know the total compensation
package and payments being made? I really doubt you do. And then to even consider this
person qualified to be included in the union negotiations is a gross conflict of interest that
even my first grader understands.
But, you take no action (as a whole) and as a resident I have to question why not? To be
crystal clear here this is not directed to a single person but to the council body lack of
transparency, accountability and governance controls related to the city manager position.
The buck stops with you and no one else. How you can't unanimously vote to know your
overhead costs is again gross negligence at the very least, bad management, governance,
unacceptable for our city and maybe more.
I am tired as a resident of the lack of transparency, the misdirection and lack of concern for
the residents who pay the taxes to support the city. I am tired of hearing that we can't get
overhead cost information because a majority of the city council doesn't have the courage
to confront the city manager. Nobody likes confrontation or conflict, but grow up and take
care of your business with the best interests of the residents first and foremost. I really
dare you to. We haven't seen our interests put first for years and the few of you on council
who are trying (and the residents know who you are) have been blocked by the rest of you
who prefer to disregard the residents (we also know who you are as well). Stop pretending
you are working in our best interests as if we (the residents) can't take care of them
ourselves because I assure we can and will. You are only putting your own interests, and
the city managers' in front of RPV residents. It's ridiculous and only furthers our lack of
trust in you. This trust, by the way, happens to be as low in our community as I have ever
seen it.

I have read the staff report and in the interest of using your time to its best advantage I am sending my
comments and will not attend the meeting, but will be watching on TV.
I have been involved as a HOA President and CHOA Board member for at least the last 10 years of these
grants. I read the staff report and wish to point out what I perceive as a very important missing piece of
the puzzle.
On the list of Grants Awarded over the 19 cycles it lists how much each group received in total funds and
some of the numbers look quiet large. However, an important factor is missing - how many homes are in
each group? If that were considered the amount of monies award would not look so significant.
I can only speak for Mediterrania who received $38,220 over 14 cycles. That is only $2730 per cycle or
$11.47 per home each year and Mediterrania also added money to those grants from our own treasury.
Most of our grants were spent on the beautification of the median strip at our entrance, -which belongs to
the city. Without this type of information the facts presented are not a true look at the previous
beautification program.
If the city does not wish to share the recycling monies with the HOA's then city wide projects of
beautification should be spread on arterial streets throughout the city in each cycle and not concentrated
in any one area. In the past I have participated in the evaluation of these grants as part of CHOA and
relayed this type of information to the city. The big complaints by the HOA's in previous years was that if
the monies for beautification are spent in any one spot everyone else is left out.
Years ago, HOA groups recycled themselves and used that money to beautify their areas. Now all the
recycling monies go directly to the city. Where is the incentive for each of the HOA's to participate and
recycle if nothing is returned to them. The previous Recycling Grants beautified all of the city. Yes, some
groups did not participate but that was their choice. The grants were available to all. Please retain the
recycling grants program in a similar form to what we have had in the past.

Our needs are for entry fence replacement, tree trimming, landscape updating, and new
(matching) street lettering. The fence was installed about 15 years ago as an entry gateway visual
that was consistent with the surrounding streets. It is now dryrotted and portions have been
removed.

Supporters of the Program recommended that some funds be returned
to the homeowners' associations for uses in their particular
communities, and that part of the monies be used for overall
E community improvements, specifically identified were road
maintenance and improved street sweeping. It was also
recommended that part of the funds be used toward the proposed
updated version of the Trails Network Plan. Individual
associations with already existing recycling programs expressed
their interest in joining the City's curbside recycling program
as soon as possible. Many residents commended the City's efforts
regarding recycling efforts. Concerns were raised as to how
monies would be distributed to individual homeowners not
associated with homeowner associations. The residents also
supported the concept that some of these monies be granted to the
Art Center and individual PTAs.
The issue of temporary discontinuation of this service, i.e. due
to travel plans, was addressed in terms of monthly fees. Mayor
Bacharach stated that this issue had not been addressed
previously and that it will be researched by Staff.
in their summary, the City Council expressed their appreciation
for the residents' support of the program. The Council noted
that no one had recommended to lower recycling fees, and that
they were pleased with the overall co c ntne residents to
have the monies reimbursed to the individual homeowners'
associations, as well as to the Community in general.
Mayor Bacharach concluded that a report will be submitted to. the
City Council at the meeting to be held on April 10, 1989, at
Ridgecrest School.
ADJOURNMENT: At 8:50 P.M. the meeting adjourned
on motion of Mayor Bacharach.

ALTERNATIVE USES FOR THE RECYCLING FUND (1301)
Mayor Brooks opened the public hearing on the consideration of
alternative uses for the Recycling Fund and the City Clerk reported
that notice of the public hearing had been duly published and that
written protests had been received and were part of the agenda
packet.
Assistant City Manager Antil presented the February 16th staff
memorandum and the recommendation to consider alternate uses of
recycling fund monies and instruct staff to prepare any necessary
documentation if changes are made to the current recycling program
and budget.
During Council discussion the suggestion was made that disposition
of this fund should be determined by the Long Range Finance
Committee but then concern was expressed about the appropriateness
of this inasmuch as the method of expenditure of these funds was
a City Council policy decision and not one to be made by a
committee.
Speaking in favor of using the recycling funds for beautification
projects were the following: Rene Cartwright, 30630.. Calle de
Suenos, representing the Palos Verdes Panorama owners Association
and Elizabeth Kelly, 6611 Vallon Dr.
Council then resumed its the discussion of the use of these funds
and comments focused on the amount of money that had been paid out
to homeowner associations for these beautification projects, the
cost of the "Recycler" of the month program, and the marketing
effort to -date for the whole recycling program. Additional
comments concerned how residents who were members of homeowners
associations benefitted from the program whereas those not
belonging to an association did not derive any benefits.
Council then proceeded to discuss the condition of Hawthorne
Boulevard and in particular the poor appearance of the fences and
walls along that street and the fact that it had been intended that
some of the recycle money would be used to beautify that main
corridor. The suggestion was the made that perhaps a certain
amount of this money should be set agide in the Capital Improvement
Program and be used for beautification projects. Additional
comments next centered on getting feedback from the Long Range
Finance Committee on the use of these funds and how beautification
projects could be identified and spread throughout the City.
Eouncilwoman Bacharach moved, seconded by Councilman McTaggart to
continue the public hearing on'this matter until after receipt of
the report from the Long Range Finance Committee and that a summary

that presently obtained from Earl Weinstein, and that this City
pays him more for the service than the other peninsula cities,
Councilman McTaggart moved, seconded by Councilwoman Bacharach to
keep the services of Mr. Weinstein but renegotiate the contract!
Motion carried on a 4 - 1, with Councilman Kuykendall voting no.
Betsey Kelley, 6611 Vallon Drive, spoke in favor of the present
system.
City Council Cablecast (305 - ouncil requested a presentation by Steve
Fowler of Dimension Cable Services to explain the kind of equipment
necessary to improve the quality of the council meeting
transmission.
Councilman Kuykendall moved, seconded by Mayor Brooks to combine
the public information program together with the subcategories of
the Reader Board, Newsletter and Public Information program on the
next review of the budget. Motion carried.
Increases! Public Information Effort (305)- It was the consensus to
issue quarterly Newsletters, to get contract help for writing
articles, to consider a Public Information Plan and to use more of
the 30 second public announcements on the public access channel.

Recycle Fund - Council briefly discussed several areas related to
the use of these fund: the advantage that neighborhoods with
homeowner organizations have over those that don't have them
insofar as the use of the recycle funds for beautification projects
are concerned, and the cost and extent of beautifying Hawthorne
Boulevard. Councilman Kuykendall moved, seconded by Councilman
McTaggart to transfer the fund balance of $233,000 in the recycle
fund to road maintenance. Motion carried.
With regard to the use of the $100,000 annual revenue in this fund,
Councilman McTaggart moved, seconded by Councilwoman Bacharach to
pay 50t of the for code enforcement costs and the balance to pay
for beautification projects and graffiti removal. Motion carried.
Recess: At 8:30 P.M. Mayor Brooks declared a recess. The,meeting
reconvened at 8:45 P.M.

Lighting of Bus Shelters - councilman Kuykendall moved, seconded by
Councilman McTaggart to approve approximately $10,000 to $15,000
for lighting for the bus shelters. Motion carried. The suggestion

City parks.
