RPV Council and Staff,
Mr. and Mrs. Michael DeNardo, residing at 290; Vista del Mar, have
retained my services on behalf of their health, safety and property interests
vis-a-vis the revised expansion plans for Marymount College. The matter is
scheduled for a hearing on April 17, 2012.
The most recent revision hasn't allowed adequate time for study or
environmental assessment, but following are my initial concerns;
• There may be drainage problem causing potential damage to the
DeNardo property from runoff from Marymount's property.
• Mr. DeNardo has allergies and his home has no air conditioning.
There is no environmental analysis or description of mitigation for
the potential airborne particulates from additional grading and
construction.
• Expanding the 2010 plan creates the potential for additional mischief
in a large unsupervised and unpatrolled parking lot. There is no
environmental assessment of public safety impacts to neighbors nor a
description of mitigation controlling access.
• There is no mitigation for the additional noise and nuisance caused
by parking volumes exceeding the 2010 approval.
• There is no measureable estimate for the amount of light which will
flood nearby properties. The parking lot lights appear to radiate
horizontally rather than being shadowbox utilities which would direct
light downward. There is also no description of hours or other
mitigation for the effect of the lights.
* There is no measurable estimate of noise pollution caused to the
neighbors from additional grading and extensive compaction. There
is also no assessment of potential hydrology and geology issues.

• No measureable estimate exists of ground vibration or tremors caused
by extensive compaction, raising concern about cracks and damage to
the house, perimeter walls, pool, driveway or other structures.
It would violate the environmental rights of residents for RFV to consider expansion of
the 2010 approval based on a negative impact report at this point. May I respectfully
suggest this is not a minor revision and any deliberation should be postponed until
further environmental study has been done and the results provided to the public.
It is unjust to allow developers to continue taking additional bites at the apple after a
development approval has been issued. It sets a bad precedent for future projects and
causes residents to fight the same battles multiple times.
For all of the above reasons we respectfully request the Council protect the unique low-
density quality of life in the RPV community by denying the applicant's attempt to
modify the 2010 project approval. Denial of the application will satisfy the intent of
RPV residents and prevent future legal and political confrontations.

The new plans seem to be more like what was originally approved. It does not make sense that the
plans changed at or after the deadline to make written comments to city council - how can this be fair?
It would seem to me if the plans change at the last minute, the date of the review with city council
should be delayed. Some concerns:
1. There appear to be more parking spaces than originally planned in the area
immediately adjacent to our property - is that correct? Any additional adjacent
spaces are going to increase the effects on our property.
2. Lighting is a concern —will the lights be turned off at some certain time each day? I
am concerned with lighting so close, and the 10' tall lighting structures - why not 5' or
6'?
3. Access —there is a gate, and this parking is supposed to be limited access. Will there
be limits as to the times this area is open? Closed at a certain time?
4. How will the college limit noise from this area — human noise, horns, alarms? What if
we start to experience loud car alarms at all hours of the night?

5. Drainage issues — we are concerned that there is adequate drainage planned on Marymount to protect
our property from damage. I honestly know nothing about such engineering, but I am concerned.
6. Construction dust —the city says there is to be no dust on neighboring properties. My concern — we
have no air conditioning, and I have allergies, and they are planning this for summertime. If there is dust
on our property — what do I do? I asked you if the standard is no dust on our property. You talked about
them following "accepted procedures." But, if these procedures are not preventing dust, what then? I
think the standard of performance should be no dust on neighbor's property.
7. Construction noise — what is acceptable noise from such construction, and what is unacceptable? Is
there a measure and maximums?
8. Vibration —my understanding is they will be doing extensive compaction. How much vibration will we
experience and what about the potential damage to our property? Are there measures and maximum
levels of vibration? There must be some limit to the amount of vibration a neighboring property owner
is expected to incur. Will our house, driveway, pool, or perimeter walis develop cracks or failures. I am
concerned this is a true risk with such significant earth moving so close. You mentioned they will have
insurance or bonds, but if we are experiencing teeth rattling vibrations, that would be very
uncomfortable during the construction process. If they cause damage, it may be insured, but then our
property its torn -up and we experience construction issues and having to deal with insurance companies
- something we would rather avoid.
9. Land movement —with them doing a major cut, grading and compaction; what about the risk of land
movement affecting our property.
Not sure you can answer all these issues, but any you can would help me understand the potential issues, and enable

Attached Illustrations:
A: The Central Section of the Campus including portions of the South -
facing Slope. This is a composite overlay of the referenced Geotechnical
Map Plate I (required slope stabilization area in orange) against the Site
Utilities Upgrade Plan A l . l (Sewers in Red) and the Proposed Parking
Lot Plan (Revised Version) showing the proposed Drainage 24° Line (in
Purple).
As part of the parking lot expansion project, the college proposes the followin"
improvements to accommodate the expanded parking lot:
- grading to stabilize the south slope below the parking lot. The grading on the south
slope involves removing uncompacted fill and restoring the grades at a slope of 3:1 with
a sheer key.
- on-site drainage facilities including a detention basin to collect and convey storm water
runoff to the city's existing storm drain facilities at pre -development levels in order not to
adversely impact the existing storm drains
- the installation of a bio filter system to treat storm water runoff to remove pollutants for
water quality purposes

As indicated in the April 17 staff report under Additional Information, the utility plan is
not before the city council because it's consistent with the council conditions and involves
upgrading the existing on-site utilities that is subject to review and approval by the city's
building official as described in the council approved conditions. The proposed upgrade
to the existing utilities is to improve the existing on-site electric and gas lines. The
college is not seeking permits to upgrade its existing sewer lines.
The city's building official, city's engineer, and city's geotechnical consultant will review
the engineering plans during to plan check process in the Building and Safety Division to
ensure the grading and utility plans comply with the council adopted conditions, the city
uniform building codes and uniform plumbing codes. The plan check process has not
been initiated yet but is expected to occur later this week. Tim Gordon and Lois Karp
have been informed of this and told that city staff will keep them posted on when the
engineered plans are submitted to the city and that staff will meet with them to ensure
their concerns are assessed prior to the issuance of any grading permits.
B. The Proposed Athletic Facility First Floor Basketball Court over the
proposed location of the Marymount Utilities Improvement Plan Main
Transformers. Note: Eliminates the North basket, with no room past the
Free Throw Line.
At this time, the college is not seeking permits to construct the council approved Athletic
Facility. However, as described above and in the April 17 Council Staff Report, the
college, under a separate permit process, seeks permits from the Building and Safety
Division to upgrade its existing gas and electric lines. Because Staff is not certain when
or if the college will seek pen -nits to construct the Athletic Facility, staff is reviewing the
plans for the utility upgrade and the parking lot expansion project as independent and
permanent projects. As such, if and when the colleges seeks building permits for the
athletic facility, at that time, the college will need to demonstrate to the city's satisfaction
how the athIrtic facility fits in the context of the existing improvements including the
above ground transformers.
In other words, if the college installs above ground transformers as part of its utility
upgrade that conflicts with the location of the future athletic facility, at the time the
college seeks building permits for the athletic building it will need to address the
transformers without adjusting the footprint of the council approved athletic facility. If in
the future the college seeks to amend the footprint of the athletic facility, the college will
need to obtain council approvals as either a minor modification or CUP revision.
Otherwise, the college will need to seek permits to relocate the transformers including
incurring costs involved in the relocation.
C: A Cross Section View (Plate II op cit) at Cross Section Line B - B' shown at the right
edge of Illustration A. The proposed drainage lines and existing sewer lines are within the
orange area of required slope stabilization. The Proposed Drainage Line for the new
Parking Lot begins at an elevation of approximately 900' (bottom of pipe) and decrease
1.25' per lineal 100' going West along the upper slope area. This means that it will require
deep trenching at levels below (assumed) all existing sewer lines. OSHA Trenching
Safety requirements will be in effect for such deep trenching_
The trenching required to install the proposed drainage lines is subject to review and
approval by the city's building official, city's engineer, and city's geotechnical consultant
to ensure the grading and temporary shoring to accommodate the installation of the new
utilities does not adversely impact the existing utilities or surrounding grades and
improvements. Furthermore, during the plan check process in the Building and Safety
Division the city will ensure that the proposed utilities and grading complies with the
uniform Building codes and uniform plumbing codes prior to issuance of any grading
permits.
D. The Staff Presentation to the City Council of August 18, 2009 showing details of the
Required Soil Buttress Stabilization Sheer Key at three areas of the Slopes, including the
removal of deep Bentonite Layers along. Cross Section A - A' from Plate II. Note the
added excavations and Maximum depths - 18,000 C'Y and 7,000 CY with 25' deep
Maximum Cuts. The current proposed Parking Lot Pian does not include this required
Slope Stabilization grading which is required in accordance with GEO-1, etc. and as
shown in the E1R Findings, etc.
As part of the parking lot expansion project, there will be over 7,000 cubic yards of earth
movement. The grading plans identifies the grading area which includes a portion of the
southern slope below the parking lot. The grading plan also indicates that there will be 4 -
feet of cut and fill. According to the geotechnical report submitted to the city on Friday,
April 13, the grading includes a sheer key. As part of the plan check process, the city's
building official, geotechnical consultant, and city engineer will require detailed
information regarding the grading including the maximum depth of cut and fill to
accommodate the sheer key. As indicated in the council adopted conditions, if the
proposed grading does not comply with the 2010 council adopted grading quantities
(approximately 90,000 cubic yards of earth movement) the city will not issue any grading
permits.
E. There are significant additional conflicts with the Utilities Upgrade Site Pians A1.0
and Al. 1 with respect to quite a number of other on -campus Sewer Lines, Water and Gas
Lines as shown therein.
As part of the plan check process, the city's building official will ensure that the proposed
utilities including the proposed drainage lines do not conflict with the existing on site
untilities and complies with the city adopted uniform building codes and plumbing codes
prior to issuing any grading permits. As indicated in the staff report, if compliance is not
determined, permits will not be issued by the city.

F. There are no schedules provided for either the Parking Lot Plan or Utilities Upgrade
Plans and such schedules would allow consideration of how long the slope stabilization
will require and how long the confluence of sewer lines will be unusable.
According to the council adopted conditions, prior to the issuance of any grading permits,
the college is to submit a construction management plan for review and approval by the
city. The construction management plan is to include, among other things, a construction
schedule, construction fence plan, construction employee parking plan, etc. Staff does
not expect the construction management plan to be submitted for another few weeks
during the plan check process which to date has not been initiated yet.
G. The College has submitted a request for Entitlement Extension beyond September 30,
2012 and the contents of that request should be carefully considered as well before
proceeding with any decision on the proposed (Revised) Parking Lot Plan. The
Engineering firm for the First Parking structure Lot Plan was replaced bay another firm
for the Revised Plan.
As indicated in the April 17 staff report, the time extension request was submitted last
week and will be brought to the council for its consideration in late spring or early
summer.

My responses to CCC/ME's email that is to be forwarded to the Mayor and the entire
city council are noted below following each comment.
It is important that the Council understand that the agenda item before them is to only determine
that the layout of the proposed parking lot expansion project substantially complies with the
parking lot layout approved by the city council in 2010. Furthermore, because the college has
valid planning entitlements, if the proposed parking lot had matched the layout of the 2010
council approved parking lot, this item would not be before the council but rather would go
directly into the Building and Safety division as part of the plan check process. This is common
for all development projects, large or small, in the city.

Re: CC Agenda April 17; item#1 Marymount College Parking lot Expansion
Project
We request that you defer a decision to approve the modifications requested by
Marymount because there are specific facts, which have not been included in the
Staff report, They are:

1. The plan that was distributed by List Serve to the public on April 4th
(which had a comment period closing April 10) is not the plan, which
was distributed in your packet. The plan in your packet is dated April
11. These plan you have with last minute changes is a tactic that has
Iof�
often been used by Marymount in the past to limit public discussion and subsequently change
the project.
The plan posted on the city's website and attached to the list -serve message issued on April 10th is the same plan
attached to the city council staff report. An electronic copy of the plans were emailed to staff on April 10 followed
by the delivery of the hard copies on April 11. The electronic copy was posted on the website immediately and the
council received a copy of the hard copy as part of the agenda packet.
2. There is also a Utility Upgrade Plan, which was received by staff on March 16t", which is not in
your packet. There are conflicting construction problems when these 2 plans are constructed
simultaneously.
The utility plan is not before the city council because it's consistent with the council conditions and involves
upgrading the existing on-site utilities that is subject to review and approval by the city's building official as
described in the council approved conditions. The proposed upgrade to the existing utilities, as noted on the city's
website and in the April 17th staff report, is to improve the existing on-site electric and gas lines. If and when the
colleges seeks building permits for future buildings (i.e. The athletic building) or improvements, at that time, the
college will need to demonstrate to the city's satisfaction how the proposed improvements fits in the context of the
existing improvements.
In other words, if the college installs above ground transformers as part of its utility upgrade that conflicts with the
Iocation of the future athletic building, at the time the college seeks building permits for the athletic building it will
need to address the transformers without adjusting the footprint of the council approved athletic building. If in the
future the college seeks to amend the athletic building footprint, the college will need to obtain council approvals as
either a minor modification or CUP revision.
3. We have asked the City to have Marymount build a parking lot for the last 2 -years. But
we do not want a parking lot at the expense of public safety, a landslide or a flood. The
project is unsafe as presented because:
The city concurs with the above statement which is why engineering plans for the project is subject to review and
approval by the building official during the city's plan check process prior to the city's issuance of any grading
permit. The plan check process occurs in the Building and Safety Division for all development projects in the city
and occurs after conceptual approvals are obtained by the Planning Division.
The 2010 council adopted conditions clearly state that approvals at various milestones in the plan check process are
to be obtained prior to the city's issuance of any grading or building permits.
a) The grading quantities are largely understated due to the fact that the sheer key
stability grading is not in the plans.
According to the council approved conditions, prior to issuance of any grading permit, the college is to submit
geotechnical reports for review and approval by the city geologist. On Friday, April 13 the college submitted
geotechnical reports for the proposed parking lot expansion project. The geotechnical report has been transmitted to
the city's geologist to initiate the review process. As indicated in the staff report grading permits will not be issued
for the parking lot project until the geotechnical reports are approved.
Having said that, staff has reviewed the geotechnical reported submitted on April 13th and a sheer key is proposed.
The sheer key is not shown on the plans provided to the council because these plans are the architectural plans not

the engineering plans. The engineering plans will be submitted to building and safety when the plan check process
is initiated which I believe will occur later this week. Lastly, the 2010 council adopted conditions permit
approximately 90,000 cubic yards of earth movement and the amount of proposed earth movement for the parking
lot expansion project is subject to the council conditioned limits.
b) The plans are lacking the essential grading of the south facing slope, which needs a sheer key
buttress for stability as called out in the Associated Soils Engineering report date May 2002,
2005,and 2009. The plan in your packet only shows the remedial grading which is shallow and
merely cosmetic.
See response above. The geotechnical report requires a sheer key. The engineered grading plans when submitted to
Building and Safety will need to comply and correspond with the geotechnical reports.
c) These plans show a road being built on the edge of the south facing slope for access to the
parking lot. The approved plan had a retaining wall as part of the road plan. There is no
retaining wall on these plans.
The amount of grading currently proposed for the south slope to accommodate the proposed parking lot and access
road does not require the construction of a retaining wall. Notwithstanding, the city geologist will review the
geotechnical reports and engineering plans to determine whether or not a retaining wall is warranted. This will
encompass reviewing past and present geotechnical reports by the city's geologist prior to the city's issuance of any
grading permit.
d) There are no engineering plans, grading plans or any details respecting the Detention Basin
mandated as mitigation in the EIR.
The council approved project requires the construction of a detention to control runoff flows from entering the city's
existing storm drains and for water quality purposes. As required in the council approved conditions and mitigation
measures, the details relating to the proposed detention plan are to be shown on the engineering plans at the time
the plan check process is initiated. Staff believes the plan check process will be initiated later this week. During the
plan check process staff will verify the location and sizing of the detention basin as it relates to the required
hydrology reports to ensure water flows entering the city's storm drain system is at pre -development flow rates. The
2010 council approvals do not allow the college to convey additional water into the city's storm drain system from
what is currently being conveyed. In other words there should be no net increase of water runoff which is why a
detention basin is required (to detain the water runoff).
e) Staff requested Marymount submit a Geology Report in 2009 and 2010 and the City still does
not have this report! Nothing should be approved without the EIR mandated Geology Report.
The council adopted conditions require the review and approval of geotechnical reports in the plan check process.
As indicated above the city received the latest geotechnical reports on Friday April 13 and the report has been
transmitted to the city's geologist to initiate the review process. This is consistent with the council adopted
conditions.
4. There are no approvals from Fish & Game or other public agencies or a riparian report,
which were part of the EIR mandates for the Detention Basin.

The council certified EIR includes mitigation measures intended to minimize potential environmental impacts to a
less than significant level. As required by the EIR, prior to issuance of any grading permit, the college shall obtain
approvals from Fish and Game, if the proposed detention basin is located is an identified and protected blue line
steam. The college has initiated the required review process which must be completed prior to the city's issuance of
any grading permit.
5. This project triggers 85 conditions of approval listed in the City Council approved EIR
Resolution 2010-41. It is clear from the incomplete plans that were submitted that
Marymount has no intention to include all required EIR mitigations. You will have
more revisions to this plan before the project begins.
City staff has reviewed with the college's legal counsel and project construction team the applicable conditions and
mitigation measures to ensure compliance prior to issuing the grading permit. City staff will continue to work with
the college through the plan check and construction process to ensure such compliance.
Approval of these project modifications is premature. There is insufficient time to complete the
parking lot before the college fall semester starts in August.
As previously indicated, the Council is only being asked to review the proposed layout of the parking lot to
determine whether the layout substantially complies with the 2010 council approved plans. The engineering and
geotechnical related matters will be addressed during the plan check process in the Building and Safety Division.
What we should be discussing is where will the student's park when school begin for the fall
semester. It is manifestly unfair to ask the neighbors to endure a third year with cars parked all over
the streets.
The proposed parking lot expansion project is intended to construct a permanent parking lot that accommodates 463
parking spaces as required by the city council in 2010. The college wishes to have the expanded parking lot
completed by the 2012 fall term. City staff is working with the college to see that this goal is achieved provided that
all the applicable conditions and mitigation measures are met.
Maryinount promised the near by residents to take all the cars off the street. Enforce that
promise.
The recommendation made in the Staff Report to open the CUP and Iower the student
enrollment CAP to match the number of parking spaces only works on paper. How could this be
enforced?
This would be achieved by amending the conditions of approval. Furthermore, if the college is found to be in
violation of the conditions the city will not process any future requests until the violation had been addressed.
Please defer approving this project until all required EIR mitigations are included
in the plans and information is available for everyone's review. We are asking for one
thing, no more or no less, all parties should honor the EIR contract.

It is come to Staff's attention that the site plan for the Parking Lot Expansion Project to be considered at
Tuesday's meeting does not clearly indicate the layout of the 2010 Council approved parking lot. As
such, attached is the 2010 Council approved site plan that depicts the approved parking lot layout. In
summary, the current parking lot proposal is in the same location as the 2010 Council approved parking
lot with the exception of 15 parking spaces located between the parking lot and the proposed walkway
way, I have identified these 15 parking spaces with a red circle on the attached site plan for the proposed
parking lot expansion project. These exhibits will be incorporated into the power point presentation at
Tuesday's meeting.
