TECHNICAL SERVICES AGREEMENT WITH PALOS VERDES
ON THE NET
On November 15,2011,the City Council approved the Professional Technical Services
Agreement (the "Agreement")between the City and Palos Verdes on the NET ("PVNET")
with a 2-year term and a gO-day termination provision.The new Agreement includes a
provision for fixed monthly fees for Help Desk,Server Support,Website and GIS services
totaling $282,000 annually (upon completion of the IT Plan).These services have been
consistently provided to the City in the day to day operations of the City's IT System.
Website and Server Support services have been billed to the City based upon a fixed
monthly fee for many years.Prior to the new Agreement,Help Desk and GIS services
have been billed based upon actual service hours multiplied by $55 and $40 hourly rates
for Ted Vegvari and other technicians in accordance with the previous agreement.
A summary of the fixed monthly fees as provided in the new Agreement is as follows:

The FY11-12 budgetforthe IT program was developed with the expectation that Help Desk
and GIS Services would be billed and paid using fixed monthly fees as noted above in
accordance with the Agreement.PVNET agreed to bill the City $11,500 each month for
Help Desk services and $6,000 each month for GIS services (totaling $17,500 per month),
retroactively effective July 1,2011.This will result in significant savings to the City over
billings based upon actual time and standard rates.Based upon a review of PVNET's time
records for actual GIS and Help Disk services from July 1,2011 through November 30,
2011 by the Deputy Director and myself,it appears as though the City has saved at
least $30,000 by paying the monthly fixed fee rather than based upon actual time and

rates in accordance with the previous agreement.
Tonight,the City Council is asked to approve the invoices for GIS services from July 1,
2011 through November 30,2011 via the warrant register,as well as email services for
three months through November 30 th .Again,services have been consistently provided to
the City in the day-to-day operations of the City's IT System.The payment for invoices for
Help Desk services through November 30,2011 will be presented with the warrant register
on December 20,2011 for approval.
At the request of Mayor Pro-Tem Misetich,Staff expects to provide an overview of the
PVNET Aweement as early as the December 20,2011 meeting of the City Council.

Please distribute to the city council after the new councilmembers are sworn in and us
old ones have left the dais.I have copied one councilmember but understand I cannot
copy others at this time.
I ask the council to carefully consider any change to the one hour rule.The rule does
not limit the council itself and does not impair a councilmember's ability to prepare for
properly agendized items.All the rule limits is the ability of a councilmember to use
staff time (a public resource)for an item that is not on a council agenda unless and until
a majority of the council approves the use of such public resources in a open meeting.
Prior to the one hour rule,councilmembers were free (and some--albeit a minority--did)
use staff time as they saw fit without approval of their fellow councilmembers and
without notice to the public.This was not limited to the late Council member
Gardiner's inquisitions which I took pains to publicize,but included large amounts of
staff time being spent to study a breakwater project with considerable public resources
being devoted without any practical public review.
A number of councilmembers have asked that use of staff time and staff salaries,
benefits and other expenses be made public.Councilmember Campbell often asked for
a summary of the time being spent on,for example,the Annenberg proposal.Should I
have been allowed,as just one councilmember,to direct staff to study matters relating
to the Annenberg project without notice to the public,or even to my fellow
councilmembers,and without putting the matter on an agenda?After insisting that
information about staff be public why would the council move quickly to obscure the use
of staff time from the public?
I hope the council will reject any efforts to obscure its handling of public resources.

LEITERS TO THE EDITOR
Last week the News asked readers if they thought the community at large would approve of the use of
temporary,portable stadium lights during home Friday night football games.Here are two responses:
I am a pro-light person and many-year resident.You published my pro-letter months ago.I am totally for
temporary lights if that is the only way to get lights on Friday nights.

We raised three kids up on the Hill,going to both high schools,and they were into all sports without stadium
lights.
If granted they will want to go past the five Friday nights and then the baseball teams will want to play at
night.
Where will it end?
The traffic is bad enough now.It will mean more cars,more congestion,more trash.We don't need it and
don't want it.
Those of us who live around the school have enough problems.Also,when they run out of money who will
end up paying for these lights -us,the taxpayers.
Let this issue die.

Donors should know
I read with great interest your article,"Strain piling on for school district/'dated Nov.25.
A couple of things that the pro-lights group and their donators need to know.
Because of the frivolous lawsuits,brought by a few self-interested people,the Palos Verdes school district
has spent over $50,000 dollars from the general fund,the one that pays the teachers salaries,on attorneys
fees and research to satisfy these suits.So,if the lights donors support these lawsuits,there goes another
one or two teachers!

Also,the people and companies that donated to the lights fund should contact their tax preparers to find out
if their donation is still tax-deductible,especially if they took the tax deduction in 2010.They may find out
that if the money is not used for its intended purpose,it is not tax-deductible.You donors might ask for your
money back before it is all gone.
I have been told that the Peninsula High basketball team rents another basketball facility for their big
games.
Why not have the football team rent Harbor College stadium for their big football games.You can probably
get a lot of nights for $250,000!

[Saturday]'I had the privilege of joining a small but enthusiastic group of folks for an Occupy PV session at
the top of the Hill.Many people honked as they drove by and there was a good feeling about being out
there.
One person came over to ask what we were doing and why.She essentially said that she felt this was too
nice a neighborhood for "that sort of thing."
I couldn't disagree more.The top of the Hill is exactly where this sort of thing ought to happen.She
reinforced my feeling that unless those of us who can go home to a comfortable bed,get up and get out to
express our concern for the need for change in our society,little will actually change.This kind of civil,law-
abiding gathering needs to grow,be appreciated and be heard.As long as protesters are characterized as
"just a bunch of homeless complainers"or a "bunch of overprivileged college kids,"we will be dismissed.
Only a broad-based,orderly,articulate group of solid citizens have a chance of being heard.
A favorite moment [Saturday]was when a handsome young man drove slowly by in his fine Lexus
convertible,gave a friendly wave and happily called out,"I'm part of the 1 percent."I was charmed by his
obvious good will.I hope he'll continue to enjoy his good fortune and,being a caring person,will join us one
Saturday to help change what is wrong in our current system.
There are many reasons for deep concern about what is happening in our country.We don't all have to have
the same list of concerns but we do need to get the attention of our legislators to start thinking.Getting out
and visibly expressing concern,beyond pushing a button to sign another petition,is essential.Just hoping
change will happen won't work.
Please watch for an Occupy gathering and consider giving an hour or so of your time to join them to support
peaceful and orderly change.If we're not visible,no one can see us.

Where were the tents,camp sites,sleeping bags et cetera?Last Saturday about 20 people stood in front of
Bank of America with signs saying Occupy PV.They were there for a few hours.
Does PV need to be occupied?Good question.
It was a mini-protest as compared to the Occupy LA and other larger live-ins,but it was quite quaint and the
type of low-profile protest one would expect from living in Palos Verdes.

The world was shocked by images of UC Davis campus police pepper spraying peacefully assembled students
on Nov.18.
As an individual,I deplore the police force's actions.As a board member of the Cal Aggie Alumni Association
of UC Davis,I voted in favor of a resolution passed after emergency meetings of the board that condemns
the police actions,supports Chancellor Linda Katehi's and UC President Mark Yudof's steps to investigate the
incident,and reaffirms CAAA's commitment to work for additional governmental and philanthropic support
for public higher education.The full resolution can be found at www.alumnLucdavis.edu.
At the root of the situation is the students'justifiable frustration with the chronically low and decreasing
levels of state support for higher education.For the first time in California,state funding for prisons is higher
than that for public higher education.And,for the first time,the expected family contribution to tuition is
higher than the state's contribution.
Much has been said recently about whether a college education is worth the cost.Regardless of the
economic merits of the debate,the willingness of the student protestors at UC Davis to absorb searing
pepper spray at point-blank range,without retaliating,moving or flinching,has told us how much they value
such an education.We owe it to these examples of personal courage to demand of our legislators that they
restore state funding for higher education.

To the Honorable Mayor Tom Long and Members of the City Council;
I would like to draw your attention to the above entitled information regarding
Marymount College's Master Land Permit Application (C-1 05)for their land
use at 1600 Palos Verdes Drive North (PVDN)as included in the most recent
RPV Planning Staff's "Border Issues"Read and File document.
As a direct and most illuminating contrast to this latest new set of documents,
I recommend that.you read Comment Letter #20 in the first Section 12
Comments and Responses beginning at page 228 to the October 2007 DEIR.
Therein you will find direct contradictions from College's Officials and Legal
Representative denying any feasibility for development of this same PVDN
property for various reasons,including Dr.McFaddens'bold lie in a letter and
related documentation to the RPV Planning Commissi'on,that the "geological
stability of the land at that site should be considered."
Dr.Mcfadden's point was to exclude the "bench area"east of the U.S.S.New
Jersey Street as (virtually)unbuildable as reported in and referred to on page
8 (as the 'cut-slope')of the 1988 Final Rough Grade Report by the Hunt
Building Corporation prepared by Soil Testing and Engineers,Inc.That is the
same area now slated by the College for a two story parking garage with
additional construction amenities as well.
Further,the statements and remarks submitted in a letter of August 27,2007
by the College's Land Use Attorney,Donald Davis falsely claimed variously
that the Colleges'PVDN land use site's "designation is inconsistent with the
project"is a shameful misrepresentation given that the College's latest 20-
year submittal to Los Angeles City Planning Department promotes this site for
just that purpose.(from page Two of Comment letter #20).
Attorney Davis's next regrettable misleading and erroneous distraction was
that "the site is not economically viable."(Page Three of Comment letter #20).
Just the opposite is true.
And so on and so forth.The College's assertions regarding the utilization
potential of their Palos Verdes Drive North (PVDN)land have been proven
false time and time again.This is a lesson RPV should not ignore in future
dealings with the College.
I am concerned that any and all future assertions by the College regarding
modification or change to their existing approved expansion plans for their

RPV 30800 Palos Verdes Drive East site will prove equally worthless and misleading and
should therefore be accorded all appropriate consideration warranted.
As suggested by a former United States President,"Trust but Verify";but with very little
"Trust"and a great deal of "Verify"for this applicant.

by commercial haulers.For over two decades,the City has renewed the non-exclusive
commercial hauling agreements on an annual basis.
This item does not include the residential (single and multi-family)services provided by
EDCO and Universal Waste Systems,Inc.Furthermore,this item is not related to the
residential collection matter on Arrowroot Lane.

In response to a question I received,I wanted to offer a clarification regarding Item #6 (City
Council Meeting Schedule)on next Tuesday night's agenda.You may have noticed that there
was no mention to the December 20th City Council meeting in the staff report.Staff omitted this
meeting from the discussion because we are not proposing to modify this regularly scheduled
meeting in any way.Unless directed otherwise by the City Council,it would be staff intent to
prepare for and conduct this meeting as we for any regular Council meeting,with no changes to
the start time,'location or type of agenda items.I hope this is helpful.Please let me know if you
have any questions.
