Dear Senator Feinstein,
The Mayor and City Council of Rancho Palos Verdes would like to encourage your office to investigate
the. potential hazards at the Rancho LPG Holdings LLC facility at 2110 N. Gaffey St., San Pedro, CA
90731.
Our concerned citizens gave us copies of documents that are disturbing and may pose a potential threat
to our citizens, their property and their business. A representative of one of our HOA attended a
meeting with North West San Pedro Neighborhood Council and representatives from Rancho Holdings.
They reported to us that Rancho Holdings has a "like/kind" inspection policy which is when they inspect
one tank and assume the other tank is in similar condition. This policy of inspections would not be
tolerated for airlines or nuclear facilities. We hope this inspection policy would be part of your
investigation.
The Rancho Holdings LLC facility was built in 1973 without permits. We have seen the permits in
1978 stating "These permits are to legalize tanks that were built in 1973 without a permit". We request
an explanation how such a facility can be built without permits. We also would like information how an
inspector can do a thorough inspection it is built and operational.
According to Los Angeles City Planning Department website it is within an earthquake fault zone,
methane zone, landslide and liquefaction zone. How can the permit in 1978 be signed off under these
circumstances?
According to the Los Angeles Building and Safety office there is NO seismic gas shut off valve located
at that parcel.
We believe this facility poses a potential terrorist threat because we can easily park our car or stand
within a couple hundred feet of these tanks.

located across Westmont Avenue.

There is a nearby municipal airport in Torrance, CA that routinely services small aircraft that fly over
the area the propane and butane tanks are located.
There was a recent quantitative risk analysis report by Cornerstone that caused us concern because five
of the eight scenarios posed a risk to the lives and property of the citizens of Rancho Palos Verdes. We
have dedicated a staff member to monitor this issue and we agree with our citizens that this is very
important to public safety.
The facility was recently purchased August 10, 2010 for $19,000,190.00.
The City of Rancho Palos Verdes would like to fin-ther assist your office in your investigation into this
facility and provide support as needed.

MRCA and the City of Rancho Palos Verdes for Ranger services as follows:

after the imposition of the fuel surcharge, the surcharges will be eliminated.

1. The overall cost is now to be slightly over $170,500 per year. What was
our original estimate of the combined cost by the PVPLC, patrol and other
costs?
Staff Answer:
Patrolling the Preserve to ensure compliance with City regulations
including compliance with approved trail plans has always been the
responsibility of the City and not the PVPLC. In 2009, to effectively
enforce city regulations in the preserve, the City made the decision to
implement a Park Ranger Program. During the June 2009 Budget
process, the City planned for the program to consist of part-time city staff
to patrol the Preserve. Later in 2009, the City explored the option of
contracting with the Mountains Recreation and Conservation Authority for
Park Ranger Services. Benefits included that the MRCA Rangers were
sworn peace officers, wildland fire fighters, supplied their own equipment,
required no training, and came with abundant experience.
In December 2010, the City entered into a 120 -day pilot program with
MRCA. At the conclusion of the pilot program, the City was pleased with
MRCA services and entered into a one-year agreement (April 2010 -April
2011) with MRCA and increased patrol from 30 hours per week to 40
hours per week. This agreement expires April 2011. The increased cost

of the agreement for the period of April 2011 through June 2014 is a result
of an increase in hourly rate, an increase in the number of service hours,
and an increased contract time.
2. The average total of 54 hours a week is a 44.4% increase over the
average total hours in the year April 2010 to March 2011. What is the
estimated increase in the period following the expiration of this new
contract?
Staff answer: The figure of 1,944 patrol hours between the period of April
2010 — March 2011 does not reflect an entire one year contract period.
The 1,944 patrol hours cover a period of mid April 2010 through early
March 2011 (approximately 47 weeks) which averages at about 41 hours
per week. The contract was for 2,080 hours total, which will make the
overall increase a 35% increase.
At the May 2010 Budget Workshop, Council directed staff to increase
ranger services by approximately $40,000, including the implementation of
a Junior Ranger Program. To arrive at the level of increase proposed
tonight, staff considered the number of hours by which the 2010-2011
contract would be increased by an additional $40,000.
Staff does not anticipate an increase in hours over the next three fiscal
years. However, at the time of the next contract renewal, and at the
associated budget workshops, staff will present City Council with the
information necessary to decide whether increased patrol and interpretive
programming are warranted or needed. In addition, MRCA Supervising
Ranger Jewel Johnson will be at the Council Meeting tonight to give a
brief presentation and answer any questions.
3. On page 3-2, third paragraph is the statement that "also included in the
contract figures is ranger drive time." What drive time does that include
and is that common for contracts with protective service personnel?
Staff answer: The contract accounts for one hour of travel time per ranger
commute to the City of Rancho Palos Verdes; broken into 30 minutes of
travel to the City, and 30 minutes returning to various ranger bases,
including Santa Monica, the San Fernando Valley, and Whittier.
Other protective service contracts that may be comparable are City
contracts with Los Angeles County Sheriff and Los Angeles County
Animal Control. We do not include drive time in the Los Angeles County
Sheriff contract because of the close proximity of the Lomita Sheriff
Station and the regional nature of the agreement. We do include drive
time in the Los Angeles County Animal Control agreement, as they are a
greater distance from the City. For protective service agreements,

including personnel drive time is common when the personnel are a

Any comments on Funds for CIP, WQFP, and Employee Benefits? (These funds
also changed by amounts over $100,000.)
Staff Reply:
The Capital Improvement Projects (CIP) fund had a $128,382 disbursement to
Sully -Miller for the residential overlay project on February 1St
The Water Quality Flood Protection (WQFP) fund received a $141,652
distribution from the County for storm drain user fees collected, yet only had
small disbursements for professional services related to the San Ramon Canyon
Stabilization project and installation of a catch basin for Lake Machado runoff
during the month of February.
Cash activity in the Employee Benefits fund reflects debits for employee
withholdings and credits for payments of total expenses (both City share and
employee share). The excess of credits over debits reflects payment of the
City's share of expenses. The largest contributor to the $102,750 excess of
credits over debits was the City's share of employee insurance premiums totaling
$72,523.

Subject: Signs in Public Rights of Way and on Public Property
Gentlemen
I have previously written to the Planning Commissioners when this issue was brought befre them, and my
comunication is included in the staff report for tonight's meeting. Instead of repeating what I previously stated,
please consider my letter to the Commissioners as a letter addressed to the Council.
I support restrictions as to size, color and location of signs for non-profts and for election matters, but do not feel a
ban should be put into place. We can model our rules after those of RHE which allows signs with limited size, font
size and color. We have never had a problem in this community regarding content and there is no evidence that any
signs have ever contained material or verbiage that has been claimed to be offensive. Unless and until there is a
problem, please do not start invoking censorship.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF RANCHO PALOS VERDES DENYING THE APPEAL OF
HEIGHT VARIATION NO. 697, THEREBY APPROVING
THE APPLICANT'S REQUEST FOR A SECOND STORY
ADDITION AT 28105 GOLDEN MEADOW DRIVE.
WHEREAS, on March 11, 1991, the applicant, Dr. Gary Rinzler,
received administrative approval from the Director of
Environmental Services for an 874 square foot second story
addition to his home at 28105 Golden Meadow Drive which will
measure 21'-3" above existing, adjacent grade; and
WHEREAS, on March 25, 1991, within the 15 day appeal period,
adjacent property owner's to the immediate south of the subject
property, Mr. and Mrs. Richard van der Weyde, appealed the
Director's decision to the Planning Commission; and
WHEREAS, after notice issued pursuant to the provisions of
the Rancho Palos Verdes Development Code, a public hearing before
the Planning Commission was held on May 14, 1991, at which time
after hearing evidence presented by all interested parties, the
Commission unanimously voted to deny the appeal, thereby approving
the project; and
WHEREAS, on May 29, 1991, within the 15 day appeal period,
the same appellants filed a written appeal of the Planning
Commission's decision to the City Council; and
WHEREAS, on July 2, 1991, after notice pursuant to the
provisions of the Rancho Palos Verdes Development Code, the City
Council held a public hearing at which time all interested parties
were given the opportunity to be heard and present evidence; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: That pursuant to Section 17.02.040 of the
Development Code guidelines, the applicant has complied with the
provisions set forth for early neighborhood consultation, in that
he had obtained a sufficient number of signatures on the Early
Neighborhood Consultation form supplied by the City to satisfy
this requirement.
Section 2: That the applicant constructed a temporary space
frame of the outline of the proposed addition; the height and
location of which were verified by Staff.

Section 3: That the structure does not significantly impair a
view or vista from public property (parks, major thoroughfare,
bikeway, walkway, equestrian trail, etc.) which has been
identified in the City's General Plan, Coastal Specific Plan or
City approved viewing area.
Section 4: That the proposed structure is not located on a
ridge or promontory.
Section 5: That there is no significant cumulative impact
caused by granting the application since those properties which
have been identified as enjoying ocean views of which could be
affected by the applicant's proposal, (7002 and 7003 Brookford
Drive), would completely lose those views if the neighbors to the
immediate west and downslope from both of these properties were to
legally develop their properties per the City's Development Code
with 16 foot structures. Therefore, the adverse effects of the
applicant's proposal on these views would be immaterial. It has
also been determined, as a result of additional view analyses from
properties on Ambergate Drive, that views from these properties
will not be cumulatively impaired since a significant portion of
the ocean views will remain if similar additions are constructed
to other homes in the vicinity.
Section 6: That the proposed structure has been designed and
situated in such a manner as to minimize view obstruction since
the applicant has situated the second story addition centrally on
the lot (a significant distance from both the front and rear yard
property lines) and has significantly reduced the size and scale
of the original second story addition proposal.
Section 7: That based upon view analyses, the applicant's
proposal will not significantly impair views enjoyed by
surrounding properties. Those properties identified above which
do enjoy ocean views, will not be adversely affected by the
applicant's proposal.
Section 8: That based upon analysis of the surrounding
vicinity, the proposed structure will be compatible with the
neighborhood. Although the existing residence is larger in terms
of total square footage when compared with other homes in the
area, it complies with all of the applicable criteria in the
Development Code for development (i.e. open space, setbacks, and
height). The second story addition will utilize common
architectural features and/or materials that are consistent with
those found throughout the area and it is Staff's opinion that the
addition is not excessively bulky nor will it create a massive
structure.
Section 9: That the proposed project complies with all other
Development Code requirements.

Section 10: For the foregoing reasons and based on
information and findings included in the Staff report and'6vidence
presented at the public hearing, the City Council of the City of
Rancho Palos Verdes hereby denies the appeal of Height Variation
No. 697, thereby upholding the Planning Commission's decision to
approve the second story addition at 28105 Golden Meadow Drive
subject to the conditions in Exhibit "A" attached hereto and made
a part hereof, said conditions being necessary to preserve the
public health, safety, and general welfare.

VERDES RECITING THE FACTS OF THE SPECIAL MUNICIPAL ELECTION HELD

WHEREAS, a Special Municipal Election was held and conducted in the City of
Rancho Palos Verdes, California, on Tuesday, March 8, 2011;
WHEREAS, pursuant to Resolution No. 2010-91 adopted on October 5, 2010,

Consolidated Elections and the City of Los Angeles Election Division canvassed the

Section 3: That the total number of votes in favor of Measure C was 2,049 and
the total number of votes opposed was 5,433.
Section 4: That the City Council does declare and determine that:
As a result of the election, a majority of the voters voting on Measure C (proposing that
a City Charter be adopted to change the City of Rancho Palos Verdes from a general
law city to a charter city) did not vote in favor of this measure and that said measure
was not carried and shall not be deemed adopted and ratified.
Section 5: The City Clerk shall enter on the records of the City Council of the
City a statement of the results of the election showing:
1. The whole number of ballots cast in the City;
2. The measure voted upon; and
3. The total number of votes given for and against the measure.
Section 6: That the City Clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

passed on the information to the other members that I am working with on this issue and I believe they are
planning on attending this Tuesdays meeting and refer to the letter I gave you. Since the Senators offices are
looking into this matter now, we feel the timing for such a letter is now not in June.
If it is at all possible to include the new information I gave you and ask the city council to send letters to Senator
Feinstein and Senator Boxer offices in the report for Tuesdays meeting, it would be greatly appreciated.

I dropped off a CD and some copies of permits for you regarding the Rancho tanks on Gaffey. On the CD is a
draft letter for the Mayor and City Council to send to Senator Feinstein and Senator Boxer offices as well as

Dear Senator Feinstein,
The Mayor and City Council of Rancho Palos Verdes would like to encourage your office to investigate
the potential hazards at the Rancho LPG Holdings LLC facility at 2110 N. Gaffey St., San Pedro, CA
90731.
Our concerned citizens gave us copies of documents that are disturbing and may pose a potential threat
to our citizens, their property and their business. A representative of one of our HOA attended a
meeting with North West San Pedro Neighborhood Council and representatives from Rancho Holdings.
They reported to us that Rancho Holdings has a "like/kind" inspection policy which is when they inspect
one tank and assume the other tank is in similar condition. This policy of inspections would not be
tolerated for airlines or nuclear facilities. We hope this inspection policy would be part of your
investigation.
The Rancho Holdings LLC facility was built in 1973 without permits. We have seen the permits in
1978 stating "These permits are to legalize tanks that were built in 1973 without a permit". We request
an explanation how such a facility can be built without permits. We also would like information how an
inspector can do a thorough inspection it is built and operational.
According to Los Angeles City Planning Department website it is within an earthquake fault zone,
methane zone, landslide and liquefaction zone. How can the permit in 1978 be signed off under these
circumstances?
According to the Los Angeles Building and Safety office there is NO seismic gas shut off valve located
at that parcel.
We believe this facility poses a potential terrorist threat because we can easily park our car or stand
within a couple hundred feet of these tanks.
This is a photo of the Rancho LPG tanks which was taken from the heavily used Field of Dreams Park
located across Westmont Avenue.

There is a nearby municipal airport in Torrance, CA that routinely services small aircraft that fly over
the area the propane and butane tanks are located.
There was a recent quantitative risk analysis report by Cornerstone that caused us concern because five
of the eight scenarios posed a risk to the lives and property of the citizens of Rancho Palos Verdes. We
have dedicated a staff member to monitor this issue and we agree with our citizens that this is very
important to public safety.
The facility was recently purchased August 10, 2010 for $19,000,190.00.
The City of Rancho Palos Verdes would like to further assist your office in your investigation into this
facility and provide support as needed.
