Mayor Long,Council members,Carol and Joel,
I think the referenced Ordinance is drafted incorrectly.It now reads that a property owner has to sign an application
to have his propety INCLUDED in the moratorium area.Is that what is intended?If the ordinance is adopted as
drafted it would appear to precluse the City from placing a dangerous property within the boundaries against the
owner's consent.Frankly,I cannot fathom a circumstance where a property owner would apply to have his property
included in the area.Perhaps I am missing something.

Carol,
Why are you not simply amending 15.20.100 to delete the requirement of having a concurrent application (which
15.20.100 doesn't exactly say,though it implies it obliquely)?
Adjusting the moratorium boundary is not exactly a ministerial act to be approved solely on the basis of the City
engineer's opinion (we've had some incompetent ones in the past).At a minimum an application for removal should
be approved by the director (though preferably the Council because of the liability the City might have if the
decision turns out later to have been a bad one).Also,what about public notice and hearing?Why should there be
none under this ordinance?
Assuming a property is removed from the area by virtue of this ordinance,where does it provide that in the event
the property owner later wants to build he has to come back to the city with an updated geological study for a re-
evaluation of the proprety's then current geological condition before a building permit can be issued?I have not
studied the Muni Code thoroughly so this may be covered elsewhere.
As per my email yesterday,it also makes no sense that under the proposed ordinance ALL applications have to be
signed by the property owner,since applications can be submitted by the City for the purpose of adding the
property TO the area (did you REALLY mean that the City has to apply to its own engineer for permission to ADD
a property to the moratorium area)?Did you really mean that a property owner has to evidence consent to be
ADDED to the area by signing the application?I think you may need to go back to the drawing board on this one.
Just think how wonderful it would be if we were a charter city and only got ONE shot at reading an ordinance
before it was adopted more quickly (one of the stated "advantages"of being a charter city)!

Geology is about as reliable as VooDoo.Dr./Professor Perry Erlich was the City Geologist for free.$2
Million of State money and one million cubic yards of moved dirt and the PB landslide part of PV Drive
South is back to having two ski jumps at the west end,a "bump"and an "s"curve at the east end and
sinking in the middle.Geologists know a lot about where dirt is.They don't know diddly squat about
where it might go in the next million years or million minutes.
Private property rights should not be based on VooDoo.City ordinances and Staff decisions should be
based on a serious analysis as presented to the public in a very transparent way....S

did not catch the first reading of this proposed ordinance.I know Lois
annoyed you by pointing out every typo and math error in the Staff Reports.
She would have caught this one back in December because it is really

The Landslide Moratorium Boundary Line was codified rather arbitrarily
several years ago in the interest of the health,safety and welfare of the
people who own property in the newly formed City of Rancho Palos Verdes.
This proposal is not in the best interests of the majority of the City's property
owners.
Looking at it from both the existing General Law City methodology and the
proposed City Charter,this ordinance says that The City can apply to The
City to change a private property owner's entitlements and Staff would be
authorized to make the change without a public hearing.
The City Geologist can move the line wherever he pleases?
A property owner can opt into the moratorium?
V'all need to Q,ive this one a third and fourth reading.

Dear Joel,To read the Daily Breeze one would think Jim York had thrown in the towell with his battle to decelop
Point Vue and had decided instead to become an organic farmer.What rubbish!All I see is a transparent end run
around the council's decision not to accept his original application for a conditional use permit.This "golf course"
of his is mare like an oversized back yard putting green;two holes with no membership,no hours and no sraff.
Ancillary to this "golf course"will be an out door night club to host hundreds of people;how absurd.This is no
more than a very poorly repackaged effort to achieve what he failed in his first effort.I beg you to recognize this for
the farce that it is.

QUESTIONS AND COMMENTS:
Ray and Alan,
Here are some questions on this issue (the page number references are to the
Harris report):
1.Page 2,under recommended Alternative 1A,next to last paragraph (and
page 23,first paragraph,reference to a "gravity buttress.")
As shown on the map on page 9-1,the blue line from the location of the
,upstream inlet and pipe is basically the majority of the existing canyon.Is
it planned for the entire length of his canyon planned to be filed up with
30-feet of dirt?Will this stabilize the sides of the canyon and resolve all of
the problems?
Public Works response:The project does not propose to fill the entire canyon
along the Alternative 2A Alignment.The fill associated with this alternative would
extend from the inlet structure adjacent to the upper switchback down to a point
immediately above the City boundary line.The length of this section is
approximately 900 feet long.About 500-feet of the fill is expected to be 30'deep,
requiring the import of about 45,000 cubic yards of fill.This portion of the
preliminary design would not work without removing the upstream runoff water at
the proposed inlet structure.
Filling the canyon beyond this would not service stabilizing the landslide and
would likely be environmentally problematic.
2.Page 8,middle paragraph (and page 10-last paragraph).Was the
easement onto the private property obtained?If not why,and would this
be a case for eminent domain acquisition?
Public Works response:Easements have not been obtained.If obtained they
would follow environmental studies and confirmation of the Preferred Alternative.
The private property referred to in the report is located in the City of Los Angeles.
3.Page 13,last paragraph.Has the CLA performed a detail CCTV video
inspection as recommended?

1.There are several places in the Harris report where the term "Shelf Ready"is ysed .Shouldn't that be "Shovel
Ready".The places are:Page 1 -next to last paragraph,last sentence,Page 3 -Last paragraph,first line,Page 35 -
second paragraph in "D".
2.Page 2 -Last sentence in thew "Alternatives"paragraph.Nothing is infinetly superior.Perhaps far superior
would be better.
3 On page - 3 A line of protection exceeded only by a slight amount over the cost of 2A which has a much higher
cost and environmental imapct.
Just some thought about how others may interpret these in the future.

I received notification from the Executive Office Board of Supervisors that per Government Code Section 50270,
the City Selection Committee shall consist of the Mayor of each city within the county (see below).Attached for
your convenience is the Council Assignment List from December 21,2010 which reflects that Councilman
Wolowicz was appointed as the delegate and Mayor Pro Tem Misetich as the alternate.I will include this in late
correspondence for tomorrow evening.

county or the ,legislative body thereof.Where the office of county
clerk is separate from the office of clerk of the board of
