I know you may not be able to make comments regarding the lawsuit filed by Dr. Brophy that names all of you as Respondents and Real Parties in interest, even though I have yet to meet Mayor "Wolfowicz" and not all of your names appear on the ballot arguments against or the rebuttal of 9/8/2010 arguments in favor of Measurf`` But none of you are named in Mr. Lewis's lawsuit as defendants, Respondents, or Real Parties in Interest and that lawsuit seems to seek a judge's determination whether statements contained in the legal wording of the measure and or its arguments in favor or rebuttal of arguments against Measure P are true and not deceptive or misleading, and whether they are redundant, for the most part, compared to what you all approved within The Marymount College Facilities Expansion Project. I hope you agree that no matter what lawyers on all sides suggest, having a judge make a determination about matters contained in both lawsuits serves the voters of Rancho Palos Verdes better than what differing attorneys debate about. What we may also find out by early tomorrow afternoon is what Marymount's representatives might do should the judge's rulings not go the way Dr. Brophy and others want them to go. I am also wondering if and how many Yes on P signs might be found on public property on September 15 or 25, for that matter. I continue to religiously support The Marymount College Facilities Expansion Project but not The Marymount Plan and I am still waiting for representatives from Marymount College to state how religiously they support The Project for their College, which this Council voted into law and whether they would use The Project's elements to provide a 21St Century College experience to future students. There is a new rumor that Marymount might launch a high-level science program where they intend on sending a person to the Sun. A written Notice to proceed will be issued for each task that is authorized. The estimated number of contracted hours is included in the retainer amounts specified for each task. If a task is expected to take longer or cost more than the authorized amount, a change order would be approved and issued. This increase in cost would ultimately affect the cost related to other tasks. Other tasks would be appropriately reduced so as not to exceed the total authorized amount. If a task is not completed or authorized that amount remains unspent. Regards, Anthony Misetich Councilman City of Rancho Palos Verdes McLean reply: The expenditure is for three months services provided by Palos Verdes on the Net (PVNet), including general day to day website support, network and user support, geographic information system (GIS) mapping support and several on- going projects. The projects include the recent texting enhancement of the alert system, the development of the emergency incident reporting system recommended by the Emergency Preparedness Committee and the beginning of the implementation of a project management system in Public Works. As you may recall, PVNet serves as the day to day IT contractor. The City has no staff dedicated to provide IT support for users and public information the City provides. The FY09-10 budget for the IT program was built on an estimate of $250,000 for website, network and user support and GIS support. It is likely that some payments made during early FY09-10 were for carryover expenditures from FY08-09. The hourly rates are $40 for IT technicians and $55 for services provided by Ted Vegvari. Once the detail computations have been made what process is used to review for reasonableness or comparison to surrounding cities? Staff Reply: Staff compared certain RPV fees with those of surrounding cities in 2009, in conjunction with the Cost Based Fee Study. Once cost -based fees are set at 100% of the City's cost, a comparison with other cities can be misleading; as other cities' local law, processes and resulting costs may differ from our own. Staff expects that when another full study is done in a few years, another comparison will be made with other cities' fees. Perhaps a more relevant comparison would be to determine whether other cities are setting their fees at 100% of cost (regardless of their local law, procedures and resulting costs), or if they are setting fees at some subsidized rate (e.g. 80% of cost). 2. Page 15-7, Direct Expenses. This was explained several years ago, but I cannot recall the detail answer. Based on a "standard" year of 2,080 hours, what are the adjustments to arrive at 1,580 hours? Staff Reply: Holidays, vacations, sick leave, training, morning/afternoon breaks, and start up/shut down time was subtracted from 2,080 hours to arrive at an average estimate of 1,580 productive work hours for full-time staff. 3. As to Item No. 2, 1 agree that we should consider language to that effect or at least language keeping the city consistent with existing general law city requirements. I am not sure I want to force the city to seek out and correct every inconsistency even where there is no complaint. I don't think that was your intent. I assume you just didn't want the city to have extra powers. As to Item No. 1 1 generally agree with salary range disclosures and I think Sacramento is headed in that direction. But I am reluctant to include such detail in a constitution (which is what a charter is), particularly since your reference is technology driven and technologies change. Again I cite the US constitution and how it compares with California. The federal constitution is much shorter and avoids most details such as this. Overly detailed constitutions spawn litigation and choke government. But had you been present at the drafting of the federal constitution (in fact I hear some say you were present) I suspect (this is tongue in cheek) that you would have offered (or perhaps did offer) the following provision during the consideration of a more detailed federal constitution: "Emoluments of Office, Article MMCDVIII: The emoluments of each of those persons holding an Office for profit under thefe United Statef and each of them shall have said emoluments published in newfpaperf of general circulation in each of the Statef hereof at least once per annum. There shall be one publication in such an aforesaid newfpaper for each 10,000 people in each State, but in no event less than two publications per State.
