RANCHO PALOS VERDES CITY COUNCIL MEETING DATE: 10/16/2018 AGENDA REPORT AGENDA HEADING: Consent Calendar AGENDA DESCRIPTION: Consideration and possible action to amend an existing professional on-call design contract with Penco Engineering for the Palos Verdes Drive West Median Beautification (PVDW Beautification) Project to extend the limits for the design of this project by one block to the north, and authorize an additional appropriation for $29,520. RECOMMENDED COUNCIL ACTION: 1) Authorize Staff to amend the existing on-call professional on-call design contract with Penco Engineering for the PVDW Beautification Project to include the design services for one additional block; 2) Authorize an amendment to the existing professional on-call design contract with Penco, subject to City Attorney’s approval as to form; and, 3) Approve an additional appropriation for $29,520. Penco’s proposal for design services (page C-1) BACKGROUND AND DISCUSSION: City Council has previously approved the design of the PVDW Beautification Project (from Marguerite Dr. to approximately 1000’ south of Hawthorne Blvd.) which is currently under construction. The improvements under this project include installation of irrigation and landscaping on the PVDW median. A section of the median in the area between the City limit with Palos Verdes Estates (PVE) and Marguerite Dr., measuring approximately 400’ in length, was not funded as part of this project. 1 This area of median was originally intended to be improved with landscaping and a trail, as part of the City’s segment of the California Coastal Trail (CCT) which, for the most part, was completed in 2013. However, due to project funding limitations associated with construction bids that were significantly higher than the budgeted amount, this segment of the CCT project was not completed. The City’s segment of the CCT was primarily funded by a grant awarded to the City and the Palos Verdes Peninsula Land Conservancy (PVPLC) in the amount of $500,000 in 2010 by the California Coastal Conservancy (CCC) (Attachment B). The City contributed $60,000 towards the CCT project as a matching fund. PVPLC was a co-applicant in the grant application because of trail improvements associated with the portion of the CCT in the Palos Verdes Nature Preserve. With the commencement of construction of the current landscape median project, Staff has received requests from residents to expand the scope of work to include the section of the median between Marguerite Dr. and the PVE city limit. In considering these requests, the City has an opportunity to complete a portion of the trail that would connect our City to PVE, as originally envisioned in the CCT project, and at the same time address residents’ desire for landscaping at this location, an entry point to the City. Staff recommends adding this trail and landscaping to the current construction contract through a change order once the design is complete. Staff will coordinate work with the City of PVE to connect to the existing PVE median trail. The new trail will be built with decomposed granite to match the surrounding areas, with Americans with Disabilities Act (ADA) compliant curb ramps at the Marguerite Dr. crossing of the southbound lanes of PVDW . A Rectangular Rapid Flashing Beacon (RRFB) will be required at this crosswalk, based on the Uniform Traffic Control Devices manual (CA MUTCD) (Attachment A) Staff has approached Penco Engineering (Penco) to complete the design of Phase II because of their familiarity from previous work on this project; availability of in-house staff, including survey services; and knowledgeable and professional staff. The proposal for the additional work is attached. (Attachment C) Design will be scheduled for completion before the existing contract work is complete. A construction change order will be brought before City Council for approval at a future date. Accepting Staff’s recommendations will authorize an amendment to the existing professional on-call design contract with Penco, subject to City Attorney’s approval as to form, and authorize an additional appropriation of $29,520. ALTERNATIVES: In addition to the Staff recommendations, the following alternative action is available for the City Council’s consideration: 2 1. Reject Staff’s recommendations and consider inclusion of this median in future CIP projects. WHEREAS, the Legislature of the State of California has established the State Coastal Conservancy ("Conservancy") under Division 21 of the California Public Resources Code, and has authorized the Conservancy to award grants to public agencies and nonprofit organizations to implement the provisions of Division 21; and WHEREAS, the Conservancy awards grants for projects that it determines are consistent with Division 21 of the Public Resources Code and with the Conservancy's Strategic Plan and that best achieve the Conservancy's statutory objectives, in light of limited funding. WHEREAS, the City of Rancho Palos Verdes ("applicant") has applied for or intends to apply for Conservancy grant funding for the construction of the City's segment of the California Coastal Trail ("the project"). WHEREAS, the Conservancy encourages applicants for grant funding to certify through a resolution the applicant's approval of the application and of certain listed assurances at the time of submission of an application to the Conservancy for an award of grant funds. The grantee shall provide$60,000 (sixty thousand dollars)and any funds beyond those granted under this agreement which are needed to complete the project. CONDITIONS PRECEDENT TO CONSTRUCTION AND DISBURSEMENT The grantee shall not begin construction of the project and the Conservancy shall not be obligated to disburse any funds unless and until the following conditions precedent have been met: 1. The Rancho Palos Verdes City Council has adopted a resolution authorizing the execution of this agreement. 2. The Executive Officer of the Conservancy("the Executive Officer")has approved in writing: a. A work program for the project, as provided in the"WORK.PROGRAM" section,below. b. An authorized representative of the grantee shall sign the first page of the originals of this agreement in ink. This agreement shall run from its effective date December 31,2031 ("the termination date") unless otherwise terminated or amended as provided in this agreement. However, all work shall be completed by November 30,2012 ("the completion date"). The grantee shall submit a final Request for Disbursement no later than February 28, 2013. Resolution No. 2011-31 Exhibit A Page 4 of 34 B-6 City of Rancho Palos Verdes Grant Agreement No. 10--080 Page 5 SIGNS The grantee shall install and maintain a sign or signs visible from the nearest public roadway identifyinging the project,acknowledging Conservancy assistance and displaying the Conservancy's logo and directing the public to the project.The Conservancy shall provide to the grantee specifications for the signs. The grantee may incorporate the required information into other signs, such as the interpretive signs as approved by the Executive Officer. In special circumstances,where the placement of signs or the general specifications are inappropriate,the Executive Officer may approve alternative,more appropriate methods for acknowledging the sources of funding. In addition to signs acknowledging Conservancy assistance,the grantee shall install and maintain California Coastal Trail emblems on the real property and on all other real property interests controlled,maintained or managed by the grantee that are deemed by the Conservancy to be existing segments of the California Coastal Trail. Emblem locations shall be determined by the grantee in consultation with the Conservancy. The grantee shall submit plans describing the number, design,placement and wording of the signs,interpretive signs,or the specifications of a proposed, alternative method. The Conservancy will withhold final disbursement until the signs are installed as approved by the Conservancy. BONDING If the grantee intends to use any contractors on any portion of the project to be funded under this agreement, construction shall not begin until each contractor has furnished a performance bond in favor of the grantee in the following amounts: for faithful performance, one hundred percent of the contract value; and for labor and materials, one hundred percent of the contract value. This requirement shall not apply to any contract for less than$20,000. Any bond furnished under this section shall be executed by an admitted corporate surety insurer licensed in the State of California. COSTS AND DISBURSEMENTS When the Conservancy determines that all"CONDITIONS PRECEDENT TO CONSTRUCTION AND DISBURSEMENT"have been fully met, the Conservancy shall disburse to the grantee, in accordance with the approved project budget, a total amount not to exceed the amount of this grant, as follows: The Conservancy shall disburse funds for costs incurred to date, less ten percent,upon the grantee's satisfactory progress under the approved work program, and upon the grantee's submission of a"Request for Disbursement"form, which shall be submitted no more frequently than monthly but no less frequently than quarterly. The Conservancy shall disburse the ten percent withheld upon the grantee's satisfactory completion of construction and compliance with Resolution No. 2011-31 Exhibit A Page 5 of 34 B-7 City of Rancho Palos Verdes Grant Agreement No. 10-080 Page 6 cOSTS AND DISKURSEMENTS (Continued) the"PROJECT COMPLETION"section, below, and upon the Conservancy's acceptance of the project. The Conservancy will reimburse the grantee for expenses necessary to the project when documented by appropriate receipts. The Conservancy will reimburse travel and related expenses at actual costs not to exceed the rates provided in Title 2,Division 1, Chapter 3, Subchapter 1,Article 2 of the California Code of Regulations ("CCR"), except that reimbursement may be in excess of these rates upon documentation that these rates are not reasonably available to the grantee. Reimbursement for the cost of operating a private vehicle shall not,under any circumstance, exceed the current rate specified by the State of California for unrepresented state employees as of the date the cost is incurred. The Conservancy will reimburse the grantee for other necessary expenses if those expenses are reasonable in nature and amount taking into account the nature of the project,its location, and other relevant factors. The grantee shall request disbursements by filing with the Conservancy a hilly executed Request for Disbursement"form(available from the Conservancy). The grantee shall include in the form its name and address,the number of this agreement,the date of the submission,the amount of the invoice,the.period during which the work was actually done, and an itemized description,including time, materials, and expenses incurred of all work done for which disbursement is requested. The form shall also indicate cumulative expenditures to date, expenditures during the reporting period, and the unexpended balance of funds under the grant agreement. An authorized representative of the grantee shall sign the forms. Each form shall be accompanied by: 1. All receipts and any other source documents for direct expenditures and costs that the grantee has incurred. 2. Invoices from contractors that the grantee engaged to complete any portion of the work funded under this agreement and any receipts and any other source documents for costs incurred and expenditures by any such contractor,unless the Executive Officer makes a specific exemption in writing. 3. A supporting progress report summarizing the current status of the.project and comparing it to the status required by the work program (budget, timeline,tasks, etc.) including written substantiation of completion of the portion of the project for which the grantee is requesting disbursement. Resolution No. 2011-31 Exhibit A Page 6 of 34 B-8 City of Rancho Palos Verdes Grant Agreement No. 10-080 Page 7 COSTS AND DISBURSEMENTS (Continued) The grantee's failure to fully execute and submit a Request for Disbursement form, including attachment of supporting documents,will relieve the Conservancy of its obligation to disburse funds to the grantee until the grantee corrects all deficiencies. EXPENDITURE OF FUNDS AND ALLOCATION OF FUNDING AMONG BUDGET ITEMS The grantee shall expend funds in the manner described in the approved project budget. The allocation of the Conservancy's total grant among the items in the project budget may vary by as much as ten percent without approval by the Executive Officer. Any difference of more than ten percent must be approved in writing by the Executive Officer. The Conservancy may withhold payment for changes in particular budget items which exceed the amount allocated in the project budget by more than ten percent and which have not received the approval required above. The total amount of this grant may not be increased except by amendment to this agreement. Any increase in the funding for any particular budget item shall mean a decrease in the funding for one or more other budget items unless there is a written amendment to this agreement. PROJECT COMPLETION Within ninety days of completion of construction of the project,the grantee shall supply the Conservancy with evidence of completion by submitting a final report which includes: 1. An inspection report by a licensed architect or registered engineer or the grantee's Public Works Director certifying completion of the project according to the approved work program. 2. Documentation that signs are installed as required by the"SIGNS"section of this agreement. 3. A fully executed final"Request for Disbursement." 4. "As built"drawings of the completed project and photographs documenting project progress and completion. Within thirty days of grantee's submission of the above, the Conservancy shall determine whether the grantee has satisfactorily completed the project. If so, the Conservancy shall issue to the grantee a letter of acceptance of the project. The project shall be deemed complete as of the date of the letter. Resolution No. 2011-31 Exhibit A Page 7 of 34 B-9 City of Rancho Palos Verdes Grant Agreement No. I:04)80 Page 8: EARLY TERMINATION SUSPENSION AND FAILURE TO PERFORM Before the project is complete, either party may terminate this..agreement for any reason by proViding the other party with seven-days notice in-writing-and the conservancy may the agreement upon written.notice. In either case, the grantee shall immediately..stop.work-under the agreement and take all reasonable nieasures to prevent further costs to the Conservancy. The Conservancy shall be responsible for any reasonable and non-cancelable.obligations-incurred by the grantee in the performance of this agreement prior to the date-of the notice to terminate or suspend,but only up to the undisburs.ed-balance of funding authorized in this agreement. Any notice suspending work under this agreement shall remain in effect until-further written notice from the conservancy-authorizes:.to resume. The Conservancy..may, at its sole discretion, consider extenuating circumstances and not..:req4ire repayment for work partially completed. This paragraph-.shall:not-limit::any.-otlier'remedies-that the Conservancy may have for breach of this agreement.. The parties expressly agree to waive, release and relinquish the recovery of any.:consequential damages that may arise out of the termination or suspension of this agreement under this section. The grantee shall include in any agreement with any contractor retained for work under this agreement a provision that entitles the grantee to suspend-or terminate the agreement with the contractor for any reason on written notice and on the same terms and conditions specified in this section. 'Maintenance costs" include ordinary repairs and replacements ea:mewing nature necessary to prolong the'life Of capital assets and basic structures,and the expenditure of funds necessary to replace or reconstruct capital assets or basic structures. Without the written permission of the Executive Officer,the grantee shall not use or allow the use for mitigation(in other words, to compensate for adverse changes to the environment elsewhere)of any portion of real property on-which the Conservancy has funded construction. Resolution No. 2011-31 Exhibit A Page 8 of 34 B-10 City of Rancho Palos Verdes Grant Agreement No. 10-080 Page 9 MITIGATION In providing permission, the Executive Officer may require that all funds generated in connection with any authorized or allowable mitigation on the real property shall be remitted promptly to the Conservancy. INSPECTION Throughout the term of this agreement, the Conservancy shall have the right to inspect the project area to ascertain compliance with this agreement. INDEMNIFICATION AND HOLD HARMLESS The grantee shall be responsible for, indemnify and hold harmless the Conservancy,its officers, agents, and employees from any and all liabilities, claims, demands, damages, or costs, including,without limitation, litigation costs and attorneys fees, resulting from or arising out of the willful or negligent acts or omissions of the grantee, its officers, agents, contractors, subcontractors, and employees, or in any way connected with or incident to this agreement, except for the active negligence of the Conservancy,its officers, agents, or employees. The duty of the grantee to indemnify and hold harmless includes the duty to defend as set forth in Civil Code section 2778. This agreement supersedes the grantee's right as a public entity to indemnity see Gov. Code section 895.2)and contribution(see Gov. Code section 895.6) as provided in Gov. Code section 895.4. The grantee waives any and all rights to any type of express or implied indemnity or right of contribution from the State, its officers, agents, or employees, for any liability resulting from, growing out of, or in any way connected with or incident to this agreement. Nothing in this agreement is intended to create in the public or in any member of it rights as a third party beneficiary under this agreement. INSURANCE The grantee shall procure and maintain insurance, as specified in this section, against claims for injuries to persons and damage to property that may arise from or in connection with any activities of the grantee or its agents,representatives, employees,volunteers, or contractors associated with the project undertaken pursuant to this agreement. Verification of Coverage. The grantee shall furnish the Conservancy with original certific.ates,in the form attached as Exhibit.B to this agreement, and amendatory endorsements effecting coverage required by this clause. All certificates and endorsements are to be teceived.and approved by the Executive Officer before work commences. The Conservancy may require, at any time,complete,certified copies of all required insurance including endorsements affecting the.coverage. 7. Contractors. The grantee shall include all contractors as insureds under its policies or shall require each contractor to provide and maintain coverage consistent with the requirements of this section. To the extent.generally available, grantee shall also require each professional - contractor to provide and maintain Errors and Omissions Liability insurance appropriate to the contractor's profession and in a reasonable amount in light of the nature of the project with a minimum limit of liability of$1,00000. 8. Premiums and Assessments. The Conservancy is not responsible for premiums and assessments on any insurance policy. AUDITS/ACCOUNTING/RECORDS The granteesh4limaintAin financial accounts,documents,and records(collectively, "records") relating to this agreement,in accordance with the guidelines:of"Generally Accepted Accounting Principles"("G.A.14Y").publihed by the American Institute of Certisfi.ed Public Accountants. The records shall include,without limitation,evidence sufficient to reflect properly the amount, receipt,deposit,and disbursement of all funds related to the construction, implementation,of the Palos Verdes Peninsula California Coastal Trail project, and the use,management, operation and maintenance of the.real property. Time and effort reports are also required. The grantee Resolution No. 2011-31 Exhibit A Page 11 of 34 B-13 City of Rancho Palos Verdes Grant Agreement No. 10-080 Page 12 AUDITS/ACCOUNTING/RECORDS (Continued) shall maintain adequate supporting records in a manner that permits tracing from the request for disbursement forms to the accounting records and to the supporting documentation. Additionally,the Conservancy or its agents may review, obtain, and copy all records relating to performance of the agreement. The grantee shall provide the Conservancy or its agents with any. relevant information requested and shall permit the Conservancy or its agents access to the grantee's premises upon reasonable notice, during normal business hours,to interview employees and inspect and copy books,records,accounts, and other material that may be relevant to a matter under investigation for the purpose of determining compliance with this agreement and any applicable laws and regulations. The grantee shall retain the required records for a minimum of three years following the later of final disbursement by the Conservancy, and the final year to which the particular records pertain. The records shall be subject to examination and audit by the Conservancy and the Bureau of State Audits during the retention periods. If the grantee retains any contractors to accomplish any of the work of this agreement, the grantee shall first enter into an agreement with each contractor requiring the contractor to meet the terms of this section and to make the terms applicable to all subcontractors. The Conservancy may disallow all or part of the cost of any activity or action that it determines to be not in compliance with the requirements of this agreement. After completing the project, the grantee shall promptly conduct a final financial and compliance audit of revenue and expenditures. An independent Certified Public Accountant shall conduct the audit and prepare a report in compliance with GAAP. In place of performing a separate audit, the grantee may submit to the Conservancy,within a time that the Conservancy specifies, a copy of the grantee's federal"single audit." COMPUTER SOFTWARE The grantee certifies that it has instituted and will employ systems and controls appropriate to ensure that,in the performance of this agreement, state funds will not be used for the acquisition, operation or maintenance of computer software in violation of copyright laws. NONDISCRIMINATION During the performance of this agreement, the grantee and its contractors shall not unlawfully discriminate against,harass, or allow harassment against any employee or applicant for Resolution No. 2011-31 Exhibit A Page 12 of 34 B-14 City of Rancho Palos Verdes Grant Agreement No. 10-080 Page 13 NONDISCRIMINATION (Continued) employment because of sex,race, color, ancestry,religious creed,national origin, ethnic group identification,physical disability(including HIV and AIDS), mental disability,medical condition,marital status, age(over 40) or sexual orientation(Government Code section 12940). The grantee and its contractors also shall not unlawfully deny a request for or take unlawful action against any individual because of the exercise of rights related to family-care leave Government Code sections 12945.1 and 12945.2). The grantee and its contractors shall ensure that the evaluation and treatment of their employees and applicants for employment are free of such discrimination,harassment and unlawful acts. Pursuant to Government Code section 12990,the grantee and its contractors shall comply with the provisions of the Fair Employment and Housing Act(Government Code section 12900 et seq.)and the applicable regulations(California Code of Regulations Title 2, section 7285.0 et seq.). The regulations of the Fair Employment and Housing Commission regarding Contractor Nondiscrimination and Compliance(Chapter 5 of Division 4 of Title 2 of the California Code of Regulations)are incorporated into this agreement by this reference. The grantee and its contractors shall give written notice of their obligations under this clause to labor organizations with which they have a collective bargaining or other agreement. This nondiscrimination clause shall be included in all contracts and subcontracts entered into to perform work provided for under this agreement. LABOR COMPLIANCE PROGRAM This agreement is funded in whole or in part with funds from the"Safe Drinking Water, Water Quality and Supply, Flood Control,River and Coastal Protection Bond Act of 2006"("Proposition 84"). Section 75075 of the Public Resources Code imposes on a body awarding any contract for a public works project financed in any part with Proposition 84 funds responsibility for adoption and enforcement of a"labor compliance program"under Labor Code section 1771.5(b). The grantee shall review these statutory provisions and related provisions to determine its responsibilities. INDEPENDENT CAPACITY The grantee, and the agents and employees of grantee,in the performance of this agreement, shall act in an independent capacity and not as officers or employees or agents of the State of California. The Executive Officer shall notify the grantee of the designation in writing. AMENDMENT Except as expressly provided in this agreement,no changes in this agreement shall be valid unless made in writing and signed by the parties to the agreement. To the extent appropriate, City of Rancho Palos Verdes shall ensure that the final designs of project are consistent with the Conservancy's 'Standards and Recommendations for Accessway Location and Development' and with all applicable federal and state statutes, regulations and guidelines governing barrier-free access for persons with disabilities. Staff further recommends that the Conservancy adopt the following findings: Based on the accompanying staff report.and attached exhibits,the Coastal Conservancy hereby finds that: The proposed project is consistent with the current Project Selection Criteria and Guidelines. 2. The proposed authorization is consistent with Chapter 9 of Division 21 of the Public Resources Code,regarding coastal.access. 3. The proposed project will serve greater than local needs. PROJECT SUMMARY: Staff recommends that the Conservancy provide up to$500,000 to the City of Rancho Palos Verdes for final design and construction of the California Coastal Trail("ccr)through the City of Rancho Palos Verdes and the Palos Verdes Peninsula Preserve. The proposed project will complete approximately nine miles of coastal trail through the City of Rancho Palos Verdes,linking the cities of Palos Verdes Estates and Los Angeles..(See Exhibit 2.) Portions of the trail currently exist,but the conditions vary widely from unimproved dirt single-track paths to improved trails with decomposed granite. However,the majority of the proposed route is currently unimproved dirt paths created by hiker use over the years. Most of these existing trails are localized and unmarked with few connections between the various bluff trails. The few improved trail segments consist of paved sidewalks,or decomposed granite and are generally unmarked. The proposed project will improve existing trails and create new connections to form a network of trails that will be signed and identified as the Coastal Trail. The project will correct the existing deficiencies by upgrading existing dirt tracks with decomposed granite and expanding the trail width Where appropriate,installing consistent CCT signs,directional trail markers,coastal interpretive panels,rest benches,trail access cross-walks and post and cable fence for,pedestrian safety,habitat protection and finally,replanting with native plants. The project will complete the coastal trail along the City of..Rancho Palos Verdes' entire coastline. The traitwill serve both pedestrians and bicyclists,in addition to providing.wheelchair access where feasible. Bicyclists will be accommodated on some portions ofthe Coastal Trail, while other portions will utilize bike lanes. The proposed trail improvements will be constructed over a route identified in both the 2008 Rancho Palos Verdes Coast Vision Plan and the City's Conceptual Trails Plan. The plan envisioned a mixed,multi-use(hike,bike,equestrian)trail with parts retained in a rugged state,while other parts are improved or sidewalk trails. In all cases the trail will create a continuous coastal trail system as close to the ocean as possible. Additionally,the trail will create connections to beaches and the Palos Verdes Nature Preserve with sufficient transportation access to encourage public use by the greater Los Angeles in-land communities. The trail alignment traverses property within the City of Rancho Palos Verdes and the Palos Verdes Nature Preserve. Palos Verdes Peninsula Land Conservancy("PVPLC") and the City of Rancho Palos Verdes have entered into an agreement whereby PVPLC will construct the trail within the Preserve and on City-owned property. The PVPLC currently serves as habitat land manager for the City of Rancho Palos Verdes and the Palos Verdes Nature Preserve. Site Description: The 13.6-square mile coastal City of Rancho Palos Verdes is located on the southwest side of the Palos Verdes Peninsula in Los Angeles County. It is bounded on the north by the communities of Rolling Hills, Rolling Hills Estates, and Palos Verdes Estates and to the east by the San Pedro neighborhood of the City of Los Angeles. The Palos Verdes Peninsula constitutes the southern boundary of Santa Monica Bay, a crescent- shaped embayrnent of about 250 miles. Unlike the flat sandy beaches and densely populated communities in the North Bay,the Palos Verdes Peninsula sits on high bluffs overlooking picturesque cove and rocky beaches. Project History: In Rancho Palos Verdes, the CCT has been part of open space planning for many years. In 2008, a route was finalized in the Rancho Palos Verdes Visions Plan. The city has taken steps to increase open space and preserve coastal habitat. The Coastal Conservancy has worked with PVPLC and the City on a variety of projects in support of conservation efforts on the peninsula. The CCT on the Palos Verdes Peninsula location has long been a high priority for the Conservancy South Coast Region,and if authorized this will be the first step toward the goal of linking the 22-mile segment traversing the beaches of Santa Monica Bay around the point to Los Angeles and Long Beach harbors. PROJECT FINANCING Coastal Conservancy 500,000.00 City of Rancho Palos Verdes 60,000.00 Total Project Costs 560,000.00 The expected source for the Conservancy funds for this project is the FY 08/09 appropriation to the Conservancy from the Safe Drinking Water, Water Quality and Supply, Flood Control, River Page 3 of 7 Resolution No.-12014Z1 EA:IIBrirExhibit A r Page 17 of 34 B-19 PALOS VERDES PENINSULA COASTAL TRAIL and Coastal Protection Bond Act of 2006,Public Resources Code section 75001 et seq. Proposition 84"). Proposition.84 authorizes the use of bond funds for projects that promote access to the coastal resources of the state and are consistent with the Conservancy's enabling legislation, Public Resources Code § 3.1-000 et seq. (Public Resources Code.§ 75060(b)). Consistency of the project with the Conservancy's statutory mission is discussed below in Consistency with Conservancy's Enabling Legislation." The proposed project will improve existing trails and create new connections to form a network of trails along the City of Rancho Palos Verdes coast. The City of Rancho Palos Verdes has set aside $60,000 to assist with the Coastal Trail improvements. PVPLC is under a long-Aerm contract for management and maintenance of Ranch Palos.Verdes Preserve, and has committed to continue.its volunteer programs. PVPLC is well qualified and experienced with engaging volunteers, as demonstrated by logging.in 12,197 volunteer hours in 2009. CONSISTENCY WITH CONSERVANCY'S ENABLING LEGISLATION: The proposed project is consistent with Division 21„ Chapter 9 of the Public Resources Code Sections 31400-31409),regarding public access and enjoyment of coastal resources. Section 31400 states that the Conservancy shall have a principal role in the implementation of a system of public accessways to and along the state's coastline. In particular,this project is consistent with Public Resources Code Sections 31.400.1 and 31400.3-,which allows the Conservancy to provide grants to local governments to develop lands for public access purposes to and along the coast and provide assistance to public agencies in establishing a system of public coastal accessways. Through the proposed action,the Conservancy would continue its role supporting the development of an important public accessway,the CCT. The proposed Rancho Palos Verdes segment of the CCT will provide nine miles of continuous trail system along the Palos Verdes Peninsula and establish the Coastal Trail on the Palos Verdes peninsula. CONSISTENCY WITH THE COASTAL CONSERVANCY'S STANDARDS AND RECOMMENDATIONS FOR ACCESSWAY LOCATION AND DEVELOPMENT: The Rancho Palos Verdes section of the CCT is consistent with the Conservancy's Standards for Accessway Location and Development as follows: Standard No. Protect the Public and Coastal Resources Consistent with this standard, the trail improvements would be located and designed in a manner that would: minimize alteration of natural landforms and be subordinate to the setting's character; prevent unwarranted hazards to the land and public safety; ensure the privacy of adjoining residences; and protect environmentally sensitive habitats. Standard No. 2: Correct Hazards Consistent with this standard all trails and other accessways will be set back from eroding bluff edges and designed and located in a manner that will prevent further bluff erosion. Standard No. 5:Environmentally Sensitive Areas Consistent with this standard, all trails would be located and designed to avoid impacts to environmentally sensitive areas. Standard No. 8: Trails Consistent with this standard, the Coastal Trail will provide a continuous trail along the coastal bluff, along with vertical trails that connect streets and parkland with the shore and scenic overlooks. Standard No. 10: Coastal Bikeways Consistent with this standard, the Coastal Trail will provide both Class I and III bike paths and routes along the coast. Standard No. 13: Barrier-Free Access Consistent with this standard,the Coastal Trail will be improved to allow for barrier free access, as required by and consistent with all applicable federal and state statutes, regulations and guidelines governing barrier-free access for persons with disabilities. CONSISTENCY WITH CONSERVANCY'S 2007 STRATEGIC PLAN GOAL(S) & OBJECTIVE(S): Consistent with Goal 1,Objective 113, the proposed project would result in Coastal Trail signs along nine miles of Coastal Trail. Consistent with Goal I,Objective 10,the proposed project would result in construction of approximately nine miles of Coastal Trail. CONSISTENCY WITH CONSERVANCY'S PROJECT SELECTION CRITERIA & GUIDELINES: The proposed project is consistent with the Conservancy's Project Selection Criteria and Guidelines, last updated on June 4,2009, in the following respects: Required Criteria 1. Promotion of the Conservancy's statutory programs and purposes: See the"Consistency with Conservancy's Enabling Legislation"section above. 2. Consistency with purposes of the funding source: See the"Project Financing"section above. 3. Support of the public: The proposed project has strong support from City of Los Angeles Councilwoman Janice Hahn as well as the public. See project support letters in Exhibit 3. Location: The proposed project is located within the coastal zone in the City of Rancho Palos Verdes. 5, Need: Without Conservancy funding to complete the Rancho Palos Verdes segment of the California Coastal Trail,the trail would remain in its current state, limiting regional connectivity with the greater 1,200 mile CCT. 6. Greater-than-local interest: The City of Rancho Palos Verdes I Palos Verdes Peninsula Preserve is an important open space and coastal habitat resource for inland communities of Los Angeles County that has an urban population of nearly 10 million people. When completed, approximately nine miles of continuous Coastal Trail will not only serve residents of several surrounding communities, but also serve the larger population by providing improved and new access opportunities through inland trail links,public transportation,or other forms of transportation. Additionally, it will link existing city, county and state beach parks and access facilities into a coordinated access system of regional and statewide significance. 7. Sea level rise vulnerability: The proposed trail route traverses areas well outside the elevations projected for sea level rise vulnerability. The Coastal Trail alignment traverses along ocean bluffs which average between 100-200 feet in elevation.The Rancho Palos Verdes Coastal Specific Plan trails will be setback from the bluff edges a minimum of 15 feet and use erosion control native plants restoration where needed. Maintenance,by PVPLC,will correct potential erosion from trail use when needed. Additional Criteria 8. Leverage: See the"Project Financing" section above. 9. Realization of prior Conservancy goals: See the"Project History"section above. 10. Minimization of greenhouse gas emissions: The City of Palos Verdes and the Palos Verdes Land Conservancy will use mostly hand tools and other low emissions construction techniques wherever possible when constructing trails, however some mechanized construction methods may be necessary, but will be kept to a minimum. CONSISTENCY WITH LOCAL COASTAL PROGRAM POLICIES: Palos Verdes Peninsula Coastal Trail involves properties that are located within the Coastal Zone and are subject to the jurisdiction of the City of Rancho Palos Verdes Specific Coastal Plan adopted 1978;'certified 1983). The proposed project is consistent with the relevant sections of the Specific Coastal Plan (SCP)and the City of Rancho Palos Verdes's General Plan. The SCP's Path and Trail Networks Subsection within the Urban Environment Element recognizes "that recreational and environmental amenities found along the coastal area are of regional and state-wide significance." Specifically, a network of paths and trails are"an integral part of the locomotion component of the infrastructure,walkways,bikeways and coastal access" in the SCP. The Corridors Element"joins together the various physical elements proposed by the Plan through their use preservation,and enhancement of access,edges,and visual and natural characteristics."(C-1) The SCP identifies Palos Verdes Drive West/South/25th Street as the primary"access corridor"within the coastal region and acts as the"spine"of the access corridor concept,connecting"a series of laterals and loops within the coastal region."(C-5)The proposed project implements the SCP's Access Corridor. (see Exhibit 2) COMPLIANCE WITH CEQA: The City of Rancho Palos Verdes has determined that the construction of the RPV Coastal Trail will not result in adverse impacts to the environment under the California Environmental Quality Act("CEQA"). The REV segment of the CCT primarily transverses existing paths that need minor site or roadway improvements or the installation of identification signs. These improvements to the existing trail will not adversely impact the environment including biological resources. The project is categorically exempt from CEQA under 14 California Code of Regulations, Section 15301, for Existing Facilities,and Section 15304 for Minor Alterations to Land in that no major structures such as bridges or retaining walls will be constructed as part of the project. PROJECT DISCUSSION The project consists of the preparation of PS&E construction documents to design a new median trail on Palos Verdes Drive West (PVDW) between Marguerite Drive and approx. 100’ north of Lunada Vista (to connect to the City of Palos Verdes Estates’ existing trail), include new landscaping and irrigation of said median and installation of one (1) new pedestrian crosswalk on southbound PVDW, just north of Marguerite Drive. PENCO previously performed a topographic survey of the project location (completed in January 2018) and prepared a preliminary (30%-level) design plan of the proposed trail improvements (see Exhibit A on page 6). It is our understanding the trail alignment shown on the preliminary design plan is the City-approved alignment and will serve as the basis of the preparation of the Final design PS&E construction documents. The new trail surface is proposed to consist of decomposed granite and is intended to comply with the City’s Trail Network standards and ADA standards. Additional proposed improvements consist of: 1) consideration of a drainage swale adjacent to the median trail to mitigate surface erosion, 2) a composite header in lieu of redwood header for each edge of the trail, which may include doweling the header or verify if interlocking is an option to mitigate displacement at the header joint, and 3) removing and reconstructing the existing curb ramp at the northwest corner of PVDW and Marguerite Drive to ADA compliance and to align with the new median crossing and 4) installing a rectangular rapid flashing beacon (RRFB) for the new pedestrian crosswalk, in conformance to the City’s requirements and reference the latest edition of the California Manual C-1 City of Rancho Palos Verdes. Deliverables are prepared in accordance with engineering practices that address required standards and guidelines. Documents submitted to the City are independently checked and back-checked. The review process will include a 2nd thorough “back check” review of all recommended corrections Construction Document Processing Process 90% PS&E and 100% PS&E for approval with City staff (2 City plan checks). After receiving final approval of the 100% PS&E by the City, PENCO will provide the City with a project file of the final signed plans on Mylar for City’s signature, specifications and construction cost estimate. 6 SPECIAL PROVISIONS Prepare special provisions only (not a full specification package) in SSPWC Greenbook (2015 Edition) format for the proposed median trail and pedestrian crossing improvements, consisting of earthwork, decomposed granite trail, trail header, curb ramps, signing and striping and the rectangular rapid flashing beacon. Regarding traffic control requirements for the proposed improvements, PENCO will provide strict requirements and restrictions regarding staging and traffic control in the project specifications, with a focus on minimizing public inconvenience, and include the following: 1) Require the Contractor to “button up” and reopen the roadway to traffic at the end of each working day; 2) Maintain access to residents; 3) Maintain emergency access at all times; 4) Maintain adequate travel lanes, bike and pedestrian access during construction; and 5) Establish clear working hours and lane closures.
