Sample sign (page B-1) BACKGROUND AND DISCUSSION: The City and its residents have recently experienced significant congestion and other public health, safety and welfare issues related to: (1) the high volume of people seeking to access the Palos Verdes Nature Preserve (“Preserve”), including the Portuguese Bend Reserve near Del Cerro Park; and (2) the presence of individuals seeking to access the Preserve at night when it is closed to the public, to engage in activities such as unpermitted night-time hiking and illicit drug use. At its July 31, 2018, meeting, the City Council discussed possible solutions to the foregoing issues at length. One of the proposed solutions on which the City Council reached a consensus was prohibiting night-time parking on Crenshaw Blvd. between the entrance to the Portuguese Bend Reserve and the intersection of Crest Rd. As such, the City Council directed Staff to take the measures necessary to formally impose this prohibition. Pursuant to City Council direction, the City 1 01203.0006/497172.2 Attorney has prepared resolution (Attachment A) prohibiting night-time parking on the subject portion of Crenshaw Blvd. The City currently allows day-time and night-time street parking along the portion of Crenshaw Blvd. between the entrance to the Portuguese Bend Reserve and the intersection of Crest Rd., an area which contains 41 parking spaces (the “Parking Spaces”), including 10 recreation permit spaces. Staff has briefed the Traffic Safety Committee (TSC) of this proposed action on August 20, 2018, and the TSC is in full support of this proposal. California Vehicle Code (“CVC”) Section 22507(a) provides that local authorities may, by ordinance or resolution, prohibit or restrict the stopping, parking, or standing of vehicles on certain streets or highways, or portions thereof, during all or certain hours of the day. The draft resolution would prohibit night-time parking in the Parking Spaces pursuant to the authority of CVC Section 22507(a). Night-time parking, for purposes of the resolution, is defined as the time period between one hour after sundown and one hour before sunrise. Under CVC Section 22507(a), the resolution shall not apply until signs or markings giving adequate notice thereof have been placed. Accordingly, the draft resolution provides that, as soon as practicable after its adoption, the City Manager shall cause signs to be placed in the area as deemed necessary to provide adequate notice of the new parking restrictions. The resolution also specifies the required content of the signs, which is consistent with the content of other signs currently in place in the City (Attachment B) pursuant to RPVMC Section 12.16.030 (except with respect to the authority underlying the restriction). Adoption of the proposed resolution would prohibit night-time parking on the subject portion of Crenshaw Blvd. every night. The resolution would take effect immediately, and the restrictions would be enforceable as soon as the necessary signage is in place. ALTERNATIVES: In addition to the Staff recommendation, the following alternative actions are available for the City Council’s consideration: 1. Direct Staff to revise the proposed resolution, and to agendize the revised resolution for adoption at the next City Council meeting. 2. Direct Staff to take no action this time. 2 RESOLUTION NO. 2018-__ A RESOLUTION OF THE CITY COUNCIL OF CITY OF RANCHO PALOS VERDES, CALIFORNIA, PROHIBITING NIGHT-TIME PARKING ON CRENSHAW BOULEVARD FROM THE ENTRANCE OF THE PORTUGUESE BEND RESERVE TO THE INTERSECTION OF CREST ROAD WHEREAS, the City of Rancho Palos Verdes (“City”) is a general law City located in the County of Los Angeles, State of California; and, WHEREAS, California Vehicle Code Section 22507(a) provides that local authorities may, by ordinance or resolution, prohibit or restrict the stopping, parking, or standing of vehicles on certain streets or highways, or portions thereof, during all or certain hours of the day, and that, with the exception of alleys, the ordinance or resolution shall not apply until signs or markings giving adequate notice thereof have been placed; and, WHEREAS, in order to protect public health, safety and welfare by addressing criminal activities and nuisance impacts arising from unlawful or unpermitted access to and use of the Portuguese Bend Reserve, which access and use is facilitated by the night-time availability of street parking on Crenshaw Boulevard from the entrance of the Portuguese Bend Reserve to the intersection of Crest Road, the City Council sees fit to prohibit night-time parking on such portion of Crenshaw Boulevard. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: Section 1: That the foregoing recitals are true and correct, and are incorporated herein by reference. Section 2: That the City Council hereby adopts the following findings: A. The City currently allows day-time and night-time street parking along Crenshaw Boulevard, from its origin at the entrance to the Portuguese Bend Reserve (“Reserve”), a part of the Palos Verdes Nature Preserve, to the intersection of Crest Road, an area which contains several dozen parking spaces (the “Parking Spaces”). B. There are residential neighborhoods of the City surrounding the stretch of Crenshaw Boulevard where the Parking Spaces are located. C. The City and its residents have recently experienced significant congestion and other public health, safety, and welfare issues related to: (1) the A-1 Resolution No. 2018-__ Page 2 of 3 high volume of people seeking to access the Reserve; and (2) the presence of individuals seeking to access the Reserve at night, when the Reserve is closed to the public. D. The Parking Spaces are frequently used by individuals seeking to unlawfully enter the Reserve at night, to engage in a range of activities including unpermitted night-time hiking and illicit drug use, and the availability of the Parking Spaces at night attracts the presence of such individuals by facilitating their access to the Reserve. E. The availability of the Parking Spaces at night has resulted in undue night-time congestion (which increases the risk of vehicular and pedestrian accidents due to obstructed visibility), trespassing and other criminal activities, and noise and other public nuisance impacts in the residential neighborhoods surrounding the Parking Spaces and the entrance to the Reserve, to the detriment of the residents of such City neighborhoods. Section 3: That, based on the findings set forth in Section 2, and in order to protect and promote public health, safety and welfare, the City Council hereby prohibits night-time parking along Crenshaw Boulevard, from the entrance of the Portuguese Bend Reserve to the intersection of Crest Road. For purposes of this resolution, “night-time” shall mean the time period beginning one hour after sundown and ending one hour before sunrise. Section 4: That, in accordance with Vehicle Code Section 22507, the parking restrictions set forth in Section 2 shall not apply or be enforced until signs or markings giving adequate notice of the restrictions have been placed. The City Manager, or his or her designee, as soon as practicable after adoption of this resolution, shall cause the placement of signs along the subject portion of Crenshaw Boulevard. The number and location of the signs or markings shall be as deemed necessary by the City Manager to give adequate notice of the restrictions. The signs shall read substantially as follows: NO PARKING BETWEEN ONE HOUR AFTER SUNDOWN & ONE HOUR BEFORE SUNRISE. VEHICLES IN VIOLATION ARE SUBJECT TO BEING CITED AND TOWED AT OWNER’S EXPENSE. Section 6: That if any section, subsection, subdivision, sentence, clause, phrase, or portion of this resolution is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remainder of this resolution. The City Council hereby A-2 Resolution No. 2018-__ Page 3 of 3 declares that it would have adopted this resolution, and each and every section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional. Section 7: That the City Clerk shall certify to the passage, approval, and adoption of this resolution, and shall cause this resolution and its certification to be entered in the Book of Resolutions of the City Council of the City. Section 8: That the adoption of this resolution does not constitute a “project” within the meaning of Section 15378 of the California Environmental Quality Act (CEQA) Guidelines, as the parking restrictions do not have the potential for resulting in either a direct physical change to the environment, or a reasonable foreseeable indirect physical change in the environment.
