BACKGROUND AND DISCUSSION:
In 2010, Staff presented the Palos Verdes Drive East Safety Improvements
Implementation Plan to the City Council (Attachments B & C). This plan included nine
priority projects that were identified by the then-Traffic Safety Commission and the
City’s Traffic Engineering consultant as a result of the Palos Verdes Drive East Safety
Improvements Preliminary Study Report (performed and prepared by Willdan
Engineering). The Palos Verdes Drive East Traffic Safety Improvements from Bronco
Dr. to Lower Headland Dr. Project evolved from the project priority list [KF1]approved by
the City Council (Table 1 – item 1 & 6 and Exhibits 16, 18-A & 18-B of Attachment C). In
2014, the City Council approved a resolution to receive federal reimbursement for the

Project (Attachment D). The total budget for this project is $502,095, with 90% funded
by Federal Highway Safety Improvement Program (HSIP) funds and 10% local match.
Staff and the Consultant Design Engineer met with the residents of the project area and
representatives of the local equestrian community in 2015 to gather input regarding the
design of this project. The pre-final engineering drawings were developed based on
input from these groups. Subsequently, there were two public meetings with the
residents adjacent to the trail and the interested parties (held in April and May 2018) to
go over the scope of the project and seek their input (Attachment A). Attendees at both
meetings were almost evenly split between supporting and opposing the project.
At this point, the design expenditures for this project have been $36,000. If the project
is canceled, the City will need to reimburse the State ninety percent of the design cost.
If the project is to be finalized, the current funding is sufficient to complete the design
and the construction. However, the final cost will be determined once the project is
advertised and bids are received. Furthermore, the proposed improvements for this
project will require the removal of existing trees and vegetation along the trail path
which will require an additional $150,000 for landscape improvements as part of a
mitigation plan.
Staff will present the findings of the public input as part of this project status update to
the City Council at the meeting. Based upon these findings and the lack of clear
community consensus for or against this project, Staff seeks the City Council’s direction
as to how (or if) to proceed with the project.

PVDE at Bronco Intersection Improvements
Project Description: Equestrian Trail along PVDE from Bronco Drive to Lower Headland Drive.
Project Development Summary
This project development summary will provide a chronological record of the activities completed to date to improve the
vehicular, pedestrian and equestrian traffic safety along Palos Verdes Drive East (PVDE) near Bronco Drive and Headland Drive.
In 2010, a comprehensive report (Palos Verdes Drive East Preliminary Study by Willdan) was presented to City Council that
identified key areas along the PVDE corridor. The corridor is generally a narrow, north-south two-lane roadway that serves as
a primary traffic artery for the Palos Verdes Peninsula. Within the City of Rancho Palos Verdes, PVDE extends six miles from
the North City Limit, north of Conestoga Drive, to Palos Verde Drive South. PVDE serves not only motor vehicles, but also
serves pedestrians, bicyclists and equestrians. For most of its length, however, there are minimal separate provisions for
pedestrians, bicyclists or equestrians, and this situation sometimes creates conflicts between the motor vehicles and the other
modes of transportation.
The purpose of the Study Report was to identify key areas for safety improvements, to serve as the basis for obtaining future
outside funding, and to provide a programming tool for the Capital Improvement Program (CIP) and City budget. Accordingly,
the Study Report reviewed the existing facilities and conditions of PVDE in the City of Rancho Palos Verdes then established a
priority listing of the key areas requiring safety improvements. The current project extending from Bronco Drive to the far
Headland Drive was established as the highest priority project due to the roadway geometry and narrow pavement width
coupled with the potential pedestrian, bicycle and equestrian conflicts.
The City staff applied for and received a federal grant (90% funded) to address this priority project and has since processed
the required right of way and environmental clearances as well as completed the preliminary construction plans. During the
project design period about three years ago, the designer and City staff met with representatives of the local equestrian
community to obtain first hand input regarding their experience with the typical equestrian paths of travel and to document
their safety observations. Their input was instrumental in the design development and led to providing the proposed roadway
crossing at the far Headland Drive location with a flashing warning device that will be operated by the rider that desires to
cross the road. This location was selected due to the adequate sight distance available at that location.

The equestrian traffic will cross the roadway and progress westerly towards Bronco Drive along the north side of the street.
There will be extensive removal of the existing trees and shrubbery shown above to provide an area for the widening into the
existing slope. The typical section of the trail is shown below.

There will be a five-foot tall retaining wall constructed approximately eight feet into the slope to provide for the equestrian
trail, which will be bordered on the street side with a wooden rail fence similar to one constructed last year with the paving
rehabilitation project. The equestrian zone will be shared with pedestrians, while bicycle traffic will stay in the six-foot curb
lane between the white edge line and the curb. The equestrian trail is planned to be continuous with the wall offset from the
curb line, as shown above, at just over eight feet. The clear zone will be just under seven feet. The exception to this layout will
occur at two existing drive entrances where the equestrian and pedestrian traffic will be continuous across the driveways but
without the retaining wall.
The drive entrances both extend to approximately 6-feet of the travel way with decorative pavers and pilasters located well
with the public right of way. The lower 8-feet of each entrance will be replaced with concrete pavement allowing the
equestrian traffic to cross each in line with the trail on either side. The concrete pavement is necessary to provide a non-slip
surface for the equestrian traffic.
The trail on either side of each entrance will be graded to raise up to the level of each driveway, thereby avoiding extensive
reconstruction of the steep driveways. As the pilasters are within the crossing zone in both cases, they must be removed to
provide clear passage.

Provisions have been included in the project construction documents to re-landscape the areas disrupted during construction
of the retaining wall. After the wall is constructed, but still part of the construction contract, the detailed landscape plan will
be created. Participation from the affected homeowners will be solicited to provide input into the replacement landscape
details. The City will provide a concept rendering prepared by a landscape architect to facilitate this process.
On April 5, 2018, City staff invited residents to an informal presentation of the project at City Hall. The invitations were
extended to residents located within 500 feet of the project. A good representation from the community attended and voiced
their opinion on various project elements. It was apparent that the equestrian community was in favor of the project,
particularly the flashing beacon crossing and the off-pavement equestrian path. However, they expressed concern with
crossing the drive entrances. The plans are being changed to better accommodate those crossings.
The property owners, whose frontage will be cleared to make space for the equestrian trail, were not in favor of that project
element. The current plan changes will affect the drive entrances with modifications over the lower 8-feet of each entrance.
Since the meeting, there has been some communication with homeowners outside of the 500-foot radius that would like to
also provide input.

RECOMMENDATION
Approve the Palos Verdes Drive East Safety Improvements Preliminary Study Report and
modify the Citywide Traffic and Roadway Safety Goal of improving traffic and roadway
safety in residential neighborhoods and on arterial streets to include an implementation
plan.
BACKGROUND
The City Council adopted Tactical Plan for 2009 sets goals for the two year period ending
in December 2010.Milestones 1 and 2 of the Citywide Traffic and Roadway Safety Goal
reads as follows:
1.By June 30,2009,subject to the City's receipt of a requested $280,000 state grant,put
out for bid the construction of the Palos Verdes Drive East roadway safety improvements.
This item will be brought back to the City Council for further direction if the City does not
receive the requested grant award.
2.By November 30,2009,following the implementation of the FY 08-09 Palos Verdes
Drive East roadway safety improvements referenced in Milestone No.1,present a
conceptual planning report to City Council to address additional traffic and safety
improvements on Palos Verdes Drive East.
Milestone No.1 is work in progress.The Palos Verdes Drive East (PVDE)roadway
safety improvement early action project,designed to improve signage and guardrails along
PVDE,will be implemented while studies for a multi-modal transportation system,as
referenced in Milestone No.2,on PVDE are in progress.A grant in the amount of
$280,500 has been awarded to the City for design and construction of the project.
Construction is expected to begin as early as September 2010.Considering the current
progress of the project,milestone no.1 is revised:
"By September 30,2010,award a construction contract for the PVDE early action safety
improvement project."

Milestone No.2 is work in progress.The PVDE Preliminary Study Report,completed by
Willdan Engineering,is the first step towards creating a multi-modal transportation corridor
that is safe for all users.The report,provided to Council under a separate cover,is the
result of successful collaboration among the Traffic Safety Commission (TSC),the public
and staff.The revised milestone no.2 reads:
"By April 30,2010,present an implementation plan to initiate priority projects as
recommended by the conceptual planning report entitled "Palos Verdes Drive East
Preliminary Study Report,January 2010".
During the plan development period,staff participated in several team meetings that
included Willdan Engineering and the TSC.The meetings were designed to develop a
plan of action to engage the community in the process.
Subsequent to the team meetings,three community workshops were held to receive public
input regarding PVDE.Each workshop had an unprecedented attendance and concluded
with excitement and hope by the residents.The three meetings combined yielded 150
participating residents.Table 1 summarizes the workshop dates and number of attendees:

The PVDE Preliminary Study Report represents successful participation and fact finding by
all parties involved and is fully supported by the Traffic Safety Commission.We expect
representatives from the Commission to be present at the Council meeting to advocate for
approval of the preliminary plan and moving forward to the implementation phase.The
TSC meeting minutes are included as an attachment to this report.
Staff is requesting City Council to approve the PVDE Preliminary Study Report and if
deemed acceptable,amend the tactical goal to include updated milestones.
ALTERNATIVE
As an alternative,the City Council may choose to take no action at this time or to continue
this item to a future Council meeting.No action would result in staff not proceeding with
the PVDE Preliminary Study Report and no proposed modifications to the Citywide Traffic
and roadway safety tactical goal.
FISCAL IMPACT
Approving staff's recommendation will not result in any adverse impacts to the General
Fund.Completion of activities associated with milestone no.1 is fully funded by Highway

DISCUSSION
In coordination with sub-committee members of the Traffic Safety Commission and the City's
Traffic Engineering consultant,nine priority projects,as a result of the PVDE Preliminary Study
Report,have been identified that when implemented on an incremental basis,will result in a
safer corridor for all users.
As seen in Table 1,each priority project has been prioritized based an estimated project
budget and implementation timeline.Palos Verdes Drive East is scheduled for resurfacing in
Fiscal Year 11-12.Priority projects No.1-5 can all be implemented partially,if not entirely,at
the time Palos Verdes Drive East is resurfaced.The resurfacing project will include repairs
and upgrades to sidewalks,improve walkway conditions and address all elements of the
circulation network including root pruning,tree trimming and shrubbery removal.
Funding for Priority Projects Nos.6-9 has not yet been determined.Staff recommends
including them in the City's 5-year CIP-Unfunded projects list and implementation will occur as
funding becomes available.The PVDE Preliminary Study Report and the proposed
implementation plan will be used as a tool to secure external funding for all proposed projects.
ALTERNATIVE
As an alternative,the City Council may choose to take no action at this time or to continue this
item to a future Council meeting.No action would result in staff not proceeding with the PVDE
Implementation Plan.
FISCAL IMPACT
Approving staffs recommendation will not result in any adverse impacts to the General Fund.
Priority Project budgets in excess of $100,000 will be included in the CIP schedule.All other
projects can be programmed as appropriate with the current Traffic Management program of
the City's approved budget.

RECOMMENDATIONS
1) Approve the Program Supplement Agreement No. N015 for the Palos Verdes Drive
East Bronco Drive to Headland Drive Safety Project.
2) ADOPT RESOLUTION NO. 2014-__ , A RESOLUTION OF THE CITY COUNCIL
FOR THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, APPROVING
PROGRAM SUPPLEMENT AGREEMENT NO. N015 FOR FEDERAL FUNDING OF
THE PALOS VERDES DRIVE EAST BRONCO DRIVE TO HEADLAND DRIVE
SAFETY PROJECT.
BACKGROUND
The Capital Improvement Program includes a project to construct safety improvements
along Palos Verdes Drive East between Bronco Drive and Headland Drive. The total
project cost of $542,000 is primarily funded (90%) by Federal Highway Safety
Improvement funds and partially funded with a 10% local match. The project will
include rumble strips, a median barrier, guardrails and high visibility warning devices.
Funding for the project is allocated in phases. Table 1 outlines the funding phases and
corresponding amounts:

In order for the City to be eligible to invoice for reimbursement of federal funds, the City
must execute a supplemental program agreement with Caltrans per the State
Transportation Program Local (STPL) guidelines. Attached to this staff report, for City
Council's consideration, is the Program Supplement Agreement No. N015 for $37,530
which is 90% of the design cost for the project. The City will initiate the project by soliciting
qualified consultants to commence the design efforts. Approval of the agreement and
adoption 0f a resolution is necessary to obtain reimbursement for costs associated with the
project.
Upon execution by the City and Caltrans, the City can begin to invoice Caltrans for federal
funding reimbursements in the amount of $37,530. Resolution No. 2014-_ is the formal
authorization by the City required for executing the Program Supplement Agreement.
The recommended action authorizes the Mayor and City Clerk to execute Supplemental
Agreement No. N015.
CONCLUSION
Adopting staff's recommendation will set forth the conditions for federal funding
reimbursement for the Palos Verdes Drive East Bronco to Headland Safety project.

1. The ADMINISTERING AGENCY will advertise, award and administer this project in
accordance with the current published Local Assistance Procedures Manual.
2. ADMINISTERING AGENCY agrees that it will only proceed with work authorized for
specific phase(s) with an "Authorization to Proceed" and will not proceed with future
phase{s) of this project prior to receiving an "Authorization to Proceed" from the STATE
for that phase(s) unless no further State or Federal funds are needed for those future
phase{s).
3. ADMINISTERING AGENCY agrees, as a minimum, to submit invoices at least once every
six months commencing after the funds are encumbered for each phase by the execution
of this Project Program Supplement Agreement, or by STATE's approval of an applicable
Finance Letter. STATE reserves the right to suspend future authorizations/obligations for
Federal aid projects, or encumberances for State funded projects, as well as to suspend
invoice payments for any on-going or future project by ADMINISTERING AGENCY if
PROJECT costs have not been invoiced by ADMINISTERING AGENCY for a six-month
period.
If no costs have been invoiced for a six-month period, ADMINISTERING AGENCY
agrees to submit for each phase a written explanation of the absence of PROJECT
activity along with target billing date and target billing amount.
ADMINISTERING AGENCY agrees to submit the final report documents that collectively
constitute a "Report of Expenditures" within one hundred eighty (180) days of PROJECT
completion. Failure of ADMINISTERING AGENCY to submit a "Final Report of
Expenditures" within 180 days of PROJECT completion will result in STA TE imposing
sanctions upon ADMINISTERING AGENCY in accordance with the current Local
Ass1stance Procedures Manual.
4. The Administering Agency shall not discriminate on the basis of race, religion, age,
disability, color, national origin, or sex in the award and performance of any Federal-
assisted contract or in the administration of its DBE Program Implementation Agreement.
The Administering Agency shall take all necessary and reasonable steps under 49 CFR
Part 26 to ensure nondiscrimination in the award and administration of Federal-assisted
contracts. The Administering Agency's DBE Implementation Agreement is incorporated
by reference in this Agreement. Implementation of the DBE Implementation Agreement,
including but not limited to timely reporting of DBE commitments and utilization, is a legal
obligation and failure to carry out its terms shall be treated as a violation of this
Agreement. Upon notification to the Administering Agency of its failure to carry out its
DBE Implementation Agreement, the State may impose sanctions as provided for under
49 CFR Part 26 and may, in appropriate cases, refer the matter for enforcement under 18
U.S.C. 1001 and/or the Program Fraud Civil Remedies Act of 1986 (31 U.S.C. 3801 et
seq.).
5. As a condition for receiving federal-aid highway funds for the PROJECT, the

Administering Agency certifies that NO members of the elected board, council, or other
key decision makers are on the Federal Government Excluded Parties List System
(EPLS).
6. Any State and Federal funds that may have been encumbered for this project are
available for disbursement for limited periods of time. For each fund encumbrance the
limited period is from the start of the fiscal year that the specific fund was appropriated
within the State Budget Act to the applicable fund Reversion Date shown on the State
approved project finance letter. Per Government Code Section 16304, all project funds
not liquidated within these periods will revert unless an executed Cooperative Work
Agreement extending these dates is requested by the ADMINISTERING AGENCY and
approved by the California Department of Finance.
ADMINISTERING AGENCY should ensure that invoices are submitted to the District
Local Assistance Engineer at least 75 days prior to the applicable fund Reversion Date to
avoid the lapse of applicable funds. Pursuant to a directive from the State Controller's
Office and the Department of Finance; in order for payment to be made, the last date the
District Local Assistance Engineer can forward an invoice for payment to the
Department's Local Programs Accounting Office for reimbursable work for funds that are
going to revert at the end of a particular fiscal year is May 15th of the particular fiscal
year. Notwithstanding the unliquidated sums of project specific State and Federal funding
remaining and available to fund project work, any invoice for reimbursement involving
applicable funds that is not received by the Department's Local Programs Accounting
Office at least 45 days prior to the applicable fixed fund Reversion Date will not be paid.
These unexpended funds will be irrevocably reverted by the Department's Division of
Accounting on the applicable fund Reversion Date.
7. Award information shall be submitted by the ADMINISTERING AGENCY to the District
Local Assistance Engineer within 60 days of project contract award and prior to the
submittal of the ADMINISTERING AGENCY'S first invoice for the construction contract.
Failure to do so will cause a delay in the State processing invoices for the construction
phase. Please refer to Section 15.7 "Award Package" of the Local Assistance
Procedures Manual.

NO. N015 FOR FEDERAL FUNDING OF THE PALOS
VERDES DRIVE EAST BRONCO TO HEADLAND SAFETY
PROJECT
WHEREAS, the Highway Safety Improvement program provides grant funds to
eligible agencies to improve and enhance the safety of highway facilities and traffic
control devices that will improve traffic flow and safety for roadway users; and
WHEREAS, the California Department of Transportation oversees the grant
program and authorizes the encumbrance and disbursement of Federal-Aid funds; and
WHEREAS, before grant funds can be made available, the City of Rancho Palos
Verdes ("Administering Agency" or "City") and the California Department of
Transportation are required to enter into a program supplement agreement, thereby
establishing terms and conditions applicable to the City when receiving grant funds for
the designated project; and
WHEREAS, no invoices for reimbursement of costs can be processed until a
program supplement agreement is fully executed;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY RESOLVE AND ORDER AS FOLLOWS:
Section 1. The City Council hereby approves Program Supplement Agreement
No. N015, which is attached hereto and incorporated herein by this reference, regarding
Project Number HSIPL-5413(015). The City Council authorizes the Mayor to execute
Program Supplement Agreement No. N015 and directs the City Clerk to attest thereto.
Section 2. The City Council hereby authorizes the Mayor to execute this
Resolution and directs the City Clerk to attest thereto.
Section 3. The City Council hereby appoints and authorizes the Public Works
Director, and his or her designee, as the agent for the City to conduct all negotiations,
execute and submit all documents including but not limited to applications, agreements,
amendments, and payment requests which may be necessary for the completion of the
aforementioned projects.
