A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES, CALIFORNIA, AMENDING RESOLUTION NOS. 2011-
62, 2015-111, AND 2017-40 ADOPTING REVISIONS TO THE
MANAGEMENT EMPLOYEE PERSONNEL RULES AND AMENDING
RESOLUTION NO. 2009-088 TO ADOPT BENEFIT CHANGES FOR
EMPLOYEES IN MANAGEMENT AND NON-REPRESENTED
CONFIDENTIAL CLASSIFICATIONS
WHEREAS, on January 31, 2002, the City Council previously adopted the
City's Management Personnel Rules and Procedures through Resolution No.
2002-06, which has been subsequently amended by Resolution Nos. 2002-19,
2005-134, 2007-45, 2011-62, and 2015-111; and
WHEREAS, on July 18, 2017, City Council adopted Resolution No. 2017-
40 to amend the Management Employee Personnel Rules and amend
Resolution No. 2009-088 to authorize an ongoing monthly contribution in an
amount equal to $130 per month ($60 per biweekly pay period) per employee
on a pre-tax basis to an employee retirement health savings account, which
amount shall increase by the Year Ended March Consumer Price Index for
Los Angeles County, CA at the beginning of each fiscal year; and
WHEREAS, the Bureau of Labor Statistics (BLS) introduced a new
geographic area sample for the Consumer Price Index which removed Riverside,
California from the Los Angeles-Riverside-Orange County, CA geographic area
sample and the new Core Based Statistical Area covering the City is Los
Angeles-Long Beach-Anaheim, CA as of January 2018; and
WHEREAS, the City Council desires to clarify that the proper name and
title of the index being used to determine any cost-of-living adjustments in the
City's contribution towards employee retirement health savings accounts is the
Consumer Price Index for All Urban Consumers (CPI-U) based upon the Los
Angeles-Long Beach-Anaheim, CA geographic area sample; and
WHEREAS, the City Council now desires to amend the City's
Management Employee Personnel Rules to reflect this clarification in index title
and change in geographic area sample upon which the City's contribution to the
employee retirement health savings plan is pegged, from Los Angeles-Riverside-
Orange County, CA geographic area sample to the new BLS Core Based
Statistical Area covering the City, Los Angeles-Long Beach-Anaheim, CA; and
WHEREAS, the CPI-U for Los Angeles-Long Beach-Anaheim, CA for the
year ended March 2018 was approximately 3.8%; and
WHEREAS, from time to time these rules must be revised due to relevant
changes in federal and state personnel law.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS
FOLLOWS:
Section 1: The Management Employee Personnel Rules are amended as
follows:
Rule VIII. RETIREMENT AND OTHER BENEFITS
SECTION 1. RETIREMENT HEALTH SAVINGS ACCOUNT:
Employees shall be enrolled in the retirement health savings
account upon hire. The account is funded via a one percent (1%)
employee deduction and a CITY contribution. The City's annual
contribution shall be effective the first full pay period in July by the
percentage increase in the Consumer Price Index for All Urban
Consumers (CPI-U) in the Los Angeles-Long Beach-Anaheim, CA
geographic area sample for the twelve (12) month period ending
March of each fiscal year.
Section 2: Resolution No. 2009-088 is amended to authorize an ongoing
monthly contribution in an amount equal to $62.28 per biweekly pay period per
employee on a pre-tax basis to an employee retirement health savings account,
which amount shall increase by the Year Ended March Consumer Price
Index for All Urban Consumers (CPI-U) for Los Angeles-Long Beach-Anaheim,
CA at the beginning of each fiscal year.
