AGENDA DESCRIPTION:
Consideration and possible action to approve the Second Amendment to the
Memorandum of Understanding between the City and the Rancho Palos Verdes
Employee Association (RPVEA MOU FY 2017-2020) and related draft resolutions to
update the approved salary schedule for Competitive, Confidential, Management and
Part-time classifications.
RECOMMENDED COUNCIL ACTION:
(1) Adopt Resolution No. 2018-__, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF RANCHO PALOS VERDES, CALIFORNIA APPROVING THE
SECOND AMENDMENT TO THE RPVEA MOU FY 2017-2020; and,
(2) Adopt Resolution No. 2018-__, A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF RANCHO PALOS VERDES, CALIFORNIA, AMENDING AND
RESTATING THE SALARY AND HOURLY SCHEDULE FOR THE
COMPETITIVE, MANAGEMENT, CONFIDENTIAL AND PART-TIME CLASSIFI-
CATIONS; AND SUPERSEDING THE CITY SALARY SCHEDULE IN
RESOLUTION NO. 2017-61.

BACKGROUND AND DISCUSSION:
On July 18, 2017, the City Council adopted Resolution No. 2017-39, which approved a
Memorandum of Understanding between the City and the Rancho Palos Verdes
Employee Association, the recognized employee organization for the City’s designated
Competitive Unit, for the period of July 1, 2017 through June 30, 2020 (RPVEA MOU
2017-2020)(Attachment A). The RPVEA MOU 2017-20 provided for a 2.5 % salary cost
of living (COLA) increase for all RPVEA represented employees.
At the same meeting, the City Council also adopted Resolution No. 2017-41, which
approved an updated Salary and Hourly Schedule for the Competitive Unit pursuant to
the RPVEA MOU 2017-20 and which also provided updated Management, Confidential
and Part-time Classifications salary ranges based on approval of the same 2.5% COLA
provided to RPVEA represented employees.
On November 8, 2018, the City Council adopted Resolution No. 2017-61 which
approved a Salary and Hourly Schedule for the Competitive, Management, Confidential
and Part-time Classifications that standardized the reporting of compensation for full-
time employees (annual salaries) and for part-time employees (hourly rates). The
resolution also adjusted the salary range for five classifications (from 3 to 31 cents) after
it was identified during the conversion from the City’s legacy payroll system (ADP) to
Munis that, due to rounding in ADP, some of the incumbents’ salaries were outside of
the approved salary range (Attachment B).
At the same meeting, the City Council adopted Resolution No. 2017-62, which approved
the First Amendment to the RPVEA MOU 2017-20 revising the dates for vacation
buyback/cashout (Attachment C).
In January 2018, the Bureau of Labor Statistics (BLS) introduced a new geographic
area sample for the Consumer Price Index (CPI-U) which removed Riverside, CA from
the Los Angeles-Riverside-Orange County, CA geographic area sample. The new Core
Based Statistical Area covering the City is Los Angeles-Long Beach-Anaheim, CA. The
City labor relations representatives and RPVEA representatives have met and conferred
and agreed to the Second Amendment (Attachment D) to the RPVEA MOU 2017-20,
subject to City Council determination and approval. The Second Amendment
addresses the change in CPI geographic area upon which the RPVEA MOU pegged its
Cost-of-Living Adjustment (COLA) and changes the CPI reference from Los Angeles-
Riverside-Orange County, CA to Los Angeles-Long Beach-Anaheim, CA, which has no
fiscal impact.
The RPVEA MOU 2017-20 provides for another percentage increase for all RPVEA
represented employees effective the first full payroll period in July 2018 based on the
annual March CPI-U Los Angeles-Riverside-Orange County, CA, with a minimum floor
increase of 1% and a ceiling of 2.5% each fiscal year. The CPI-U Los Angeles-Long
Beach-Anaheim, CA for the twelve-month period ending March 2018 was 3.8%, but due
to the COLA ceiling cap set forth in the RPVEA MOU 2017-20, the COLA for FY 2018-
2019 will be 2.5% for all RPVEA represented employees. Therefore, employee salaries
must be increased correspondingly within their salary ranges to reflect the mutually
agreed upon 2.5% COLA, the salary ranges must also be increased by the COLA, and
the City must adopt an updated Salary and Hourly Schedule for the Competitive Unit to
reflect these changes (Attachment E). The effective date of the COLA is July 7, 2018,
the first day of the first full pay period in July 2018.
Staff recommends the same 2.5% COLA percentage increase with an effective date of
July 7, 2018 for Management and Confidential employees as well, which must be
reflected in the updated Salary and Hourly Schedule resolution (Attachment E).
RESOLUTION NO. 2017-39
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES APPROVING A MEMORANDUM OF
UNDERSTANDING BETWEEN THE CITY OF RANCHO PALOS VERDES
AND THE RANCHO PALOS VERDES EMPLOYEE ASSOCIATION
WHEREAS, the City of Rancho Palos Verdes (City) has and continues to
recognize the Rancho Palos Verdes Employee Association (RPVEA) as the exclusive
employee organization representing the City's Competitive Unit; and,
WHEREAS, the most current Memorandum of Understanding (MOU) between the
City and RPVEA covering the Competitive Unit expired on June 30, 2017; and,
WHEREAS, the City labor relations representatives and RPVEA representatives
have successfully met and conferred to negotiate a successor MOU between the parties
pursuant to the Meyers-Milias-Brown Act (MMBA) (Government Code Sections 3500-
3511) and have jointly prepared and executed the attached tentative MOU between the
City and RPVEA for the period July 1, 2017, through and including June 30, 2020 (RPVEA
MOU 2017-2020), subject to City Council determination and approval, which is made a
part hereof by this reference; and,
WHEREAS, MMBA Section 3505.1 provides that: "If a tentative agreement is
reached by the authorized representatives of the public agency and a recognized
employee organization or recognized employee organizations, the governing body shall
vote to accept or reject the tentative agreement within 30 days of the date it is first
considered at a duly noticed public meeting...lf the governing body adopts the tentative
agreement, the parties shall jointly prepare a written memorandum of understanding.";
and,
WHEREAS, once approved by the governing body of a local agency, the MOU
becomes a binding agreement between the employee organization and the local agency;
and,
WHEREAS, the City Council now desires to adopt the attached MOU between the
City and RPVEA for the period of July 1, 2017, through June 30, 2020; and,
WHEREAS, the City's Open Public Employee Negotiations (OPEN) Policy requires
the City to place the accepted RPVEA MOU 2017-2020 on an agenda at a minimum of
two City Council meetings that are held at least two weeks apart; and,
WHEREAS, the RPVEA MOU 2017-2020 was first placed on the agenda for the
June 20, 2017, City Council meeting; and,

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The City Council approves the MOU between the City and RPVEA
for the period of July 1, 2017, through June 30, 2020 (RPVEA MOU 2017-2020), a copy
of which is attached hereto as Exhibit "A".
Section 2: Resolution No. 2015-110 is hereby rescinded and replaced by this
resolution.

subject to City Council determination and approval, which is made a part hereof by this
reference; and,
WHEREAS, the City Council now desires to amend the current MOU between the
City and RPVEA to reflect the aforementioned changes.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:

EXHIBIT A
FIRST AMENDMENT TO MEMORANDUM OF UNDERSTANDING
between the City of Rancho Palos Verdes and the
Rancho Palos Verdes Employees Association
Section X.A.9 of the RPVEA MOU 2017-20 is revised to read as follows (additions
underlined, deletions struck out):
Employees shall be entitled to cash out up to eighty (80) hours of accrued vacation leave
per fiscal year provided that the employee maintains fifty percent (50%) of their annual
vacation accrual after any cash out and provided that they cash out 1 hour for every 2
hours actually used during the 12 months preceding the cash out.
Employees may submit a request for vacation cash out during the months identified
below. Vacation cash out requests received during the first week of the months specified
March/June/September/November December) shall be paid out on the last payday of the
month and in which the request was received. Each request that is submitted within the
specified time frame shall be evaluated individually to ensure the employee meets the
payout eligibility criteria set forth herein. Eligible employees shall be paid for any
accumulated and unused vacation leave they have requested and to which they are
entitled on the last pay day of the respective month. Said cash payment shall be at the
employee's then current rate of pay.

FIRST AMENDMENT TO MEMORANDUM OF UNDERSTANDING
between the City of Rancho Palos Verdes and the
Rancho Palos Verdes Employees Association
Pursuant to the requirements of the Meyers-Milias-Brown Act ("MMBA," commencing at
California Government Code § 3500 et seq.) the City of Rancho Palos Verdes ("CITY") has
recognized the Rancho Palos Verdes Employees Association ("RPVEA") as the majority or
exclusive representative, as those terms are interchangeably used under the MMBA, for those
CITY employees in the bargaining unit defined as non-management, full-time employees in the
classifications listed on Exhibit"A"to the Memorandum of Understanding between the CITY and
RPVEA for the period through June 30, 2020 ("RPVEA MOU 2017-20"), adopted by Resolution
No. 2017-39 on May 16, 2017. This First Amendment to the RPVEA MOU 2017-20 is entered
into this 8th day of November, 2017, by and between the CITY and RPVEA. This First
Amendment shall only become effective upon City Council adoption and makes only those
changes reflected herein below, all other terms and conditions of the RPVEA MOU 2017-20
remaining the same.
This First Amendment adopts the attached revised language for Item 9 in Subsection A (Vacation
Leave) of Section X (Leaves) of the RPVEA MOU 2017-20, effective upon adoption by City
Council. This First Amendment expressly changes the month for the 4th quarter vacation buy-out
from December to November.

ending March 2018, with a maximum ceiling increase of 2.5% for COLAs for RPVEA,
Management and Confidential classifications; and
WHEREAS, the CPI-U for the twelve-month period ending March 2018 was 3.8%
would result in a 2.5% COLA for employees in the Competitive, Management and
Confidential classifications due to the COLA ceiling; and
WHEREAS, the City Council now desires to amend the City’s Salary Schedule
and Auto Allowance Schedule to reflect new salary ranges based on cost of living
adjustments (COLAs) ceiling (2.5%), as approved by the City Council at the June 5,
2018 meeting, and effective the first full pay period of FY18-19; and
WHEREAS, Rule V of the Personnel Rules of the City provides that in order to
amend the City’s Salary Schedule and Auto Allowance Schedule that changes must be
made via Resolution; and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
Section 1: The City Council amends and restates the City’s Salary Schedule
and Auto Allowance Schedule for City job classifications as set forth in Exhibit “1”, which
is attached hereto and incorporated herein by this reference, effective July 7, 2018.
Section 2: Effective July 7, 2018, the Salary Schedule created by Resolution
No 2017-61 shall be superseded by the Salary Schedule and Auto Allowance Schedule
for City job classifications as set forth in Exhibit “1”.
