RPVCCA_SR_2010_11_16_02_Status_Update_For_Future_Agenda_ItemsCITY OF MEMORANDUM RANCHO PALOS VERDES TO: FROM: DATE: SUBJECT: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL CITY MANAGER 09-- NOVEMBER 16,2010 FUTURE AGENDA ITEMS-STATUS UPDATE RECOMMENDATION Receive and file;provide further direction to staff as may be needed. DISCUSSION Staff last provided a status update to Council on January 5,2010.Tonight's update draws from the current list of Future Agenda Items. The following is a summary of Future Agenda items,intended to provide a preliminary overview of the topics and issues,along with staff recommendation for next steps which may involve further direction from Council. •Trees in the Public Right of Way:Propose to retain on Future Agenda List.The City Attorney concurs that the legal issues that surround the placement and maintenance of City trees in the public right of way brings certain ongoing risk of legal challenges from adjacent homeowners relating to possible property damage from tree roots,demands to remove trees as well as demands to save or replace trees,and disputes among neighbors over these issues.The City Attorney will work with Public Works to set forth the issues and provide policy alternatives. •Sheriff Substation within Civic Center:Propose to retain on Future Agenda List.Staff has taken the exploration of a temporary facility for public safety on our RPV City Hall campus to the point of next discussing lease arrangements.Interest in an RPV manufactured unit comes from both the Sheriff's Lomita Station,as well as McCormick Ambulance, however it is the ambulance service that has the wherewithal to pursue 2-1 funding of the facility and has the more intensive use in mind to augment and improve emergency response times which is beneficial to our city.The City Manager's Office will coordinate a discussion with the ambulance service as well as LA County Fire (the agency that contracts the ambulance service)to discuss temporary lease options. •Quasi-Judicial Decision Guidelines:Propose to drop from the list of Future Agenda Items at the request of Councilman Stern,who initiated the agenda topic. •Permitting of Above-Ground Facilities in the Right-of-Way:Propose to retain this item as a Future Agenda Item at the request of City Attorney Lynch.Although she sees an evolving body of legal challenges and precedent,the City Attorney finds value in pursuing City policy,and she will research the issue. •Gifts to City,from Estates and Planned GiVing:Propose to retain on Future Agenda List.(Long and Wolowicz)The two Councilmembers will explore a partnership with a financial services provider to develop a mechanism to allow charitable giving to the City as a non-profit,similar to a charitable remainder trust. •Citywide Sewer Fee:Propose to retain on Future Agenda List.Staff expects to present a study (well underway)on the City's sewer infrastructure conditions and projected maintenance requirements in the June-July timeframe. •Skateboard Park:Propose to retain this item for Future Agenda List.An initial discussion of a proposed skateboard facility will be included in the November 16 (tonight's)presentation of conceptual plans for Lower Hesse Park.Staff will look for further direction from Council in the context of that discussion. FISCAL IMPACT Fiscal impacts will occur as a result of adopting these staff recommendations,which could significantly impact staff effort as well as related costs such as legal services and other consultant fees. 2-2
