BACKGROUND: At the June 30,2009 City Council meeting,City Council adopted Ordinance 493 which proposed minor modifications to the existing neighborhood permit parking program.At that meeting,however,Council did not adopt formal fees associated with program implementation.At the March 2,2010 meeting,staff presented a draft resolution to establish fees for the Neighborhood Permit Parking program and in lieu of adopting fees at that time,City Council directed staff to re-evaluate the program,determine a means for which a neighborhood may sign-up or opt-out of the program and evaluate the full cost of administering such a program. As seen in Attachment A,staff has prepared a summary of the Neighborhood Permit Parking Program which describes the program purpose,establishes criteria and guidelines for eligibility and serves as a framework for the management of parking on public streets. DISCUSSION Neighborhood Permit Parking Program The neighborhood permit parking program has been available to residents since 1981. City Council,by resolution,approves a neighborhood's desire to permit parking for residents whose vehicles display the proper decal.Currently there are 5 neighborhoods in the City that have permit parking.Table 1 lists the 5 neighborhoods. 9-1 Nei hborhood Basswood/Peninsula High School Nei hborhood Seacove Nei hborhood Seaview Nei hborhood San Ramon Nei hborhood Lunada Point Development Adopted Resolution Numbers 91-60,91-65,91-82,92-81 77-92 82-70,84-45,85-57, 85-24 &85-32 93-74 The Municipal Code,Chapter 10.20 Parking Permits,defines the program parameters. Chapter 10.20 was last updated in June 30,2009 when City Council passed Ordinance 493 which updated the Neighborhood Permit Parking program.The attached Neighborhood Permit Parking Program Summary is consistent with Ordinance 493.It provides greater detail of the program's intention and administration. The permit fee for the five pre-existing permit neighborhoods was set at $1.25 back in 1981.This fee was based on the city's cost of obtaining the permit decals and was charged only once for the lifetime of the permit.This fee does not account for costs associated with administering the program. Staff contacted several neighboring Cities to inquire about their residential permit program fees and found that the Cities of Torrance,Palos Verdes Estates and Manhattan Beach all have residential permit parking programs.Their corresponding fees are listed below in Table 2. A enc Palos Verdes Estates Torrance Manhattan Beach Initial Fee $0 $0 $15 Replacement Fee $10 $25 $5 According to the Management Partner's Study,fees charged for City services should fully cover the costs of services provided and should be established through a cost- based fee analysis established by City Council.However,for the Neighborhood Permit Program staff recognizes that to fully capture all costs would create a burden to residents when compared to past fees and similar fees of neighboring cities. At the March 2,2010 Council meeting,staff proposed establishing updated fees for the Neighborhood Permit Parking program based on the City's adopted policy of establishing fees.The proposed fees were $50 for new permits and $28 for permit renewals every 3 years.This recommended fee was deemed too high (excessive)by the public and City Council did not adopt the fees associated with program implementation. 9-2 Subsequent to the March 2,2010 meeting,staff has conducted extensive outreach to the existing permit parking neighborhoods as well as neighborhoods that are interested in joining the program. As a result,several streets from the five pre-existing permit neighborhoods have submitted petitions to opt-out of the program,stating they no-longer feel the program is needed,especially at a cost of $28 to renew every three years,as previously proposed. Below is a list of streets that have submitted petitions to opt-out: :::::~:m:~::M::::i::::::M;t~::::I::::::~::::::::I.if ;:;:::·lllm.I~1:[1~:::i~11@:i:~::::::::::::~::i::~::::::::::: Fond du Lac Road (Peninsula H.S. neighborhood) Although,staff has received opt-out petitions from several streets within the five pre- existing permit parking neighborhoods,several new neighborhoods have expressed interest in enrolling in the program for several different reasons. Below is a list of streets interested in enrolling into the program: Avenida Aprenda Oceanfront Estates HOA Barkentine Road upper Lower Hesse Park Ironwood Drive Blackhorse Drive Dodson Middle School overflow parking due to chan es on campus Parkin related to trail access Parkin related to trail access Parkin related to proposed park improvements Parkin related to proposed park improvements Parking related to Peninsula High School activities Staff recognizes that the conditions which existed at the time the permit parking programs were initiated may not exist today and changes in the City over time due to newly acquired open space,improvements to City facilities and school-area traffic create a new demand on parking.Permit parking will assist in protecting neighborhoods from parking impacts as a result of improved recreational activities or a shift in educational activities. Program Costs As seen in Table 3,the cost to the City to administer the neighborhood permit parking program varies depending on the street or neighborhood interested in signing up.The City's cost include distributing parking decals,maintaining a decal and application database,staff time to attend HOA or neighborhood meetings to explain program guidelines and purchasing and maintaining neighborhood signs for one street. 9-3 Currently,staff spends minimal time monthly managing the program.As new neighborhoods sign-up,it is estimated that each new permit will take approximately 20 minutes to process and about 10 minutes to process permit renewals. Table 3 summarizes the estimated tasks and related anticipated costs when processing an application for a street that desires permit parking. T.B.D. T.B.D. T.B.D. T.B.D. T.B.D. T.B.D.=To Be Determined In looking at Table 3,the cost to process a new application for neighborhood permit parking per household is $34.23.This cost is based on the time it takes to process an application.It takes the permit clerk approximately 20 minutes to process a new application.Additional costs associated with a new neighborhood signing up for permit parking include evaluating petitions,attending HOA meeting,conducting a field investigation,the number of decals per household,signs and sign installation.These costs cannot be pre-determined due to the different circumstances and field conditions of each street or neighborhood.These costs would be paid for via a trust deposit at the time of application submittal.The trust deposit amount is determined by an engineer and charged against for the appropriate task.Any unused money on the trust deposit will be refunded to the applicant. So,for example,Jane Citizen comes to the Public Works counter with a petition in hand to establish permit parking on her street.The permit engineer will review the proposed location,conduct a brief inspection of the petition and will determine the supplemental costs needed to establish the program.If all elements are known at that time,the permit engineer will calculate the supplemental costs and inform Jane Citizen that a trust deposit for $XX is needed to get the program going.After the supplemental fees have been deposited and the preliminary work completed,each household on that 9-4 street will then pay $34 plus the cost for their decals (up to 3 per household)for their individual permit.Additionally,with the permit,each household is entitled to a flex-pass for guests and services workers at no additional cost. Considering the cost to the City for a new permit,the City Council could set the base fee at $34 for a first time permit with supplemental fees to be determined at the time of application and paid for through a trust deposit. After the initial permit expires,each issued permit will need to be renewed.The renewal process includes paying fees and securing updated decals.Table 4 summarizes the costs related to permit renewals. Administration to process a permit renewal*$17.12 *Based on the fully burdened hourly rate for a permit clerk. In looking at Table 4,the costs to the City for perm it renewals are $17.12 per household.This cost is based on the time needed to process a permit renewal.It takes the permit clerk approximately 10 minutes to process a renewal.Additional costs associated with permit renewal include the cost of new decals.Considering the cost to the City for annual renewals,the City Council may wish to consider setting a fee of $17 for an annual permit renewal fee. To realize additional savings and not administer the permit renewals annually but extend the renewal period out for three years relieves the permit holder of having to pay the administrative costs associated with renewing a permit on an annual basis.The City Council may choose to designate permits as three-year permits. In keeping with the Management Partner's Report of establishing fees to fully cover the cost of services and the Traffic Safety Commission's recommendation of establishing fees at the full cost of the program,staff recommends establishing fees at $34 for an initial permit and $17 for renewal permit. If the recommended program guidelines,as outlined in the Neighborhood Permit Parking Program Summary are acceptable,understanding the full costs associated with administering the program,staff is requesting to proceed with preparation of a resolution to adopt appropriate fees. 9-5 Fee Options Considering the purpose,cost and benefit of the Neighborhood Permit Parking Program,permit fee options are presented below. Fully subsidized program to be funded from the Traffic Management program of the General Fund.Eligibility $0 considerations include: •neighborhoods near schools •nei hborhoods near cit improvements $34 Initial Permit $17 Annual Permit Renewal $5.67 Three-ear permit $17/3 If the Council chooses to not establish fees for the Neighborhood Permit Parking Program,the program becomes a fully subsidized City program.Conversely,if Council chooses to establish fees,the fee adoption will require a public hearing and an amendment to the cost-based fee Resolution adopted by Council on September 7, 2010.The fees will go into effect 60 days after City Council adoption. AL TERNATIVE As an alternative,the City Council may choose to take no action at this time or establish different fees as may be appropriate. FISCAL IMPACT Approving staff's recommendation will not result in any adverse impact to the General Fund Attachments: A:Neighborhood Permit Parking Program Summary B:Ordinance No.493 9-6 crrv OF RANCHO PALOS VERDES NE~GHBORHOOD PERM~T PARKING PROGRAJV1 PROGRAM SUMMARY The purpose of the Neighborhood Permit Parking Program (NPPP)is to provide residents in residential neighborhoods parking relief associated with adjacent businesses,schools or attractions that generate parking.Some of the program benefits may include: •Protect residents from unreasonable burdens in gaining access to the property •Preserve neighborhood living •Maintain convenience and attractiveness •Preserve residential character of the neighborhood •Safeguard peace and tranquility The implementation of the Neighborhood Permit Parking program combined with consistent enforcement will reduce the problem of non-resident parking while offering reasonable access to parking near homes. Whenever the Director of Public Works or his designee determines that the streets of a neighborhood in which residential uses are permitted and other uses such as commercial,recreational or industrial uses are not permitted,that street is eligible for permit parking if: •more than 25%of the number of parking spaces available;and •the total of number of spaces actually occupied by any vehicle exceeds 75%. An Engineering survey must determine the parking availability. 9-7 Neighborhood Permit Parking Program Page 2 of3 November 4,2010 If the above conditions are met,the Director of Public Works or his designee shall prohibit parking during the hours when such use has been found on those streets or portions thereof to have been affected.60%signed petition in favor of permit parking. PARTCIPATION Permit parking boundaries shall be determined on a block by block basis.The Director of Public Works will initiate a Traffic Engineering Parking survey where increased parking by non-residents exists.If it is determined that a parking problem exists,the affected street and/or neighborhood must agree to the permit parking program by submitting a signed petition that bears the signatures of at least 60%of the affected residences. Similarly for streets that are currently enrolled in a permit parking program,to opt-out,at least 60%of desired residences must indicate their desire to discontinue the permit program by submission of a petition. A recommendation from the Director of Public Works will be made to the City Council for adoption of a resolution to enroll or discontinue a street or neighborhood into or out- of the program and upon adoption,appropriate signs will be erected or removed on the affected streets. PERMITS Upon adoption by City Council,permits will be issued and managed by the Public Works Department.Each household is eligible to obtain parking permits for each registered vehicle (up to 3 vehicles)and one (1)Flexpass which is to be used at the homeowner's discretion for visiting guests,care-givers or service vendors. Special Event Guest Parking may be issued for special circumstances and large gatherings such as graduations,weddings,tea parties,etc.Special event guest parking will be evaluated on a case-by-case basis. 9-8 Neighborhood Permit Parking Program Page 3 of 3 November 4,2010 APPLICATIONS Applications will be made available to the public at City Hall and the City's website.After completion of the application,an applicant can either mail in the application and all required documents or submit in person to the Public Works Department. The required documents for a permit include: Current vehicle registration and proof of residency by submitting one of the following documents:utility bill,telephone bill,cable bill or current auto insurance. Permit fees shall be approved by City Council and adopted by resolution. 9-9 ORDINANCE NO.493 AN ORDINANCE OF THE CITY OF RANCHO PALOS VERDES MODIFYING THE PARKING PERMIT PROCEDURES AND AMENDING THE RANCHO PALOS VERDES MUNICIPAL CODE. THE CITY COUNCIL OF THE CITY OF RANCHO PALOS VERDES DOES ORDAIN AS FOLLOWS: Section 1.Section 10.20.010 of Chapter 10.20 of Title 10 of the Rancho Palos Verdes Municipal Code is hereby amended to read as follows: "10.20.010 Intent and Purpose.The council does now establish a parking permit procedure whereby parking is limited or prohibited within certain areas of the City,which are to be defined by resolution of the council.In said areas,general parking may be restricted or prohibited by resolution of the council except for vehicles with appropriate permits issued through the City,in which case a vehicle may park for up to seventy-two hours subject to such additional limitations and restrictions as may be established by the council." Section 2.Section 10.20.020 of Chapter 10.20 of Title 10 of the Rancho Palos Verdes Municipal Code is hereby amended to read as follows: "10.20.020 Generally.Parking permits may be issued for any area in which parking has been limited or prohibited by a resolution of the council for each vehicle owned or regularly operated as provided in this chapter.An area that desires restricted or prohibited parking may apply to the City Council for the imposition of restrictions or prohibitions by submitting a petition demonstrating support for the proposal,which is signed by at least 60%of the owners of the properties on the street(s)where the restrictions will be imposed." Section 3.Section 10.20.060 of Chapter 10.20 of Title 10 of the Rancho Palos Verdes Municipal Code is hereby amended to read as follows: "10.20.060 Application.To obtain a residential parking permit,and guest parking permits,each bona fide resident must submit a complete application for Neighborhood Permit Parking,on the form furnished by City along with any additional documents specified on the Application and the payment of the appropriate parking permit fee." Section 4.Section 10.20.110 of Chapter 10.20 of Title 10 of the Rancho Palos Verdes Municipal Code is hereby amended to read as follows: "10.20.110 Fees·Duplicates. A.Fees for said permit shall be set by resolution of the City Council. 9-10 B.If a permittee loses,surrenders or destroys an unexpired residential parking permit issued under this chapter for a certain vehicle,the permittee may obtain another permit for the same vehicle for the unexpired term or a permit for a substituted vehicle for the unexpired term upon the payment of the fee established by resolution of the City Council. C.If a parking permit card issued under this chapter for guest parking is lost or stolen,a duplicate may be obtained for the unexpired term upon payment of the fee established by resolution of the City Council." Section 5.This Ordinance shall go into effect and be in full force and effect at 12:01 a.m.on the thirty-first (31st)day after its passage.
