RECOMMENDATION
1)Adopt Resolution No.2010-_,a Resolution of the City Council of the City of Rancho
Palos Verdes,California,Calling for a Special Municipal Election to be held on Tuesday,
March 8,2011,as Required by the Provisions of the Laws of the State of California
Relating to General Law Cities for the Submission to the Voters a Question Relating to
Adoption of a Proposed City Charter;
2)Adopt Resolution No.2010-_,a Resolution of the City Council of the City of Rancho
Palos Verdes,California,Requesting the Los Angeles City Council to Consolidate and
Direct the City Clerk of the City of Los Angeles to Conduct the Special Municipal
Election to be held on March 8,2011,with the City of Los Angeles Primary Nominating
and Consolidated Elections to be held on that date pursuant to Section 10400,et seq.
of the California Elections Code and the Election Code of the City of Los Angeles;

BACKGROUND
As part of the City Council's January 23,2010 Tactical Planning Workshop,staff was
directed to identify and report to the City Council by April 30,2010,the pros and cons of
adopting a City Charter.On April 6,2010,City Attorney Lynch provided the Council
with a staff report covering an overview of the advantages of becoming a charter city
and the procedure for becoming a charter city.At that meeting,the Council directed
staff to select a date that was suitable for City Council Members for a workshop to
discuss the topic of becoming a charter city.On June 29,2010,City Attorney Lynch
and two of her colleagues provided a detailed staff report and PowerPoint presentation
regarding the advantages and disadvantages of becoming a charter city;the procedure
for becoming a charter city;the timing of the election;and other related topics.At that
meeting the Council decided to continue the item to the next regular meeting when all
five Council Members would be present (Mayor Pro Tem Long had an excused
absence from the June 29,2010 Council meeting).On July 6,2010,the City Council
unanimously voted to direct the City Attorney to draft a simple City Charter,similar to
the Charter that was adopted by the Buena Park voters,to be placed before the
Rancho Palos Verdes voters at a consolidated election to be held on March 8,2011.
Despite the City Council's direction to place the proposed Charter on the March 8,2011
ballot,that action is not official until the attached resolutions are adopted.Mayor
Wolowicz would like the City Council to discuss whether the proposed City Charter
should be placed on the March 8,2011 ballot,or the November 2011 ballot,which is
the date of the City's next General Municipal Election to fill three City Council seats.
The Council Subcommittee,along with Staff,discussed this issue by telephone with the
League of California Cities'election expert,who recommended in favor of having the
the proposed charter on the March 2011 election ballot.
The City of Los Angeles needs to know whether the Rancho Palos Verdes election on
the proposed charter will be consolidated with the City of Los Angeles'election no later
than October 20,2010,which will allow the City of Los Angeles ample time to prepare
resolutions for its Council's consideration.Therefore,the Council could continue the
item setting the election (and the item on the Charter itself)one more meeting,if
necessary,until the October 19,2010 Council meeting.
DISCUSSION
The draft Resolutions presented for Council's consideration this evening set the date
and time for the Special Municipal Election on the Charter City Measure to be placed on
the March 8,2011 ballot;request consolidation of the City's Special Election with the
Primary Nominating Election of the City of Los Angeles and request that the City of Los
Angeles conduct the election and provide election services to the City;establish
priorities for filing a written argument in support of the City measure to change from a

General Law City to a Charter City and direct the City Attorney to Prepare an Impartial
Analysis,and provide for the filing of rebuttal arguments for City measures submitted at
municipal elections.
ADDITIONAL INFORMATION
Pursuant to Elections Code Section 9286(a),the City Elections Official shall fix a date
14 days from the Calling of the Election as a deadline for the filing of arguments for or
against any City measure.However,pursuant to Section 9286(b),that deadline may be
different when an election is consolidated with another election.The City Clerk will
select appropriate dates in order to comply with the election schedule established by
the City of Los Angeles and to avoid conflicts with the holidays.Pursuant to Elections
Code Section 9285,if the City Council adopts a resolution allowing for the filing of
rebuttal arguments,rebuttal arguments relating to a City measure shall be filed with the
Elections Official no later than 10 days after the final filing date for primary arguments.
In the resolutions regarding the primary argument,the City Council may choose to
designate some or all of the Members of the City Council Members to file arguments
supporting the initiative.
FISCAL IMPACT
The City Clerk's Office received an estimated cost of $70,000-90,000 from the City of
Los Angeles'Election Division for conducting the Special Municipal Election in
consolidation with the City of Los Angeles Primary Nominating Election on the March 8,
2011 Ballot;therefore a Resolution Amending the Budget Appropriation for Fiscal Year
2010-2011 has been prepared for the Council's adoption this evening.

VERDES,CALIFORNIA,CALLING FOR A SPECIAL MUNICIPAL ELECTION
TO BE HELD ON TUESDAY,MARCH 8,2011,AS REQUIRED BY THE
PROVISIONS OF THE LAWS OF THE STATE OF CALIFORNIA RELATING
TO GENERAL LAW CITIES FOR THE SUBMISSION TO THE VOTERS A
QUESTION RELATING TO ADOPTION OF A PROPOSED CITY CHARTER.
WHEREAS,a Special Municipal Election shall be held on
March 8,2011,to submit to the voters at the election a question relating to
adoption of a City Charter;and
WHEREAS,it is anticipated that the Special Municipal Election will be
consolidated with the City of Los Angeles Primary Nominating and Consolidated
Elections to be held on the same date,and shall be conducted as a consolidated
election under the Election Code of the City of Los Angeles and as further
provided in the resolutions and ordinances of the City of Rancho Palos Verdes
and the City of Los Angeles pertaining to this election;
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RANCHO
PALOS VERDES,CALIFORNIA,DOES RESOLVE,DECLARE,DETERMINE
AND ORDER AS FOLLOWS:
Section 1.That pursuant to the requirements of the laws of the State of
California relating to General Law Cities,there is called and ordered to be held in
the City of Rancho Palos Verdes,California,on Tuesday,March 8,2011,a
Special Municipal Election.
Section 2.That the City Council,pursuant to its right and authority,
does hereby order submitted to the voters at the Special Municipal Election to be
held on March 8,2011,the following measure:

Section 4.That the City Charter must be approved by a majority of the
votes cast,in order for the Charter to become law.

Section 5.That the ballots to be used at the election shall be in the
form and content required by law.
Section 6.That the City Clerk is authorized,instructed and directed to
procure and furnish any and all official ballots,notices,printed matter and all
supplies,equipment and paraphernalia that may be necessary in order to
properly and lawfully conduct the election.
Section 7.That the polls for the election shall be open at seven o'clock
a.m.of the day of the election and shall remain open continuously from that time
until eight o'clock p.m.of the same day when the polls shall be closed,pursuant
to Elections Code Section 10242 or Los Angeles City Election Code Section 826
(whichever is applicable to this election),except as otherwise provided in
Elections Code Section 14401 or Section 857 of the Election Code of the City of
Los Angeles (whichever is applicable to this election).
Section 8.That in all particulars not recited in this resolution,the
election shall be held and conducted as provided by law for holding municipal
elections.
Section 9.That notice of the time and place of holding the election is
given and the City Clerk is authorized,instructed and directed to give further or
additional notice of the election,in the time,form and manner required by law.
Section 10.That the City Clerk shall certify to the passage and adoption
of this Resolution and enter it into the book of original City Resolutions.

Charter of the City of Rancho Palos Verdes
PREAMBLE
We the people of the City of Rancho Palos Verdes declare our intent to restore to our
community the historic principles of self governance inherent in the doctrine of home-
rule.Sincerely committed to the belief that local government has the closest affinity to
the people governed,and firm in the conviction that the economic and fiscal
independence of our local government will promote the health,safety and welfare of all
the citizens of this City,we do hereby exercise the express right granted by the
Constitution of the State of California to enact and adopt this Charter for the City of
Rancho Palos Verdes.
Article I -Municipal Affairs:Generally
Section 100.Municipal Affairs.The City shall have full power and authority to adopt,
make,exercise and enforce all legislation,laws,and regulations and to take all actions
relating to municipal affairs that may be lawfully adopted,made,exercised,taken or
enforced under the Constitution of the State of California,without limitation,except as
otherwise provided in Articles 11/,IV,Vand VI of this Charter..
Article II -General Laws
Section 100.General Law Powers.In addition to the power and authority granted by
the terms of this Charter and the Constitution of the State of California,the City shall
have the power and authority to adopt,make,exercise and enforce all legislation,laws
and regulations and to take all actions and to exercise any and all rights,powers,and
privileges heretofore or hereafter established,granted or prescribed by any law of the
State of California or by any other lawful authority.In the event of any conflict between
the provisions of this Charter and the provisions of the general laws of the State of
California,the provisions of this Charter shall control.
Article III -Form of Government
Section 100.Council-Manager Form of Government.The municipal government
established by this Charter shall continue to be the form of government known as the
"Council-Manager"form of government,which means the City Council shall establish
the policies of the City,and the City Manager shall carry out those policies.
Article IV -Compensation and Expenses
Section 100.Councilmember Compensation.All of the members of the City Council,
including the Mayor,shall continue to receive as compensation for their services a
monthly salary in an amount established in accordance with,and limited by,the
provisions of law applicable to the salaries of City Council members in general law cities
as set forth in Section 36516 of the Government Code of the State of California or any
successor provision thereto.The City shall not provide any additional compensation for
attendance at other meetings of City or City-affiliated commissions,committees,

subcommittees,and boards of directors,including the Rancho Palos Verdes
Redevelopment Agency and the Rancho Palos Verdes Improvement Authority.
Section 200.Councilmember Expenses.All of the members of the City Council,
including the Mayor,shall continue to be entitled to reimbursement for their actual and
necessary expenses incurred in the performance of their official duties as stated in,and
limited by,the provisions of law applicable to the reimbursement for expenses of City
Council members in general law cities as set forth in Sections 36514.5,53232.2 and
53232.3 of the Government Code of the State of California or any successor provisions
thereto.
Section 300.Staff Compensation.The compensation provided to City staff shall
continue to be approved in a transparent manner at duly noticed City Council meetings.
Article V -Gifts of Public Funds
Section 100.Gifts of Public Funds.The City shall comply with the laws of the State of
California that are applicable to general law cities with respect to the prohibition against
gifts of public funds.
Article VI -General Plan
Section 100.General Plan.The General Plan is the paramount City land use
document.The City shall be governed by State law as it applies to general law cities
with respect to the requirement that the zoning ordinance must be consistent with the
General Plan.
Article VII -Interpretation
Section 100.Construction and Interpretation.The language contained in this Charter is
intended to be permissive rather than exclusive or limiting and shall be liberally and
broadly construed in favor of the exercise by the City of its power to govern with respect
to any matter which is a municipal affair,except as otherwise provided in Articles III,IV,
V and VI of this Charter.
Section 200.Severability.If any provision of this Charter should be held by a court of
competent jurisdiction to be invalid,void or otherwise unenforceable,the remaining
provisions shall remain enforceable to the fullest extent permitted by law.
The electors of the City of Rancho Palos Verdes,by a majority of the votes cast,
adopted this Charter of the City of Rancho Palos Verdes at the general municipal
election held .The results of such election were certified by the City
Council of the City of Rancho Palos Verdes through adoption of its Resolution No.

ANGELES TO CONDUCT THE SPECIAL MUNICIPAL ELECTION TO BE

returns of the Special Municipal Election;and that the election be held in all respects as
if there were only one election;

PALOS VERDES DOES RESOLVE,DECLARE,DETERMINE AND ORDER AS
FOLLOWS:
Section 1.That pursuant to the requirements of Sections 10400 et seq.of the
California Elections Code,and the provisions of the Election Code of the City of Los
Angeles,the Los Angeles City Council is hereby requested to consent and agree to the
consolidation of the Rancho Palos Verdes Special Municipal Election with the City of
Los Angeles Primary Nominating and Consolidated Elections on Tuesday,March 8,

Section 3.That the City of Los Angeles Election Division is authorized to mail
official sample ballots and voter information pamphlets to all registered voters in the City
of Rancho Palos Verdes and canvass the returns of said Special Municipal Election.
The election shall be held in all respects as if there were only one election,and only one
form of ballot shall be used.
Section 4.That the polls for the election shall be open at seven o'clock a.m.
of the day of the election and shall remain open continuously from that time until eight
o'clock p.m.of the same day when the polls shall be closed,pursuant to Los Angeles
City Election Code Section 826,except as provided in Section 857 of the Election Code
of the City of Los Angeles.
Section 5.That the Los Angeles City Council is requested to issue
instructions to the City Clerk of the City of Los Angeles to conduct the Special Municipal
Election for the City of Rancho Palos Verdes and take any and all steps necessary for
the holding of the consolidated election.
Section 6.That the City of Rancho Palos Verdes recognizes that additional
costs will be incurred by the City of Los Angeles by reason of this consolidation and
agrees to reimburse the City of Los Angeles for any such costs.
Section 7.That the City Clerk is hereby directed to file a certified copy of this
resolution with the Los Angeles City Council and the City of Los Angeles Election
Division.
Section 8.That the City Clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.

measure to the City Attorney of the City of Rancho Palos Verdes ("City Attorney").The
City Attorney shall prepare an impartial analysis of the measure not exceeding 500

measure.The impartial analysis shall be filed with the City Clerk by the date set by the
City Clerk for the filing of primary arguments.
Section 3.That the City Clerk shall be responsible for complying with provisions of
Section 9295 of the California Elections Code and,after completing of the public
examination period set forth in that provision,shall file the final text of the impartial
analysis and the ballot arguments in favor and against the measure,including argument
author information,with the Election Division of the Los Angeles City Clerk's Office by
the date designated by the Los Angeles City Clerk to enable timely preparation of the
voter information pamphlet for the consolidated election.
Section 4.That the City Clerk shall certify to the passage and adoption of this

REBUTTAL ARGUMENTS FOR MEASURES SUBMITTED AT
MUNICIPAL ELECTIONS.
WHEREAS,Section 9285 of the Elections Code of the State of California
authorizes the City Council,by majority vote,to adopt provisions to provide for the filing
of rebuttal arguments for measures submitted at municipal elections;
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES,CALIFORNIA,DOES RESOLVE,DECLARE,DETERMINE AND ORDER AS
FOLLOWS:
Section 1.That pursuant to Section 9285 of the Elections Code of the State of
California,when the City's elections official,Rancho Palos Verdes City Clerk ("City
Clerk")has selected the arguments for and against the measure which will be printed
and distributed to the voters,the City Clerk shall send a copy of an argument in favor of
the proposition to the authors of any argument against the measure and a copy of an
argument against the measure to the authors of any argument in favor of the measure
immediately upon receiving the arguments.
The author or a majority of the authors of an argument relating to a measure may
prepare and submit to the City Clerk a rebuttal argument not exceeding 250 words or
may authorize in writing any other person or persons to prepare,submit,or sign the
rebuttal argument.
A rebuttal argument may not be signed by more than five authors.
The rebuttal arguments shall be filed with the City Clerk,signed,with the printed
name(s)and signature(s)of the author(s)submitting it,or if submitted on behalf of an
organization,the name of the organization,and the printed name and signature of at
least one of its principal officers,not more than 10 days after the final date for filing
direct arguments.The rebuttal arguments shall be accompanied by the Form of
Statement To Be Filed By Author(s)of Argument.
Rebuttal arguments shall be printed in the same manner as the direct arguments.
Rebuttal arguments shall consist solely of written arguments for or against the measure
and shall not contain any pictures or illustrations.Each rebuttal argument shall
immediately follow the direct argument that it seeks to rebut.
Section 2.That the City Clerk shall be responsible for complying with provisions
of Section 9295 of the California Elections Code and,after completion of the public
examination period set forth in that provision,shall file the final text of the rebuttal
arguments in favor and against the measure,including argument author information,
with the Election Division of the Los Angeles City Clerk's Office by the date designated

by the Los Angeles City Clerk to enable timely preparation of the voter information
pamphlet for the consolidated election.
Section 3.That all previous resolutions providing for the filing of rebuttal
arguments for measures are repealed.
Section 4.That the provisions of Section 1 shall apply at the next ensuing
municipal election and at each municipal election after that time.
Section 5.That the City Clerk shall certify to the passage and adoption of this
Resolution and enter it into the book of original Resolutions.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES,AMENDING RESOLUTION NO.2010-55,THE BUDGET APPROPRIATION
FOR FISCAL YEAR 2010-2011,FOR A BUDGET ADJUSTMENT TO THE CITY'S
GENERAL FUND TO PAY FOR THE COST OF THE MARCH 8,2011 SPECIAL
MUNICIPAL ELECTION.
WHEREAS,Section 3.32 of the Rancho Palos Verdes Municipal Code provides that all
expenditures in excess of budgeted allocations must be by supplemental appropriation of the
City Council;and,
WHEREAS,on June 15,2010,the City Council of the City of Rancho Palos Verdes
adopted Resolution 2010-55,approving a spending plan and authorizing a budget appropriation
for the 2010-11 fiscal year;and,
WHEREAS,on July 6,2010,the City Council of the City of Rancho Palos Verdes
unanimously approved the drafting of a City Charter to be placed before the voters at a Special
Municipal Election to be held on March 8,2011;and,
WHEREAS,a budget increase in the City Clerk's Program of the General Fund is
necessary to provide for this service.
NOW BE IT,THEREFORE,RESOLVED BY THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES:
