STAFF L1ASON:ANDY WINJE,ASSOCIATE ENGINEER~ RECOMMENDATIONS: 1)Accept the work as complete and authorize the City clerk to file a Notice of Completion with the County Recorder; 2)Approve Change Order No.1 with Mike Drews Construction Company,Inc.,and increase the current Purchase Order by $15,382.50,for a total of $229,132.50,for additional costs incurred during construction; 3)Approve additional expenditures totaling $25,714.75 related to ancillary professional, technical,regulatory and construction fees and services; 4)Authorize the Director of Public Works to release the Performance Deposit to Mike Drews Construction Company 35 days after the recordation of the Notice of Completion by the County recorder contingent upon no claims being filed specific to the project;and 5)ADOPT RESOLUTION NO.RDA 2010-_,A RESOLUTION OF THE BOARD OF THE RANCHO PALOS VERDES REDEVELOPMENT AGENCY,AMENDING RESOLUTION NO. RDA 2010-09,THE BUDGET APPROPRIATION FOR FISCAL YEAR 2010-11,TO INCREASE THE BUDGET IN THE PORTUGUESE BEND CAPITAL PROJECTS FUND. BACKGROUND On June 1,2010,the Redevelopment Agency Board (RDA)found that an emergency exists, which would not permit the delay arising from a competitive solicitation for bids for repair work.Accordingly,the RDA approved a contract with Mike Drews Construction Company, Inc.(Contractor)to remove approximately 1000 feet of vegetation located to the south of the Palos Verdes Drive South roadway and to re-grade a portion of the roadway shoulder and 1 of 3 RDA B-1 adjacent slope to eliminate cracks and fissures using dirt accumulating on the down slope areas of both RDA and Portuguese Bend Club property. The Contractor has completed its work authorized by the RDA to remove the vegetation in the area where the cracks are located,fill the cracks and fissures and rebuild the 2:1 slope adjacent to the road. DISCUSSION Due to the urgent nature of the project,the grading work was authorized before all the ancillary costs could be identified.The following additional costs were incurred to perform the work in compliance with regulatory and legal requirements.Pre-construction photos were commissioned due to the sensitive nature of the project.Environmental clearances from the Planning Department based on the work of a professional biologist engaged to assess the habitat were obtained.Removal of the brush during construction revealed more extensive slope degradation than was originally anticipated,requiring additional grading. The additional earthwork triggered new NPDES permitting requirements (effective July 1, 2010)and a professional consultant was hired to help the City comply with these regulations.An Erosivity Waiver was obtained,reducing the regulatory requirements and costs by as much as $20,000,but an application fee and slope stability measures (hydroseeding)were still required.A summary of ancillary costs is shown in Table 1. Od STbl2Cha e -anQe r er ummary Item Cost Water Truck Rental (248 hours)$8,680.00 Water (45,400 CF)$1,702.50 Performance Deposit $5,000.00 Sub-Total $15,382.50 2of3 RDA B-2 ADDITIONAL INFORMATION To control these additional costs,Staff solicited informal bids for the NPDES services from the list of on-call consultants and selected the consultant who provided the best overall approach in its proposal.Informal bids were selected for the pre-construction photos and hydroseeding contractors.The City does not have on-call contractors for either of these specialties.Staff generated at least three bids for each trade and selected the lowest qualified bid in each case. CONCLUSION As previously found,the RDA authorized the emergency project to repair the road embankment and improve the stability adjacent to Palos Verdes Drive South with soil from the Portuguese Bend Club.The urgent nature of the work required authorization of construction before all the ancillary and incidental costs could be identified.Once these additional needs became known,staff worked to minimize the additional costs through informal competitive bidding,regulatory strategy and frequent communication with the grading contractor.Staff recommends that the Agency Board approve the recommendations provided by Staff. FISCAL IMPACT The total additional cost to this project is $41,097.25 for a total project cost of $254,847.25. The additional cost will be borne by the RDA Portuguese Bend Capital Projects Fund.
