BACKGROUND On June 1,2010,the Redevelopment Agency Board found that an emergency exists,which will not permit a delay arising from a competitive solicitation for bids to enter into a contract with a grading contractor,to perform emergency grading to eliminate cracks and fissures on the seaward side of Palos Verdes Drive South and to rebuild the shoulder adjacent to the Palos Verdes Drive South roadway. Accordingly,the Redevelopment Agency Board approved a contract with Mike Drews Construction Company,Inc.to remove approximately 1000 feet of vegetation located to the south of the Palos Verdes Drive South roadway and to re-grade a portion of the roadway shoulder and adjacent slope to eliminate cracks and fissures. DISCUSSION Approval of the emergency for this work required a four-fifths (4/5)vote of the Redevelopment Agency Board under Public Contract Code Section 22050(a)(1). In addition,Public Contract Code Section 22050(c)(1)requires that when a governing body takes action under Section 22050(a)(1),it must review this action and reaffirm it by a four-fifths (4/5)vote at each subsequent regularly scheduled meeting until the work is completed and accepted. Accordingly,because at the time of writing this report,removal of the vegetation in the shoulder area is underway,staff has placed this item on tonight's agenda.This RDA A-1 item will be placed on each subsequent agenda until all the work is completed and the Redevelopment Agency accepts the project as complete. CURRENT STATUS The biologist has completed a study to determine if Gnatcatchers were nesting or inhabiting the area where the vegetation is to be removed and the grading work is to be performed.The previously graded slopes do not have good quality habitat for Gnatcatchers and accordingly none of the small birds were noted in the area during the survey. Grading work is expected to begin this week following removal of the vegetation adjacent to the roadway.The grading will continue approximately 6 weeks until the work is complete. RDA A-2
