RECOMMENDATION
Adopt Resolution No.2010-_,authorizing the submittal of a used oil payment
program application to the California Department of Resources Recycling and
Recovery,and authorizing the Director of Public Works to execute any agreements,
contracts,and requests for payment as necessary to implement the program,until
rescinded.
BACKGROUND
On June 15,2010,the City Council approved Resolution No.2010-45,a resolution of
the City Council authorizing the submittal of applications to the California Department of
Resources Recycling and Recovery for the Used Oil Collection Program.Subsequently,
City staff received notice from a representative of CalRecycle,the state entity awarding
such funds,that the City must amend its resolution to call the program the Used Oil
Payment Program.Thus,staff requests adoption of Resolution No.2010-_,which is
identical in text to the prior resolution adopted on June 15,2010,except for a change in
the program's name.For the Council's reference,the prior resolution that the City
Council approved on June 15,2010,along with the staff report for that resolution,are
attached.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES AUTHORIZING THE SUBMITTAL
OF APPLICATIONS TO THE CALIFORNIA DEPARTMENT
OF RESOURCES RECYCLING AND RECOVERY FOR THE
USED OIL PAYMENT PROGRAM
WHEREAS,Public Resources Code section 48690 et seq.authorizes the
California Department of Resources Recycling and Recovery ("CaIRecycle"),formerly
known as the California Integrated Waste Management Board,to make payments to
qualifying jurisdictions for implementation of their used oil programs as required;
WHEREAS,in furtherance of this authority,CalRecycle is required to establish
procedures governing the administration of the Used Oil Payment Program;and
WHEREAS,CalRecycle's procedures for administering the Used Oil Payment
Program require,among other things,an applicant's governing body to declare by
resolution certain authorizations related to the administration of the Used Oil Payment
Program.
BE IT,THEREFORE,RESOLVED BY THE CITY COUNCIL OF THE CITY OF
RANCHO PALOS VERDES:
1.The City Council of the City of Rancho Palos Verdes authorizes the submittal
of a used oil payment program application to CalRecycle;
2.The Director of Public Works is hereby authorized and empowered to execute
in the name of the City of Rancho Palos Verdes all documents,including but
not limited to,applications,agreements,annual reports inclUding expenditure
reports and amendments necessary to secure said payments to support the
City's used oil payment program;and
3.This authorization is effective until rescinded by the City Council of the City of
Rancho Palos Verdes.

RECOMMENDATION

rescinded.
BACKGROUND
The City implemented its first curbside used oil recycling program during FY 94-95.
The curbside collection of oil filters was added in 1999.These activities were funded by
the Used Oil Block Grant Program funded annually by the Integrated Waste
Management Board ("CIWMB").On January 1,~01 0,the California Department of
Resources Recycling and Recovery ("CaIRecycle")replaced the CIWMB as the funding
agency for the block grants.Starting FY 10-11,the City will receive funds through the
Used Oil Collection Program,awarded by CalRecycle.
Currently,the City's residents are entitled to free curbside collection of used motor oil
and filters at curbside on their recycling day,which is on the first collection of each
week.Starting July 1,2010,EDCO,the City's new waste collection and recycling
company,will collect used oil and filters on their collection day,however,the resident
must call in advance and request such a collection.
To date,the used oil and filter recycling program has accomplished the following tasks:
•Established certified used oil collection centers within City limits.

•Provided NPDES,used oil,and environmental education booths at various events.
•Produced and distributed various public outreach materials including:refuse bill
inserts,leaky car postcards,calendars,promotional and educational item
giveaways.
•Organized and promoted school assemblies regarding recycling and stormwater
pollution prevention and used oil recycling.
•Stenciled various storm drain catch basins throughout the City.
•Contributed to Los Angeles County's regional used oil recycling media campaign.
•Implemented storm water mitigation programs,including installing catch basin
inserts,maintaining installed inserts,and organizing public education and outreach
efforts.
DISCUSSION
CalRecycle requires new resolutions authorizing the City to apply for grant funds
under the new Oil Payment Program ("OPP").This resolution is due June 30,2010.
This resolution ensures that the City will be able continue applying for and receiving
grant funds under the new program.
Previous resolutions were for a specific period of time,such as one year or couple
of years.As suggested by CalRecycle,to streamline the application process and to
improve efficiency,the attached resolution is "open ended"unless rescinded.
The grant application form will be completed online.A staff report and a resolution
will no longer be needed on an annual basis.However,staff will be able to continue
applying for the grant online because the same resolution will be in effect until
rescinded.
The City will continue its used oil and filter recycling program and its stormwater
pollution prevention outreach and activities where eligible.This will help offset
General Fund expenditures.In FY 10-11,the City expects an estimated funding of
$10,000 for the OPP.The precise amount has not yet been determined.
ALTERNATIVE
Instead of an "open ended"resolution,approve a resolution for a period of four (4)
years,FY 10-11 to FY 13-14.
FISCAL IMPACT
If authorized,the City will continue to receive annual funds of approximately $10,000
in FY 10-11 and FY 11-12 for the promotion and collection of used motor oil and
filters.Those funds will be deposited in the Waste Reduction Fund.No funding will
be received if not authorized.
