The Administrative Citation Ordinance provides Code Enforcement Officers with a method to achieve Code compliance more quickly and at a lower cost in the majority of cases,thereby reducing the number of cases that need to be sent to the City Attorney's Office and reducing overall costs. DISCUSSION The City has contracted with Mountains Recreation and Conservation Authority (MRCA) for park ranger services within the City's 1 AOO-acre Palos Verdes Nature Preserve, including the authority to issue criminal citations for violation of Chapter 12.16 of the Municipal Code.The City Attorney's Office has drafted the attached Ordinance,which would amend the current Administrative Citation Ordinance to provide authority for MRCA park rangers to issue administrative citations within the Nature Preserve for violations of Chapter 12.16 of the Municipal Code. The proposed Ordinance also provides that for any violation of the Code for which there is no specific administrative penalty established,the administrative penalty fine would be one-hundred dollars ($100)for the first violation,two hundred dollars ($200)for the second violation of the same Code provision within twelve months of the first violation, and five hundred dollars ($500)for the third and each additional violation of the same Code provision within twelve months of the first violation. The proposed Resolution would amend the current Administrative Citation Penalty Schedule to provide authority for issuance of citations by Code Enforcement Officers, Sheriff's Deputies,and Park Rangers,for certain violations of the Municipal Code which are not currently covered under the current Schedule,including violations of provisions of Chapter 5.20 (Solicitation),Chapter 6.04 (Animals),Chapter 9.30 (Skateboards, Roller Skates,Online Skates,Scooters and Similar Devices on Posted Property),10.24 (Off-Road Use of Vehicles),and certain provisions of Chapter 12.16 (Streets,Parks and Recreational Facilities).Administrative penalties could thus be issued for Code violations occurring both within the Palos Verdes Nature Preserve as well as in other parts of the City. 14-2 Administrative Citation Ordinance and Resolution July 20,2010 Page 3 of 3 The proposed Ordinance and Resolution further implement the Administrative Citation Ordinance to provide an additional remedy for the City to use in those situations where Staff and the City Attorney determine that an administrative citation process will provide a more expeditious and cost effective method for achieving compliance with the Rancho Palos Verdes Municipal Code.The City will continue to pursue criminal penalties for more serious violations. FISCAL IMPACT The benefits of the program would save the City time and money in City Attorney case preparation and court costs,along with the City benefiting from citation fee income.
