BACKGROUND
In 2008,pursuant to Ordinance No.473,the City of Rancho Palos Verdes enacted an
Administrative Citation Ordinance to provide citation authority to code enforcement staff
for violations of the Rancho Palos Verdes Municipal Code.The City Council also
adopted an Administrative Citation Schedule pursuant to Resolution Nos.44 and 92,
which contain the fine amounts for administrative citations issued under the Ordinance
for violation of certain provisions of the Municipal Code.
The Administrative Citation Ordinance provides Code Enforcement Officers with a
method to achieve Code compliance more quickly and at a lower cost in the majority of
cases,thereby reducing the number of cases that need to be sent to the City Attorney's
Office and reducing overall costs.
DISCUSSION
The City has contracted with Mountains Recreation and Conservation Authority (MRCA)
for park ranger services within the City's 1 AOO-acre Palos Verdes Nature Preserve,
including the authority to issue criminal citations for violation of Chapter 12.16 of the
Municipal Code.The City Attorney's Office has drafted the attached Ordinance,which
would amend the current Administrative Citation Ordinance to provide authority for
MRCA park rangers to issue administrative citations within the Nature Preserve for
violations of Chapter 12.16 of the Municipal Code.
The proposed Ordinance also provides that for any violation of the Code for which there
is no specific administrative penalty established,the administrative penalty fine would
be one-hundred dollars ($100)for the first violation,two hundred dollars ($200)for the
second violation of the same Code provision within twelve months of the first violation,
and five hundred dollars ($500)for the third and each additional violation of the same
Code provision within twelve months of the first violation.
The proposed Resolution would amend the current Administrative Citation Penalty
Schedule to provide authority for issuance of citations by Code Enforcement Officers,
Sheriff's Deputies,and Park Rangers,for certain violations of the Municipal Code which
are not currently covered under the current Schedule,including violations of provisions
of Chapter 5.20 (Solicitation),Chapter 6.04 (Animals),Chapter 9.30 (Skateboards,
Roller Skates,Online Skates,Scooters and Similar Devices on Posted Property),10.24
(Off-Road Use of Vehicles),and certain provisions of Chapter 12.16 (Streets,Parks and
Recreational Facilities).Administrative penalties could thus be issued for Code
violations occurring both within the Palos Verdes Nature Preserve as well as in other
parts of the City.

The proposed Ordinance and Resolution further implement the Administrative Citation
Ordinance to provide an additional remedy for the City to use in those situations where
Staff and the City Attorney determine that an administrative citation process will provide
a more expeditious and cost effective method for achieving compliance with the Rancho
Palos Verdes Municipal Code.The City will continue to pursue criminal penalties for
more serious violations.
FISCAL IMPACT
The benefits of the program would save the City time and money in City Attorney case
preparation and court costs,along with the City benefiting from citation fee income.

WHEREAS,pursuant to Ordinance No.473,the City of Rancho Palos Verdes
enacted Chapter 1.16 of the City of Rancho Palos Verdes Municipal Code to implement
an Administrative Citation Ordinance for the expeditious resolution of violations of the
Municipal Code,which such remedy is in addition to criminal,civil or other legally
established process that may be pursued to address Code violations and is reasonably
necessary to protect the health,safety and welfare of the citizens of the City of Rancho
Palos Verdes;and
WHEREAS,Chapter 1.08 contains the general penalty provisions applicable to
issuance of criminal citations associated with violations of the Municipal Code;and
WHEREAS,it is necessary to amend Chapters 1.08 and 1.16 to further
implement the provisions of the City's Administrative Citation Ordinance;
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND,DETERMINE,AND ORDER AS FOLLOWS:
Section 1:Chapter 1.08 (General Penalty)of Title 1 (General Provisions)of

Section 7:Severability.If any section,subsection,subdivision,paragraph,
sentence,clause or phrase in this Ordinance or any part thereof is for any reason held
to be unconstitutional or invalid or ineffective by any court of competent jurisdiction,
such decision shall not affect the validity or effectiveness of the remaining portions of
this Ordinance or any part thereof.The City Council hereby declares that it would have
passed each section,subsection,subdivision,paragraph,sentence,clause or phrase

thereof,irrespective of the fact that anyone or more sections,subsections,
subdivisions,paragraphs,sentences,clauses or phrases be declared unconstitutional,

Section 8:Posting.The City Clerk shall cause this Ordinance to be posted in
three (3)public places in the City within fifteen (15)days after its passage,in
accordance with the provisions of Section 36933 of the Government Code.The City
Clerk shall further certify to the adoption and posting of this Ordinance,and shall cause
this Ordinance and its certification,together with proof of posting,to be entered in the
Book of Ordinances of the Council of this City.
Section 9:Effective Date.This Ordinance shall go into effect and be in full
force and effect at 12:01 a.m.on the thirty-first (31 st)day after its passage.

WHEREAS,Sections 1.16.010 through 1.16.250 of Chapter 1.16
(Administrative Penalties)of Title 1 (General Provisions)of the Rancho Palos
Verdes Municipal Code established an administrative remedy program for
violations of the Code,including authority for the adoption of an administrative
citation penalty schedule;and
WHEREAS,pursuant to Resolution Nos.2008-44 and 2008-92,the City
has adopted an Administrative Citation Penalty Schedule which established the
amounts of administrative penalties for certain violations of the Rancho Palos
Verdes Municipal Code;
NOW THEREFORE,be it resolved by the City Council of the City of
Rancho Palos Verdes as follows:
Section 1:The following administrative citation penalties are hereby
established:
$100.00 for the first offense,
$200.00 for the second offense within one year of the first offense,and
$500.00 for the third offense and each additional offense within one year
of the first offense,
for any violation of any of the following provisions of the Rancho Palos Verdes
Municipal Code:
