Adopt Resolution No.2010-_,thereby adopting the City's 2010 Local Development Report (LDR)
and self-certifying the City's conformance with the 2004 Congestion Management Program (CMP)
for Los Angeles County.
BACKGROUND
A Congestion Management Program (CMP)was enacted by the State Legislature in 1990 to
improve traffic congestion in California's urban areas.In accordance with the State statute,the Los
Angeles County Metropolitan Transportation Authority (MTA)[previously known as the L.A.County
Transportation Commission (LACTC)]adopted the first CMP for Los Angeles County on November
18,1992.
The CMP instituted procedures to address deficiencies projected to occur on the Los Angeles
County regional roadway network.Since the CMP is a countywide program,all local jurisdictions
are requested to participate in the Deficiency Plan process,regardless of the number of CMP
intersections or congestion levels within each City's limits.
The MTA has updated and adopted several Congestion Management Programs since 1993.Most
recently,the MTA adopted the 2004 CMP.The 2004 CMP summarizes the results from nine years
of highway monitoring,eight years of local growth monitoring,and thirteen years of local
transportation improvements.In addition,the 2004 Program modified the local responsibilities by
suspending the requirements for maintaining a positive credit balance.In past years,each local
jurisdiction's Congestion Management efforts were tracked by a point system that reflected the
impact of local growth (debits)and benefits of transportation improvements (credits).The object
was to maintain a positive credit balance.Due to concerns raised by cities,in August 2003,the
MTA Board authorized a nexus study to evaluate the feasibility of implementing a congestion
mitigation fee to meet CMP Deficiency Plan requirements.While work on Phase II of the Nexus
study continues,the CMP Countywide Deficiency Plan requirement for maintaining a positive credit
balance has been suspended.As a result,cities do not have to report their transportation

improvement strategies for the 2006 cycle.However,reporting on all new development activity and
adopting a self-certification resolution is still required.
In accordance with the 2004 CMP,the purpose of this agenda item is for the City Council to adopt
the attached self-certification conformance resolution,thereby adopting the City's 2010 Local
Development Report (LDR)and self-certifying the City's conformance with the CMP requirements.
The LDR is a reporting form,which calls for information on new net development in our City within
the 2009-2010 fiscal year.The City's 2010 LDR is attached.Upon adoption,the resolution and
2010 LDR will be transmitted to the MTA for its review and approval.
DISCUSSION
In adopting the attached self-certification resolution,the City resolves that it is in conformance with
all the applicable requirements of the 2004 CMP and has taken,or will take,each of the following
four specific actions (the requisite action appears in bold type and the City's response in normal
type):
1.By June 15,of odd numbered years,the City will conduct and transmit to the MTA traffic
counts and calculated levels of service for selected arterial intersections,consistent with
the requirements identified in the CMP Highway and Roadway System Chapter.
The current year of 2010 is not an odd numbered year and therefore the requisite action is not
applicable.Next year's (2011)report will address this action.
2.The City has locally adopted and continues to implement a Transportation Demand
Management (TDM)Ordinance,consistent with the minimum requirements identified in
the CMP Transportation Demand Management Chapter.
On February 2,1993,the City Council adopted the required TDM Ordinance (Municipal Code
Chapter 10.28)and staff continues to implement the TDM Ordinance,where applicable.As part of
the Development Code Amendment proceedings,completed in May 1997,the TDM Ordinance was
incorporated into the Development Code by reference.
3.The City has locally adopted and continues to implement a land use analysis program,
consistent with the minimum requirements identified in the CMP Land Use Analysis
Program Chapter.
On September 17,2002,the City Council adopted an amended set of Local CEQA Guidelines,
which incorporated the County's CMP Land Use Analysis program into the City's environmental
review procedures.City staff continues to implement the land use analysis program where
applicable.
4.The City has adopted a 2010 Local Development Report consistent with the reqUirements
identified in the CMP.The LDR tracks new development,exempted development,and
development adjustments as a result of building permits issued between June 1 and May
31.
During the period between June 1,2009 and May 31,2010,there were building permits issued for
nine new single-family units,one 770ft2 market-rate multi-family unit,thirty-three low income senior
housing units (Mirandela),and one 11 ,000ft2 Trader Joe's establishment.Additionally,there were
demolition permits issued for one single-family residential unit and one 6,820ft2 restaurant.Based

on this data,there was a net increase of eight residential units,4,190ft2 of commercial development,
and thirty-three exempted residential units (Mirandela).Thirty-three of the thirty-four units in the
Mirandela development are categorized as exempted activity because they are income restricted to
low,very low,and extremely low incomes.
ADDITIONAL INFORMATION
The 2004 Congestion Management Program guidelines specify that a resolution of conformance
must be adopted by the local jurisdiction's governing board at a noticed public hearing.A public
notice was published on July 1st for the City Council public hearing on July 20,2010.
CONCLUSION
In accordance with the Deficiency Plan of the 2004 CMP,the City Council,through a noticed public
hearing,must adopt a self-certification conformance resolution,whereby the City agrees to conform
to the local responsibilities required by the 2004 CMP,including preparation of the 2010 LDR.As
documented in this Staff Report,the City is in conformance with all applicable requirements of the
2004 CMP and has taken all of the required actions of the Deficiency Plan.Therefore,Staff
recommends that the City Council adopt the attached Resolution No.2010 -_.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES,FINDING THE CITY OF RANCHO PALOS VERDES,LOCATION
WITHIN LOS ANGELES COUNTY TO BE IN CONFORMANCE WITH THE
CONGESTION MANAGEMENT PROGRAM (CMP)AND ADOPTING THE CMP
LOCAL DEVELOPMENT REPORT,IN ACCORDANCE WITH CALIFORNIA
GOVERNMENT CODE SECTION 65089.
WHEREAS,CMP statute requires the Los Angeles County Metropolitan Transportation
Authority (LACMTA),acting as the Congestion Management Agency for Los Angeles County,to
annually determine that the County and cities within the County are conforming to all CMP
requirements;and,
WHEREAS,LACMTA requires submittal of the CMP Local Development Report by
September 1 of each year;and,
WHEREAS,on July 20,2010,after notice issued pursuant to the provisions of the
Development Code,the City Council held a public hearing,at which time all interested parties
were given an opportunity to be heard and present evidence;and,
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF RANCHO PALOS
VERDES DOES HEREBY FIND,DETERMINE AND RESOLVE AS FOLLOWS:
Section 1:That the City of Rancho Palos Verdes,located within Los Angeles County
has taken all of the following actions and is in conformance with all applicable requirements of
the 2004 CMP adopted by the LACMTA Board on July 22,2004.
The City of Rancho Palos Verdes,located within Los Angeles County has locally
adopted and continues to implement a transportation demand management ordinance,
consistent with the minimum requirements identified in the CMP Transportation Demand
Management chapter.
The City of Rancho Palos Verdes,located within Los Angeles County has locally
adopted and continues to implement a land use analysis program,consistent with the minimum
requirements identified in the CMP Land Use Analysis Program chapter.
The City of Rancho Palos Verdes,located within Los Angeles County has adopted a
Local Development Report,attached hereto and made a part hereof,consistent with the
requirements identified in the 2004 CMP.This report balances traffic congestion impacts due to
growth within the City of Rancho Palos Verdes,located within Los Angeles County with
transportation improvements,and demonstrates that the City of Rancho Palos Verdes,located
within Los Angeles County is meeting its responsibilities under the Countywide Deficiency Plan
consistent with the LACMTA Board adopted 2003 Short Range Transportation Plan.
Section 2:That the City of Rancho Palos Verdes,located within Los Angeles County
Clerk shall certify to the adoption of this Resolution and shall forward a copy of this Resolution
to the Los Angeles County Metropolitan Transportation Authority.

Exempted Development Definitions:
1.LowNery Low Income Housing:As defined by the California Department of Housing and Community
Development as follows:
-Low-Income:equal to or less than 80%of the County median income,with adjustments for family size.
-Very Low-Income:equal to or less than 50%of the County median income,with adjustments for family size.
2.High Density Residential Near Rail Stations:Development located within 1/4 mile of a fixed rail passenger
station and that is equal to or greater than 120 percent of the maximum residential density allowed under
the local general plan and zoning ordinance.A project providing a minimum of 75 dwelling units per acre
is automatically considered high density.
3.Mixed Uses Near Rail Stations:Mixed-use development located within 1/4 mile of a fixed rail passenger
station,if more than half of the land area,or floor area,of the mixed use development is used for high
density residential housing.
4.Development Agreements:Projects that entered into a development agreement (as specified under Section
65864 of the California Government Code)with a local jurisdiction prior to July 10,1989.
5.Reconstruction or replacement of any residential or non-residential structure which is damaged or destroyed,
to the extent of>or =to 50%of its reasonable value,by fire,flood,earthquake or other similar calamity.
6.Any project of a federal,state or county agency that is exempt from local jurisdiction zoning regulations and
where the local jurisdiction is precluded from exercising any approval/disapproval authority.These locally
precluded projects do not have to be reported in the LDR.
