RPVCCA_RDA_SR_2010_07_06_A_PVDS_Lanslide_And_Road_Stability_GradingMEMORANDUM TO: FROM: DATE: SUBJECT: REVIEWED: STAFF L1ASON: CHAIRMAN WOLOWICZ AND BOARD MEMBERS OF THE RANC 0 ALOS VERDES REDEVELOPMENT AGENCY OM,DEPUTY DIRECTOR OF PUBLIC WORKS JULY 6,2010 PALOS VERDES DRIVE SOUTH LANDSLIDE (EAST END) LANDSLIDE AND ROAD STABILITY GRADING CAROLYN LEHR,EXECUTIVE DIRECTOR 09- RON DRAGOO,SENIOR ENGINEER RECOMMENDATIONS Review and reconfirm by four/fifths (4/5)vote,the Redevelopment Agency's previous action taken on June 1,2010,authorizing staff to continue with the actions taken below to perform emergency grading to address landslide movement and preserve the Palos Verdes Drive South roadway. BACKGROUND On June 1,2010,the Redevelopment Agency Board found that an emergency exists,which will not permit a delay arising from a competitive solicitation for bids to enter into a contract with a grading contractor,to perform emergency grading to eliminate cracks and fissures on the seaward side of Palos Verdes Drive South and to rebuild the shoulder adjacent to the Palos Verdes Drive South roadway.Accordingly,the Redevelopment Agency Board approved a contract with Mike Drews Construction Company,Inc.to remove approximately 1000 feet of vegetation located to the south of the Palos Verdes Drive South roadway and to re-grade a portion of the roadway shoulder and adjacent slope to eliminate cracks and fissures. DISCUSSION Approval of the emergency for this work required a four-fifths (4/5)vote of the Redevelopment Agency Board under Public Contract Code Section 22050(a)(1). In addition,Public Contract Code Section 22050(c)(1)requires that when a governing body takes action under Section 22050(a)(1),it must be review this action and reaffirm it by a four-fifths (4/5)vote at each subsequent regularly scheduled meeting until the work is RDA A-1 completed and accepted.This item will be placed on each subsequent agenda until the work is completed and the Redevelopment Agency accepts the project as complete. CURRENT STATUS The biologist who is working on this project is in the process of conducting a study to determine whether there are any gnatcatchers nesting or inhabiting the area where the vegetation is to be removed and the grading work is to be performed.Once the biologist completes the report,the grading work can be conducted,subject to the biologist's recommendations. Meanwhile,the City presently is performing extensive repair work on the Palos Verdes Drive South roadway,which includes grinding activities to smooth out the road surface and injecting fissures with a sand slurry mixture to fill in the voids prior to paving the road. 2of2 R6876-000 1/1232443.2 RDA A-2
