RPVCCA_SR_2010_06_15_18_Muni_Code_Amendment_Regulating_Storage_Of_TrashMEMORANDUM TO: FROM: DATE: SUBJECT: REVIEWED: Staff Coordinator: HONORABLE MAYOR &CITY COUNCIL MEMBERS JOEL ROJAS,COMMUNITY DEVE~DIRECTOR JUNE 15,2010 U1/ AMENDMENT TO MUNICIPAL CODE SECTION 8.24.060 MAKING A MINOR AMENDMENT TO THE REGULATIONS FOR THE STORAGE OF TRASH CONTAINERS ON PRIVATE PROPERTY CAROLYN LEHR,CITY MANAGER 09--- Julie Peterson,Code Enforcement OffiC~ RECOMMENDATION Staff recommends that the City Council read the ordinance by title only,waive further reading and introduce Ordinance No.,an Ordinance of the City of Rancho Palos Verdes amending Section 8.24.060(A)(2)of the Rancho Palos Verdes Municipal Code to revise the screening requirement for the storage of trash containers on private property. DISCUSSION Beginning July 1,2010 a new company will be providing waste and recycling services to the City.With this change,new automated carts will be provided to the residents for rubbish collection.These carts vary in height from 39 inches to 42 inches,and are wider and deeper than most trash cans currently used by residents,which are typically 32 to 36 inches in height. Municipal Code Section 8.24.060(A)(2)currently prohibits the storage of trash cans on private properties in front or side yards which are "visible"from the public right-of-way. Most residents store their trash cans in their side yard behind their gates or in some type of a trash enclosure built for their trash cans.With the increase in height of the new trash carts,some residents may find that they cannot store these carts and remain in compliance with the code.Specifically,for some residents,their current gates or walls may be slightly shorter than the new carts allowing for the top portion of the carts to be seen,even slightly, from the public right-of-way.To be in compliance,some residents may have to increase the height of their gates or walls or change the dimensions of their trash enclosures.By making a minor modification to the language that the carts be "substantially"screened from the public right-of-way,residents may have more options on how to store their trash carts to be in compliance with the code. 18-1 As such,staff recommends revising Municipal Code Section 8.24.060(A)(2)as follows (strikethrough text for text to be removed and underline bold text to be added): The storage of trash garbage or refuse cans,bins,boxes or other such containers in front or side yards visible which are not substantially screened from view from the public right-of-way or adjoining property. CONCLUSION Staff recommends that the City Council adopt the attached Ordinance to revise the language in Municipal Code Section 8.24.060(A)(2). Attachment: •Ordinance No.__ 18-2 ORDINANCE NO.
